2002-11-12 PC Minutes . CITY OF ALBERTVILLE PLANNING & ZONING COMMISSION ApPROVED MINUTES November 12, 2002 . 1. CALL TO ORDER - ROLL CALL - ADOPT AGENDA Chair Budde called the regular meeting of the Planning and Zoning Commission to order. PRESENT: Chair Ed Budde, Commission members Ron Klecker, Tim Sweeney, Sharon Leintz, Russell Winslow, Council Liaison LeRoy Berning, City Engineer Pete Carlson, Assistant City Planner Aaron Jones, and Deputy Clerk Bridget Miller. Chair Budde made a motion to approve the agenda as presented. Klecker seconded the motion. All voted aye. 2. MINUTES a) September 11, 2002, regular meeting Leintz made a motion to approve the September 11, 2002 minutes as presented. Klecker seconded the motion. All voted aye. . b) October 8, 2002, regular meeting Budde made a motion to approve the October 8, 2002 minutes as presented. Klecker seconded the motion. All voted aye. 3. PUBLIC HEARINGS a) Outlets at Albertville Phase III Chair Budde opened the public hearing at 7:06 p.m. He turned it over to the City Planner to go over the site and building plan. Assistant City Planner Aaron Jones introduced himself to the Commission and audience. Explained he was filling in for Al Brixius. Assistant City Planner Jones then went over the background and the revised layout and other concerns that were brought before the Commission and Council at the October 29th workshop. Chair Budde commented that City Engineer Carlson had submitted additional information for our review. City Engineer Carlson then went over very briefly what he had handed out before the meeting started. . · He touched on the sidewalk issue. · He commented on the number of fire hydrants. · Commented about the water main extended to along the Towne Lakes development. Something that City Engineer Carlson would like to work on over the winter to find . . . They have one in the plan but would like to explore the options. · He did share with the commission that JMJ has submitted revised plans to him in the last couple of days. Chair Budde asked if there was anyone in the audience to represent JMJ. Bobbie Morse and Shane Bullough were present. Council Liaison Berning had a number of concerns with the preliminary plat. For the most part he wanted to know about the sidewalk. Will the customers/pedestrians be able to cross CR 19 and have a sidewalk available on both sides? Chair Budde asked if there was anyone else in the audience regarding this public hearing. Neil Bateman, a future resident of Albertville, had a question as to if the DNR had been involved with what is being done. It seems rather close to School Lake. City Engineer Carlson confirmed that the City has worked with the DNR to revise our Shoreland ordinance. The DNR has not gotten back to the City Engineer, but they don't normally review these plans. He feels that when it comes back from the DNR, after they review it, they would not have to many comments. Another future resident had a concern with the garbage dumpsters. When they become full and it's a windy day will the debris blow around the area. He also wanted to know more about the landscaping. Bobbie Morse shared that the City Planner Brixius has kept everyone in mind. He wanted to make sure that there was plenty of landscaping. Chair Budde asked if there were anyone else in the audience who had concerns about the public hearing. Chair Budde closed the public hearing at 8:12 p.m. Leintz made a motion to approve the Outlets at Albertville Phase III with the additions shared by the City Engineer and Assistant City Planner. Klecker seconded the motion. All voted aye. This will go before the City Council at the November 18, 2002 Council meeting. b) Gary Vetsch, 5772 Main Avenue NE Chair Budde opened the public hearing at 8:15 p.m. . . . City of Albertville Planning and Zoning Commission November 12,2002 Minutes Page 3 of 5 Chair Budde asked the Assistant City Planner Jones to review the CUP. Assistant City Planner Jones stated that the applicant, Gary Vetsch, is requesting a conditional use permit (CUP) in order to allow an accessory residential use on the second floor of an existing commercial use building. Chair Budde asked if there was anyone in the audience representing this request. There was none. Commission member Leintz asked if there were any other situations like this III Albertville. Council Liaison Berning said there are only a few commercial buildings on Main Avenue with apartments above them. Commission member Leintz wanted to know if there were any zoning codes that require an enclosed parking or garage to be available. Assistant City Planner Jones read from the Zoning Ordinance what is needed to be done to conform to the zoning ordinance. Commission member Klecker did not feel comfortable approving this CUP N ariance request. He was looking at the safety issues - what if a fire should start in the rear and they would be able to get out safely. Commission member Winslow agreed with Klecker and the safety issues with the site. Chair Budde asked if there was anyone else in the audience in regards to the public hearing. There was no one. Chair Budde closed the public hearing at 8:41 p.m. Chair Budde made a motion to deny the Conditional Use Permit and Variance request. Klecker seconded the motion. All voted aye. c) Don's Bus Garage/Parade Car Rentals, 6000 LaBeaux Avenue Chair Budde opened the public hearing at 8:43 p.m. Chair Budde asked ifthis was an amendment to the PUD. Assistant City Planner Jones confirmed that it would be an amendment to the PUD that is in place. Chair Budde asked if there was anyone in the audience representing this amendment. . . City of Albertville Planning and Zoning Commission November 12,2002 Minutes Page 4 of 5 Mark Daleiden of parade Car Rentals was present to go over what he would like to do. Commission member Klecker would like to know if he would be selling the cars. Mark commented that he might sell them. He would probably bring them to an auction to buy or sell the cars. Chair Budde asked if there was anyone else in the audience regarding this public hearing. There was no one present. Chair Budde closed the public hearing at 9:00 p.m. Leintz made a motion to approve the amendment to the PUD. Winslow seconded the motion. All voted aye. This will go before the City Council on December 2, 2002. d) Mark Haller, 11565 50th Street NE Chair Budde opened the public hearing at 9:03 p.m. Chair Budde asked the Assistant City Planner Jones to go over the Conditional Use Permit request. Assistant City Planner Jones stated that the applicant is requesting a CUPNariance to build a detached garage on his existing property at 11565 50th Street NE. He added that the resident currently has an attache 28' x 28' garage on the property. The lot size is 192.5 feet wide at the street and 1,312 feet deep which is approximately 5~ acres. Chair Budde asked if the applicant was present. Mark Haller addressed the commission explaining his request. He stated that the neighbor to the west has an attached garage, a detached garage and a horse barn. The neighbor to the south has an attached garage and a pole barn and his property is slightly less acreage than mine. Chair Budde asked if there was anyone else in the audience regarding this public hearing. There was no one present. Chair Budde closed the public hearing at 9:10 pm. Klecker made a motion to approve the CUP N ariance. Winslow seconded the motion. All vote aye. . 4. OTHER BUSINESS . . .
