2006-04-11 PC Minutes . . . ~ ~~~r.!.'!iJL€ PLANNING and ZONING COMMISSION MINUTES April 11, 2006 Albertville Council Chamber 7:00 PM CALL TO ORDER - ROLL CALL - ADOPT AGENDA PRESENT: Chair Sharon Leintz, Commission members Frank Kocon, Dan Wagner, Tiffany Meza, and Scott Dorenbush, Council liaison LeRoy Berning, City Planner Al Brixius, Zoning Administrator/Building Official Jon Sutherland, and City Clerk/Secretary Bridget Miller Chair Leintz called the Planning and Zoning Commission meeting of the City of Albertville to order at 7:00 p.m. ADOPT AGENDA MOTION BY Commission member Dorenbush, seconded by Commission member Meza to approve the agenda as presented and on file in the office of the City Clerk. Motion carried unanimously. MINUTES MOTION BY Commission member Kocon, seconded by Commission member Dorenbush to approve the February 14, 2006 minutes as amended and on file in the office of the City Clerk. Motion carried unanimously. Amend the February 14,2006 minutes to reflect Tiffany Meza was present. PUBLIC HEARINGS ST. MICHAEL/ALBERTVILLE CLINIC - PRELIMINARY AND FINAL PLAT, CONDITIONAL USE PERMIT (CUP), PLANNED UNIT DEVELOPMENT (PUD), REZONING, AND SITE AND BUILDING PLAN REVIEW Chair Leintz opened the public hearing at 7:06 p.m. According to the City Planner Brixius, HDR/Jordan Architects and Albertville Medical Building LLC applied to construct a medical office building and other new buildings on three existing parcels located at the corner ofCSAH 18, otherwise known as Jason Avenue NE and CSAH 19 also known as LaBeaux Avenue NE within Albertville. The application submitted is for Preliminary Plat, Conditional Use Permit (CUP), Planned Unit Development (PUD), Final Plat, . and a Site and Building Plan Review. The applicant is looking for Rezoning of Parcel C. The majority of the site is zoned B-2, Limited Business District, which allows for medical clinics and office buildings. Parcel C is zoning R-IA, Residential Low Density Single-family. The applicant has been working with the City to rezone the property B-2 to match the other two parcels. Access to the site will include a right-in-only drive off of CSAH 19, and a full entrance from CSAH 18. Internal access off of city streets will be a full entrance at the comer of 51 st Street NE and Kyler Avenue NE. Access to the site must be reviewed and approved by Wright County. The County is requiring a 70-foot right-of-way from the center line ofCSAH 19 and CSAH 19; this right-of-way should be approved by the County prior to construction. City Planner Brixius discussed the trash enclosure and noted it extends across the property line of Lot 1 and Lot 2. The west property line should be moved 30-feet to the west to accommodate the rear yard setback ofthe B-2 District. The applicant has proposed four ground signs and two building signs for the entire site. In past CUP/PUD approvals of comprehensive sign plans, an extra freestanding sign has been allowed; therefore we will allow the extra freestanding sign on Lot 1 under the sign details. Chair Leintz asked if anyone was present regarding the public hearing. . There was no one in the audience with concerns regarding the Clinic. Since it appears the building has double frontage, such as those in Albertville Crossings 2nd, Albertville Premium Outlets Phase III, there is consideration to allow for additional signage. There will be exposure along CSAH 19 (LaBeaux Avenue NE) and Kyler Avenue NE. Chair Leintz closed the public hearing at 7:38 p.m. MOTION BY Commission member Meza, seconded by Commission member Kocon to approve the Albertville Medical Center - Preliminary and Final Plat, Conditional Use Permit (CUP), Planned Unit Development (PUD), Rezoning Parcel C from R-IA to B-2, and Site and Building Plan Review all subject to the staffs recommendation as amended, including the Building Official's review, City Engineer's review and City Council approval at the May 1, 2006 City Council meeting. Motion carried unanimously. ZONING ORDINANCE AMENDMENT -MODEL HOMES Chair Leintz opened the public hearing at 7:40 p.m. . . . . City Planner Brixius stated that recently model homes have been approved as part of a new subdivision. Staff feels a need to create greater stipulations to the approval of model homes to maintain a higher quality. Chair Leintz asked if anyone was present regarding the public hearing. There was no one in the audience with concerns regarding the Amendment to the Zoning Ordinance pertaining to Model Homes. Chair Leintz closed the public hearing at 7:49 p.m. MOTION BY Commission member Dorenbush, seconded by Commission member Meza to approve Ordinance No. 2006-xx entitled (Zoning Ordinance Amendments Relating to Model Homes) with staffs recommendations, as amended and City Council approval at the May 1, 2006 City Council meeting.
