1991-08-27 PC Minutes Continuation of PH . . . PLANNING & ZONING COMMISSION CONTINUATION OF PUBLIC HEARING ON JIM HENNUM'S LOT DIVISION REQUEST August 27, 1991 Albertville City Hall 7:30 PM PRESENT: Commission Members LeRoy Berning, Donatus Vetsch, Tom Hall er, Mark Dal eiden, and Rick Bishop, Ci ty CI erk Linda Houghton Chairman Hall er reconvened the publ ic hearing on the lot division requested by Jim Hennum, which was continued from the August 13, 1991, meeting. The Commission reviewed the information provided by Ci ty Engineer Thore Meyer in his letter dated August 21, 1991. According to the engineer, a storm sewer extension would need to be constructed to the west and north to continue the drainage system if this lot is to be filled. In addition, drainage and utility easements will need to be provided on all four sides of the lot, as required by the City's sub-division ordinance. Several persons in the audience expressed their concerns that drainage would be a problem if the lot is built upon. The Commission explained to the audience in attendance that the City now requires a site plan approved by the building inspector before a lot can be built on. The Commission heard that the property owner has failed to provide adequate drainage for the 55th Circle and 56th Street area which he also developed. The Commission reviewed the concept plan of the Marx property and the property being considered for a lot split. The Commission is concerned about the drainage situation on Lots 7, 8, 9, 10, and 11 of Block 7 and the area to the north of these lots as shown on the concept plan. Berning made a motion stating that although the Planning and Zoning Commission does not disapprove of the proposed lot split, the Commission recommends that the Ci ty Counci I deny the lot division until the drainage problem on 55th Circle and 56th Street is corrected by the developer. Bishop seconded the motion. All voted aye. Vetsch made a moti on to set a publ i c hearing on a sign proposed by DJ' s that is over the maximum square footage for Tuesday, September 24, 1991, at 7:30 PM. After reviewing the recommendations from the Planning & Zoning Commission from August 27, 1991, (a copy of the minutes are enclosed), the Council voted to approve your lot division contingent upon the following: 1. The drainage problem between 55th Circle and 56th street is corrected by cutting a swale on the lot lines to drain the water toward the catch basin, to which you agreed at the September 16, 1985, City Council meeting. (A copy of those minutes are also enclosed.) 2. Drainage and utility easements must be provided on all four sides of the newly created lot, as recommended by the City engineer in his August 21, 1991, letter to the Planning Commission. Attached is a partial map of the area, to which our following comments are directed. - The proposal is to split off the easterly 150' + of the long, narrow tract of land presently owned by Jim Hennum, creating a single lot fronting on Lander Avenue N. E. Filling of this lot would be necessary to make this a buildable site. Presently a drainage swale crosses the proposed lot in a northwest-southeast direction, providing overflow drainage from the wetlands into the existing storm sewer on Lander Avenue N.E. If this lot is to be filled, a storm sewer extension needs to be constructed to the west and north to continue the existing drainage system. One location for this storm sewer extension would be as per the attached drawing. A catch basin would be located on the northwest corner of the newly established lot, providing an inlet for the drainage swale. Future land development would necessitate the extension of this storm sewer line. In addition, drainage and utility easements will provided on all four sides of the lot, as per city ordinance. Jim Hennem agreed to have his builders cut a swail on the lot line to drain the water toward the catch basin that is being put in by the City. The 1985-l~t hearing was called to order by the Mayor and Ken Ashfeld explained the assessment. Three of the thirteen property owners were present, but no one objected to the assessment. A motion was made by Schwenzfeier and seconded by Cornelius to approve the assessment role as listed. All were in favor. N.S.P. informed the City that they could not go ahead with putting electric underground in the Bueadry 2nd Addition until lot corners are staked. Maureen will check with Larry Henning and other property owners to see if they want Meyer-Rohlin to do it for them for the cost of between $60.00 to $75.00 a lot. Fireman school and resolution to adopted the Fireman's By-laws were postponed until a later date. A motion was made by Braun and seconded by Schwenzfeier to go ahead with putting in two new windshields and one side window glass on the Rescue Truck. All were in favor. In addition the Council voted to approve the resolution regarding the charges for car fires. Gary Meyer was told to offer Frankfort Township a $5,000.00 cash settlement in regards to their lawsuit against the City of Albertville, providing that if any money is paid back by Joint Powers that Albertville will be reimbursed. A motion by Schwenzfeier and seconded by Vetsch to approve the Joint Powers' resolution 85-1 regarding the right to assess service charges on taxes. All were in favor. CITY OF ALBERTVILLE ALBERTVILLE, MINNESOTA 55301 PHONE: 497-3384 CITY COUNCIL MINUTES 9/16/85 Regular meeting of the City Council was called to order by Mayor Jim Walsh, with all members present. Others present included Gary Meyer, Ken Ashfeld, Don Berning and Maureen Andrews. A motion by Cornelius and seconded by Braun to accept the minutes as read. All were in favor. Rite Cable will be at the October 24th Council meeting to give the Council an update on the Cable TV acquisition for Albertville. A letter from a concerned citizen regarding Hordis Brother's Glass Company burning of packing rraterials was read and Maureen was asked to send a letter to Hordis Brothers to inform them of the complaint. Several people were present to discuss the dog problem on 57th and Large Avenue, including the City Dog Catcher. There was some discussion about the callout on night of Friday the 13th. It was agreed upon that that the Dog Catcher will review the Dog Catching Ordinance and make SGme recommendations to Gary Meyer regarding any changes. The Lions' sign was discussed. The Council felt that the sign should be moved to the spot where the old Bicentenial sign was located and that it should be put in permanently with steel posts. The repair of the other City sign, as W~U .as the sign in the park will be left as is until next spring. A motion was made by Cornelius and seconded by Vetsch that the City Administrator should be responsible for getting the messages on the sign. All were in favor. A motion made by Cornelius and seconded by Schwenzfeier to approve a beer license for the Albertville Fir~'s Fund Raiser to be held Oct. 18th at City Hall. A motion to approve a building permit for Bob Braun so that he can build a garage on the site of an old barn, was made by Schwenzfeier and seconded by Vetsch. The motion carried, Braun abstained from voting. Maureen was told to put notice in the Crow River News asking for a new Planning Commission member.
