2002-12-10 PC Minutes . . . CITY OF ALBERTVILLE PLANNING & ZONING COMMISSION APPROVED MINUTES December 10,2002 1. CALL TO ORDER - ROLL CALL - ADOPT AGENDA Chair Budde called the regular meeting of the Planning and Zoning Commission to order. PRESENT: Chair Ed Budde, Commission members Ron Klecker, Tim Sweeney, Sharon Leintz, and Council Liaison LeRoy Berning, City Planner Al Brixius, and Deputy Clerk Bridget Miller. Klecker made a motion to approve the agenda as presented. Leintz seconded the motion. All voted aye. 2. MINUTES a) November 12, 2002 regular meeting Leintz made a motion to approve the November 12,2002 minutes with the correction of paragraph 8 on Page 3 'He was looking at the safety issues - what if a fire should start in the rear and they would not be able to get out safely. Klecker seconded the motion. All voted aye. 3. PUBLIC HEARINGS a) Especially for Children Chair Budde opened the public hearing at 7:03 p.m. City Planner AI Brixius went over the Conditional Use Permit before the commission. Especially for Children is requesting the CUP to operate a childcare facility at 5600 LaCentre, Suites 112-114 of Albertville. The application indicates that Especially for Children anticipates serving approximately 150 children at this site. The lot on which the site is located is zoned B-2 Limited Business District. The application indicates that the site consists of7,500 square feet within a 25,200 gross square foot single story multi-tenant retail center. The plans indicate four (4) parking stalls to be designated as 20-minute parking stalls for the purpose of dropping-off and/or picking up children. A large loading zone in the rear of the building is in the plans. Such loading zone will be accessed from the rear of the building. A striped pedestrian crossing area connecting the southwest parking area to the curb in front of the daycare shall be installed. The applicant's notes indicate the 4,720 square foot area may be divided into two (2) separate play areas: one for infants and toddlers and one for pre-school children. The structure and operation shall be in compliance with the State of Minnesota, Department of Human Services Regulations and shall be licensed accordingly. Chair Budde asked if there was anyone present to represent this CUP. Peter Rindelaub was present to tell a little more about the Childcare facility. Chair Budde asked what the maximum capacity of the daycare facility is? Peter Rindelaub said it would be calculated by the State of MN Regulations. Commission member Klecker asked about the location of the playground and also had a concern about the lights on the building. It was confirmed that they would be wall-mounted lights and the light would be directed downward. They would be on 24 hours a day 7 days a week. . Chair Budde asked about the type of fence would be around the playground. What will the height be? Commission member Sweeney asked about where the sick/ill children are placed until a parent or other adult picks them up? Especially for Children representative commented that they would probably be isolated in the Administrator's Office on a cot. Commission member Sweeney asked about background checks on employees. Again the representative responded that they would go through the State for background checks. Commission member Sweeney asked about teenagers looking for a part-time job. He asked about pricing? Also if they would consider being open in the evenings? Chair Budde asked about the outdoor playground and the bigger toys - will there be enough room and where would they be? A question came up about the parking stalls and when they anticipate opening. . Chair Budde asked if there were anyone else in the audience who had concerns about the public hearing. Page 3 of 4 Commission member Klecker made a motion to approve the CUP with the stipulation of the City Planner Brixius stated. Commission member Leintz seconded the motion with the stipulation and the 6- foot high fence. All voted aye. b) B-3 Car Rental Amendment Chair Budde opened the public hearing at 7:46 p.m. City Planner Brixius went over the basic amendment to the Zoning Ordinance. In response to the previous request to allow car rental use in the B-3 District, it was requested by the City Attorney that the ordinance be revised to more clearly define car rental as an allowable use in the B-3 Zoning District. Chair Budde asked if there were anyone else in the audience who had concerns about the public hearing. Chair Budde closed the public hearing at 8:13 p.m. Commission member Leintz made a motion to approve the Amendment to the B-3 District Zoning Ordinance. Klecker seconded the motion. All voted aye. . c) B-2A Rezoning Map Chair Budde opened the public hearing at 8:15 p.m. Chair Budde asked the City Planner to go over the areas of re-zoning. City Planner Brixius went over the map and the areas that were in mind. There was additional discussion on the B-2A Rezoning. The question was asked if everyone was notified of the rezoning. The commission went on to locate other areas they would consider rezoning to B-2A. Chair Budde asked if there were anyone else in the audience who had concerns about the public hearing. Chair Budde closed the public hearing at 8:46 p.m. Commission member Leintz made a motion to approve the B-2A Rezoning on the areas noted on the map. Klecker seconded the motion. All voted aye. . OTHER BUSINESS a) Outdoor Sales, Rental, Storage, Analysis Chair Budde proceeded with the remaining agenda items. City Planner Brixius went over the issue before the commission. The City was recently approached by a commercial rental business, which inquired about the ability to store and display their merchandise outside their building in a B-3 zoning district. There was considerable discussion on the outdoor sales issue before the commission. The commission looked around the city of Albertville map and tried to identify where else in Albertville they could possibly place the rental businesses' request for a sales/rental car dealer. The commission suggested re-Iooking at the ordinances and zoning definitions. . b) Accept Resignation from Tim Sweeney Chair Budde acknowledged the resignation from commission member Tim Sweeney. Congratulated him on the election and opportunity to serve on the City Council. c) Discuss filling Planning Commission position It was discussed to advertise for the open position on the Planning Commission. 5. ADJOURNMENT Commission members Klecker and Leintz wanted to know the status of the stoplights on the comer of CR 19 and 57th Street. With the opening of Cobom's they have a 4-way stop sign. There are a number of people who don't know it is there. Some of the cars are going right through and not stopping. It was advised to contact Wright County Sheriff s Department. Suggest putting up some flashing lights to bring it to the motorists' attention. Klecker made a motion to adjourn at 9:05 p.m. Leintz seconded the motion. All voted aye. .
