City of Albertville Planning & Zoning Commission Minutes September 15, 2004 Albertville City Hall CALL TO ORDER - ROLL CALL - ADOPT AGENDA 7:00 PM PRESENT: Chair Sharon Leintz, Commission members Frank Kocon Dan Wagner, Scott Dorenbush, and Council Liaison Tom Fay, City Planner Al Brixius, Zoning Administrator Jon Sutherland and City Clerk/Secretary Bridget Miller ABSENT: Commission member Tiffany Meza Chair Leintz called the Planning and Zoning Commission meeting of the City of Albertville to order at 7:00 p.m. MOTION BY Commission member Wagner, seconded by Commission member Kocon to approve the agenda as presented. Motion carried unanimously. MINUTES: Amend the August 10, 2004 minutes page 3 - Motion by Commission member Meza, seconded by Commission member Wagner to approve the FTTH Communications CUP/PUD request with the additional recommendations ofthe landscaping. Motion carried unanimously. MOTION BY Commission member Kocon, seconded by Commission member Dorenbush to approve the August 10, 2004, Planning & Zoning Commission Minutes as amended. Motion carried unanimously. NEW BUSINESS None PUBLIC HEARINGS: HUNTER PASS PRELIMINARY PLAT/ CUP / PUD Chair Leintz opened the public hearing for Hunter Pass at 7:04 p.m. Minnesota Development Agency, LLC., has submitted an application for Preliminary Plat and Conditional Use Permit Planned Unit Development approval for a development of76.6 acres in the northeast comer of the City of Albertville. The site is bounded on the north by 70th Street, the east by MacIver Avenue the south by Mud Lake and the west by the Towne Lakes . preliminary plat. The proposed development consists of95 single-family lots. The proposed subdivision design is based on a concept known as "coving". Coved subdivisions utilize curvilinear street patterns and varied front yard setbacks as a means of providing more visual open space and unique streetscape appearance. Implementation of the subdivision design requires flexibility from the front setback standards to establish the varied setback versus the standard 30-foot front yard setback of the R-IA Residential district. The applicant is also requesting flexibility from the R-IA lot area and lot width requirements as well as street ROW width and street width requirements. The site is significantly impacted by Mud Lake and existing wetlands. There is medium to high- density residential development planned in the City of Otsego abutting the site to the north and east. A curvilinear street pattern is proposed providing two connections to 70th Street, one connection to MacIver Avenue. The applicant has submitted grading, drainage, and utility plans which are subject to the review and approval of the City Engineer. Upon review ofthe proposed Preliminary Plat and Conditional Use Permit/Planned Unit Development, it is staffs' view that the proposed 95 single-family residential lots are consistent . with the intent of the comprehensive plan for the subject area. Matthew Froelich was present to answer any questions the commission members may have. Commission member Wagner had a question about if we collect funds for park dedication and how dee does it affect the future of the lot to maybe a park. He asked about sidewalks and will they be concrete. He would like to know the timing of when they will be installed. City Planner Brixius informed the commission that the city collects funds for park dedication. When there are no plans for parks the city would get a cash park dedication. The City of Albertville requires a 10 percent land dedication or per unit cash dedication in lieu of land for each subdivision. The Albertville Comprehensive Park and Trail System Plan does not designate any future parks in the subject area. There was a concern from Commission member Wagner and the roads lining up across 70th Street and the abutting Towne Lakes development. Zoning Administrator Sutherland would like to see how a house is going to sit on some of the lots. He sees in the future the resident needing a variance to add a deck or other. City Planner Brixius suggested the applicant supply an inventory of index for every lot in the subdivision. . . . Chair Leintz asked if there was anyone in the public here to speak regarding this plat. The Valerius' were present to find out what was going to happen to their land. It would be surrounded by this development. They were advised to contact the City Administrator and the City Planner to go over some suggestions. Chair Leintz closed the public hearing 8:15 p.m. MOTION BY Commission member Wagner, seconded by Commission member Dorenbush to approve with the 13 recommendations. Motion carried unanimously. ALBERTVILLE CROSSINGS 3RD PRELIMINARY PLAT / FINAL PLAT Chair Leintz opened the public hearing for the Preliminary Plat/Final Plat of Albertville Crossings 3rd Addition at 8:17 p.m. Cascade II Land Development Company is requesting a preliminary and final plat for one lot of the Albertville Crossings 3rd Addition. The developer is preparing the land in order to sell the lot for commercial development. The site is currently undeveloped, no buildings are proposed at this time. The applicant is seeking preliminary and final plat approval of Lot 1, Block 1 of Albertville Crossings 3rd Addition. No building or site development is proposed at this time. Staff finds that the proposed plat is generally consistent with the Subdivision Ordinance. There are three Recommendations should the Planning Commission approve this Preliminary and Final Plat. Commission member Wagner discussed the first recommendation of a public street. Commission member Kocon wanted clarification of how the present and proposed streets would line up. The applicant would like to meet to discuss the feasibility of the public street. Chair Leintz asked ifthere was anyone present for the Albertville Crossings 3rd Addition. There was no one present. Chair Leintz closed the public hearing 8:31 p.m. MOTION BY Commission member Dorenbush, seconded by Kocon to approve the Preliminary and Final Plat of Albertville Crossings 3rd with the three recommendations. Motion carried unanimously. . SHOPPES AT PRAIRIE RUN Preliminary Plat / Site and Building Plan Review Chair Leintz opened the public hearing for the Preliminary Plat for the Shoppes of Prairie Run at 8:32 p.m. . The applicant, Granite City Real Estate, LLC. has requested preliminary plat and site and building plan review for a three building, multi-tenant retail commercial development on two separate parcels. The development includes a mixture of retail uses including a future restaurant in the northern two buildings and a pet supply store in the southern building. The site is 4.98 acres in area, abuts County Road 19 to the east and Kyler Avenue to the west. The Comprehensive Plan designates the subject site for commercial use. The Zoning Map classifies this site as B-2, Limited Business District. The applicant is also requesting a CUP/PUD to allow for two principal dwellings to be located on one parcel. The northern site has three access points off of Kyler Avenue. The circulation pattern within the site is generally satisfactory with 24-foot wide drive aisles, compliant with two lane traffic standards. The southern lot is shown to be independent of the northern parcel in terms of circulation. The site has two separate accesses one of which is proposed to be utilized for truck loading. Upon review of the applicant's submittal there are a number of site layout issues that need to be addressed prior to a recommendation of approval. These issues, including the final layout and . design of the building and parking area of Lot 2 may require a revision in the proposed plat, thus making the current preliminary plat application premature. Daniel Tempel was present to answer any questions or concerns the Planning Commission might have with this development. He brought in a revised plan, which the City Planner was seeing for the first time. Dan asked if they could go over the 15 recommendations. Ones access off of Kyler Avenue must be eliminated from the southern lot and a circulation pattern must exist between both the northern and southern parcels. An access and cross easement agreement between the property owners of the two parcels must be submitted and approved by the City Attorney. The applicant must demonstrate how loading/unloading of delivery vehicles will safely occur within the site. The width of the loading aisle running north south along the west side of the site is to be increased from 10 feet to 20 feet. . . . . The applicant must submit a snow removal plan for staffs review and approval. (There was additional conversation regarding this.) The site plan must be revised to show the location and detailed description of the shared trash enclosures that are properly screened and constructed of similar material to that of the principal structure. (On the revised plans handed out this evening this was moved to a new location) To be more consistent with surrounding commercial development, the landscape plan must be revised to include a mixture of Scarlet Sentinel Maple, Norway Maple, and Boulevard Linden at approximately 50-foot intervals. (The applicant said they would be in compliance with this.) Lighting fixtures are to be mounted on poles no higher than 25 feet. All lighting must be 90-degree cut-off. Any lighting added to the exterior of the building must be hooded or controlled in some manner so as not to reflect light into adjacent right- of-ways. A comprehensive signage plan consistent with the Albertville Sign Ordinance must be submitted and reviewed by staff. The applicant must submit detailed building and elevation plans of each of the buildings on the site. The applicant must utilize a "warm" building fayade color scheme to be consistent with surrounding commercial development. Additional accenting is to be utilized along the eastern fayade of the southern most building to break up the monotony of a solid stucco wall. All grading, drainage, and utility issues are subject to the review and approval of the City Engineer. (The applicant stated the he is working with the City Engineer to meet these issues. ) Comments of other City Staff. Commission member Wagner had a concern with Outlot B. He asked if there would be a sidewalk for pedestrian accessibility. Chair Leintz asked if there was anyone present regarding this development. There was no one present. Chair Leintz closed the public hearing 9:16 p.m. MOTION BY Commission member Wagner, seconded by Kocon to approve the Preliminary Plat, Conditional Use Permit for the Shoppes at Prairie Run. Motion carried unanimously. . OTHER BUSINESS SHOPPES AT TOWNE LAKES SITE AND BUILDING PLAN REVIEW Al Keller has submitted an application for Site and Building Plan review of the Shoppes at Towne Lakes One. The site and building plan review is for the multiple tenant building on Lot 4. The proposed building is 9,500 square feet and located in the northern portion of the development. Wanda Kramer representing G.c.1. Builders was present to answer any concerns or questions the Commission might have. Commission member Wagner had a concern with the flow of traffic within the site. Ms. Kramer commented that she would take these issues back to G.C.1. Builders. She reviewed the 18 recommendations and shared that most of the recommendations are workable. MOTION BY Commission member Dorenbush, seconded by Wagner to approve the Site and . Building Plan Review for the Shoppes at Towne Lakes One, Lot 4. Motion carried unanimously. PLANNING AND ZONING COMMISSION RULES Chair Leintz asked the Building Official to table the review of the Planning and Zoning Commission Rules.
