PLANNING & ZONING COHHISSION KARCH 24. 1992 ALBERTVILLE CITY HALL 7:00 PH COHMISSION HEMBERS PRESENT: Tom Haller, Rick Bishop, LeRoy Berning, Tim Phillips, Building Inspector Kevin Mealhouse, City Attorney Mike Couri, City Engineer Thore Meyer and Secretary Ann Bednarczyk. ABSENT: Donatus Vetsch Chairman Haller called the meeting to order at 7:05 PM. Bishop welcomed new Commission member Tim Phillips. The Commission reviewed the agenda and added request for a 25' setback on a lot which has configuration. Berning made a motion to approve agenda. Bishop seconded the motion. All voted aye. Ron Long's an unusual the amended Berning made a motion to approve the minutes of the March 10, 1992 meeting as submitted. Bishop seconded the motion. All voted aye. Haller opened the public hearing for Doug Psyk's plat approval of the 5th and 6th Additions on the motion made by Bishop and seconded by Berning. The Park land dedication as indicated on the plat shows much of the proposed dedicated area to be low land and unusable. Psyk stated that this property is shown by the DNR to be wetlands. Thore stated that the use and development of this wetland will probably be restricted by the DNR. Couri stated that the Ordinance does state that the dedicated park land must be usable, It was suggested that the City could request a dollar dedication instead of land, or a combination of both land and money. The Commission feels that the Park Board should be consulted on this issue. Psyk stated that if he is required to dedicate money, he wants to see it used for parks in his area. Couri stated that where that money is spent is entirely up to the City Council's discretion. Psyk will contact the DNR to find out exactly how much of this land is wetland. Couri reminded the Commission that it would be wise to keep their options open regarding this dedication. Phillips questioned why natural gas isn't brought into these developments at the same time as other utilities. The Developer's Agreement could be drawn up to include this stipulation. No further comments were forthcoming from Berning made a motion to close the public hearing. the motion. All voted aye. the floor and Bishop seconded . PLANNING COMMISSION - 3/24/93 Page 2 Bishop made a motion to recommend that the Council approve the Psyk plat for the 5th and 6th Additions contingent upon the following: 1. DNR determination regarding wetland 2. Erosion plan 3. Satisfactory park dedication of land, money, or a combination of both. The motion was seconded by Berning. All voted aye. The public hearing regarding preliminary plat approval for Westwind 4th Addition was opened by Haller on a motion made by Berning and seconded by Bishop. All voted aye. Berning questioned the park dedication. Darkenwald stated that they had dedicated 14+ acres and $10,000 which was paid in 1988. The Commission expressed their concern that so much of this dedicated land is wet and is currently unusable. Darkenwald stated that in dry years it could be used as ball fields, although the City would never be able to build upon it. The Commission felt the Park Board should be consulted on this issue. . Finishing Kahler Drive was discussed. Darkenwald stated that they intended to finish it as a class 5 road until they decided for what use they would develop outlots a and b. Thore stated that he felt this situation would be fine. The Commission and Couri expressed their concern due to the fact that the bulk of the traffic would continue to use the same street they currently do and that as development progressed it would become progressively heavier. The Commission expressed their concern that access to the park was not as convenient as it should be. Darkenwald stated that he didn't want to put an access to the park between private homes. The Commission questioned whether the City's concern should lie in what is most advantageous to the Developer, or in what is most advantageous to the City and its residents. Wi th no further discussion from the floor, Berning made a motion to close the public hearing. Bishop seconded the motion. All voted aye. Bishop made a motion to table this issue until the concerns regarding the park and finishing Kahler Drive are resolved more satisfactorily. Berning seconded the motion. All voted aye. . Bishop made a motion to open the public hearing on the rezoning request for Dennis Fehn. Berning seconded the motion. All voted aye. . PLANNING COMMISSION - 3/24/92 Page 3 The Fehn property is currently zoned R-3. Fehn is requesting that his property be rezoned to 1-2, however, the property does not meet the 5 acre requirement. A Conditional Use Permit is also not a solution since Fehn' s business is not a permitted use for a C.U.P. The Commission questioned whether or not a change in the Zoning Ordinance was a feasible solution. Couri stated that if that was the solution the Commission settled on, they would have to amend the Ordinance and map prior to doing any rezoning. Berning made a motion to close the public hearing. seconded the motion. All voted aye. Bishop Berning made a motion to table further discussion of the ordinance and map changes until the next meeting. Bishop seconded the motion. All voted aye. The Commission directed Ann to call Frankfort and find out what they have the MacAlistar area near Fehn zoned as. Bishop made a motion to open the public hearing for the rezoning and subdivision request from Dayle Veches. The motion was ~ seconded by Berning. All voted aye. The proposed easement for a possible future frontage road was discussed and it was agreed to change the easement width to 48.75' from 40.75 feet. The Commission feels it is important that when this lot split takes place a park dedication fee of $170.00 be made. Veches stated that this would not be a problem. Haller made a motion to close the public hearing. seconded the motion. All voted aye. Berning Berning made a motion to recommend that the City Council approve the rezoning and subdivision requests for Dayle Veches with the easement change from 40.75' to 48.75'. Bishop seconded the motion. All voted aye. Ron Long presented a survey of lot 3, block 4, Westwind, which has a very unusual configuration, and requested that he be allowed a 25' setback. Berning made a motion to recommend that the Council approve the 25' setback in this case. Bishop seconded the motion. All voted aye. . Berning made a motion to schedule a public hearing for April 28, 1992 at 7: 00 PM to discuss possible changes to the Zoning Ordinance regarding fees, charges, and expenses be paid for various subdivision and zoning related expenses. A joint meeting has been scheduled with the Park Board for Tuesday, April 14th, at 7:00 PM to discuss the Park Boards plans and ideas for future park development. Bishop made a motion to adjourn the meeting at 9: 40 PM. Berning seconded the motion. All voted aye.
