7. Public Hearings
A. Improvement Hearing — CSAH 19 Feasibility
Couri clarified there should be two motions this evening. One to accept the CSAH 19 Feasibility
Study and one to approve the resolution to order the improvements.
Nafstad reported Kwik Trip has reviewed the study and will escrow the amount for their entrance
and he also spoke with the land department at Simon corporate. He stated that Simon is not
supportive of covering the city's cost for the signal improvement that is included in the proposed
$360,000 amount. They would be supportive of a number around $240,000 though. Nafstad
suggested completing the intersection improvements whether the mall participates or not. He
reported the next step would be approving the assessment agreement once a final number is reached.
They do need a temporary easement to do the improvements but will not need to purchase it.
Vetsch asked about using Municipal State Aid (MSA) funds and Council discussed how that could
be done. Nafstad reported there would be no bonding or levying required to fund the improvements;
Albertville's share would be funded by reserves/MSA.
Olson inquired if staff is confident the project won't go over budget. Nafstad replied that ultimately
the bids will need to be approved by the Council. Olson felt the estimate seemed high this year, but
he has seen that elsewhere as well.
Olson inquired about the special assessment process. Nafstad stated that since the mall does not
want to cover the city's portion of the signal, the amount is yet to be determined. Couri reported that
there will need to be another hearing for the assessment with the final amount.

Court stated that the resolution as presented should actually be two separate resolutions and he asked
that Council approve the first resolution accepting the feasibility study and also approve the second
resolution ordering the improvements.

Olson reported that a new FYCC Coordinator was hired and has started.
Joint Powers Water Board
Nafstad reported that board discussed a Master Utility Agreement for the replacement of the
waterinain along CSAH 19. He stated there is a new operator at the water plant, Larry Koch, and he
felt he will be a good fit there. Nafstad further reported that he has asked Veolia to summarize the
services they provide to the plant as well as other cities they service.
B. Finance
1) Waiver of Special Assessments on tax forfeited property 101-022-000020,
Barthel Industrial Park Outlot A
Lannes reported that she had been contacted by Wright County that there is a tax forfeit lot that has
special assessments on it and they were inquiring if the City wanted to waive those prior to the
auction of lot. Waiving the assessments would result in a better bid amount to hopefully put the
parcel back on the tax rolls. However, she stated that neither the county nor the city have any proof
of payment towards the assessments. Court reported the lot is not buildable as currently zoned and
to be buildable it would require a variance, which would be difficult to prove the need for one.
Council discussed several options of development for the parcel or possibly contacting adjacent land
owners if they had an interest in the lot. They also discussed purchasing the property.
Nafstad suggested they bring this item back at a future meeting.
C. Public Works/Engineering
1). DNR Utility License for WWTP Forcemain
Nafstad reported that a motion is needed for approval of the license.

1). Clean-up Day Update
Nafstad reported that there will not be a clean-up day this year as the Elk River burn plant is no
longer open. The nearest is St. Paul and it is not feasible for trucks to go there due to long trip times,
DOT hours, and cost. St. Michael has researched local options for residents to bring their own
items to and plans to advertise and promote those to residents; staff will do the same for Albertville.
Nafstad stated that staff spoke with the city's recycling vendor and it may be possible to hold a large
recycle -only event.
2). Review of St. Michael Sanitary Sewer Extension Agreement
Nafstad reported the development is in the final plat phase and this item will be coming back to City
Council. He stated there is an estimated 250 homes in the plat. Vetsch stated this should help with
the outflow and inflow of the ponds. Nafstad stated that the extension of sanitary sewer service is a
benefit to Albertville by improving drainage, building SAC/WAC funds and selling sewer service.
3). City Administrator's Update
Nafstad reported bids for the CSAH 19 will be opening in the next couple weeks.
Nafstad stated that the website will be open soon to order centennial shirts for the committee and
Council soon and he encouraged Council to order shirts.
Cocking reported there may be some funds for the WWTP improvements moving through the
legislature and would be a possible block grant program.

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Adopt Resolution 2019-010 approving a street naive change for Linden St NE
in the Towne Lakes 7th Addition (from 69th Street NE to Lakewood Drive NE).
BACKGROUND: While setting up for the future billing information of the new Towne Lakes
7th Addition, City Staff discovered that Linden Street NE had been named incorrectly during the
original platting process. City practice dictates that all streets that begin with a "name" cannot be
titled as a "street". This practice also follows the Wright County 9-1-1 grid mapping guidelines.
City Staff is requesting that Linden Street NE (from 69th Street NE to Lakewood Drive NE) be
renamed to Linden Way NE. Should Council approve the resolution, Albertville Public Works
will be notified to post a new street sign, and Wright County will be notified.
KEY ISSUES:
• A resolution to approve the renaming of Linden Street NE is attached.
• The misnaming of Linden Street NE was recently discovered by City Staff.
• The new street name, Linden Way NE, will fit both the City's addressing practices and
the Wright County 9-1-1 grid.
• There are currently no houses on the affected street.
POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the
authority to either approve or deny any street name change requests.

A RESOLUTION CHANGING STREET NAME
TOWNE LAKES 7TH ADDITION
WHEREAS, the City Council of Albertville has identified an error in the naming
of a street in the Towne Lakes 7th Addition plat; and,
WHEREAS, the City Council is desirous of having the Towne Lakes 7th Addition
plat amended in order to have the street names comply with adjoining plats.; and,
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of
Albertville hereby renames Linden Street NE (from 69th Street NE to Lakewood Drive
NE) as Linden Way NE.
Adopted by the City Council of the City of Albertville this 18th day of March, 2019.

SUBJECT: PUBLIC WORKS - ST. MICHAEL SEWER CONNECTION AND USE AGREEMENT
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Approve Sewer Connection and Use Agreement between the City of Albertville
and the City of St. Michael.
BACKGROUND: Developers owning land immediately south of Albertville's pond (located
just south of the new high school) and west of the Albert Villas subdivision are proposing a
residential development with up to 250 single family residential homes. However, at this point
in time, St. Michael cannot serve this property with sanitary sewer service and has requested that
Albertville allow St. Michael's wastewater to drain into Albertville's sewer lines for treatment at
the Albertville wastewater treatment plant (WWTP).
In approximately 2008-2009, Albertville spent a considerable amount of money building a storm
water retention pond on land just south of the new high school/middle school and just west of the
Albert Villas neighborhood. That pond was necessary to stop persistent flooding that had
frequently impacted several homes and streets in the Albert Villas neighborhood as water
upstream of Albert Villas flowed into the Albert Villas subdivision before making its way to
County Ditch No. 9. While the pond has been doing its job well, there is concern that as
properties upstream from the pond urbanize in the coming decades, the amount of water draining
into the pond will again cause flooding in the Albert Villas neighborhood. One potential solution
to this problem is the construction of a drainage bypass, a ditch connecting the pond to County
Ditch No. 9, which would prevent much of the storm water from ever reaching the Albert Villas
neighborhood.
The proposed sewer service contract allows St. Michael to connect up to 250 homes in a defined
area to Albertville's sanitary sewer system. The homes will be metered and the City will bill St.
Michael for sanitary sewer operating costs in the same way Albertville's residents are billed, plus
a 3% administrative fee to the City of Albertville. St. Michael will pay Albertville's SAC
charges and Albertville's trunk sewer charge. St. Michael will also pay its share of any
significant improvements to Albertville's WWTP that are not paid from SAC charges or rates
(both of which St. Michael will already be paying under this agreement).
In return, St. Michael will require the developer of the subdivision to construct a bypass ditch
that is expected to make any flooding of Albert Villas much less likely in the future and require
the developer to convey a drainage and utility easement to Albertville so that the ditch can be
maintained by Albertville (if necessary) in the future. Albertville will be providing St. Michael
with a trail easement over a portion of Albertville's ponding property. St. Michael will construct
and maintain any trail that is placed within this easement.

The contract will be perpetual in duration, although St. Michael may eventually terminate the
sewer service portion of the contract if it ever decides to serve the property with sewer service
from St. Michael. The bypass ditch, its easement, and the easement for the trail will remain in
perpetuity and cannot be terminated unilaterally.
St. Michael will be responsible for all construction and maintenance costs of its sewer line that
will connect to the existing sewer main in the Albert Villas neighborhood. Albertville will bill
St. Michael monthly for sewer service, and St. Michael will cut a check to Albertville in
payinent.
Albertville has the excess sewer capacity at the WWTP to handle sewer flows from the 250
homes in addition to the projected full build out of the City of Albertville.
KEY ISSUES:
• Albertville will provide sewer service to up to 250 homes in St. Michael.
• St. Michael will pay SAC and Trunk charges per Albertville's ordinance requirements.
• St. Michael residents will pay the same sewer rates as Albertville's residents, plus an
additional 3% administrative charge.
• Albertville will receive a drainage and utility easement and St. Michael will cause a
drainage ditch to be constructed that will bypass Albert Villas.
• Albertville will give a permanent trail easement to St. Michael over a portion of the pond
property.
POLICY/PRACTICES CONSIDERATIONS: Albertville staff believes this arrangement will
benefit both Cities. Albertville will receive all of its normal sewer fees, will have a slightly
larger pool of sewer users to spread its fixed costs over, and will likely prevent future flooding of
the Albert Villas neighborhood. St. Michael will be able to develop land that it otherwise might
not be able to for many years.
FINANCIAL CONSIDERATIONS: If all 250 homes were to develop, Albertville would
receive S 1,150,000 at today's SAC rates with an approximate S 150,000 in additional sewer trunk
access charges. Any additional costs Albertville will incur in treating the additional wastewater
generated by the 250 homes will be more than offset by the additional revenue Albertville will
receive from St. Michael on a monthly basis.
LEGAL CONSIDERATIONS: This agreement establishes a perpetual contract for the
provision of services. Albertville will remain the owner and operator of its sewer system, while
St. Michael will own and operate the sewer lines serving the 250 homes in St. Michael.
Albertville will have the right to keep the bypass ditch operational in perpetuity and will have a
drainage and utility easement over this ditch. While St. Michael can terminate the sewer service
portion of this agreement (it would need to then treat its own sewage), the drainage and trail
portions of the agreement cannot be terminated unless both parties agree.

SEWER CONNECTION AND USE AGREEMENT
CITY OF ALBERTVILLE /CITY OF ST. MICHAEL
THIS AGREEMENT, is made and entered into by and between the CITY
OF ALBERTVILLE, a Minnesota municipal corporation (hereinafter,
"ALBERTVILLE") and the CITY OF ST. MICHAEL, a Minnesota municipal
corporation: thereinafter "ST. MICHAEL" J.
RECITALS
1. ALBERTVILLE owns and operates a Wastewater Treatment Facility,
hereinafter "WWTF," for the treatment of sanitary wastewater.
2. ALBERTVILLE has adopted ALBERTVILLE City Code Seeti(3n
Title 9. Chapter 3 which controls the discharge of
wastewater into its system and which Ordinance assures that each
recipient of the wastewater treatment benefit pays its
proportionate share of the cost of operation, maintenance, and
replacement of the wastewater treatment services.
3. ST. MICHAEL is proposing to allow the development of up to
250 single-family residential lots on property abutting
ALBERTVILLE, in a development to be known as "Fieldstone
Passage" (the "Subdivision") as well as a future development in the
to the south neFtheFn ^^rof that land identified as PID 114-
500-101200 and PID 114-500-101400 (together with the
Subdivision, collectively the "Service Area"), as generally shown on
Exhibit A
4. ST. MICHAEL does not presently have sanitary sewer trunk facilities
that are capable of serving the Service Area at this time, but sanitary
sewer service to the Service Area is consistent with ST. MICHAEL'S
comprehensive land use plan and its future sanitary sewer plan. The
parties agree that ST. MICHAEL planned and contemplates
providing sanitary sewer service to the Service Area sometime in
the future but that ST. MICHAEL will approve the Subdivision
because ALBERTVILLE will provide sanitary sewer service to the
Service Area in accordance with the terms of this Agreement.
5. ST. MICHAEL desires to discharge wastewater from the Service
Area to the WWTF for treatment.

6_ALBERTVILLE agrees to accept the discharge of wastewater from
the Service Area and treat such wastewater at the WWTF pursuant
to the terms and conditions herein.
�7. ALBERTVILLE desires to permanently improve the storm water
drainage system in the Albert Villas neighborhood with the
construction of a bypass directly to County Ditch 9 that is intended
to be placed on a portion of the Subdivision.
NOW, THEREFORE, in consideration of the recitals and the other mutual
obligations of the parties herein expressed, ALBERTVILLE and ST.
MICHAEL do agree as follows:
1. Definitions. For purposes of this Agreement:
A. The term "ST. MICHAEL'S Collection System" shall mean gravity
sewers and forcemains within the immediate boundary of ST.
MICHAEL which discharge sewage to the WWTF as well as that
portion of the sewer main located west of the
"44eALBERTVILLE sewer main located in Kahl Avenue N.E. or
located west of the ALBERTVILLE sewer main located west of Kagan
Avenue N.E. in the City of ALBERTVILLE.
B. The term "ST. MICHAEL Interceptor" shall mean the gravity
Interceptor sewer and forcemain within the boundary of
ALBERTVILLE commencing with the sewer main located in Kahl
Avenue N.E. and the sewer main located in Kagan Avenue N.E. in the
City of ALBERTVILLE that ST. MICHAEL'S Collection System
discharges into to its discharge at the ALBERTVILLE WWTF.
C. The term "non -domestic user" shall mean any commercial,
industrial, institutional or business user.
D. ADW AVERAGE DRY WEATHER —Flows measured during a 30-day
period of normal groundwater and no runoff.
E. AWW AVERAGE WET WEATHER —Flows measured during a 30 day
period of high groundwater and inflow.
F. PHWW—PEAK HOURLY WET WEATHER —Flows measured during
a period of high groundwater and assuming a 5-year storm event.

2. Terms of Agreement:
A. ST. MICHAEL shall have the right for as long as
ALBERTVILLE "'� lle operates its wastewater treatment plant
to discharge its sanitary wastewater from the Service Area into the
ALBERTVILLE WWTF, as long as ST. MICHAEL complies with the
discharge provisions of this Agreement or until this Agreement is
terminated as otherwise provided herein. ST. MICHAEL shall be
responsible for all maintenance, repair and replacement of the ST.
MICHAEL Collection System and all expenses related to the same,
and such system shall be owned by ST. MICHAEL. ST. MICHAEL
shall keep the ST. MICHAEL Collection System in good repair at all
times. ST. MICHAEL shall be responsible for timely fulfilling all
Gopher One locate requests on the ST. MICHAEL Collection System.
B_ST. MICHAEL shall operate and maintain, at no expense to
ALBERTVILLE, a drainage bypass system designed to accommodate
and convey contributing flows from the upstream watershed
contributing to the flood mitigation pond, as shown on the attached
Exhibit B, and as may be modified as approved by ST.
MICHAEL and ALBERTVILLE engineering staffs. The bypass system
will include the construction of those improvements as shown on
the attached Exhibit B . ST. MICHAEL shall cause t-These

Subdivision developer in conjunction with the platting of the
Subdivision and the construction by the Subdivision developer of
the public improvements associated with the Subdivision. The

Both ST. MICHAEL and ALBERTVILLE recognize that both cities will
have drainage and utility easements over the same property. ST.
MICHAEL agrees that any improvements or modifications it makes
within the ALBERTVILLE drainage and utility easement shall be
made in such a manner that it shall not interfere with the operation
or maintenance of the drainageway established by this Agreement,
provided, however. that ST. MICHAEL may, at its expense, modify
the bypass system as shown in the attached Exhibit D. In any event.
ALBERTVILLE shall have the right to maintain the drainage
improvements (including the bypass system) in its drainage and

-B-. D. ST. MICHAEL shall not issue certificates of occupancy for anv
houses in the Subdivision until such construction of the drainage
bypass system shown on Exhibit B is complete and the drainage and
utility easement required by paragraph 2.C. above has been
delivered to ALBERTVILLE. The parties understand and agree that
this bypass ditch and accompanying drainage and utility easement
is intended to provide flood relief to properties in
"'zALBERTVILLE and is an integral part of the consideration
in this Agreement.--ALBERTVILLE shall be under no obligation to
accept sanitary sewer flows from the Service Area until the drainage
bypass ditch is constructed and operating consistent with the
requirements of this Agreement and the drainage and utility
easement has been provided to ALBERTVILLE. However, both ST.
MICHAEL and ALBERTVILLE do not and cannot guaranty that there
will never be flooding in the area even after the drainage bypass
system is constructed
4.E. AI zALBERTVILLE shall provide St " e]ST. MICHAEL
with a thirty (30) -foot wide trail easement in the approximate
location as shown on the attached Exhibit ED- in

conjunction with the platting of the Subdivision. S+. " e!ST.
MICHAEL shall be responsible for constructing and maintaining said
trail.
-&F. ST. MICHAEL may terminate the portions of this Agreement
dealing with sanitary sewer service by written notice to
ALBERTVILLE, but only if said notice is given to ALBERTVILLE 1) at
least twelve (12) months prior to the proposed termination date,
and 2) at least twelve (12) months prior to the commencement of
any expansion or improvement of the existing WWTF for which
ALBERTVILLE intends on financing via bonding (commencement
occurs upon the awarding of a contract for such expansion). If the
notice is given after the commencement of saidaR expansion or
improvement of the existing WWTF, the termination shall be
effective upon the final repayment of any debt issued to finance
such WWTF expansion. There will be no reimbursement to ST.
MICHAEL for any SAC Charges or Sewer Trunk Charges, or any
other costs, expenses or charges paid by ST. MICHAEL or owed by
ST. MICHAEL to ALBERTVILLE, should ST. MICHAEL elect to
terminate those portions of this Agreement dealing with sanitary
sewer service this AgFeemen . In the event of termination of such
portions of this Agreement by ST. MICHAEL, the requirements of
paragraph 2.13. ; 2.C,� 2.1) and 2.E.: of this Agreement shall
remain in force and shall not be terminated. The parties intend for
paragraphs 2.B.. 2.C.. 2D and 2.E. to remain in force in perpetuity.
3. CONTRACT FOR SERVICE. This Agreement establishes a contract
for providing sewer service to ST. MICHAEL for the benefit of the
Service Area. Nothing in this Agreement shall be construed to establish
a joint powers agreement, or to convey any ownership interest in the
ALBERTVILLE WWTF to ST. MICHAEL.
4. Compliance with Applicable Laws.
A. Prior to initial connection of the Subdivision to the WWTF, ST.
MICHAEL shall adopt an Ordinance providing for sewer use
containing provisions similar to ALBERTVILLE'S Sewer Use
Ordinance (currently contained in Title 9, Chapter 3 of the
ALBERTVILLE City Code) and ensuring that new sewers and
connections to ST. MICHAEL'S Collection System are properly
designed and constructed ("Sewer Use Ordinance"). The ST.
MICHAEL Sewer Use Ordinances shall be submitted to

ALBERTVILLE for review and approval prior to adoption by ST.
MICHAEL. ALBERTVILLE'S review and comments are limited to
those technical issues which would impact the operation of the ST.
MICHAEL Interceptor or the WWTF. At least 30 days prior to
making any amendments to the ALBERTVILLE Sewer Use
Ordinance, ALBERTVILLE will forward copies of the proposed
changes to ST. MICHAEL. ST. MICHAEL shall maintain and enforce
its Sewer Use Ordinance, and shall update it ordinance from time to
time to keep it consistent with the terms of ALBERTVILLE'S Sewer
Use Ordinance. Failure by ST. MICHAEL to maintain and enforce its
Sewer Use Ordinance shall give ALBERTVILLE the right to recover
all costs and damages caused by ST. MICHAEL'S failure to enforce
its Sewer Use Ordinance, including, but not limited to, reasonable
engineering and attorney fees.
B. In the construction, maintenance, and operation of its sewer system.
ST. MICHAEL shall comply with all applicable state and federal laws.
ST. MICHAEL may retain any company it chooses to operate and
maintain ST. MICHAEL'S Collection System, or may maintain the
same with its own employees.
C. ALBERTVILLE shall enforce its Sewer Rate and Sewer Use
Ordinance at the point of discharge from ST. MICHAEL'S Collection
System into the ST. MICHAEL Interceptor, and in addition to its
contractual and legal remedies shall have the right to refuse to
accept or treat wastewater in violation of ALBERTVILLE'S or ST.
MICHAEL'S Ordinances. ALBERTVILLE shall notify ST. MICHAEL in
writing of any violations and give 30 iiatieedays' notice prior
to exercising its right to refuse wastewater. ALBERTVILLE shall
have the right to recover from ST. MICHAEL all costs and damages,
including reasonable engineering and attorney fees caused by
discharged wastewater in violation of ALBERTVILLE'S or ST.
MICHAEL'S Ordinances. ALBERTVILLE shall have approval
authority over all pre-treatment of ST. MICHAEL'S wastewater prior
to its discharge into the ST. MICHAEL Interceptor. However,
ALBERTVILLE shall not have the authority to reject a user that
meets the requirements of ALBERTVILLE Sewer Use Ordinance as
amended from time to time.

B. ST. MICHAEL shall not discharge wastewater that exceeds the
following limitations:
6. Construction of Sewer Main:
A. ST. MICHAEL shall cause to be constructed, at no expense to
ALBERTVILLE, all of ST. MICHAEL'S Collection System, including its
connection to ALBERTVILLE'S existing sewer main located in Kagan
Avenue or Kahl Avenue. All plans and specifications for ST.
MICHAEL'S Collection System to be constructed shall be approved
by the ALBERTVILLE City Engineer prior to commencement of
construction of said lines.
B. In the event that ST. MICHAEL needs a second connection from ST.
MICHAEL'S Collection System to ALBERTVILLE'S sewer main
located in Kagan Avenue or Kahl Avenue, such second connection

may be installed in the same manner as set forth in paragraph 6§.A.
above.
C. ST. MICHAEL shall be responsible for maintaining the ST.
MICHAEL'S Collection System at its own expense. ALBERTVILLE
shall be responsible for maintaining the ST. MICHAEL Interceptor
using funds from sewer rates paid by its users as well as the sewer
rates paid by the ST. MICHAEL-" "presidents connected to
ALBERTVILLE'S sewer system.
D. In the event ST. MICHAEL terminates the sewer service portion
of this Agreement pursuant to paragraph 2.E. above, ST. MICHAEL
shall permanently seal off the ST. MICHAEL Collection System
before it enters the ST. MICHAEL Interceptor in a manner that will
prevent inflow and infiltration into the ST. MICHAEL Interceptor.
7. Testing and Sampling:
A. ALBERTVILLE shall provide, install and maintain sampling devices
which shall be suitable for sampling ST. MICHAEL'S wastewater
generated from the Service Area according to set time intervals,
time impulse, and/or proportionate to flow rates. All costs incurred
by ALBERTVILLE to install said sampling devises and to test said ST.
MICHAEL'S wastewater, including maintenance and replacement of
testing equipment, shall be billed to ST. MICHAEL and paid within
30 days of billing.
B. Sampling shall be carried out by customarily accepted methods.
"BOD" and "TSS" sampling shall be done from 24-hour composite
samples.
C. Upon the agreement of the ST. MICHAEL City Engineer and the
ALBERTVILLE City Engineer, testing of the content of the
wastewater as required under this Agreement may be suspended if
the Engineers determine that the test results have sufficient
consistency to determine that the composition of the wastewater is
predictable and such testing is not required by law.
D. Both parties shall cooperate in performing such additional tests and
samples as may be required by the state or federal agency having
jurisdiction.

E. Testing and sampling required by this Agreement shall be
performed by ALBERTVILLE at the expense of ST. MICHAEL and
laboratory analysis shall be completed at a state approved and
certified laboratory. During the first two years, or until the ST.
MICHAEL AWW flows reach. GPD, testing and sampling Formatted: Highlight
shall be limited to two times per year.
F. In addition. ST. MICHAEL shall have the right at all reasonable times
to inspect, examine, sample, and test all wastewater of ST. MICHAEL
generated from the Service Area at ST. MICHAEL'S own expense.
8. Operations:
A. Both parties will at all times use reasonable and diligent care to
keep their sewer systems and water pollution control facilities in
good operating condition.
B. ST. MICHAEL shall take reasonable steps to minimize inflow and
infiltration in the ST. MICHAEL Collection System.
C. All records and accounts relating to the operation of the WWTF and
the applicable sewer ordinances shall be made available for
inspection by either party at any reasonable time, subject to the
Cities' normal records retention schedules.
D. Both parties will cooperate with each other In the enforcement of
their sewer related ordinances.
E. Neither party shall be liable to the other for damages in case of an
operational or system failure not due to legal fault as defined by
Minn. Stat. § 604.01 or which is caused by an event beyond a party's
control.
F. "' eALBERTVILLE reserves the right to require St " SST.
MICHAEL to periodically televise the sewer lines within its
jurisdiction that are connected to "'zALBERTVILLE's WWTF
for the purpose of determining the condition, operation, and
potential inflow and infiltration of such lines.
"'zALBERTVILLE reserves the right, at ALBERTVILLE'S cost
and expense, to periodically inspect such sewer lines to determine
their operational status.

9. Charges and Payments:
A. ST. MICHAEL shall pay ALBERTVILLE a Sewer Availability Charge
("SAC") for every structure in the Service Area that is connected to
ST. MICHAEL'S Collection System whose sewage is conveyed to the
ST. MICHAEL Interceptor facility. The SAC shall be paid at the time a
building permit is issued, and the amount of such SAC shall be the
same amount as required by Section 9-1-2 of ALBERTVILLE'S City
Code (or its successor provision) had the building permit for said
structure been issued in the City of ALBERTVILLE.
B. ST. MICHAEL shall pay ALBERTVILLE a Sanitary Sewer Trunk
Access Charge ("Sewer Trunk Charge") for every acre of land that is
contained on a final plat that contains any properties that connect
to ST.MICHAEL'S Collection System. The Sewer Trunk Charge shall
be paid on all acreage in the plat, including outlots, streets and
parks, but excluding wetlands. The Sewer Trunk Charge shall be
paid at the time of final plat approval and shall be calculated
according to the amount set forth in ALBERTVILLE'S City Code
Section 9-1-2-2 or its successor provision as it is in effect at the time
of final plat approval, calculated as if the acreage in question were
located within the ALBERTVILLE Sanitary Sewer District.
C_ST. MICHAEL shall pay to ALBERTVILLE user fees (for the use of the
WWTF and the ST. MICHAEL Interceptor, also known as "OM&R") at
the same sewer user rates charged to ALBERTVILLE residents.
Amounts owed to "'reALBERTVILLE shall be calculated on a
per user basis, meaning that an amount due for each ST. MICHAEL
property in the Service Area connected to the WWTF shall be
calculated using ALBERTVILLE'S sanitary sewer rates as set out in
the ALBERTVILLE City Code. As of the date of this Agreement.
ALBERTVILLE calculates sewer bills for each month of the year

by the number of days in the month to be billed, or 2) the actual
water used in the month to be billed. This same process shall be

connect to the WWTP after February 1 in any. year shall be billed

ST. MICHAEL homes connected to the WWTP (as measured during
the most recent February) multiplied by the number of days in the

new home, after which time it shall be billed in the same manner as
all other ST. MICHAEL homes connected to the WWTF. These
billing methods shall be used until such time as ALBERTVILLE
changes its billing procedure by ordinance for ALBERTVILLE'S
residents, in which case such ordinance change shall aRply to the
ST. MICHAEL properties discharging to the WWTF.
^r-ty r^N the billing period in question. ST. MICHAEL shall cause
the water meters of all ST. MICHAEL homes connected to the WWTF
to be read at the end of each month and provide ALBERTVILLE with
such water meter readings within three business days after such
meters are read.
D. =The OM&R charges so computed shall be billed to ST. MICHAEL
following the last day of each month and shall be payable to
ALBERTVILLE within 30 days of billing. In addition. ST. MICHAEL
shall pay ALBERTVILLE an administrative fee of 3% of the monthly
EOM&R charges due to ALBERTVILLE from ST. MICHAEL.
A-.E. ST. MICHAEL shall pay ALBERTVILLE for the replacement,
expansion, or relining of the ST. MICHAEL Interceptor, including
major service on or replacement of lift stations, provided the costs
of such work is not otherwise financed entirely via increases in
sewer rates. In the event of the replacement, expansion, or relining
of the ST. MICHAEL Interceptor financed in whole or in part through
a method other than increases to the ALBERTVILLE sewer user
rates and use of ALBERTVILLE SAC funds, ST. MICHAEL shall
impose an additional rate increase (in addition to the rates
described in paragraph 9.C. above) on those users in the Service
Area who are connected to the ST. MICHAEL Interceptor in an
amount sufficient to pay for the proportion of the cost of the
replacement, expansion, or relining of ST. MICHAEL Interceptor, not
otherwise paid through increased rates, equal to the proportion of
ST. MICHAEL flows through the portion of the ST. MICHAEL
Interceptor being replaced, expanded or relined to the total amount
of all flows through such section of the ST. MICHAEL Interceptor
being replaced, expanded or relined. Flows shall be measured by
using 274 gallons per day per household and average daily flows in

January for non-residential properties whose flows travel through
the ST. MICHAEL Interceptor. Such additional rate increase shall be
added to the monthly amount due to ALBERTVILLE and may be
structured such that ST. MICHAEL'S proportionate share of the cost
is paid over a ten-year period, or over a period equal to the
ALBERTVILLE bond repayment period, whichever is longer, with
interest at the same interest rate as the bond issued by
ALBERTVILLE (if applicable) to finance the replacement, expansion,
or relining of the ST. MICHAEL Interceptor.
F. The effective date for OM&R rate adjustments under the terms of Formatted: Numbered + Level: 1 +

10. Future Construction.
In the event ALBERTVILLE determines that it is desirable to expand the Formatted: List Paragraph
capacity of the WWTF, renovate the WWTF, upgrade the WWTF, or replace
or add major components of the WWTF (collectively, "WWTF Expansion"),
ALBERTVILLE shall notify ST. MICHAEL before such WWTF Expansion
occurs. In the event of a WWTF Expansion financed in whole or in part
through a method other than increases to the ALBERTVILLE sewer user rates
and use of ALBERTVILLE SAC funds, ST. MICHAEL shall impose an additional
rate increase (in addition to the rates described in paragraph 9.C. above) on
those users in the Service Area who are connected to the WWTF in an
amount sufficient to pay for the proportion of the cost of the WWTF
Expansion, not otherwise paid through increased rates, equal to the
proportion of ST. MICHAEL flows to the WWTF (calculated at 274 gallons per
day per household times 31 days) to all flows to the WWTF during the
immediate past January. Such additional rate increase shall be added to the
monthly amount due to ALBERTVILLE and may be structured such that ST.
MICHAEL'S proportionate share of the cost is paid over a ten-year period, or
over a period equal to the ALBERTVILLE bond repayment period, whichever
is longer, with interest at the same interest rate as the bond issued by
ALBERTVILLE to finance the WWTF Expansion.
11. Remedies:

A. The parties agree that if either party believes the effect of this
Agreement is inequitable or unfair to its citizens, such party may by
sixty (60) days written notice, or sooner if agreed in writing by both
parties, request renegotiations of any part of this Agreement and
the other party will in good faith participate in such negotiations.
B. Mediation Statement — If a dispute arises out of or relates to this
Agreement, or the breach thereof, and if the dispute cannot be
settled through negotiation, ALBERTVILLE and ST. MICHAEL agree
first to try in good faith to settle the dispute by mediation before
resorting to arbitration, litigation, or some other dispute resolution
procedure.
C. In addition to the remedies provided in this Agreement and those
normal remedies provided by law for breach of contract, the parties
specifically agree that this Agreement may be enforced in a Court of
competent jurisdiction by an action to require specific performance.
D. If at any time ST. MICHAEL defaults in making payments due at a
specific time, an interest rate (in accordance with any then existing
ALBERTVILLE ordinance) shall be added to the payments. If no such
ordinance exists, then the interest rate shall be the prime rate then
in effect at the Federal Reserve Board, plus 1.5%.
12. Infiltration and Inflow: The parties will cooperate with all
applicable agencies and will enforce the requirements imposed by
ALBERTVILLE ordinances in order to attempt to eliminate infiltration
and inflow existing in their respective systems.
13. Miscellaneous: Nothing in this Agreement shall limit the right of
ALBERTVILLE to enter into a sewer use agreement with any other
party.
14. Jointly Drafted: In the event of litigation over the meaning of a
provision within this document, the parties agree that this document
shall be deemed to have been jointly drafted by ALBERTVILLE and ST.
MICHAEL.
15. No Third- Party Beneficiary Rights: This Agreement is not Formatted: Font color: Text 1
intended to and shall not be construed to give any third party any
interest or rights (including, without limitation, any third party

beneficiary rights) with respect to or in connection with any agreement
or provision contained herein or contemplated hereby.
16. Threshold for Effectiveness of this Agreement:
Notwithstanding anything in the foregoing, this Agreement shall
become effective only upon the recording of the final plat of the
Subdivision.
IN WITNESS WHEREOF, the City Council of ALBERTVILLE, by
appropriate resolution duly adopted, has caused this Agreement to be
executed in its corporate name by its Mayor and City Clerk; and the
City Council of ST. MICHAEL by appropriate resolution duly adopted.

Dear Mr. Nafstad:
Enclosed are three copies of the Cooperative Construction Agreement providing for payment by the City of
Albertville to the State for the City's share of the costs to construct the Creamery pond within the corporate City
limits.
Please present this agreement to the City Council for their approval and execution, which includes original
signatures of the City's authorized officers on two copies of the agreement. The third copy of the agreement is
for use by the City until a fully executed copy is returned.
Also required are two original copies of a resolution passed by the City Council authorizing its officers to sign the
agreement on its behalf. A suggested form of resolution is enclosed.
Please return the two signed agreements and resolutions to: Claudia Dumont, Project Manager, Minnesota

This Agreement is between the State of Minnesota, acting through its Commissioner of Transportation ("State") and
the City of Albertville acting through its City Council ("City").
Recitals
The State will perform, as a design -build contract, Trunk Highway No. 94 construction including addition of
eastbound third lane from County State Aid Highway (C.S.A.H.) No. 19 to Trunk Highway No. 241 and
westbound third lane from C.S.A.H. 37 to T.H. 241, construction of westbound exit loop at T.H. 241
interchange, replacement of Bridge No. 86812 on T.H. 241 in Saint Michael with Bridge No. 86822,
replacement of Bridge No. 86817 and No. 86818 over Wright County C.S.A.H. 19 in Albertville with new
Bridge No. 86823 and other associated construction upon, along and adjacent to T.H. 94 from 0.4 Mile west
of Bridge No. 86818 over C.S.A.H. 19. in Albertville to Crow River Bridge 0.3 Mile east of T.H. 241 in
Saint Michael according to State -prepared plans, specifications and special provisions designated by the State
as State Project No. 8680-172 (T.H. 94=392) and No. 8680-177 (T.H. 94=392) and No. 8612-20
(T.H. 241=241) ("Project"); and
2. City cost participation is required for the Creamery Pond construction and the City is willing to participate in
the costs of said construction, including any associated design and construction engineering delivery costs and
right-of-way costs; and
3. Agreement No. 1032801 between the State and the City of Saint Michael will address T.H. 241 Trail
construction; and
4. Agreement No. 103282 between the State and Wright County will address C.S.A.H. 19 southeast ramp, left
turning lane, median, signal, lighting and the Creamery Pond construction; and
S. Minnesota Statutes § 161.20, subdivision 2 authorizes the Commissioner of Transportation to make
arrangements with and cooperate with any governmental authority for the purposes of constructing,
maintaining and improving the trunk highway system.

Agreement
1. Term of Agreement; Survival of Terms; Plans; Incorporation of Exhibits
1.1. Effective Date. This Agreement will be effective on the date the State obtains all signatures required by
Minnesota Statutes § 16C.05, subdivision 2.
1.2. Expiration Date. This Agreement will expire when all obligations have been satisfactorily fulfilled.
1.3. Survival of Terms All clauses which impose obligations continuing in their nature and which must survive
in order to give effect to their meaning will survive the expiration or termination of this Agreement,
including, without limitation, the following clauses: 3. Maintenance by the City; 8. Liability; Worker
Compensation Claims; 10. State Audits; 11. Government Data Practices; 12. Governing Law; Jurisdiction;
Venue; and 14. Force Majeure.
1.4. Exhibits. Preliminary Schedule "I" is attached and incorporated into this Agreement.
2. Construction by the State
2.1. Contract Award The State will advertise for technical and price proposals and award a design -build
contract to the "Low Bid/Best Value Proposer" for State Project No. 8680-172 (T.H. 94=392) according to
the State Request for Qualifications (RFQ) and Request for Proposal (RFP) documents, which are on file in
the office of the Commissioner of Transportation at St. Paul, Minnesota, and incorporated into this
Agreement by reference ("Project Plans").
2.2. Direction, Supervision and Inspection of Construction.
A. Supervision and Inspection by the State. The State will direct and supervise all design -build activities
performed under the design -build construction contract, and oversee all construction engineering and
inspection functions in connection with the design -build construction. All design -build construction will
be performed according to the State's Request for Proposals, the Contractor's technical proposal, and
approved plans.
B. Inspection by the City. The City participation construction covered under this Agreement will be open to
inspection by the City. If the City believes the City participation construction covered under this
Agreement has not been properly performed or that the construction is defective, the City will inform the
State District Engineer's authorized representative in writing of those defects. Any recommendations
made by the City are not binding on the State. The State will have the exclusive right to determine
whether the State's contractor has satisfactorily performed the City participation construction covered
under this Agreement.
2.3. Plan Changes, Additional Construction, Etc.
A. The State may request the Contractor to make changes in the design and/or design -build contract
construction, which may include the City participation construction covered under this Agreement, and
will enter into any necessary addenda and change orders with the State's contractor that are necessary to
cause the design -build contract construction to be performed and completed in a satisfactory manner.
The State District Engineer's authorized representative will inform the appropriate City official of any
proposed addenda and change orders to the design -build contract that will affect the City participation
construction covered under this Agreement.
B. The City may request additional work or changes to the work in the plans as part of the design -build
contract. Such request will be made by an exchange of letter(s) with the State. If the State determines
that the requested additional work or plan changes are necessary or desirable and can be accommodated
without undue disruption to the project, the State will cause the additional work or plan changes to be
made.

2.4. Satisfactory Completion of Contract The State will perform all other acts and functions necessary to cause
the design -build contract to be completed in a satisfactory manner. Acceptance by the State of the completed
design -build contract construction will be final, binding and conclusive upon the City as to the satisfactory
completion of the design -build contract construction.
2.5. Permits
A. The City will submit to the State's Utility Engineer an original permit application for all utilities owned
by the City to be constructed hereunder that are upon and within the Trunk Highway Right -of -Way.
Applications for permits will be made on State form "Application For Utility Permit On Trunk Highway
Right -of -Way" (Form 2525).
B. The City will submit to the Minnesota Pollution Control Agency the plans and specifications for the
construction or reconstruction of its sanitary sewer facilities to be performed under the design -build
contract and obtain, under Minnesota Statutes § 115.07 or Minnesota Rules 7001.1030, subpart 2C,
either a permit or written waiver from that agency for that construction or reconstruction. The City is
advised that under Minnesota Rules 7001.1040, a written application for the permit or waiver must be
submitted to the Minnesota Pollution Control Agency at least 180 days before the planned date of the
sanitary sewer facility construction or reconstruction.
3. Maintenance by the City
Upon completion of the Project, the City will provide the following without cost or expense to the State:
3.1. Municipal Utilities. Maintenance of any municipal -owned utilities construction, without cost or expense to
the State.
3.2. Creamery Pond
A. The City will share the maintenance responsibilities of the Creamery Pond. Maintenance will include,
but not limited to, litter, debris and silt removal, mowing, erosion repairs and any other maintenance
activities necessary to preserve the facilities and to prevent conditions such as flooding, erosion,
sedimentation or accelerated deterioration of the facilities. The City will be responsible, to the extent
provided by law, for its own acts and omissions in connection with maintaining the storm water
treatment pond.
B. The City will share in the cost of future major maintenance at a rate based on the ratios of contributing
water volume entering into the pond at the time that the major maintenance is required. The City's
contributing water volume entering into the pond at the time the pond was designed is 49 percent for the
Creamery Pond. Major maintenance includes, but is not limited to, removal of sediment, repair of major
erosion problems, major structure and entrance pipe repair and any other major maintenance activities
necessary to preserve the facilities and to prevent conditions such as flooding, erosion, sedimentation or
accelerated deterioration of the facilities. The State and the City may enter into a separate agreement to
define additional responsibilities for maintenance of the pond.
C. The City will share in all responsibilities, obligations and liabilities arising out of or by reason of the
drainage collecting into and being discharged from the pond. The City will share such responsibilities,
obligations and liabilities at a rate based on the ratio of contributing water volume entering into the pond
as referenced in the previous paragraph, however, contributing water volume ratios may change based on
development and alteration of land use in the vicinity.
3.3. Additional Drainage. Neither party to this Agreement will drain any additional drainage volume into the
storm sewer facilities constructed under the design -build contract that was not included in the drainage for
which the storm sewer facilities were designed, without first obtaining written permission to do so from the
other party.

4. Basis of City Cost
4.1. Schedule "P : The Preliminary Schedule "I" includes all anticipated City participation construction and
associated design items and the construction engineering cost share covered under this Agreement, and is
based on engineer's estimated unit prices.
4.2. City Participation Construction. The City will participate in the following as indicated. The lump sum
amounts shown are based on the engineer's estimate and include all construction engineering delivery costs
associated with the City's cost participation.
A. 49 Percent will be the City's rate of cost participation in the Creamery Pond construction, associated
design and acquisition of right-of-way. The lump ,sum values of the construction, associated design and
acquisition of right-of-way cost are tabulated through Sheet No. 2 to No. 4 of the Preliminary
Schedule "I".
4.3. Design and Construction Engineering Costs. The City's cost for design and construction engineering is
itemized as a bid item cost.
5. City Cost and Payment by the City
5.1. City Cost. $89,501.70 is the City's estimated share of the costs of the design -build construction and
associated design, construction engineering delivery and State contract construction engineering costs. Upon
award of the design -build contract, the State will revise the bid item lump sum amounts based on design -
build contract bid item unit prices.
5.2. Conditions of Payment. The City will pay the State the full and complete lump sum amount, as revised
based on the design -build contract bid -item prices, after the following conditions have been met:
A. Execution of this Agreement and transmittal to the City.
B. The City's receipt of a written request from the State for the advancement of funds.
5.3. Final Payment, Additional City Requested Work. Upon completion of all contract construction and upon
computation of the final amount due the State's contractor and only if additional work has been requested
under Article 2.3.13 of this Agreement, the State will prepare a Final Schedule "I" and submit a copy to the
City. The Final Schedule "I" will be based on final quantities of any additional City requested participation
construction items and the construction engineering cost share due to additional requested work. The
computation by the State of the amount due from the City will be final, binding, and conclusive. The State
and the City waive claims for any payments or refunds less than $5.00 according to Minnesota Statutes
§ 15.415.
6. Authorized Representatives
Each party's Authorized Representative is responsible for administering this Agreement and is authorized to give
and receive any notice or demand required or permitted by this Agreement.

7. Assignment; Amendments; Waiver; Contract Complete
7.1. Assignment Neither party may assign or transfer any rights or obligations under this Agreement without the
prior consent of the other party and a written assignment agreement, executed and approved by the same
parties who executed and approved this Agreement, or their successors in office.
7.2. Amendments. Any amendment to this Agreement must be in writing and will not be effective until it has
been executed and approved by the same parties who executed and approved the original Agreement, or
their successors in office.
7.3. Waiver. If a party fails to enforce any provision of this Agreement, that failure does not waive the provision
or the party's right to subsequently enforce it.
7.4. Contract Complete. This Agreement contains all prior negotiations and agreements between the State and
the City. No other understanding regarding this Agreement, whether written or oral, may be used to bind
either party.
8. Liability; Worker Compensation Claims
8.1. Each party is responsible for its own acts, omissions and the results thereof to the extent authorized by law
and will not be responsible for the acts and omissions of others and the results thereof. Minnesota Statutes
§ 3.736 and other applicable law govern liability of the State. Minnesota Statutes Chapter 466 and other
applicable law govern liability of the City.
8.2. Each party is responsible for its own employees for any claims arising under the Workers Compensation
Act.
9. Nondiscrimination
Provisions of Minnesota Statutes § 181.59 and of any applicable law relating to civil rights and discrimination are
considered part of this Agreement.
10. State Audits
Under Minnesota Statutes § 16C.05, subdivision 5, the City's books, records, documents, and accounting
procedures and practices relevant to this Agreement are subject to examination by the State and the State Auditor
or Legislative Auditor, as appropriate, for a minimum of six years from the end of this Agreement.
11. Government Data Practices
The City and State must comply with the Minnesota Government Data Practices Act, Minnesota Statutes Chapter
13, as it applies to all data provided under this Agreement, and as it applies to all data created, collected, received,
stored, used, maintained, or disseminated by the City under this Agreement. The civil remedies of Minnesota
Statutes § 13.08 apply to the release of the data referred to in this clause by either the City or the State.
12. Governing Law; Jurisdiction; Venue
Minnesota law governs the validity, interpretation and enforcement of this Agreement. Venue for all legal
proceedings arising out of this Agreement, or its breach, must be in the appropriate state or federal court with
competent jurisdiction in Ramsey County, Minnesota.
13. Termination; Suspension
13.1. By Mutual Agreement. This Agreement may be terminated by mutual agreement of the parties.
13.2. Termination for Insufficient Funding. The State may immediately terminate this Agreement if it does not
obtain funding from the Minnesota Legislature, or other funding source; or if funding cannot be continued at
a level sufficient to allow for the performance of design -build contract construction under the Project. -
Termination must be by written or fax notice to the City.

13.3. Suspension. In the event of a total or partial government shutdown, the State may suspend this Agreement
and all work, activities and performance of work authorized through this Agreement.
14. Force Majeure
Neither party will be responsible to the other for a failure to perform under this Agreement (or a delay in
performance), if such failure or delay is due to a force majeure event. A force majeure event is an event beyond a
party's reasonable control, including but not limited to, unusually severe weather, fire, floods, other acts of God,
labor disputes, acts of war or terrorism, or public health emergencies.

SUBJECT: PUBLIC WORKS / ENGINEERING — 2019 STREET IMPROVEMENTS
RECOMMENDATION: This space on the agenda is reserved for the City Council to consider
acceptance of the lowest bid received for the 2019 Street Improvements project. It is respectfully
requested that the Mayor and Council consider the following motion:
MOTION TO: Approve Resolution No. 2019-011 entitled A Resolution Accepting Low Bid for
2019 Street Improvements
INFORMATION: The proposed improvement project was advertised and on March 13, bids for
the improvements were opened. A total of seven (7) bids were received with proposals ranging
from $826,548.95 to $948,882.25, as shown on the attached Bid Tab.
The following elements, together with related work, are included in the project:
Street Overlay — Including the following street segments:
• Karston Avenue NE — 61st Street NE to CSAH 37
• Karston Drive NE
• 61 st Street NE — Karston Drive NE to a point approx. 650 ft east of Kahl Ave.
• Kahler Drive NE — Karston Drive NE to Kalenda Drive NE
• 53rd Street NE — Kalenda Drive NE to CSAH 19
Street Reclaim and Pave — Mackenzie Ave NE — South of 60th Street NE (bid Part B)
Sidewalk Improvements — The existing 8' bituminous boulevard trail located along the
project streets including, Kahler Drive NE, Karston Ave NE, and 53rd Street NE, will be
replaced by 5' concrete walk.
Miscellaneous — The project will also include spot curb repair, pavement milling,
driveway patching and construction, utility adjustments, boulevard/yard grading, and turf
restoration
KEY ISSUES:
Low Bid for the project is $826,548.95, which includes the bid Part A and B.
Low Bid Received by Valley Paving, Inc.
Bids received are well below the engineer's estimate of $997,000
FINANCIAL CONSIDERATIONS: The proposed project will be funded through multiple
funds including the 2019 streets budget, and capital reserves. The low bid amount is for
$826,549. These figures do not include the overhead costs associated with surveying services or

construction inspection and testing. Overhead and construction contingencies are estimated to be
approximately 15% of the construction amount.
LEGAL CONSIDERATIONS: The Mayor and Council possess the authority to authorize
municipal improvements, and to accept or reject bids for municipal improvements.

A RESOLUTION ACCEPTING LOW BID FOR THE
2019 STREET IMPROVEMENTS
WHEREAS, plans and specifications for street, sidewalk, utility, drainage and other related
municipal improvements to the certain city streets and trails have been prepared by Bolton &
Menk, Inc. and such plans and specification have been presented to the Albertville City Council
for approval; and
WHEREAS, pursuant to an advertisement for bids for the proposed improvements, bids
were received, opened and tabulated; and
WHEREAS, it appears that Valley Paving, Inc. of Shakopee, Minnesota is the lowest
responsible bidder; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Albertville,
Minnesota, as follows:
The bid of Valley Paving, Inc., said "Low Bidder", in the amount of $826,548.95 for the
construction of said improvements in accordance with the plans and specifications and
advertisement for bids is the lowest responsible bid.
2. Said bid of said Low Bidder is accepted.
3. The City Administrator and City Clerk are hereby authorized and directed to enter into a
contract with said "Low Bidder" for the construction of said improvements for and on
behalf of the City of Albertville.
Approved by the City Council of the City Albertville this 18te day of March, 2018.

SUBJECT: ADMINISTRATION — REQUEST FOR THE STATE OF MINNESOTA TO DEED TAX
FORFEITED PROPERTIES TO THE CITY
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following motion:
MOTION TO: Adopt Resolution No. 2019-XXX Requesting the State of Minnesota to Deed
Tax Forfeited Land to the City of Albertville.
BACKGROUND: Wright County forwarded to the City a property that has gone tax forfeit in
the County. City Staff provided the Council with background information and outstanding
assessments on the parcel from the 1980's at the March 4, 2019 City Council in the amount of
$15,504.23. At the meeting the Council directed staff to look into the City acquiring the parcel.
A resolution to purchase the parcel number 101-022-000020, once approved by Council, will be
sent to Wright County.
Staff received notice of the price the Wright County Board approved for the parcel. The price set
by the County Board for the parcel is $100.00 plus fees and taxes associated with the sale. Staff
is seeking feedback from Council on whether to purchase the parcel for that amount.
KEY ISSUES:
Currently this is not a developable parcel, as it is an outlot. The parcel could be
developed in the future with platting and a variance.
The City cannot make a profit on the parcel if there is a future sale.
FINANCIAL CONSIDERATIONS: The purchase of the property will be paid from the general
fund.
LEGAL CONSIDERATIONS: The City Council can purchase property but cannot make a
profit on the sale of the parcel.

RESOLUTION REQUESTING THE STATE OF MINNESOTA TO DEED TAX
FORFEITED LANDS TO THE CITY OF ALBERTVILLE
WHEREAS, Wright County informed the City that several properties in the
City have been forfeited for failure to pay taxes and that the City could acquire such
properties for a lawful public use under Minn. Stat. 282.01, Subd. la; and
WHEREAS, the City desires to acquire one of the tax forfeited properties
pursuant to Minn. Stat. 282.01, Subd.la.(b) for economic development purposes; and
WHEREAS, Wright County informed the City that the property identified by
PID No. 10 1 -022-000020 has been forfeited for failure to pay taxes and that the City
could acquire such property for a lawful public use under Minn. Stat. 282.01, Subd.
la;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ALBERTVILLE, WRIGHT COUNTY, MINNESOTA:
1. The Public Works Director is directed to notify Wright County in writing that
the City of Albertville intends on acquiring the following property for a
lawful public purpose under Minn. Stat. 282.01, Subd. la(b):

GENERAL ADMINISTRATION
Centennial Planning: The next meeting is March 25, 2019 at 7:00 p.m. and all are welcome.
Ice Arena: The Arena Board is working on the budget for the 2019/2020. The draft budget
currently shows a loss of approximately $60,000. Rental rates and tiers are being reviewed and
will likely need to be increased. The next meeting is April 8, 2019.
ENGINEERING/PUBLIC WORKS
Ditch No.9: Due to the rain and rapid snow melt, we contracted to have Ditch No. 9 cleared of
snow from CR 119 in St. Michael to 49th Street to mitigate flood potential.
194 Cooperative Construction Agreement: Included as an agenda item is MnDOT's construction
agreement for the 194 project. Per the agreement, Albertville's cost share is estimated to be
approximately $89,000, which is the cost associated with the pond for the eastbound on -ramp.
Wright County is entering into a similar agreement to cover the cost of the on -ramp; however,
per the County Cost Share Policy, cities are responsible for pond maintenance and a portion of
the pond cost.
Sanitary Sewer Service Agreement: The latest draft of the agreement is included as an agenda
item. St. Michael has approved final plat for phase 1 of Fieldstone Passage — Phase 1, which
includes 40 lots.
2019 Street Project: Valley Paving, Inc. submitted the low bid in the amount of $826,548.95.
Once awarded, we will enter into a contract with Valley Paving and set a date for a pre -
construction meeting.
70th Street Project: Discussion with MnRoad and Otsego on potentially partnering to improve
70th Street between CSAH 19 and Kadler are ongoing and I believe MnRoad would like to pursue
a project in 2019.
WWTP Forcemain Project: Plans have been submitted to all of the reviewing agencies. We are
currently working on obtaining all of the necessary permits. The MPCA anti -degradation permit
has been published for public comment through May 13 and the MPCA will publish the EAW on
Monday. The EAW has a 30 day public comment period. We have submitted a CUP application
to the City of Otsego, which will go to their April 1 Planning Commission meeting. Currently we
are working towards an award date of May 20.

The Wright County Sheriff's Office, in partnership with the community,

Citizens of Wright County,
The Wright County Sheriff's Office is the 3rd largest Sheriff's Office in the State of Minnesota. We provide law
enforcement services to 13 of the county's 16 cities along with all unincorporated areas of Wright County. In a
strong partnership with the community, we are able to provide the citizens with reliable service to maintain
the high-level quality of life that we have come to enjoy and expect.
There are 10 divisions within the Sheriff's Office; Administration, Patrol, Corrections, Communications, Court
Security, Criminal Investigations, School Resource, Special Investigations Unit (Narcotics), Warrants/Civil
Process/Transport and Community Policing/ Recreational Services and Enforcement.
With the help of our community, the Wright County Sheriff's Office will continue to meet our challenges of

The City of Albertville has been contracting law enforcement services with the
Sheriff's Office for over 40 years. Albertville achieved 24 hours a day coverage in
2005 and maintained that level of service until 2015. In July of 2015, the contract
was increased to 28 hours a day coverage.
2018 Activity
Sheriff Deputies responded to 5,896 calls for service in Albertville in 2018.
Of those calls for service, 2,907 incidents turned into a case report and
required further investigation by the deputies. The summaries below

The Special Investigations Unit (SIU) is part of the Wright County Sheriff's Office Criminal
Investigations Division. The unit is comprised of a sergeant and two full time deputies. This is
the only plain clothes and unmarked unit within the Sheriff's Office. Due to SIU's unique
ability to blend in with the public, they are often utilized in situations where a marked patrol
unit would not be feasible. This includes the arrest of people with warrants who commonly
flee when confronted by a uniformed deputy or conducting surveillance of locations with
suspected criminal activity. One of the main functions of SIU is to investigate drug crimes
within Wright County. This is accomplished through investigative work, speaking with
concerned citizens and informants, collaborating with other law enforcement agencies,
utilizing social media, and through physical and electronic surveillance. SIU serves
approximately 70 search warrants per year within the county along with assisting other local
agencies with some of their search warrants. SIU also handles the civil forfeiture of cash,
vehicles and firearms when their use or possession was related to controlled substance.

The Major Crimes Investigation Unit (MCIU) is responsible for documenting and processing
crime scenes and evidence collected from scenes. The unit will respond when needed for
death investigations, assaults, robberies, burglaries, or any scene where advanced skills and
processing techniques are needed to collect and document evidence. MCIU also responds to
motor vehicle crashes resulting in serious injuries or death. Besides documenting the crime
scenes, MCIU is trained in processing evidence for latent prints, DNA evidence, tire and shoe
tread patterns, tool mark evidence, biological stains, and trace evidence. Most of the evidence
collected is sent to the Tri County Regional Forensic Lab where further analysis and
comparison is done and hopefully identifications are made.

School Resource Officers
The Wright County Sheriff's Department works with six school districts to provide School
Resource Officers (SRO) services on a contract basis. The eight SRO's spend a good portion of
their day making themselves visible and approachable to staff and students. The visibility of
the deputy is a friendly reminder to students, staff and visitors that safety and security is a
priority within the districts they serve. The STMA district has two SRO's assigned to their
