PLANNING & ZONING COMMISSION May 14, 1991 Albertville City Hall 7:30 PM PRESENT: Commission members Donatus Vetsch, Rick Bishop, Mark Daleiden, and LeRoy Berning, City Clerk Linda Houghton Acting Chairman Vetsch called the meeting to order. The minutes of the April II, 1991, meeting were approved on a motion by Daleiden, seconded by Bishop. Ken Lindsay pointed out that the road going to Sue Peterson's antique business is not technically a city street. The Commission expressed concerns over whether the City is liable for the street. Daleiden suggested that the City Council may wish to post the road as a minimum maintenance road. The Commission indicated that they bel ieve the potential odor problem from the retention pond proposed for Westwind Phase II is a correctable problem. There was no other discussion on the minutes. All voted in favor of approving the minutes as presented. . The minutes of the May 2, 1991, public hearing were approved on a motion by Berning, seconded by Bishop. All voted aye. The Commission requested that the City request three way stop signs for the 50th Street and Main Avenue intersection. Ken Lindsay brought his request for a variance to construct a 12' X 20' storage shed before the Commission as directed by the City Council at their April 15, 1991, meeting. Condition #2 of the Commission's recommendation on the variance request was that the building inspector inspect the property and give his opinion that there was a hardship because of the water drainage over Lindsay's property. The bui I ding inspector did inspect the property and reported to the City Council that in his opinion a hardship did not exist. . Dal eiden made a motion recommending that the Ci ty Counci I grant a variance allowing Lindsay to construct a 12' X 16' (196 sq. ft. total) storage shed contingent upon the following: (1) The storage shed is painted, sided, and shingled the same as the house. (2) No outside storage will be permitted. (3) Upon sale of the property by Lindsay, the second driveway will be removed and seeded over. (4) The second driveway cannot be extended or upgraded while Lindsay owns the property. Berning asked that Daleiden amend his motion to allow the 12' X 20' storage shed Lindsay requested but amend Item #3 to include that the curb must be replaced up to the City standards and specs ... . .. . . . upon sale of the property. Daleiden agreed to rescind his original motion. Berning then made a motion to recommend that the City Council grant a variance allowing Lindsay to construct a 12' X 20' storage shed contingent upon the following: (1) The storage shed will be painted, sided, and shingled the same as the house. (2) No outside storage will be permitted. (3) Upon sale of the property by Lindsay, the second driveway will be removed and seeded over, and the curb will be replaced up to City standards and specs. (4) The second driveway cannot be extended or upgraded while Lindsay owns the property. Bishop seconded the motion. All voted aye. The Commission reviewed the building permit request from Norm Arns of Particle Control. Building Inspector Kevin Mealhouse has not issued this building permit because he was concerned over the zoning and setbacks. Daleiden made a motion to recommend that the City Council allow the building permit to be issued as proposed and to grant Arns a variance on the setback requirements, and a variance to construct a pol e bui 1 ding, because the addi tional bui lding wi 11 conform to the existing bui ldings on the si te. Berning seconded the motion. All voted aye. The Commission asked the clerk to set up a joint meeting with the Park Board on Tuesday, June II, 1991, at 7:30 PM, to discuss plans for walkways and bike paths.
