Mayor Hendrickson called the meeting to order at 7:01p.m.

3. RECOGNITIONS — PRESENTATIONS — INTRODUCTIONS
A. Recognition of Haley Rogers, Queen of the Lakes and Former 2017-2018 Miss
Albertville
Alyssa Gallagher, Albertville Royalty Program Director, spoke on Rogers activities and qualities
during her time in the program. Gallagher stated how proud she is of Rogers work in the community
and service to the program. The Minneapolis Aquatennial Court was present and commended
Rogers. Hendrickson thanked Rogers for her service and representing Albertville so well. She then
presented Rogers with a Certificate of Appreciation.
B. Employee Years of Service Recognition — Tina Lannes
Nafstad reported that Lannes has worked for Albertville for 15 years and wears many hats in her role
with the city. Council thanked Lannes and Hendrickson presented her with a plaque.
C. Long Range Financial Plan
Andy Berg of ABDO, Eick & Meyers, LLP, the city's public accounting consultant firm, was
present to review the long range plan. Nafstad reported that annually this is reviewed as a
beginning step to the budget process.
Berg reviewed the assumptions used in the plan, the tax rate, cash balances and future debt.
Hendrickson inquired if that debt was factored into the numbers in the plan and Berg replied that it

is. The future debt is approximately $7.5 million for wastewater improvements and street projects.
These would be bonds that will come on in 2021 for payment. He reviewed the general fund,
enterprise funds and capital outlay.
Nafstad inquired if Berg felt there were any issues the Council should be aware. Berg stated the
funds are healthy but they may want to review the recycling fund in a few years as that is decreasing.
Nafstad also noted an item to be aware of is how sustainable building revenue will be as residential
growth slows.

A. Finance
1). General Obligation Sanitary Sewer Revenue Bonds Series 2019A
Tammy Omdal of Northland Securities, the city's financial consulting firm, was present at the
meeting. She stated these bonds are for the wastewater treatment plant improvements and are in the
amount of $5.7 million after receiving $2 million in grant dollars. It will be a 20 year bond. The
city's bond rating will need to be determined and that will determine the interest. Vetsch inquired if
the city's rating is favorable and Omdal replied she has no concerns. The sale of the bonds would be
in August.
Motioned by Vetsch, seconded by Olson, to accept the Finance Plan for the General Obligation
Sanitary Sewer Revenue Bonds Series 2019A. Ayes: Hendrickson, Halling, Olson and Vetsch.
Nays: None. Absent. Cocking. MOTIONDECLARED CARRIED.
Motioned by Vetsch, seconded by Olson, to Approve the Municipal Advisory Agreement between
the City and Northland Securities for the General Obligation Sanitary Sewer Revenue Bonds
Series 2019A. Ayes: Hendrickson, Halling, Olson and Vetsch. Nays: None. Absent: Cocking.
MOTIONDECLARED CARRIED.
Motioned by Olson, seconded by Halling, to Adopt Resolution No. 2019-028 for the issuance and
sale of approximately $5,720,000 General Obligation Sanitary Sewer Revenue Bonds, Series
2019A. Ayes: Hendrickson, Halting, Olson and Vetsch. Nays: None. Absent: Cocking.
MOTIONDECLARED CARRIED.
Motioned by Halling, seconded by Olson, to Approve Resolution No. 2019-029 for the issuance of
General Obligation Sanitary Sewer Revenue Bonds Series 2019A covenanting and obligating the
city to be bound by and use the provisions of Minnesota statues, section 44".086 to guarantee
the payment of the principal and interest on the bonds. Ayes: Hendrickson, Halling, Olson and
Vetsch. Nays: None. Absent: Cocking. MOTIONDECLARED CARRIED.
2). Tort Liability Insurance Renewal
Lannes reported that they must decide whether to waive the limits or not for tort liability insurance.
If the city waives these statutory monetary limits, it can increase exposure for the city and increase
the premium. The City Council has decided to not waive the limits for the last several years.
Motioned by Olson, seconded by Halling, to not waive the City's monetary limits on tort liability
established by Minnesota Statues, Section 466.04. Ayes: Hendrickson, Halling, Olson and
Vetsch. Nays: None. Absent: Cocking. MOTIONDECLARED CARRIED.
B. Planning/Zoning
1). PS Deck Site Plan and CUP for Limited Light Industrial Use
Brixius reviewed the zoning change that was approved to allow PS Deck to operate at the building.
The plan and CUP were reviewed by the Planning Commission and they recommended approval
with conditions. Those conditions include meeting all building and fire code, no outdoor storage,

demonstrate well and septic meet code, parking conditions and painting must be done in an approved
booth. Vetsch inquired what type of business use this would be and Brixius replied that PS Deck
does staining and finishing. He stated the furniture is brought in and not constructed onsite. Olson
inquired how materials will be delivered and what bind of doors are on the building. Brixius replied
that there are no dock doors. Halling inquired if there is enough space for delivery trucks to
maneuver in the paved area to the east.
Hendrickson asked if the city could require trees for screening. Olson would like to see trees planted
along CSAH 19 and 671h Street NE. Hendrickson would like to see deciduous trees, no evergreens.
Motioned by Olson, seconded by Halling, to Adopt Resolution Number 2019-030 Approving a Site
Plan and Conditional Use Permit for PS Deck for Limited Light industrial Use at 6737 Labeaux
Avenue NE and amending the resolution to include screening of the east doors by providing four
deciduous trees. Ayes: Hendrickson, Halling, Olson and Vetsch. Nays: None. Absent: Cocking.
MOTION DECLARED CARRIED.
2). Rigs to Rods Site and Building Plans, CUP and Interim Use Permit
Brixius reported that Rigs to Rods is in the current location with no Conditional Use Permit or
Certificate of Occupancy. They are seeking the CUP for their minor auto repair as well as an
Interim Use Permit for U-Haul outdoor storage. He stated that the outdoor storage must be fenced
and screened and will be used for U-Haul rental trucks and trailers. They will be allowed 500 feet of
outdoor display area as well. Brixius indicated there will be no outdoor repairs.
Hendrickson thought the business also washes vehicles and inquired if they have a drain for the
runoff water. Brixius replied they have a septic tank. Olson felt there could be concerns with the
septic being adequate for that runoff. Council discussed adding several conditions such as ensuring
the well and septic is compliant and demonstrating how car wash drainage will be collected and
treated.
Motioned by Olson, seconded by Halling, to Adopt Resolution Number 2019-031 Approving Rigs
to Rods Site and Building Plans, Conditional Use Permit and Interim Use Permit 6737 Labeaux
Ave NE to include the above listed conditions. Ayes: Hendrickson, Halling, Olson and Vetsch.
Nuys: None. Absent: Cocking. MOTIONDECLARED CARRIED.
Brixius introduced Lexi Weihe, a new hire at NAC. Council welcomed Weihe.

Olson reported the budget year begins in September and Albertville's contribution went up about
$3,000.

1). Waiver of License Fee for Centennial Celebration Mobile Food Trucks
Motioned by Olson, seconded by Halting, to authorize waiver of application fee for Mobile Food
Trucks only participating in the Centennial Celebration. Ayes: Hendrickson, Halling, Olson and

I. Administration
1). City Administrator's Update
Nafstad reported that staff sent the owner of the Hana building a letter asking them to remove the
hazard building and they have indicated that process will occur soon. Couri stated that if it is not
demolished, the city can pursue the condemnation process but it takes longer.
Nafstad reported that federal grant applications for both the Completion of the 610 interchange and
the 4 to 6 lane expansion project between Albertville and Monticello have been submitted. He stated
this was in part to the work and lobbying done by participants in the I-94 Coalition.
Nafstad was glad to say they received their permit from MPCA for the wastewater treatment plant.
The discharge limits will provide success far into the future. Also, drilling for the force main will
begin soon and last into winter/spring.
Nafstad reported that the 2019 Street hnprovements project has been slower than anticipated due to
weather and the driveway replacements to be put in. Staff has received a mix of assessment
agreements and outright payment to the contractor for driveway replacements.
Staff is working with the contractor on the Barthel house demolition. Because some asbestos was
found, there must be a two week public notice before it can be torn down.
Striping of city streets and crosswalks is schedule for this month.
City staff is working on a monument sign agreement on city property for the Fieldstone Passage
development in St. Michael.
Nafstad discussed the proposed I-94 improvement that will be occurring and stated that the goal is to
maintain four lanes open at all times. The bridge at CSAH 19 is being designed to accommodate
expansion in the future.

10. Budget Workshop
Nafstad inquired if Council would still like to hold the workshop as there were two members missing
this evening. Council would like to have the workshop at the next meeting with the full Council.
Council briefly discussed pay back options for the new fire trucks, library pay back and law
enforcement contract increase. Vetsch stated he would like to see the levy kept under 3% and
definitely not more than 5%. Olson felt they have been fairly steady over the last several years
around 3%. He stated he realizes that there will be larger increases on years when bond payments
are added.

BACKGROUND: The Lions are requesting street closures and a liquor license for strong beer
for their annual Cruis'in and Rock'in Car Show this fall. This is the same day as the STMA
Open Streets event from 10:00-2:00 p.m.
KEY ISSUES:
• This is an annual event for the Albertville Lions Club.
• The appropriate liquor license has been submitted.
• The streets have already been approved for street closure for the Open Streets event from
7:00 p.m. to 3:00 p.m.
• Staff recommends notification be mailed to the affected properties prior to the event.
FINANCIAL CONSIDERATIONS: There is minimal financial revenue collected from the
applicant for the liquor license.

Street NE from 10408 through 10460 62nd Street NE for the annual National Night Out event on
Tuesday, August 6, 2018.
BACKGROUND: National Night Out occurs on Tuesday, August 6, 2019. National Night Out is
an opportunity for local neighborhoods to meet with their neighbors and first responders to build
community relations. Staff has received several requests for partial street closures at the above
locations, visits from law enforcement and fire, and street barricades.
KEY ISSUES:
• National Night Out is Tuesday, August 6, 2019 from 6:00-8:00 p.m.
• The Albertville Fire Department and Wright County Sheriff's Office are coordinating the
neighborhood visits for the respective departments.
• Public Works will drop off and pick up barricades the day before and the day after National
Night Out.
• The applicants have completed the appropriate form and provided a detailed site plan for
the closures.

of St. Albert and the Parish Center from 8:00 a.m. to 5:00 p.m. on Sunday, September 15, 2019.
BACKGROUND: The Church of St. Albert is requesting a One -Day Temporary 3.2% Malt
Liquor License for their annual Parish Festival. The Festival will be held on Sunday, September
15. 2019 and proceeds will be used to help fund the Parish Center's operating costs. The hours
of the event will be 10:30 a.m. to 5:00 p.m. They have also requested Council approval for
lawful gambling raffle permit for the event.
In addition, the applicant has requested that Lander Avenue NE be blocked off between the
Church and the Parish Center for safety reasons between the hours of 8:00 a.m. — 5:00 p.m.
KEY ISSUES:
The Church of St. Albert has submitted the correct application and fee for a One -Day
Temporary 3.2% Malt Liquor License.
Sale of the 3.2% malt liquor will occur on the grounds of the Parish Center.
This is an annual event for the Church and Parish Center.
FINANCIAL CONSIDERATIONS: There is minimal financial revenue collected from the

Temporary On -Sale Intoxicating Liquor License for the Albertville Centennial Celebration on

BACKGROUND: The Albertville Centennial Celebration will be held on Saturday, September
21, 2019. The Centennial Planning group would like to have beer at the event and are working
with a brewer on a special edition beer for the event. The Foxtailers Snowmobile Club plans to
sell the beer by the can at the event.
KEY ISSUES:
• The beer will be stronger than 3.2% Malt Liquor requiring a One -Day Temporary
Intoxicating On -Sale Liquor License.
• The fee for this license in the City Code is $100 per day.
• Because this is a service the Foxtailers are providing for a city sponsored event, staff
recommends waiving this fee for the Foxtailers.
• Staff anticipates receiving the license application in the near future.

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider
approval of the following motion:
MOTION TO: Reduce Letter of Credit No. 631834603, held as security for the Karston Cove
51h development, to no less than $15,152 conditioned on any outstanding balances owed to the
City being paid in full.
BACKGROUND: Tate Baxter of Centra Homes, LLC has requested a reduction to the Letter of
Credit held for Karston Cove 5th Addition. The Letter of Credit is held as performance and
warranty security for the road and utility repairs and various site improvements and is currently
in the amount of $44,835.
Assuming the developer is current with all fees owed to the City and based on work completed to
date, it is recommended that Letter of Credit No. 631834603 be reduced to no less than $15,152.
The reduced balance is believed to be sufficient surety and is consistent with the development
agreement.
KEY ISSUES:
This reduction does not constitute acceptance of improvements.
Utility improvements have surpassed their 1-year anniversary.
The sidewalk was just constructed in June, 2019
POLICY CONSIDERATIONS: It is City policy to have all Letter of Credit reductions
approved by the City Council

SUBJECT: LEGAL - MODIFICATIONS TO SOLICITATION ORDINANCE
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
Review and discussion of proposed changes to the City's Solicitor ordinance to bring the
City Code in line with recent Court cases.
BACKGROUND: The City Code's restrictions on hours of solicitation was recently challenged
by a solicitor who invoked a Federal Court ruling as precedent that prohibits the relatively strict
hours of operation during which the City allows soliciting to occur. Under Federal law, those
hours may be found to be a violation of free speech and will need to be changed to come in line
with recent case law on this issue.
KEY ISSUES:
• The City Code requires peddlers, solicitors and transient merchants to obtain a license
before operating in the City and provides some limits on the extent of their activities.
• Recent Federal Court decisions have limited the City's ability to regulate peddlers,
solicitors, and transient merchants. If the City over regulates these activities, it may be
liable for violation of a person's constitutional rights, which may subject the City to
damages and payment of the individual's attorney fees.
• Because these limitations arise from Federal Constitutional law, legislation cannot "fix"
this issue and these changes are likely here to stay.
• As Federal case law continues to evolve on this issue, additional changes to the solicitor
portion of the Code will likely have to be made in the future.
• The City Attorney recommends expanding the hours that peddlers, solicitors and
transient merchants can operate, as well as eliminating other more minor regulations that
may be viewed as unnecessarily restricting free speech or interstate commerce.
• If the Council finds these changes acceptable, the City will post the proposed ordinance
amendment on its website as required by law and will bring this issue back to the
Council for enactment on the consent agenda at the August 19th meeting.
POLICY/PRACTICES CONSIDERATIONS: The City has an interest in protecting its
citizens from intrusive behavior of peddlers, solicitors and transient merchants, but such
regulation has recently become more limited in its application. Compliance with the law will
result in less protection for the City's residents.
FINANCIAL CONSIDERATIONS: Changing the City Code on this issue may potentially
save the City litigation costs and reduce the likelihood that the City will end up paying a
plaintiff's attorney's fees for violating an individual's or an organization's constitutional rights.

4-4-1: PURPOSE: 0
The purpose of this chapter is to establish regulations and licensing requirements for any person,
whether a resident of the city or not, desiring to conduct business that is not of a permanent
nature. (Ord. 2004-14)
4-4-2: DEFINITIONS: 0
The following words, terms and phrases, when used in this chapter, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
CANVASSER: Any person canvassing for funds door to door in the city on behalf of a
charitable, religious or nonprofit organization as defined in internal revenue service code section
501(c)(3).
MOBILE FOOD UNIT: A food and beverage service establishment that is a vehicle mounted
unit, such as:
A. Motorized Or Trailered/Self-Contained Unit: Motorized or trailered, operating no more than
twenty one (21) days annually at any one place, or operating more than twenty one (21) days
annually at any one place with the approval of the regulatory authority as defined in Minnesota
rules, part 4626.0020, subpart 70; and a self-contained unit, in which food is stored, cooked, and
prepared for direct sale to the consumer.
B. Operation In Conjunction With A Permanent Business License: Operated in conjunction with
a permanent business licensed under chapter 157 or chapter 28A of the Minnesota state statutes
at the site of the permanent business by the same individual or company, and readily movable,
without disassembling, for transport to another location; and a self-contained unit, in which food
is stored, cooked, and prepared for direct sale to the consumer.
C. Food Cart: A food and beverage service establishment that is a nonmotorized vehicle self-
propelled by the operator.
D. Ice Cream Truck: A motor vehicle utilized as the point of retail sales of prewrapped or
prepackaged ice cream, frozen yogurt, frozen custard, flavored frozen water or similar frozen
dessert products.
PEDDLER: Any person with no fixed place of business dealing in the city who travels around
from place to place, or street to street, carrying or transporting goods, or soliciting for all manner
of wares, services and merchandise, offering such wares, service or merchandise for sale or
making sales and delivering articles to purchasers.
SOLICITOR: Any person who goes from place to place and/or house to house soliciting or
taking or attempting to take orders for the purchase of any food, wares or merchandise, including
magazines, books, periodicals or personal property of any nature whatsoever for delivery in the

future, or orders for the performance of a service in or about the home or place of business, such
as furnace cleaning, roof repair or blacktopping.
TRANSIENT MERCHANT: Any person, whether as principal, employee or agent, who engages
in, does, or transacts any temporary or transient business in the city, either in one locality or
traveling from place to place in the city selling goods, wares, and merchandise, and who, for the
purpose of carrying on such business, hires, leases, occupies or uses a building, structure,
vehicle, property, or other place for the exhibition and sale of such goods, wares, and
merchandise. (Ord. 2014-02, 2-18-2014)
4-4-3: LICENSING REQUIREMENTS: It Ej
A. License Required; Separate Licenses: It shall be unlawful for any person to engage in the
activity of peddling, soliciting, or transient selling without first having obtained a license in
compliance with the provisions of this section. A separate license shall be secured for each
individual person engaged as a peddler, solicitor or transient merchant.
B. Application For License: The application for the license provided for in this section shall be
made to the city clerk by filing the annual license fee and by completing an application form as
provided by the city clerk. In addition to such information as the city clerk may require, the
application shall include:
1. The name of the applicant and all persons associated in business in the city.
2. The permanent home address and full local address of the applicant, and the permanent and
local telephone numbers of the applicant.
3. A brief written description of the nature of the business, the goods to be sold, and the
applicant's method of operation.
4. If employed, the name and address of the employer, together with credentials establishing the
exact relationship.
5. The length of time during which the applicant intends to do business in the city, with the
approximate dates.
6. The place where the goods or property proposed to be sold, or orders taken for the sale
thereof, are manufactured or produced, where such goods or products are located at the time the
application is filed, and the proposed method of delivery.
7. A photograph identification of the applicant(s).
8. A statement as to whether or not the applicant or the person managing the business has been
convicted of any crime, misdemeanor or violation of any municipal ordinance involving
activities licensed under this chapter, the nature of the offense and the punishment or penalty
assessed therefor.

9. If a vehicle is to be used, a description of the vehicle, together with the license number or
other means of identification.
10. A statement of the type, nature and character of the goods, wares, or merchandise to be sold
or offered for sale by the applicant, and whether the goods, wares and merchandise are proposed
to be sold from stock in possession or by sample, at auction, by direct sale, or by taking orders
for future delivery.
12. Credentials from the person for which the applicant proposes to do business, authorizing the
applicant to act as such representative.
13. For transient merchants, the addresses of all places where the business is to be located, along
with written consent of the owners or occupants. (Ord. 2004-14)
C. License Fee: The license fee for engaging in a transient business, peddling, or soliciting,
established in section 3-1-3 of this code, shall be paid at the time of application for a license.

D. Restrictions On Issuance To Transient Merchants:
1. Off Street Parking Required: No license for a transient merchant shall be issued for sales from
any location which does not have sufficient parking for customers and for areas where customer
parking would interfere with normal traffic flow. The zoning administrator must determine that
there is adequate off street parking to serve both the principal use of the property and the
transient merchant use of the property.
2. Location Near Intersection: No transient merchant license shall be issued, and no sales shall
take place, if the proposed location for transient merchant sales is within one hundred fifty feet
(150') of any intersection.
3. Duration Of Sales: No transient merchant license shall be issued for more than three hundred
sixty five (365) days. At the time of the application for the transient merchant license, the
applicant shall state the times within the license period to be used by the applicant.
E. Unlawful Use Of License: No license issued under the provisions of this section shall be used
at any time by any person other than the one to whom it is issued. (Ord. 2004-14)
F. Time of Issuance: A decision on the license will be made within the later of 1) ten business
days from receipt of completed application, or 2) five business days after return of background
check results.
G. Appeal of Denial of License: Any person to whom the City refuses to issue a license may
appeal such decision to the City Council by requesting, in writing, to have the decision reviewed
by the City Council at the next regularly scheduled City Council meeting.
4-4-4: PROHIBITED HOURS: It 0

No business solicitation is permitted between the hours of nine o'clock (9:00) P.M. to seven
o'clock (7:00) A.M.
4-4-5: PROHIBITED PRACTICES GENERALLY: It 0
A. Unlawful Purpose: It is unlawful for any solicitor to engage in solicitation for any unlawful
purpose.
B. Refusal To Leave: It is unlawful for any solicitor to refuse to leave the premises of a solicitee
when requested by the solicitee to do so.
C. License Unobtained; Solicitation: It is unlawful for any person to engage in business
solicitation without first obtaining a license therefor as provided in this chapter.
D. License Unobtained; Contribution Solicitation: It is unlawful for any person to engage in
contribution solicitation without first completing the license as provided in this chapter.
E. Fraudulent Or Deceptive Practices: It is unlawful for any solicitor to engage in any fraudulent
or deceptive solicitation practices.
F. Violations Of Council Conditions: It is unlawful to violate any conditions placed upon a
business solicitation license by the council. (Ord. 2004-14)
4-4-6: ADDITIONAL RESTRICTIONS FOR TRANSIENT MERCHANTS:
A. Operation On Public Property: It shall be unlawful for any transient merchant to sell or offer
for sale any goods, wares, or merchandise on any public lands or public right of way within the
city unless such sale is specifically authorized by the City Council.
B. Operation On Private Property: No transient merchant shall sell or offer for sale any goods,
wares, or merchandise within the city from a stationary location on private property at any
location where such sales would not be permitted by the zoning ordinance, or without first
obtaining the written consent of the property owner or occupant. The written consent must
accompany the license application.
C. Space For Off Street Parking And Display Of Merchandise: The space used by the transient
merchant, including off street parking in connection therewith, shall not exceed the space needed
for the existing business at the site, and in any case, the merchandise displayed shall not occupy
more than one hundred (100) square feet.
D. Overnight Storage: No outdoor overnight storage of transient merchant equipment or
merchandise shall be permitted.
E. Signs: No signage shall violate the provisions of this code relating to size and number of
business signs-. (Ord. 2004-14)

F. Mobile Food Units And Food Carts: Mobile food units (MFUs) and food carts, with the
exception of exempt groups or vendors as provided in section 4-4-11 of this chapter, are required
to meet the additional following standards:
1. MFUs must be licensed by the Minnesota health department, and must adhere to state
regulations for food trucks as provided in food code chapter 4626.1860 mobile food
establishments; seasonal temporary food stands; seasonal permanent food stands. Evidence of the
state license must be provided to the city as part of the local license application.
2. MFUs operations are limited to the business, industrial, and public/institutional districts, and
are not permitted between the hours of ten o'clock (10:00) P.M. and eight o'clock (8:00) A.M. Ice
cream truck vendors may operate in all zoning districts, but must adhere to the described hours
of operation.
3. MFU sites shall be kept in a neat and orderly manner, and shall adhere to the following site
requirements:
a. Trash and/or recycling collection and cleanup must be provided.
b. MFUs must provide independent power supply which is screened from view. Generators are
permitted.
c. MFUs may not maintain or use outside sound amplifying equipment, televisions or other
similar visual entertainment devices, lights or noisemakers such as bells, horns or whistles. Ice
cream trucks traveling through a residential district may have outdoor music or noisemaking
devices to announce their presence.
d. MFUs cannot obstruct the movement of pedestrians or vehicles or pose a hazard to public
safety.
e. MFUs shall be located on an asphalt or concrete surface.
f. MFUs may not be located within two hundred feet (200) of existing restaurants or coffee
shops, as measured from the MFU to the food service building. However MFUs may be
permitted within two hundred feet (200') of existing food establishments within the same
shopping center, with permission from the shopping center's owner.
g. MFUs must close during adverse weather conditions when shelter is not provided.
4. MFUs must be located on private property, and the applicant must provide written consent
from the property owner. However, MFUs may be located in a public park with approval from
the city, and ice cream trucks are allowed to operate within the public right of way in residential
districts.
5. Ice cream truck vendors are required to undergo a criminal background check prior to
operating in the community, at the cost of the applicant.

6. If MFU sites are found to be in noncompliance with any conditions as provided in this chapter,
the city reserves the right to revoke the MFU transient merchant license. (Ord. 2015-06, 8-3-
2015)
4-4-7: NOISY CONDITIONS PROHIBITED: It M
No license holder under this chapter, or any person in his behalf, shall shout, blow a horn, ring a
bell or use any sound devices upon any of the streets, alleys, parks, or other public places of the
city or upon any private premises in the city. (Ord. 2004-14)
4-4-8: UNINVITED PEDDLING, SOLICITING AND CANVASSING: 0
Any resident of the city who wishes to exclude peddlers, canvassers or solicitors from premises
occupied by the resident may place upon or near the usual entrance to such premises a printed
placard or sign bearing the following notice: "Peddlers and Solicitors Prohibited". No peddler,
canvasser or solicitor shall enter in or upon any premises, or attempt to enter in or upon any
premises, where such a placard or sign is placed and maintained. Violation of this section shall
result in the revocation of a duly issued license. (Ord. 2004-14)
4-4-9: DUTIES OF POLICE: It 0
It shall be the duty of any police officer of the city to require any person seen peddling or
engaging in like activities, and who is not known to such officer to be duly licensed, to produce
his license and to enforce the provisions of this chapter against any person when in violation of
this chapter. (Ord. 2004-14)
4-4- l 0: REVOCATION OF LICENSE: It El
The council may revoke any peddler's or solicitor's license only upon a showing of cause at a
public hearing after the licensee has received timely notice thereof and has an opportunity to
examine all witnesses in support of revocation of his or her license and the opportunity to present
witnesses on his or her behalf. Notice may be given in the same manner as that prescribed for
service of process under the Minnesota rules of civil procedure for the district courts. (Ord.
2004-14)
4-4-11: EXEMPTIONS FROM PROVISIONS: t 0
A. The city clerk may determine that certain business activities that may have characteristics
similar to those regulated by this chapter may be exempt from the requirements of this chapter.
Examples include:
1. A solicitor or canvasser doing business by appointment. A bona fide appointment is one that is
not merely obtained by going door to door in conjunction with the taking of orders, offering for
sale or selling.
2. Solicitation of orders for future door to door delivery of newspapers.

4. Canvasser who solicits orders within the state, which orders are filled at a later date with
goods yet to be shipped from any state or locale other than the state of Minnesota.
5. Any person selling or peddling the products of the farm or garden occupied and cultivated by
such person. (Ord. 2004-14)
6. All vendors involved in the following community events: Fourth Of July celebration,
community festivals (i.e., Friendly City Days), Wright County Fair, business expo, the city
approved farmers' market within a city park, Girl Scouts, Boy Scouts, fire department, and any
other community event or fundraisers the city council deems exempt. (Ord. 2014-02, 2-18-2014)
7. Garage sales, rummage sales, and craft sales conducted by the owner of the premises.
B. This chapter does not apply to any organization, society, association or corporation if such
organization is registered with the secretary of state pursuant to the provisions of Minnesota
statutes section 309.515, if such organization desires to solicit or have solicited in its name
money, donations of money or property or financial assistance of any kind, or desires to sell or
distribute any item of literature or merchandise for which a fee is charged or solicited from
persons other than members of such organization upon the streets, in office or business buildings,
by house to house canvass or in public places. To qualify for this exemption, the organization or
individual shall provide a sworn statement in writing on a form furnished by the city which shall
include the following information:
1. The name and purpose or the cause for which the license is sought.
2. The names and addresses of the officers and/or directors of the organization.
3. The period during which the solicitation is to be conducted. (Ord. 2004-14)
4-4-12: MISDEMEANOR VIOLATION; PENALTY: It M
Every person violates a provision of this chapter when such person performs an act thereby
prohibited or declared unlawful, or fails to act when such failure is thereby prohibited or declared
unlawful, and upon conviction thereof, shall be punished as for a misdemeanor, except as
otherwise stated in specific provision hereof, or upon conviction thereof, shall be punished as a
misdemeanor as provided in section 1-4-1 of this code. (Ord. 2017-01, 1-3-2017)

Hana Building Demolition. The owner of the Hana building should be tearing
the building down shortly. The last I spoke with the owner's attorney, the owner
was waiting on one additional contractor's bid before moving forward.
• Solicitor Ordinance. A draft of a revised Solicitor Ordinance is in the packet for
discussion by the Council. If the changes are acceptable, the ordinance will be
posted on the City's website as required by law and can be adopted at the August
19, 2019 meeting.
State Grant for WWTP Modifications. Adam, Tina and I finished revisions to
the State Grant agreement for the Wastewater Treatment Plant modifications.
