Mayor Hendrickson called the meeting to order at 6:17 p.m.

3. TRUTH -IN TAXATION HEARING
Lannes gave an overview of how property taxes are calculated and how the budget process works. She
provided the historical levy data and explained the expected changes to revenue and expenditures for
2020. She stated the proposed levy increase is 4.76% and it could be lowered, but not raised.
Cocking inquired if invoices are sent out to residents for fire response calls or if that is only for I-94
related calls. He stated he had received a call from a resident who had received an invoice for such.
Lannes replied that generally residents are not billed, but it could possibly have been an accident on a
county road rather than a city road; there have been some of those.
Vetsch had concerns about the MPCA permit and any possible future mandates that would require
another large wastewater treatment plant (WWTP) improvement before the bond for the discharge
pipe and plant upgrades are paid off. Lannes stated that the bond is a twenty year bond. She added
that there will be a time where there will be three bonds needing payment for wastewater
improvements over the years. They are for the original plant, plant upgrade, and then will be for the
pipe and plant improvements.
Lannes stated that several new commercial properties have now come onto the tax roll and play a part
in keeping down the residential taxes.

4. PUBLIC FORUM
Sharon Moffett, 11200 69th Street NE, was present at the meeting to voice her concerns regarding
the increase in valuation of her townhouse. She stated that it was 35.7% increase in her value
resulting in over $1,000 increase in taxes on her statement for 2020. Cocking stated that the meeting
to dispute property values is held in the spring at the Board of Appeals and Equalization. He
referred Moffett to the county assessor's office. Couri stated that it may be too late for the taxes
payable in 2020 but still encouraged her to talk to the assessor. Cocking inquired when the property
was built and Moffet replied it was built in 2017. Cocking thought perhaps the property was being
valued comparable to two story townhomes in the neighborhood. Moffet clarified hers is a one story
and only two bedrooms. Moffet thanked Council for listening and stated she would contact the
assessor's office.

FYCC
Olson reported that FYCC has hired six rink attendants for the outdoor ice rink. The board
discussed ballfield striping policy. He stated that school sports will take priority of school fields
during the school year.
Olson also reported that he attended the National League of Cities conference. There was a lot of
content but he found it beneficial and well worth it. He stated he attended a lot of the transportation
sessions and it was very interesting how other cities and states address transportation needs. Next
year's conference will be in Tampa.

Water Board
Hendrickson reported that there are some billing issues that need to be addressed. Vetsch stated that
the board heard that there will be a large increase to purchase a certain chemical that is needed to
treat the water. He said it was approximately $80,000 more, so Veolia is in a nationwide bid process
to acquire it.
B. Finance
1). 2020 Property Tax Levy and Final Budget
Lannes reviewed the proposed levy increase of 4.76% for the tax levy payable in 2020 as well as the
final 2020 budget.
Motioned by Cocking, seconded by Olson, to Approve Resolution No. 2019-042 entitled a
Resolution Adopting Property Tax Levy Collectible in 2020 (for 4.76%). Ayes: Hendrickson,
Cocking, Halling, Olson and Vetsch. Nays: None. Absent: None. MOTIONDECLARED
CARRIED.
Motioned by Cocking, seconded by Olson, to approve Resolution No. 2019-043 entitled a
Resolution Adopting the 2020 Final Budget. Ayes: Hendrickson, Cocking, Halling, Olson and

2). 2019 Enterprise Budgets and Rate Information
Lannes stated that there is no action required tonight if Council wants more time to review the rates;
the last meeting to make any changes to rates will be January 16, 2020.
Olson inquired why no increase was recommended for the tiered rates and only was recommended
for the base rate. Lannes replied that the base rate on the water and sewer fee is guaranteed to bring
in revenue as all accounts pay the base fee whereas the tiers are not guaranteed because some users
never reach amounts into the tiered rates. Olson felt there should be an increase to both the base and
the tiers. He had concerns that the low usage users keep getting stuck with any rate increase. He
provided some samples of what the base and tiers could be increased. He felt a fair number of
accounts do hit the tiered rates, so it would be beneficial to increase there as well. He felt part of the
reason they were in this position was due to the billing error that was found in the past.
Lannes stated that tiers have not been increased and the base rates have remained at the same rate
since 2017. An option would be to look at smaller yearly increases.
Cocking felt that a percentage on the base rate isn't overly burdensome. He is not opposed to an
increase in the tiered rates, but he felt that it would not generate what is needed to the make the
funds whole. He wondered if the larger volume users generate an added cost to operate the WWTP.
Council discussed the tiers and inquired if there has to be tiers. Court replied that State law requires
the tiers and was a means the State used for water conservation. Lannes emphasized that multiple
tiers need to be kept for the water fund; there is only one tier for sewer.
Olson suggested keeping the base fees as proposed resolution but to increase the tiers as below:

Utility Base Rate and Tiers as amended by Olson. Ayes: Hendrickson, Cocking, Halting, Olson
and Vetsch. Nays: None. Absent. None. MOTIONDECLARED CARRIED.
Olson would like the increase be an 80/20 split on the base/tiers. Lannes stated that residential
accounts are capped during the winter months for sewer and there are no residential accounts over
5,000. She stated the sewer fund is healthy, but they are not funding depreciation and with the new
discharge pipe, depreciation could double.
Olson stated that there will be a need to hire additional utility help in the future and they will need to
plan for the future. Hendrickson was fine with the resolution as proposed and would like to see how
it plays out for the next year. Olson wanted the funds more balanced and he wants to be sure they
don't fall behind again where they would have to have a five year base increase again. He stated
they also need to keep up with the rate of inflation as well.
Halling requested clarification be made to the sewer resolution to state that the per 1,000 tier is for
gallons over 5,000.
Motioned by Olson, seconded by Cocking, to Approve Resolution 2019-045 Setting the 2020 Sewer
Utility Base Rate and Tiers as amended by Olson and Cocking. Ayes: Hendrickson, Cocking,
Hulling, Olson and Vetsch. Nays: None. Absent: None. MOTIONDECLARED CARRIED.
C. Planning/Zoning
1). International Property Maintenance Code
Brixius stated that the International Property Maintenance Code provides for up to date and detailed
standards for buildings. This will be helpful to the rental housing inspection program as it addresses
both site and building issues such as interior condition, exterior maintenance and yard maintenance.
However, there were items with the code that the building department felt should be modified to
Albertville's standards. Brixius reported the proposed ordinance adopts the code in its entirety with
the modifications and repeals sections 10-4-4 to 10-4-9 of the existing Albertville City Code.
Olson had concerns with the grading and drainage language in the code. Section 302.2 states that
from May to October every yard shall be graded and drained to be free of standing water. He stated
that some yards never fully dry out. Brixius stated that enforcement would only be enacted if it was
causing issues. Staff felt that the language is needed in the ordinance to address mosquitos or
stagnant water issues.

Hendrickson inquired about noxious weeds and Brixius replied that is in the code and can be
addressed with the city's code enforcement policy. Couri added that it follows what the State
defines as noxious weeds.
Brixius stated that the International Property Maintenance Code is well defined and not vague for
both inspectors and residents.
Motioned by Vetsch, seconded by Olson, to Adopt Ordinance No. 2019-09 for code amendment of
sections 10-4-4 through 10-4-9, International Property Maintenance Code and authorize
publication of the summary ordinance. Ayes: Hendrickson, Cocking, Halling, Olson and Vetsch.

A RESOLUTION ESTABLISHING THE
ABSENTEE BALLOT BOARD FOR THE 2020 ELECTION CYCLE
WHEREAS, a Presidential Nominating Primary will be held on Tuesday, March 3,
2020, a State Primary Election will be held on Tuesday, August 11, 2020 and a State General
Election will be held on Tuesday, November 3, 2020 and;
WHEREAS, the City of Albertville is the responsible authority to conduct absentee
voting for such elections and is required by Minnesota Statutes 203B.121, Subd. 1 to establish an
Absentee Ballot Board, and;
WHEREAS, this board will bring uniformity in the process of accepting or rejecting
returned absentee ballots in Albertville, and;
WHEREAS: the Absentee Ballot Board will consist of a sufficient number of election
judges as provided in sections 20B.19 to 204B.22, and shall be trained in the processing and
counting of absentee ballots, and;
WHEREAS, the City Clerk shall have the authority to appoint additional election
judges to the Absentee Ballot Board as need occurs; and;
NOW, THERFORE, BE IT RESOLVED, the Albertville City Council hereby establishes
an Absentee Ballot Board consisting of the persons named in Exhibit A.

RESOLUTION NO. 2019-047
A RESOLUTION DECLARING JANUARY HUMAN TRAFFICKING AWARENESS
AND PREVENTION MONTH AND JANUARY 11, 2020 AS HUMAN TRAFFICKING
AWARENESS DAY
WHEREAS, Human trafficking is a nationwide public health and civil rights crisis. Its
victims and survivors are everywhere, with each city and community being no exception; and
WHEREAS, Human Trafficking includes both forced labor and sex trafficking; and
WHEREAS, Anyone can be a victim. In the U.S., it is estimated that 2-4 million victims
are being trafficked. 75% are exploited for sex. Almost half are children, and most are women
and girls. Victims come from all demographics. Traffickers target individuals who, for a variety
of reasons, are vulnerable; and
WHEREAS, Minnesota's Safe Harbor Law recognizes that any youth under the age of
18 who is exploited through prostitution will no longer face criminal prosecution and will instead
receive comprehensive and trauma -informed services. These services are available to youth
through age 24; and
WHEREAS, In Minnesota, the average age of participants served under Safe Harbor was
17. A slightly higher percentage of youth served were in greater Minnesota (54%) compared to
the metro area (46%). Most participants were female (91%), while 6% identified as male and 3%
as transgender, gender non -conforming and other. More than half (59%) of participants were
people of color; and
WHEREAS, Rotary International, specifically Rotary Districts 5950, 5960 and 5580 are
striving to increase awareness and promote prevention by mobilizing clubs throughout the region
and engaging their communities on this issue. The mission of the Initiative is to End Human
Trafficking in communities in Minnesota, Wisconsin, North Dakota and parts of Ontario (regions

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Adopt Ordinance Number 2019-10 for code amendment of Chapter 1000,
Ordinance 1000.5 C.3.a., adopting a more specific, clear and measurable language of swimming
pool fence requirements.
MOTION TO: Adopt Ordinance Number 2019-11 for code amendment of Chapter 1000,
Ordinance 1000.14 A, adopting location of garbage cans, waste containers and recycling bins
requirements.
BACKGROUND: The City wants the code language to stay consistent since adopting the
International Property Maintenance Code in sections 10-4-4 through 10-4-9. With this in mind,
Ordinances 1000.5 C.3.a. and 1000.14 A will be updated in the slightest to stay consistent and
clear with other recent code adoptions.
KEY ISSUES:
Swimming Pool Fences:
The changes made to the code relating to swimming pool and hot tub fences are fences
are required to be between at least 24 inches and no more than 48 inches in height when a
swimming pool is present.
As well as, aboveground pools with a sidewall height of 48 inches or more do not require
a fence, provided that safeguards are in place with a locking mechanism in order for the
pool to be inaccessible to all small children.
Garbage:
• The change made to the code relating to refuse receptacles; location and screening is
additional language specifically stating that garbage cans, waste containers and recycling
bins may be kept either within the principal or accessory building, in addition to in the
rear or side yards.
POLICY/PRACTICES CONSIDERATIONS: Ordinances 1000.5 C.3.a. and 1000.14 A of the
Albertville City Code address general building and performance requirements.
LEGAL CONSIDERATIONS: In accordance with Council procedures, the Mayor and Council
have the authority approve the code amendment which requires a majority vote of the City
Council and becomes effective upon publication.

The City Council of the City of Albertville, Minnesota Ordains:

3. Fences Or Enclosures To Restrict Access: All swimming pools for which a building permit is
required shall be provided with safeguards to prevent children from gaining uncontrolled access.
This can be accomplished with fencing or other enclosure, or any combination thereof, of
sufficient density as to be impenetrable.
a. If fences are employed, they shall be at least five feet (5') in height for inground pools,
and at least four feet (4') in height for aboveground pools of a height between at least 24
inches and no more than 48 inches in height. The bottoms of the fences shall not be more
than four inches (4") from the ground. Aboveground pools with a sidewall height of 48
inches or more do not require a fence, provided that safeguards are in place with a
locking mechanism to be inaccessible to all small children. Fences shall be of a
noncorrosive material and shall be constructed as to be not easily climbable (chainlink
fences must be vinyl coated with slats for screening). All fence openings or points of
entry into the pool enclosure shall be equipped with gates or doors. All gates or doors to
swimming pools shall be equipped with self -closing and self -latching devices placed at a
height not lower than forty eight inches (48") for a five foot (5') fence and no lower than
forty two inches (42") for a four foot (4') fence as described above, so as to be
inaccessible to all small children. Prior to filling the pool, the approved fence and/or
screen must be completely in place and inspected and approved by the city building
official.
b. Swimming pool fences shall comply with fence setback standards of section 1000.6 of
this chapter.
c. Required structure or safety fencing shall be completely installed within three (3)
weeks following the installation of the pool, before any water is allowed in the pool, and
prior to final inspection.

RECOMMENDATION: Staff respectfully requests Council consideration regarding a proposed
revision to the Officer Selection section of the Fire Department's Standard Operating Procedure.
MOTION TO: Approve a revision to the 2019 Officer Selection section of the Fire
Department's Standard Operating Procedures.
BACKGROUND: The Fire Department is currently operating under Standard Operating
Procedures (SOP's) that were authorized by City Council in December of 2018 and implemented
in January of 2019. The Fire Department is currently working through significant updates to the
SOPS, while also developing a separate, stand-alone, Standard Operating and Response
Guidelines document.
A portion of the current SOP update is the possible re -structuring, and process for appointment,
of the Board of Officers, based on best practices laid out by the League of Minnesota Cities.
The current 2019 SOP's outline an appointment process for the Deputy Fire Chief and Captains
that should take place by 12/31/2019. With the current, on -going, SOP updates and potential
Board of Officer changes, the Fire Department is requesting that the dates for the required
appointment be removed from the SOP's. Going through an appointment process now, and then
potentially another process in a couple months is not efficient.
The Board of Officers has discussed the proposed change and is in support of the revision. The
entire Fire Department membership has been made aware of the proposed change at the last two
Fire Department meetings, and has given no feedback on the revision.

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the

MOTION TO: Authorize staff to purchase Microsoft Server Software 2019 and installation
assistance not to exceed S19,500.
BACKGROUND: Microsoft Server 2008, Microsoft SQL server 2008 and Remote Desktop
Services 2008 are no longer supported. Currently we are using Microsoft 2008 Server Software
and budgeted for this upgrade purchase prior to December 31, 2019 because of the deadline by
Microsoft to switch over for end of life Server 2008 is January 14, 2020.
Staff plans to assist in the install to keep the cost down, but will need professional assistance for
the servers. Attached is a quote from Marco. Staff has also contacted Microsoft which also
quoted the salve price per license. The Server Software Licenses for Microsoft is the local
government rate from Microsoft and it is a one-time purchase that should have a usable life of 10
years, unless Microsoft ends the life of the software early. Staff will continue to budget for
replacement software on a 10 year cycle.
FINANCIAL CONSIDERATIONS: Funding would come from the Capital Fund, this purchase
has been budgeted for every 10 years.

refusal or failure to provide access shall relieve Marco of its performance obligations and may require a change order for additional
services to complete the work at a future time. Client will also provide a suitable work area for Marco personnel if work is completed on
premises.
When and where applicable, Marco will configure remote access to the Clients network for post -installation remote support. Questions or
concerns with Marco having this access should be communicated during the review of this Professional Services Engagement Agreement
in order to discuss alternative methods of support. When remote access support is authorized, Marco will use this access whenever a
support ticket is created. Marco will communicate with Client prior to Marco accessing the Clients systems for any non-support ticket

Your equipment is covered by it's respective manufacturer warranties. Please consult the warranty documentation that
accompanies the product for details. Any charges from the manufacturer are the sole responsibility of the customer (including,

warranties for a processing fee. Optional contracts or warranty enhancements are available for an additional fee at the time of
purchase.
Returns:

INFORMATION: Annually, the City reviews and updates its fee schedule for various services,
licenses, fines, permits, etc. Listed below are the most significant changes to the fee schedule for
2020:
KEY ISSUES:
• Amended nonresident fees for kitchen and upstairs rentals to be consistent with other
nonresident fees (same percentage above resident).
• Identified Central Park shelter and key deposits.
• Identified temporary intoxicating on -sale liquor licenses are per event rather than day.
This was done several years previously and is now reflected in the fee schedule.
• Added a "per event" fee for mobile food units.
• Included waste hauler fee.
• Clarified curfew fees to include cost of any prosecution.
• Added the new fines for general traffic provisions relating to truck operation and
recreational vehicles.
• Added small wireless facility fee; this ordinance was passed in 2017 but was not included

The City Council of the City of Albertville, Minnesota hereby ordains:
Section 1. Section 313- of the Albertville City Code is hereby amended to repeal the
language stricken and add the underlined language as follows:
A. Purpose: The purpose of this section is to formally establish the fees, fines, and rates
(dollar amounts) to be charged by the City. Fees are subject to State Sales Tax where
applicable.
B. Zoning Applications: Zoning applications shall consist of both a fee and escrow to be
collected with the application. The fee is a nonrefundable charge for City administration.
The escrow account is intended to cover City expenses related to engineering, planning,
and legal expenses incurred in the processing of an application. The escrow is an estimate
of costs. All applications include a written agreement between the City and the applicant
whereby the applicant agrees to pay all applicable fees, charges, administrative, planning,
engineering, and legal costs associated with the review and processing of any zoning
application. If these expenses exceed the application escrow, the applicant shall be billed
for these costs. If monies are not paid within thirty (30) days after the bill is sent to the
applicant/landowner, the City will assess the aforementioned fees, charges, and/or

SUBJECT: CLERK — MISCELLANEOUS CITY CODE AMENDMENTS FOR ERRORS AND
CLARIFICATION
RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO: Approve Ordinance No. 2019-13 An Ordinance Amending Certain Sections of
the Albertville City Code for Errors and Clarification and authorize summary ordinance for
publication.
INFORMATION: The City's codifier, Sterling Codifiers, has informed staff that while
codifying ordinances into the City Code, they identified some potential conflicts or lack of
reference to certain language or code Section. All the proposed amendments in the proposed
ordinance are minor in nature and did not need review by the Planning Commission. Department
staff has reviewed the amendments and they are summarized below.
KEY ISSUES:
• Several Sections identified fees or fines, but did not reference the fee or fine list in the
Section 3-1-3 fee table. This language was added.
• Some Sections referenced Section 1-4-1 for penalties rather than Section 3-1-3. 1-4-1
identifies there is a penalty, but 3-1-3 identifies the cost. These were corrected.
• Clarified referenced Sections for open burning.
• Included the term "revocation" in all applicable Section of the rights -of -way code dealing
with denial or revocation.
• Removed the actual fee cost from the rights -of -code and placed it into the Section 3-1-3
fee table.
• Included reference to small wireless facility permit fees and included in the Section 3-1-3
fee table.
LEGAL CONSIDERATIONS: The City Attorney has reviewed the ordinance and it shall
become effective after publication in the paper.
POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority
to set fees for services.

AN ORDINANCE AMENDING CERTAIN SECTIONS OF
THE ALBERTVILLE CITY CODE FOR ERRORS AND
CLARIFICATION
The City Council of the City of Albertville, Minnesota hereby ordains:
WHEREAS, the City of Albertville has the desire to amend certain sections of the code
for scrivener's errors and/or clarification, and;
WHEREAS, the following sections of the Albertville City Code are hereby amended as
follows:
Section 1. Section 3-5-2A2 shall be amended to read as follows:
2. Fees shall include, but shall not be limited to, actual manpower costs for all personnel
that respond to the incident (minimum of 1 hour) and the cost on a per hour basis for each
fire apparatus or other City mechanical equipment that responds to the incident
(minimum of 1 hour per unit) as established in section 3-1-3 of this title.
Section 2. Section 3-5-2B shall be amended to read as follows:
Fire Watch: Fees for personnel to stand by on fire watch due to unusual fire hazards,
while waiting for the property owner or tenant to respond to the scene following a fire
incident and/or fire alarm, may be billed to the owner of the property or the tenant, or
both, on a per hour basis with a one hour minimum as established in section 3-1-3 of this
title. One -fifth (i/s) of the fee shall be retained by the City for administrative costs, and
four -fifths (4/5) of the fee shall be paid to fire personnel standing fire watch. If a fire
watch is established at a property, the watch shall be maintained until the owner of the
property, the tenant, or his/her designated representative arrives at the property and takes
over responsibility for monitoring fire safety, or until the Fire Department personnel on
the scene determine that such responsible person either cannot be located or is unwilling
to take over responsibility for monitoring fire safety, or until the Fire Department
personnel on the scene determine that a fire watch is no longer necessary.
Section 3. Section 3-5-C shall be amended to read as follows:
Preventative Fire Watch: When Fire Department personnel provide fire watch protection,
the fees for such personnel may be billed to the owner of the property or the tenant on a
per hour basis with a one hour minimum as established in section 3-1-3 of this title. One -
fifth (i/s) of the fee shall be retained by the City for administrative costs and four -fifths

('15) shall be paid to fire personnel standing fire watch. Preventative fire watch is required
in any place of assembly or any place where people congregate where public safety is at
risk due to the number of persons, or the nature of the performance, exhibition, display,
contest, or activity, or due to unusual fire hazards.
Section 4. Section 5-4-513 shall be amended to read as follows:
B. Any person, firm or corporation violating section 5-4-3 of this chapter, in addition to
the provisions of section 5-4-4 of this chapter, is guilty of a misdemeanor and, upon
conviction thereof, shall be subject to the penalty provided in section 1 4-13-1-3 of this
code, plus the costs of prosecution in either case.
Section 5. Section 8-2-8E shall be amended to read as follows:
E. Denial Or Revocation Of Permit:
1. Reasons For Denial: The City may deny or revoke a permit for failure to meet the
requirements and conditions of this chapter or if the City determines that the denial or
revocation is necessary to protect the health, safety, and welfare or when necessary to
protect the right-of-way and its current use.
2. Procedural Requirements: The denial or revocation of a permit must be made in
writing and must document the basis for the denial or revocation. The City must notify
the applicant or right-of-way user in writing within three (3) business days of the decision
to deny or revoke a permit. If an application is denied or revoked, the right-of-way user
may address the reasons for denial or revocation identified by the City and resubmit its
application. If the application is resubmitted within thirty (30) days of receipt of the
notice of denial or revocation, no additional application fee shall be imposed. The City
must approve or deny the resubmitted application within thirty (30) days after
submission.
Section 6. Section 8-2-8L shall be amended to read as follows:
L. Small Wireless Facility Agreement: A small wireless facility shall only be collocated
on a small wireless support structure owned or controlled by the City, or any other City
asset in the right-of-way, after the applicant has executed a standard small wireless
facility collocation agreement with the City. The standard collocation agreement may
require payment of the following as established in section 3-1-3 of the ci . code:

maximum watts; or
c. The actual costs of electricity, if the actual costs exceed the foregoing.
The standard collocation agreement shall be in addition to, and not in lieu of, the required
small wireless facility permit, provided, however, that the applicant shall not be
additionally required to obtain a license or franchise in order to collocate. Issuance of a
small wireless facility permit does not supersede, alter or affect any then -existing
agreement between the City and applicant.
Section 6. Section 8-2-11 shall be amended to read as follows:
Fees and charges for right-of-way permits including registration fees, excavation permit
fees (hole, emergency hole, trench, testing results review and mapping), obstruction
permit fees, small wireless facility permit fees, permit extension fees, and delay penalty
fees shall be as established in section 3-1-3 of this Code. Fees shall be based on an hourly
rate and estimated by the City Engineer based on project size and complexity.
Section 7. Section 9-3-8, Licensed Plumbers, shall be revoked in its entirety.
Section 8. Section 10-1-3D4 shall be amended to read as follows:
4. Said inspection review fee, re -inspection fees and resurvey fee as established in section
3-1-3 of the Albertville Cites may be modified from time to time by ordinance
amendment of the city council.
Section 9. Section 10-5-3 shall be amended to read as follows:
Violation of this chapter shall constitute a petty misdemeanor and shall be punishable by
a fine pursuant to section 1 4-1 3-1-3 of this code.
Section 10. Section 10-7-913 shall be amended to read as follows:
B. Failure To Remedy; Penalties: After the expiration of seven (7) days and the violation
is not corrected or discontinued, any person convicted of such violation shall be punished
as provided in section 1 4-1- 3-1-3 of this code, and each day's violation after the initial
seven (7) day period shall constitute a separate offense.

Section 11. Section 800.2 shall be amended to read as follows:
Any person who violates any of the provisions of this ordinance shall be found guilty of a
misdemeanor and shall, upon conviction, be charged pursuant to section 1 4-1 3-1-3 of
the city code. Each day that a violation exists shall constitute a separate offense.
Section 12. Section 1000.6A shall be amended to read as follows:
A. Permit Required: Except for fence exceptions identified in subsection J of this section,
it is unlawful for any person to hereafter construct or cause to be constructed or erected
within the city any fence without first making an application fors securing, and
paving the fee as established in section 3-1-3 of the Albertville City Code for a fence
permit.
Section 13. Section 1500.4A4 shall be amended to read as follows:
4. All applications for site plan approval must be complete and in full accordance with
the requirements of this ordinance and all applicable fees shall be paid as established in
section 3-1-3 of the Albertville City Code.
Section 14. Section 2500.2 of the Albertville Zoning Ordinance is here amended to include the
following:
L. All small cell wireless facilities not within a public right of way shall adhere to all
other requirements in the chapter.
Section 15. Section 2700.4D2 shall be amended to read as follows:
2. Submission Of Development Stage: Upon approval of the general concept plan, and
within the time established in subsection C5 of this section, the applicant shall file with
the zoning administrator a development stage plan consisting of the information and
submissions required by subsection C5 of this section, as well as applicable fees as
established in section 3-1-3 of the city code, for the entire PUD or for one or more stages
thereof in accordance with a staging plan approved as part of the general concept plan.
The development stage plan shall refine, implement and be in substantial conformity with
the approved general concept plan.
Section 16. Section 2700.4E2 shall be amended to read as follows:
a. Upon approval of the development stage plan, and within the time established in
subsection D6 of this section, the applicant shall file with the zoning administrator a final
plan consisting of the information and submissions required in subsection 2700.3C of this
chapter, as well as applicable fees as established in section 3-1-3 of the city code, for the
entire PUD or for one or more stages. This plan will be reviewed and approved or denied
by city staff.

acceptance of the lowest bid received for the 2019 Street Improvements project. It is respectfully

INFORMATION: The proposed improvement project was advertised and on November 21,
2019 bids for the improvements were opened. A total of eight (8) bids were received with
proposals ranging from $9,801,755 to $13,316,273, as shown on the attached Bid Tab.
Albertville's share of the project is $1,650,143, which includes $237,360 for the Outlet Mall's
share of the intersection improvements. It is proposed the City be reimbursed by the Mall for its
share by means of a negotiated special assessment.

public hearing for the improvement on February 19, 2019, and accepted the feasibility report and
ordered the project on March 4, 2019.

WHEREAS, the Albertville City Council has ordered the improvement of Highway 19
from CSAH 37 to CSAH 38 ("Improvement"); and
WHEREAS, the City has entered into a cooperative agreement for such Improvement with
Wright County under which Wright County is to prepare the plans and specifications for such
Improvement and bid the Improvement; and
WHEREAS, such plans and specifications have been prepared and bids have been solicited
for the Improvement by Wright County;
NOW, THEREFORE, BE IT RESOLVED BY THE ALBERTVILLE CITY
COUNCIL, WRIGHT COUNTY, MINNESOTA:
1. Such plans and specifications are hereby approved.
2. The City Administrator is directed to inform the Wright County Highway Engineer that the

GENERAL ADMINISTRATION
Heuring Meadows Commons: This item was reviewed by and public hearing held at the
December 10 Planning Commission meeting. The vote was 4-1 for denial. This will come to the
January 6 City Council meeting for the Council to consider.
Annual Appointments: Council appointments to Boards and Committees will be brought to the
first meeting of the year as well as the city's Official Depositories and Consultants.
Public Works Committee: The Public Works Committee will be meeting in the near future to
discuss a replacement of a plow truck in 2020, purchase of pumps and equipment for the
WWTP, and a street sweeper.
2020 Fee Schedule: The proposed fee schedule for 2020 is included on the agenda for
Monday's meeting. The ordinance includes the new water and sewer rates recently approved
by Council.
Year End Claims: Included on the agenda is a motion to allow staff to pay all claims through
December 31, 2019 in order to close out the year.
2020 Elections: Staff is preparing for the three upcoming elections in 2020. There will be the
Presidential Nominating Primary (PNP) on March 3, State Primary Election on August 11, and
State General Election on November 6. Staff and election judges will begin training on the new
election equipment and PNP in mid to late January. Absentee voting for the PNP begins on
January 17. On a side note, there will be two special elections nearby to fill the House District
30A seat formerly held by Representative Zerwas. The special primary will be held on January
14 and the special election between the finalists will be on February 4.
2019 Audit: The preliminary audit review began this this week and the auditors will be back in
March for audit fieldwork.
Arena Board: At their last meeting, the Arena Board reviewed its capital replacement plan, set
2020 rates, and approved the 2020 Budget. The 2020 budget was set at $711,500 for the two
sheets.
Local Board of Appeals Training: Training is now available online for the members of local
appeal boards. Albertville currently has no certified, trained members. The deadline to
complete the training is 5:00 p.m. on February 1. Cities must have at least one member trained
by this deadline or the board's authority is transferred to the County for a minimum of two
years. Instructions on how to complete the training will be available at the meeting.

WWTP Forcemain Project: The work on the sludge storage tank will take place through the
winter.
581h Street NE and Central Park Improvements: An updated 58th Street design with a new
entrance into the park, as well as, relocation of the basketball court and skate park, parking lot
will be reviewed by the Parks Committee in January.
2020 Overlay Project: We are working on the 2020 Overlay Project and will present will the
proposed project to Council in January.
Savitski Drainage: Plans are complete. A condition of the railroad permit is that we need to get
soil borings in railroad right-of-way prior to construction. We are in the process of obtaining
quotes to complete the soil borings. The Geotechnical Company will also need a permit from
the railroad to conduct the borings. This potentially could push construction into 2020.
1-94 Improvements Update: Work on the new CSAH 19 bridge piers is underway.
CSAH 19 and 70' Street: Bids were opened on Thursday, November 21 and approval the plans
and specs are on the agenda for Monday. This project is set to begin in the Spring.
2019 Street Project: All project closeout paperwork has been received and final payment for
the project has been included on the agenda. The final construction cost, including change
order for 60th Street, is $882,908
Westwind Boardwalk: Final payment for the boardwalk is included on the agenda. The final
cost to construct the boardwalk is $131,149, which includes pier footing set for the gazebo.
