CALL TO ORDER - ROLL CALL - ADOPT AGENDA Chair Brown called the joint meeting of the Planning and Zoning Commission and City Council to order. PRESENT: Chair Jim Brown, Vice-chair Ed Budde, Commission members Ron Klecker, Tom Fay and Tim Sweeney, City Planner Cindy Sherman, Zoning Administrator Jon Sutherland, Deputy Clerk Bridget Miller, Mayor John Olson, Council members Scott Wallace, Keith Franklin, LeRoy Berning and City Attorney Mike Couri. The Agenda was amended as follows: Add Item 4.b. Temporary Structure Ordinance Add Item 5.a. Advertising Signage on Ballfield Fences Add Item 5.b. Portable Signage Reader Boards Change Item 5. to Item 6. Adjournment Move Item 4.b. up on the agenda Klecker made a motion to approve the agenda as amended. Budde seconded the motion. All voted aye. Motion carries. 2. MINUTES a) November 13,2001, regular meeting Klecker made a motion to approve the November 13,2001 minutes as submitted. Budde seconded the motion. All voted aye. Motion carries. 4. PUBLIC HEARINGS a) Temporary Structure Ordinance Chair Brown opened the Public Hearing at 7:04 p.m. Chair Brown informed the Commission and Council this information was laid out for their review. He asked City Planner Sherman to go over the Ordinance. .. . . . She informed the Commission that representatives of Life in Christ Church went before the City Council at the November 19,2001 Council meeting. Chair Brown asked if there was anyone in the audience from Life in Christ Church. There was no representative. Chair Brown asked if there was anyone in the audience to discuss this Ordinance. There was none. Commission member Klecker asked ifthe resident would have to apply for the Temporary Structure Permit prior to setting up the structure? Also wanted clarification as to the type of vehicle that would be allowed. City Attorney Couri and City Planner Sherman both commented about this item. City Planner Sherman did her best to clarify the vehicle type. Commission member Budde asked ifthis Ordinance was similar to another City's? City Planner Sherman stated it is similar to one that the City ofLakeville has adopted. Council member Berning asked about the possibility of eliminating travel trailers. Commission member Klecker was in agreement with eliminating travel trailers. Commission member Klecker asked about the parking ofthe cars? Would that be on the street or on the site? City Planner Sherman confirmed that the parking of additional cars or vehicles would be on the site not on the street. Chair Brown closed the public hearing at 7:21 p.m. Chair Brown asked ifthere was any additional comments or a motion to be made. Commission member Budde made a motion to approve the Temporary Structure Ordinance with the clarification of the vehicle type, zoning district restriction and the permit time limit. Sweeney seconded the motion. All voted aye. Motion carries. 3. NEW BUSINESS a) Concept Plan Review Sybrant Property - Mixed Use Development Project . . . . .' CITY OF ALBERTVILLE PLANNING & ZONING COMMISSION JANUARY 8,2002 MINUTES PAGE 3 of 6 Chair Brown turned it over to the City Planner Sherman to briefly go over the Concept Plan. City Planner Sherman reviewed the plan present to the commission. She brought to their attention the location of the site. She stated that the City Council had previous seen this plan with a few modifications. Chair Brown asked if the applicant was present in the audience. Scott Dahlke and Mike Leuer, Quality Site Design, LLC were present. Mr. Dahlke debriefed on the concept plan. He explained that they met at the staff level with a couple of layout plans. They present this similar concept before the City Council. Quality Site Design has been in contact with Doug Psyk to get his approval on incorporating a portion of his land in the plan. He (Mr. Psyk) was in agreement. He went over what they are proposing. It would be a senior housing development aimed at 55 and over tenants. Council member Wallace asked about the 3-story building - will there be underground parking? Mr. Dahlke confirmed that there will be underground parking. Mayor Olson asked bout the detached garages on the cottages. Mr. Dahlke stated that they had done a market study from surrounding cities and there is an interest in 55 and over senior housing developments. They thought the detached garage would be okay. Linda Goeb, St. Michael made the comment about the cottages located in St. Michael that had detached garages and felt they looked nice. Klecker asked if the cottages would have an association and if there would be a community room located within the complex? Mr. Dahlke said there would be an association involved but did not really note anyone area as a community room. Chair Brown asked if the cottages would be owner occupied or rental units? Mr. Leuer answered that the cottages would be owner occupied. But if the owner wants to rent it out that is his/her decision. Chair Brown asked how many units would be in the 3-story building. Mr. Dahlke replied there would be 108 units. 1" . . . .' Commission member Sweeney and City Attorney Couri both had concerns about the control of the housing development. Stating it in the Developer's Agreement that the 3- story rental units and the cottages would remain a senior housing development. That some where down the road in years to come the 3-story building becomes a rental building for all ages or a Section 8 Housing Development or Affordable Housing. Mayor Olson asked to see more details from the developers. Council member Berning said there are some of the residents that are aging and like the area. They can't shovel their driveway or maintaining a lawn. They are looking at a maintenance free type of living within the City of Albertville. Council member Franklin asked about the utilities on 53rd Street. Would the road by completed from the stub to County Road 19 or not? Mr. Dahlke answered that the road would not be installed until Doug Psyk develops the property. City Attorney Couri commented that there would be an easement for the utilities. It would be noted on the plans so in the future when the road went in they would know where the utilities are located. Council member Wallace added his comments on the traffic that would generate from this development. The City is under the process of doing a traffic study on County Road 19 at this time. If you add this development in it would only increase the amount of traffic on and off of County Road 19. Also wanted to bring to their attention that the City would have the future developer absorb some ofthe cost for the traffic study. Chair Brown asked ifthere were any additional comments on the proposed concept plan. It is a concept plan at this time. We can work out more details when they have a preliminary and final plat before the Commission and Council. City Attorney Couri did have an additional concern regarding the 53rd Street. The 9-1-1 or any other emergency vehicle would have to travel down County Road 19 to get into the development until the rest of 53rd Street was laid. PUBLIC HEARINGS a) Ordinance Revisions B-2A Zoning District Chair Brown opened the public hearing at 7:25 p.m. Chair Brown asked the City Planner Sherman to review the Ordinance Revisions before the Commission and City Council. City Planner Sherman explained that the City Council directed staffto develop a modified zoning district that would provide for a more restrictive list of permitted uses that the B-3 district. She noted that the B-1 and B-2 District regulations were included in the packet. The sections that would be revised are: Section 4350.5 which outlines the lot area and setback requirements. Section 4350.7 which outlines the maximum lot coverage by impervious surfaces. City Planner Sherman explained that the special landscape requirements that are currently proposed are tied to a value for the project so that the extent of the landscaping is relevant to the size ofthe project. It also provides for landscaping of parking lot interiors. City Planner Sherman showed the City Council and Planning Commission a sample of another city's guidelines for this type of district. What needs to be discussed is what does the City Council and Planning and Zoning Commission wants to go ahead with at this point. Would they like to see the adoption of a written explanation - which is what we have in place now only adopting the B-2A Zoning Ordinance or to go with a little bit more visual guide plan which would show examples of what is acceptable and which is not acceptable. Chair Brown reminded the members that this was a discussion session on if we should consider Re-zoning of the B-1, B-2 and B-3 Districts. Which would be adding a B-2A District into the Zoning of the Land Use Comp Plan for Albertville. City Attorney Couri shared with the Council and Commission is comments in regards to the change in the Business District Zoning. Council Berning had some concerns about the rezoning of the districts. What areas in Albertville would this affect? . . . ~ CITY OF ALBERTVILLE PLANNING & ZONING COMMISSION JANUARY 8,2002 MINUTES PAGE 6 of 6 Mayor Olson added a comment about the Zoning Ordinance book. He would like to see it more user friendly. When current look up something in the book you generally have to refer to the other districts. If you had everything explained in the zoning district would be appreciated. City Planner Sherman would put something together for future meetings. 5. OTHER BUSINESS a) Advertising Sign age on Ballfield Fences b) Portable Signage Reader Boards Council member Berning asked what the Council and Commission thought about advertising signs on ballfield fences. This would help pay for bleachers or benches. Council member Franklin had a sample from Elk River on portable reader signs. There would be a fee, which would be refundable. The company or persons would fill out a form notifying the city as to where, when and how long this sign would be there. City Planner Sherman got the impression for the Council and Commissions response that they would consider revising the Advertising portion of the Sign Ordinance. 6. ADJOURNMENT Sweeney made a motion to adjourn. Fay seconded the motion. All voted aye. Meeting adjourned at 9:06 p.m.
