Planning & Zoning Commission Minutes

CALL TO ORDER-ROLL CALL-ADOPT AGENDA
7:00 PM
PRESENT: Chair Sharon Leintz, Commission members Scott Dorenbush, Dan Wagner, Frank
Kocon, and Tiffany Meza, Council Liaison Tom Fay, City Planner Alan Brixius, and City
Clerk/Secretary Bridget Miller.
ABSENT: Zoning Administrator Jon Sutherland
Chair Leintz called the Planning and Zoning Commission meeting of the City of Albertville to
order at 7:00 p.m.
AGENDA:
Add item S.d. Towne Lakes PUD Amendment.
MOTION BY Commission member Wagner, seconded by Commission member Dorenbush to
approve the agenda as amended. Motion carried unanimously.
MINUTES:
MOTION BY Commission member Dorenbush, seconded by Commission member Meza to
approve the minutes of March 9, 2004, Planning & Zoning Commission Minutes with one minor
revision. Motion carried unanimously.

PUBLIC HEARINGS:
KARSTON COVE 3RD ADDITION
PRELIMINARY PLAT PUD AMENDMENT
FINAL PLAT
Chair Leintz opened the public hearing for Albert Villas Seventh Addition at 7:05 p.m.
City Planner Brixius handed out copies of the original concept plan for the Karston Cove 3rd
Addition. Woodside communities, LLC has submitted plans for subdivision of 43 town home
lots on 8.43 gross acres. The site is located on the south side ofCSAH 37 at the western city

limits abutting the Cedar Creek North Development. The site is zoned R-5, Medium Density- .
Multiple Family and Pilot Land Development was granted preliminary plat approval in 1998.
The purpose of this application is to amend the PUD to allow a change in housing type from
back-to-back townhomes to all "row" style townhomes on the site.
The Zoning Ordinance requires two (2) rent-free parking spaces per unit for all types ofliving
quarters proposed.
The preliminary plat shows off-site parking abutting 64th Street NE from Northwest, Northeast
and South Drives. Staffhas concerns regarding the overall maneuverability of off-street parking
with regard to its proximity to 64th Street NE. Staff recommends that Block 1, Lots 1-2 be
moved 20-feet further south (to be 35-feet from the minimum setback requirement off of 64th
Street NE) and that the parking proposed for that area be moved to the north of those buildings.
In conclusion staff finds that the proposed plan is generally consistent with the zoning ordinance.
If the Planning & Zoning Commission recommends approval of the preliminary plat, PUD
amendment, and final plat, staff would recommend that the following conditions be required as
part of that approval:
Parking
1. The site plan shall be revised to incorporate the following: show five (5) off-street
parking stalls north of Block 1, Lot 1 and 2, show four (4) off-street parking stalls .
north of Block 1, Lot 10 and 11, eliminate two (2) off-street parking stalls that abut
65th Avenue NE to the south and provide two (2) additional stalls in the south central
portion ofthe site plan. Lot 1 and 2, Block 1 shall be moved no closer than 35 feet to
65th Street ~E to provide for parking in the north.
2. No parking shall be allowed on private streets. The applicant shall be responsible for
providing and posting "No Parking" signs near all private drives.
3. Turning radii at street intersections shall be subject to the review and approval of the
Fire Chief.
Landscaping
1. The applicant shall provide a revised landscaping plan.
2. Plantings shall be relocated from all traffic visibility triangles.
3. Additional overstory deciduous trees shall be planted along both sides of 65th Street.
Signage
1. All signs proposed for the site shall require a sign permit.

Lighting
1. The applicant shall submit a photometric plan and provide details of all lighting
fixtures. The photometric plan is subject to the review and approval of City Staff.
Grading and Drainage
1. Grading, drainage, and utility plans are subject to the review and approval of the City
Engineer.
2. Lots 1,2, & 10, Block 1 and Lots 7-9 Block 2 shall be revised to allow for a 3D-foot
buffer along all wetlands.
3. Buffer areas shall be maintained with native plant materials. The grading, drainage,
and utility plans are subject to the review and approval of the City Engineer
Building Design
1. The applicant shall submit revised building elevations. A minimum of twenty-five
percent (25%) of the exterior finishes shall be brick or stone.
Additional Conditions
1. A development agreement shall be entered into between the developer and the City.
2. Submission of homeowners association documents for review and approval ofthe
City Engineer.
Roger Fink is the Land Developer representing Woodside Communities - Karston Cove 3rd
Addition. He briefly explained the name changing from Pilot Land to Woodside Communities.
As CP Brixius stated this was originally a concept approval in 1998. We have changed the site
plans some. All of the units are two-story units as demonstrated in the handouts before the
commission members.
The units will have a sliding door in the rear of the unit with a proposed 10' x 10' wood deck.
Woodside Karston Cove LLC will work with the City in getting the off-site parking in
compliance with the zoning ordinance.
Roger had a concern about the south outlot to be considered it for the future
Chair Leintz asked about the length of the driveway. City Planner Brixius will report back as to
what the previous developer was asked to change to. This issue has corne up in the past. Town
Lakes was the last concept plan.

Commission member Meza asked about the lighting in the off-site parking. City Planner Brixius .
and the developer will work something out to get some additional lighting. Council liaison
Berning asked for additional lighting within the development as well.
Commission member Kocon had an issue with snow removal. He did not see any place for the
snow storage within the plat. City Planner Brixius asked Mr. Fink to identify that in the
Developer's Agreement and/or Home Owner's Association agreement so they have written
documentation that it is okay to store the snow in the wetlands or ponding area.
Council liaison Berning asked about re-locating some of the guest parking to more of the center
of the project.
Mr. Fink explained that they were not sure about re-locating them, but would look into it.
Commission member Kocon wanted to confirm that there would be no parking allowed on the
streets. He shared that during special holidays it could get very congestive.
City Planner Brixius stated that there would be the parking lot for the park that would be
available for the overflow parking during special occasions.
A question was asked about a sidewalk. They need to show the sidewalk on the original plan.
Will there be a sidewalk in the revised plan?
Chair Leintz asked if there were any comments from the audience.

Resident of Karston Cove - we have noticed that ever since there has been more development
the wetlands have disappeared. We moved to this area and selected the specific site for the
wetland and wildlife. You are talking about snow storage and then you get the salt and sand
pushed into the wetlands. The water level has gone down considerably.
It was shared with the resident that with private drives the maintenance department does not
generally use ice removal chemicals, so there should not be any salt pushed into the wetland
areas.
A resident - from the Kollville Estate - asked about the woods or small group of trees going to
be removed?
Mr. Fink addressed the small group of trees that she was talking about. He didn't feel that they
would be harmed. They would try to preserve as much of the natural wildlife in the site as
possible.
Chair Leintz closed the public hearing 8:11 p.m.
City Planner Brixius asked to confirm what the recommendations revisions will be for the
Findings of Facts for the Councils review.

MOTION BY Commission member Dorenbush, seconded by Commission member Kocon to
approve the Preliminary Plat, PUD Amendment with the additional recommendations heard from
the Planning & Zoning Commission tonight and the Final Plat. Motion carried unanimously.
OTHER BUSINESS
CONCEPT PLAN FOR COVES OF HUNTERS LAKE - RESIDENTIAL PUD
Matt Froelich introduced himself to the commission as well as his assistant were present at the
meeting.
Mr. Froelich informed the commission that they are petitioning to change the name of the lake.
They will be presenting it to Albertville in the future. He brought to the commissions attention
the surrounding land site plans from the neighboring city of Otsego.
Mr. Froelich's assistant showed some slides to demonstrate what coving is. He showed the
commission what the original concept plan of Cedar Creek.
City Planner Brixius went over his planning report for the concept plan for Coves of Hunters
Lake Residential PUD. The purpose of this item is to review the attached concept drawing for
the Coves of Hunters Lake and provide the developer with general feedback on the design. This
is a formal concept plan review in that the developer has filed a formal application with the City.
What the developer was looking for was the commission's comments and if they would support
the PUD-RI-A concept.
It was acceptable at this point with the commission members. The developer will be bringing
this before the City Council on Monday, May 3rd for their review.
SIGN ORDINANCE - TEMPORARY SIGNS
Table this to the May 11 th Planning Commission meeting for further discussion. City
Planner Brixius asked if the commission look over the ordinance. A Public Hearing
notice will be published.

Tiffany and Dan will get back to Bridget later this week.
Concept for Towne Lakes - Revision
City Planner Brixius went over the requested revision to the Towne Lakes Concept Plan. The
commission was in agreement to go ahead with the minor revision to the Concept Plan.
