2000-02-08 PC Minutes . . . d-- CITY OF ALBERTVILLE PLANNING & ZONING COMMISSION MINUTES February 8, 2000 1. CALL TO ORDER - ROLL CALL - ADOPT AGENDA PRESENT: Chair Jim Brown, Commission Members Carolyn Bauer, Ron Klecker, Ray Meyer, and Council Liaison John Vetsch, Deputy Clerk Bridget Miller, Zoning Administrator Kevin Mealhouse, and City Planner Deb Garross. Chair Brown called the regular meeting of the Planning & Zoning Commission to order. The agenda was amended by adding Item 4( c) Recommendation to City Council Regarding County Road 19 and 57th Street, and Item 4( d) Appointment of Vice-Chair to the Planning and Zoning Commission. 2. MINUTES Meyer made a motion to approve the January 11, 2000 P & Z Minutes. Bauer seconded the motion. All voted aye. 3. PUBLIC HEARINGS (a) Burger King Opened the Public Hearing at 7:05 p.m. · CUP for Drive- Thru City Planner Garross explained that the applicant was not aware of the easement on the property under consideration. She also brought to the Commissions attention that the parking lot would be right above the sewer and watermain. If the City needed to do any repairs to the pipes, they would have to go under the parking lot to repair. It would be Burger King's responsibility to repair their own parking lot. . Sign Variance Request There was no discussion on the Sign Variance Request at this time. Chair Brown asked if there were any comments from the audience. There were no comments from the audience. Chair Brown tabled the public hearing at 7:08 p.m. Bauer made a motion to table the Public Hearing to the March 14, 2000 meeting. Klecker seconded the motion. All voted aye. . City of Albertville Planning and Zoning Commission February 8, 2000 Minutes Page 2 of4 (b) Parkside Commercial Park Opened the Public Hearing at 7:09 p.m. . Approval of Preliminary Plat . Approval of Final Plat City Planner Garross briefly went over the background ofthe proposed land to be developed. In 1998 the applicant did not file the [mal plat of Parks ide Commercial Center within the IOO-day time line, therefore all of the previous approvals are considered to be null and void. The requested approval ofthe Preliminary Plat and Final Plat requires that the Planning and Zoning Commission and the City Council consider the applications in relation to established Zoning and Subdivision Ordinance review criteria and Comprehensive Plan policies. The decision to approve or deny the project is viewed as a policy decision to be made by the City Council. . Don Jensen, Pilot Land Development Company has submitted a preliminary plat and [mal plat for Parkside Commercial Center consisting of a two (2) lot subdivision of B-3, Highway Commercial Zoned land. A 1.47 acre lot is being created to accommodate the development of a future anticipated gas station /convenience store use. The remainder of the outlot in association with Outlot B of Parks ide 4th Addition, is being replatted as Lot 2. The anticipated future development of the gas station/convenience store will require separate site plan and Conditional Use Permit review to allow for fuel sales and convenience store operations on Lot 1. Chair Brown had a question in regards to the trail system going through the development. Would the trails be recorded on the Final Plat? City Planner advised that there could be a separate easement plat filed showing the trail. It would not be noted on the Final Plat. Meyer questioned the wetlands being connected. Brown wanted to know more about the driveway access on County Road 19. The County states they have all they need from the right-of-way. There would be only the one access, which would be off of 57th Street. The City Planner went over the recommendations noted on Page 6 of the Planner's Memo included in the Planning and Zoning Packet. . City Engineer's comments have not been presented as of February 8, 2000. The CUP would be applied for when the Builder/Developer presents a site plan for the Casey's Gas/Convenience Store. City of Albertville Planning and Zoning Commission February 8, 2000 Minutes Page 3 of4 Meyer was concerned with the parking lot - it looks as if it could hold up to 130 parking spaces. He is very concerned with the traffic that would be created with the development. Zoning Administrator Mealhouse mentioned that after the traffic light proposed for County Road 19 and 37 is installed then a traffic study could be done to find out if an additional traffic light is needed. What will the lighting in the parking lot be like? Council Liaison Vetsch asked what the proposed hours ofthe store would be. Don Jensen replied that he anticipates it would be a 24-hour store. There was discussion about the berm that was created. Would that be destroyed or left? It would depend on what proposal comes forward for development on the lot. Don Jensen also commented that it would depend on what would be going in to the space. Chair Brown asked if there were any comments from the audience. Ceri Kucera asked about a fence going up behind the store to stop the garbage and other debris from blowing into the residential development. Justin Tourville asked about the wetland that was located on the outlot. Would they try to retain that or would it be filled in. That would be something for the City Engineer to answer. Chair Brown closed the public hearing at 7:51 p.m. Bauer made a motion to approve the Preliminary Plat and Final Plat for the Parkside Commercial Park with changes noted at the meeting. Meyer seconded the motion. All voted aye. 4. OTHER BUSINESS (a) Street Light Contract Chair Brown briefly discussed what is expected ofthe Commission on the Street Light Contract. Klecker asked ifthe cost ofthe street light wiring would be absorbed by the developer and then passed on the cost of the lots in the development? Vetsch commented that it could be escrowed into the development and distributed throughout the number of lots in the development. Chair Brown asked if there were any comments from the audience.
