Chairman Haller called the meeting to order.
Bishop made a motion to approve the agenda as printed.
Daleiden seconded the motion. All voted aye.
The minutes of the MaRch 14, 1991, meeting were amended under
the members present to read LeRoy Berning, rather than Greg
Berning. The amended minutes were approved on a motion by
Daleiden, seconded by Berning. All voted aye.
The minutes of the March 21, 1991, meeting were approved on
a motion by Daleiden, seconded by Bishop. All voted aye.

Daleiden made a motion to open the public hearing on the
Condi tional Use Permi t request from Sue Peterson to operate an
antique shop at 5445 Marlowe Avenue NE. Berning seconded the
motion. All voted aye.
Sue Peterson explained her proposal to open the antique shop
from Thursday through Sunday from 10:00 AM to 6:00 PM. She would
like the option to open more days at a later date if business
warrants. She presented the Commission with a map of her property.
The business will be operated out of Buildings #1 and #4, Hath of
which have been approved by the building inspector.
The Commission questioned if there was adequate parking space
for her customers. Peterson indicated that she has plenty of room
for parking. The issue of dust control was raised. Ed Breun is
the only other resident in the area and he indicated to the
Commission that he will not have a problem with dust from the extra
traffic.
There was no other public comment.
Daleiden made a motion to recommend that the City Council
grant a CUP to Sue Peterson to operate an antique shop in Buildings
#1 and #4 Thursday through Sunday from 10:00 AM to 6:00 PM,
contingent upon meeting all City ordinances regarding signs. The
CUP will be reviewed before additional days or hours of operation
. are considered. Bishop seconded the motion. All voted aye.
Vetsch made a motion to close the public hearing for Sue
Peterson. Berning seconded the motion. All voted aye.

Berning made a motion to open the public hearing on the
prel iminary pI at for Westwind Phase I I. Dal eiden seconded the
motion. All voted aye.
Engineer Thore Meyer reviewed the preliminary plat proposed
for Phase II. There will be a bermed retention area around the
park area that will regulate the outlet of water into County Ditch
9. The proposal has been amended so that water will stand in the
retention area at a minimum depth of 4 feet and a maximum depth of
10' in order to conform with the EPA's requirements. The purpose
of the standing water is to improve the quality of the water before
it eventually enters the Crow River. The burden to the City is
that periodically the bottom of the pond must be cleaned out.
Bishop expressed concerns over the City's liability with standing
water. Meyer indicated that the City can require the developer to
fence the pond area, thereby limiting access to the standing water.
Comments from the public expressed concerns over the odor from
the standing water and about mosquito control. Thore indicated
that there may at some times be odors from the pond, but there was
nothing that can be done to eliminate that problem. As far as
mosquito control, the City nor the County has a mosquito control
program.

Costs associated with creating the berm and the pond would be
the responsibility of the developer. Attorney Radzwill suggested
that the Commission could require that the berm and the pond be
constructed along with Phase II. This would give the City the
option of looking at how the pond area works before Phase III.
Vetsch recommended that the developer also be required to fence the
pond area at the time of construction.
Arlyn Nelson, Wright County Commissioner, presented a letter
dated April 5, 1991, from County Attorney Wyman Nelson, concerning
drainage into County Ditch 9. The County Attorney is requesting
hard statistical data from the project engineer concerning the
amount of additional runoff into County Ditch 9. Nelson indicated
that the County may require a public hearing because additional
water into County Ditch 9 also affects the property owners along
County Ditch 21. Attorney Radzwill advised Thore to provide any
additional data available to the County Board so that they can
address the question and set up their hearing if necessary.
The Commission directed the engineer to calculate the costs
of maintenance of the pond.

Bishop made a motion to recommend that the Ci ty Counci I
approve the preliminary plat for Westwind Phase II, contingent upon
the following:
(1) The city engineer's communication with the County
Attorney regarding outlet into County Ditch 9 and County approval
of the plan.
(2) The developer will install a fence around the pond area.
Berning seconded the motion. All voted aye.

Bishop made a motion to close the publ ic hearing on the
Westwind Phase II preliminary plat. Daleiden seconded the motion.
All voted aye.
The Commission discussed the requests for storage sheds in the
Westwind Phase I development. The developer has covenants for the
development which he says prohibits storage sheds on the lots. The
consensus of the Commission is that the property owners and the
developer must resolve this issue.
Ken Lindsay brought his variance request to the Commission for
a decision. He would like to construct a 12' X 20' storage shed,
15' high, with a wooden, raised floor. If the variance is granted,
Lindsay will remove the three existing storage sheds on his
property.
Dal eiden made a motion to recommend that the Ci ty Counci I
grant Ken Lindsay a variance to construct the 12' X 20' storage
shed continent upon the following:
(1) The storage shed is painted, sided, and shingled the same
as the house.
(2) Building Inspector Kevin Mealhouse verifies to the City
Council that water drainage through the back of Lindsay's property
prevents him from adding storage space to his garage, thereby
creating a hardship for Lindsay.
(3) No outside storage will be permitted.
(4) The City Council considers the removal of the Lindsay's
second driveway upon sale of the property by the present owner.
(5) The second driveway cannot be extended or upgraded.
Berning seconded the motion. All voted aye.
Daleiden made a motion to adjourn at 9:30 PM, seconded by
Berning. All voted aye.

RE: County Ditches 9 and 21
Dear Arlyn:
As requested, I have reviewed what I believe to be the applicable law
regarding the use of County Ditch No. 21 as an outlet.
I would also like to state that I have reviewed the documents which
the County Auditor has in her possession, and it would appear that the
development in the City of Albertville has been well engineered
insofar as it relates to the run-off to County Ditch No.9.
It would appear that Minnesota Statutes l03E.4ll and l03E.401 apply to
this situation. I believe that the County is justified and, in fact,
should have engineering data on the adequacy of the outlet. By this
specifically I refer to the capacity of County Ditch No. 21 to accept
the additional or accelerated run-off from the proposed development.

(2) show that the use of the drainage system will be of public benefit and utili~

(3) be accompanied by a plat showing the location of the drainage system and the

(4) be accompanied by specifications showing the plan of connection from the
municipal drainage system to the drainage system. : rid
Subd. 2. Approval by pollution control agency. The plan for connecting the munici~ '
pal drainage system to the drainage system must be approved by the pollution control
agency.
Subd. 3. Filing; notice. (a) If proceedings to establish the drainage project to be
used as an outlet are pending, the petition must be filed with the auditor. The municipal
drainage system petition must be presented to the drainage authority at the final hear-
ing to consider the detailed survey report and viewers' report. Notice of the municipal
drainage system petition must be included in the final hearing notice.
(b) If the drainage system to be used as an outlet is established, the municipal
drainage system petition must be filed with the auditor. When the petition is filed, the
drainage authority in consultation with the auditor shall, by order, set a time and place
for hearing on the petition. Notice of the hearing must be given by publication and by
mailed notice to the auditor of each affected county.
Subd. 4. Hearing and order. (a) At the hearing the drainage authority may receive
all evidence of interested parties for or against the granting of the petition. The drainage ~. _
authority, by order, may authorize the municipality to use the drainage system asan
outlet, subject to the conditions that are necessary and proper to protect the rights of
the parties and safeguard the interests of the general public, if the drainage authority
determines:
(I) that a necessity exists for the use of the drainage system as an outlet for the
municipal drainage system or the overflow from the system;
(2) that use of the drainage system will be of public utility and promote the public
health; and . ~.
(3) that the proposed connection conforms to the requirements of the pollution
control agency and provides for the construction and use of proper disposal works. .
(b) The drainage authority must, by order, make the municipality a party to the
drainage proceedings and determine the benefits from using the drainage project or sys-'
tem as an outlet.
Subd. 5. Benefits and assessments if drainage system is established. If the drainage
system is established, the drainage authority must determine the amount the munici-
pality must pay for the privilege of using the drainage system as an outlet. The amount
must be paid to the affected counties and credited to the account of the drainage system
used as an outlet. The municipality is liable for all subsequent liens and assessments
for the repair and maintenance of the drainage system in proportion to the benefits, as
though the benefits were determined in the order establishing the drainage system. ...'

CONSTRUCfION OF DRAINAGE PROJECT
I03E.SOl CONTRACT AND BOND.
Subdivision 1. Preparation. The county attorney, the engineer, and the attorney for
the petitioners shall prepare the contract and bond. The contract and bond must.
include the provisions required by this chapter and section 574.26 for bonds given by
contractors for public works and must be conditioned as pro~ided by section 574.26
for the better security of the contracting counties and parties performing labor and fur-
nishing material in performance of the contract. The prepared contract and bond must.
be attached and provided to the contractor for execution. .
Subd. 2. Contractor's bond. The contractor shall file a bond with the auditor for
