In review of the City approval the term multi-retail services was used to describe permitted uses, this is rather vague. I have discussed this with the City Administrator and we believe the intent was to allow uses that are permitted in the B-3 zone, which includes permitted uses in the B-2 and B-1 zones. I believe the exception to this is the restaurant use that was specifically discussed by the Council and was Limited to a coffee shop. I hope this information clarifies the permitted uses for the multi-tenant building. Please contact me if you have any questions. The legal description of the subject property is Lot 1, Block 1 Albertville Plaza. 2. The applicant has an existing wall sign of 140 square feet and one freestanding sign 75 feet in height and 200 square feet in size. 3. The Albertville Plaza site is not unique or does the site present a hardship that can be overcome by additional signage. The site already is afforded signage above and beyond a typical B-3 site through the PUD approval (i.e., the 75 foot tall freestanding sign and front wall sign). 4. The Council finds that the proposed variation is based in part on the desire to increase the value or income potential of the business. The applicants own description of need represents that this is one of the driving interests in pursuing the variance. 5. As such, there is no physical hardship that is unique to this site which creates a need for additional signage. 6. The introduction of a 200 square foot illuminated wall sign on the northwest corner of the building would introduce additional lighting into the adjoining residential neighborhood. As such, it would have a negative impact on the adjoining properties and would be inconsistent with the intent of the conditions outlined in the original PUD agreement which state that no wall signage shall be allowed on the rear of the buildings facing residential zoned areas. Decision: Based on the foregoing considerations and applicable ordinances, the applicant's request for sign variance has been denied based on review of the criteria and the most current plans and information received to date. Albertville Plaza Multi-tenant building. As we discussed, according to the plan the foot-candle standard of 0:4 is met at the property lines. However, there is an on-going glare issue at the site. In discussions with the City Council they have directed staffto work with you to resolve the glare issue. There are three things to be addressed. First is the screening' of the wall packs on the building. Either some type of shield needs to be constructed to direct the light downward or a different type of fixture needs to be placed on the building. Secondly is the parking lot lighting. The heads on the posts need to be adjusted to direct the light at a 90-degree angle. After this adjustment we will assess if any cut-off shields will be necessary on the lights. The third issue is the freestanding sign for 2nd Wind. The sign is internally illuminated but it is very bright. The City has a regulation that requires that the sign not be illuminated between the hours of 11:00 pm and 7:00 am, when the use is not open for business. It is imperative that the sign be regulated with some type of timing device so that the sign is consistently off during these hours. The Council is willing to review each step incrementally to assess the impact on the lighting reduction. For example, first adjust the heads on the poles, if that is not adequate then. shields will be required. Once adjustments are made, the City will require that an as-built lighting plan with measurements of foot-candles be provided. I have included a copy of the relevant portions of the ordinance regarding lighting of the parking areas as well as the sign. Please contact me with a schedule for modifications at the site. In review of our case file, we find that no lighting plan was submitted showing details for lighting types or lighting contours as part of the PUD review. Section 1000.10, Glare of the Albertville Zoning Ordinance, requires any light used to illuminate an off-street parking area, sign or other structure shall be arranged as to deflect light away from an adjoining residential zone or from public streets. Direct or sky reflected glare whether from spotlights or from high temperature process such as combustion, welding, shall not directed into any adjoining property... The source of light shall be hooded or controlled in some manner so as not to light adjacent property. Bare incandescent light bulbs shall not be permitted in view of adjacent property or public right-of-way. Any light or combination of lights which cast light on a public street shall not exceed one foot candle meter reading as measured from the centerline of said street. Any light or combination of lights which cast lights on a residential property shall not exceed .4 foot candles meter reading at said property line. In view of this ordinance requirement, and the non submission of a site lighting plan, we would advise the City to notify the owner of the Albertville Plaza that they should submit a lighting plan showing cut sheets for each lighting fixture as well as a photometric plan showing the foot candle contours on the property. This plan should demonstrate that all lighting, parking lot and building is directed downward and away from sensitive areas. The site is zoned PUD and was approved for unrestricted commercial development as part of the Westwind PUD. The existing PUD also allowed pylon signs consistent with the Sign Ordinance allowance for lots abutting the freeway. The current application is to amend the PUD and implement a development plan with specific uses with an internal system of shared access. The application also includes platting the property. ATTACHMENTS • Site location • Development plan • Preliminary Plat PRELIMINARY PLAT/DEVELOPMENT PLAN The preliminary plat consists of three lots and one large outlot: Lots 1 and 3 currently have development proposed that are subject to site plan review later in the agenda. Lot 2 will be subject to site plan review in the future. Outlot A may become more than one lot and will be subject to platting and site plan review in the future. The uses on the parcels under the amended PUD are praposed to be restricted to restaurant, automobile service, professional office, bank, motel, daycare and retail sales. The uses praposed are subject to the ability to provide a site plan with reasonable setbacks, lot coverage and parking ratios. All perimeter setbacks shall be consistent with the ordinance for B-3 zoning and parking. Following the public hearing the Planning Commission recommended that no restaurants or auto service be permitted on lots 1, 2 or on Outlot A. Stormwater Management/Utilities. An overall design has been submitted regarding stormwater management and utilities on the site. The City Engineer is reviewing the information and will provide comments prior to the Commission meeting. Access. The entire development will be served via two accesses, one to County Road 37 and one to County Road 19. The access points, designs and any additional improvements are subject to the review and approval of Wright County. The internal system will be a private road through the site with individual accesses and parking for each use. Cross easements for access and parking will be recorded for the entire PUD. Landscaping. Same berming and landscaping was installed with the residential portion of the PUD. Additional plantings will be required on the commercial side but this will be addressed with the individual site plans. RECOMMENDATION The Planning Commission held a public hearing on this matter and they recommend approval of the amended PUD to be known as Albertville Plaza with the following conditions: 1. The PUD shall be limited to two multi-tenant ground signs at 75 feet in height and 125 feet in area. 2. Each lot may have one ground sign not to exceed 10 feet in height and 40 square feet in area. 3. No wall signs shall be allowed on the rear of buildings facing residentially zoned areas. 4. RJ Marco Construction Inc. has submitted as application for Site Plan review to allow the construction of an 11,800 sq. ft. Multi-tenant building to include, among other uses, retail sales and a liquor stare to be located on the west side of County Road 37. The site is zoned PUD and the uses are permitted under the PUD. The site is approximately 2.41 acres in size and the Comprehensive Plan guides this area for Commercial Development. The property is zoned PUD and the use is consistent with the development plan for the area. Site Access/Circulation: Access into the site will be from the internal private road. Circulation will be provided around the entire building. The proposed fast food site includes adrive-through lane separate from the rest of the on-site circulation. The drive aisle areas and parking on the west side of the site is adjacent to residential uses. Staff would like to see the maximum separation that can be accommodated in order to provide a meaningful buffer. Parking: The ratio for shopping center was used to calculate .parking space. This requires 5.5 spaces per 1000 square feet of space which works out to be 65 spaces required, 69 spaces are provided. The parking as proposed .should. be adequate for the uses proposed. Shared parking will be available under the PUD agreement. All areas will be bounded with concrete curb and gutter with bituminous surfacing. All spaces shall be at least 8 'h` x 20' with 24' drive aisles. Parking shall also be provided to meet ADA regulations. Building type and construction: The proposed building will have an exterior consisting of rockface block and burnished block with an accent band. The front of the building utilizes glass storefronts with colored awnings proposed over. the individual tenant spaces. The south elevation is very plain and some additional banding or mix of materials should be provided to create a nicer view from the public road and the main entrance into the site. There is a sign band shown on the front of the building that will allow wall signs up to 5% of the total wall area, the sign ordinance allows up to 15°I°. Wall Signage shall be limited to the areas identified on the exterior elevation plan submitted and a date of approval will be provided following City action. Exterior Storage/Screening: No exterior storage is proposed as part of the application. The trash area shall be enclosed and is to be constructed of materials to match the building. Because of the proximity to the residential use west of the site staff recommends that the trash enclosure be moved to a different location on the site. Any roof top equipment shall be screened as appropriate. Grading/Drainage/Utilities: The final plans are subject to the review and approval of the City Engineer. Landscaping Plan: A landscaping plan has been submitted that shows a number of plantings but there are no labels on the plan. A buffer a minimum of 6 feet in height as required by the ordinance shall be included in the revised landscape plan. Special attention should be given to screening headlights since the circulation pattern directs traffic so that it may create headlight issues. A revised plan shall be submitted subject to the review and approval of the City Planner. The applicant shall post the appropriate landscape guarantee as required by the Zoning Ordinance. Lighting: A lighting plan has not been submitted. This shall be submitted prior to issuance of a building permit and is subject to the review and approval of the City Planner. RECOMMENDATIQN The application is .proposed under a Planned Unit Development.. The Planning Commission reviewed this request and they recommend approval with the conditions outlined below. 1. The site shall be modified to provide the maximum setback possible to the west property line adjacent to residential. uses. 2. The site is zoned PUD and was approved for unrestricted commercial development as part of the Westwind PUD. The existing PUD also allowed pylon signs consistent with the Sign Ordinance allowance for lots abutting the freeway. The current application is to amend the PUD and implement a development plan with specific uses with an internal system of shared access. The application also includes platting the property. ATTACHMENTS • Site location • Development plan • Preliminary Plat PRELIMINARY PLAT/DEVELOPMENT PLAN The preliminary plat consists of three lots and one large outlot: Lots 1 and 3 currently have development proposed that are subject to site plan review later in the agenda. Lot 2 will be subject to site plan review in the future. Outlot A may become more than one lot and will be subject to platting and site plan review in the future. The uses on the parcels under the amended PUD are restricted to restaurant, automobile service, professional office, bank, motel, daycare and retail sales. The uses proposed are subject to the ability to provide a site plan with reasonable setbacks, lot coverage and parking ratios. All perimeter setbacks shall be consistent with the ordinance for B-3 zoning and parking. Stormwater Management/Utilities. An overall design has been submitted regarding stormwater management and utilities on the site. The City Engineer is reviewing the information and will provide comments prior to the Commission meeting. Access. The entire development will be served via two accesses, one to County Road 37 and one to County Road 19. The access points, designs and any additional improvements are subject to the review and approval of Wright County. The internal system will be a private road through the site with individual accesses and parking for each use. Cross easements for access and parking will be recorded for the entire PUD. Landscaping. Some berming and landscaping was installed with the residential portion of the PUD. Additional plantings will be required on the commercial side but this will be addressed with the individual site plans. RECOMMENDATION Staff recommends that the Planning Commission recommend approval of the amended PUD to be known as Albertville Plaza with the following conditions: 1. The PUD shall be limited to two ground signs at 75 feet in height and 125 feet in area. 2. Each lot may have one ground sign not to exceed 30 feet in height and 40 square feet in area. 3. Wall signs shall be consistent with the City sign regulations. 4. Uses on the site shall be restricted as follows: a) Lot 1: Multi tenant retail, office, and restaurant. b) Lot 2 and Outlot A: Restaurant, automobile service, professional office, bank, hotel/motel, daycare and retail sales. c) Lot 3: Restaurant 5.
