Call to Order Mayor Hendrickson called the meeting to order at 6 pm. Discussion of the Albertville 2030 Vision Study Proposed Land Use Plan City Planner Brixius presented the 2030 Vision Study proposed Land Use Study. The City Council and Planning Commission members discussed the 2030 Vision Study and the Future Land Use Concept Plan. As part of the presentation, the group reviewed seven (7) specific sites for rezoning. City Planner Brixius and City Administrator Nafstad answered questions from the City Council and Planning Commissioners. General consensus of the group was to maintain commercial land use along county road 19, investigate changing the land use in the northwest part of town from business campus/commercial to industrial. Additionally, the group favored maintaining current policies related to multi -family development and desired to continue to evaluate changes to the proposed land use plan on a case by case. 3. The motion carried. 3. 2021 Enterprise Budgets and Rate Information Finance Director Lannes presented the staff report and answered questions from Council. City Administrator Nafstad answered questions from Council. There was Council discussion regarding the water, sewer and storm water rate information. The Council directed staff to bring the item back to a future Council meeting. D. Planning/Zoning 1. Gonyea/Watermark Properties — Single Family Concept Plan City Planner Brixius provided an overview from the October 19 Council meeting in which the item was first presented and said the applicant would like feedback on the updated concept plan. Mr. Peterson, Watermark's Director of Operation, reviewed the project details and amenities that would be included with the single-family rental. Mr. Peterson also provided information on the proposed changes to the concept plan since the last Council meeting. He answered questions from Council. City Administrator Nafstad and City Attorney Couri answered questions from Council. Discussion of Expansion of Governor's Executive Orders Councilmember Hudson provided background information on the item and asked if Council would be interested in drafting a resolution regarding the Orders. He said he would be willing to table the item until the December 7 Council Workshop. City Attorney Couri answered questions from Council regarding the Executive Orders. There was Council discussion regarding the recent Governor's Executive Orders and possible actions. Council determined to discuss the item at the December 7 City Council Workshop. I. Administration 1. Call for a City Council Workshop with the Wright County Sheriff's Department for December 7, 2020 at 5:30 pm City Administrator Nafstad said the Truth -in Taxation Hearing was scheduled for December 7 at 6:15 pm. He asked if Council preferred to schedule this meeting earlier on the 7th or on another date. There was Council discussion regarding the proposed Council workshop and meeting date. The Council's consensus was to schedule the Council Workshop for November 30, 2020, at 5 pm. 2. Discussion on a request to live stream public meetings City Administrator Nafstad said he had received a request to live stream the public meeting. He answered questions from Council and said the public meeting are currently audio recorded. City Finance Director Lannes said the approximate cost to live stream the meeting would be between $10,000 to $30,000 and she answered questions from Council. There was Council discussion regarding live streaming the public meetings and the consensus was to not move forward with the request. BACKGROUND: Each year the City Council shall identify its official meeting dates for the coming year. KEY ISSUES: There are several recognized holidays that fall on the first and/or third Mondays throughout the year. These include: o Monday, January 18 - Martin Luther King Jr. Day o Monday, February 15 - President's Day o Monday, September 6 — Labor Day The City Council meetings that would normally meet on these days have been moved to the Tuesday immediately following the holiday. Generally, if a fifth Monday falls during a calendar month, the cities of Albertville and St. Michael and the STMA School Board have generally set a joint meeting for the fifth Monday which will occur on March 29, August 30, and November 29 next year. POLICY/PRACTICES CONSIDERATIONS: Council may choose to change, add or delete meetings as needed throughout the year and will be required to post notice at least 72 hours in advance of changes, cancellations, or additional meetings. INFORMATION: Due to the COVID-19 pandemic, Minnesota Governor Walz has issued several executive orders throughout 2020 that have impacted local businesses. In recognition of these impacts, staff has been researching potential reimbursements for liquor license fees. Liquor license fees are meant to pay for license insurance, inspections, monitoring compliance (insurance, training, etc.), enforcement and compliance checks of the license. As part of the executive orders, on -sale license holders have experienced limited sales throughout 2020 resulting in significate revenue loss. Rather than refunding part of the 2020 liquor license fees for the on -sale licensees, Staff is recommending waiving the liquor license fees for the new license period beginning April 15, 2021. KEY ISSUES: • Due to the COVID-19 pandemic, Governor Tim Walz has issued several executive orders that have resolved in significant loss in revenue to bars and restaurants in the City of Albertville. • Liquor license renewal applications for the 2021-2022 license period will be sent to the licensed establishments at the end of December 2020. • The City of Albertville's liquor license period runs from April 15 to April 14. • The City of Albertville has 8 on -sale intoxicating liquor license and 2 on -sale wine and 3.2 malt liquor licenses. BACKGROUND: On September 21, 2020, the City Council certified a preliminary levy of $4,317,153 to Wright County. Based on the preliminary levy, Wright County has prepared and mailed projected tax statements to all residents. On Monday, December 7, the City Council will host a public hearing, known as a Truth -In -Taxation, for the Council to take public comments on the proposed budget and levy. Following public comments, the City Council at a regularly convened meeting may approve or adjust the final levy, which is then certified to Wright County for taxes payable in 2021. Coinciding with the adoption of the City's Levy, the City Council officially adopts a 2021 budget detailing projected revenue and expenses. KEY ISSUES: • The public Truth -in -Taxation hearing was held prior to Council approvals. • The proposed budget and levy represent a total levy increase of 2.90%. • The debt service budget has decreased by $36,280 and the general fund operations levy has increased by $109,077 and the capital levy increased $48,876 for the 2.90% total levy increase. • The proposed budget includes anticipated LGA funding (estimated $115,635). • Staff provides the final levy to the County Auditor no later than end of business day December 28, 2020. POLICY CONSIDERATIONS: The Council reviews and approves all budgets and tax levies. FINANCIAL CONSIDERATIONS: In reviewing the projected 2021 budget, staff anticipates maintaining the Office of the State Auditors recommendation of at least 35% of the budget in designated funds for general reserve. Mayor and Council Communication December 7, 2020 SUBJECT: PLANNING DEPARTMENT - GOLF CARTS AND ATV USE ON CITY STREETS RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: Provide direction to City Staff as to whether they wish to make some accommodation allowing golf carts to travel on public streets. BACKGROUND: The City routine receives questions and complaints regarding golf carts and ATV use on city streets. Attached is MN State Statute 169.045 which addresses Special Vehicle Use of Roadways. This statute allows a City to adopt an ordinance to allow vehicle such as ATV, Golf Carts and mini - trucks to use public streets. Without this type of ordinance these vehicles are not allowed to travel on public streets except for crossing a public street at an intersection. Title 7, Chapter 3 of the Albertville City Code deals with Snowmobiles and Recreation Vehicles traveling within the City. This chapter allows the snowmobiles and recreational vehicles licensed for highway operation to use the public streets with conditions. Chapter, Section 7-3-5 also addresses the operation of ATVs as follows: "Except as provided in this section, no person shall operate or knowingly permit the operation of an all -terrain vehicle upon any street or highway within the city, including any portion of the right of way. Nothing in this section shall be interpreted to prohibit the operation of an all -terrain vehicle on the outside slope of a trunk, county state aid, or county highway within the city." Neither the definition of Recreational Vehicle or ATV includes golf carts. Staff requests Council's direction on this matter. KEY ISSUES: RECREATIONAL MOTOR VEHICLE: (Definition) Trail bikes, amphibious vehicles and similar devices, other than snowmobiles, used at least partially for travel on natural terrain, but not "special mobile equipment" as defined in Minnesota statutes section 168.011, subdivision 22, which is hereby incorporated herein by reference; also including any self-propelled vehicle and any vehicle propelled or drawn by a self- propelled vehicle used for recreational purposes, including, but not limited to, a motorized bicycle, all -terrain vehicle, motorcycle, hovercraft or motor vehicle licensed for highway operation which is being used for off road recreational purposes. This definition includes "off highway motorcycles" as defined in Minnesota statutes section 84.787, and "all -terrain vehicles" as defined in Minnesota statutes section 84.92. The operation of Recreational Vehicles in Albertville must comply with the standards of Section 7-3-4: RECREATIONAL VEHICLES: A. All Minnesota safety and required equipment laws apply to all recreational vehicles. B. All Minnesota state laws regarding prohibited conditions and operations apply to all recreational vehicles. C. The following are prohibited conditions and operations of recreational motor vehicles within the city: 1. On the private property of another without lawful authority or consent of the owner (or occupant) of such property. 2. On public sidewalks, walkways or trails provided or used for pedestrian travel. 3. On or across park lands or ice skating rinks, whether on lakes or flooded areas, nor shall such vehicles park on such area unless such areas have been specially designated for such use. 4. On any publicly owned lands and/or frozen waters, including, but not limited to, school grounds, playgrounds, and recreation areas, unless such areas have been specially designated for such use, except as provided in section 7-3-5 of this chapter. 5. While under the influence of alcohol, controlled substances, or combination of both. 6. At a speed greater than reasonable and proper under all the surrounding circumstances. 7. At any place in a careless, reckless or negligent manner so as to endanger the person or property of another or to cause injury or damage thereto. 8. In a manner so as to create a loud, unnecessary or unusual noise which disturbs, annoys or interferes with the peace and quiet of other persons. 9. In any cemetery. 10. In any planting or tree nursery in a manner which damages or destroys growing stock. (Ord., 1988; amd. Ord. 1997-5, 5-6-1997; 2005 Code) • ALL -TERRAIN VEHICLES: A motorized flotation tired vehicle of not less than three (3) low pressure tires, but not more than six (6) tires that is limited in engine displacement of less than eight hundred (800) cubic centimeters and total dry weight less than nine hundred (900) pounds. Golf Carts are not included in the definition of All -Terrain Vehicles. All -Terrain Vehicles are prohibited on public streets in Albertville per Section 7-3-5: ALL -TERRAIN VEHICLES: Except as provided in this section, no person shall operate or knowingly permit the operation of an all -terrain vehicle upon any street or highway within the city, including any portion of the right of way. Staff would provide a Golf Cart definition and provide a prohibition similar to the Section 7-3-5 All- Terrain Vehicles. If the Council wishes to allow the use of Golf Carts on public streets, Staff would provide code examples from other cities that may be pursued. Within these codes some Cities require residents to obtain permits through the City to allow a specific person to drive a golf carts on city streets (the permit is exclusive to a specific driver with conditions for operating the cart). A second option is to allow everyone to use golf carts on City streets with specific conditions on operation of the golf Carts. (driver age restrictions, specific travel streets, insurance requirements, hours of operation, speed limits, etc.) FINANCIAL CONSIDERATIONS: If Cart use is prohibited, we would not anticipate significant financial impact to the City. If Cart use is allowed, the City will need to examine the fees for issuing a cart operation permits if this option is pursued. LEGAL CONSIDERATIONS: The City will depend on the County Sheriff for enforcement of traffic laws. In this respect, any new code changes will be coordinated with the County Sheriff Department. Subd. 1. Designation of roadway, permit. The governing body of any county, home rule charter or statutory city, or town may by ordinance authorize the operation of motorized golf carts, all -terrain vehicles, utility task vehicles, or mini trucks, on designated roadways or portions thereof under its jurisdiction. Authorization to operate a motorized golf cart, all -terrain vehicle, utility task vehicle, or mini truck is by permit only. For purposes of this section: (1) an all -terrain vehicle has the meaning given in section 84.92; (2) a mini truck has the meaning given in section 169.011, subdivision 40a; and (3) a utility task vehicle means a side -by -side, four-wheel drive, off -road vehicle that has four wheels, is propelled by an internal combustion engine with a piston displacement capacity of 1,200 cubic centimeters or less, and has a total dry weight of 1,800 but less than 2,600 pounds. Subd. 2. Ordinance. The ordinance shall designate the roadways, prescribe the form of the application for the permit, require evidence of insurance complying with the provisions of section 65B.48, subdivision 5 and may prescribe conditions, not inconsistent with the provisions of this section, under which a permit may be granted. Permits may be granted for a period not to exceed three years, and may be renewed. A permit may be revoked at any time if there is evidence that the permittee cannot safely operate the motorized golf cart, all -terrain vehicle, utility task vehicle, or mini truck on the designated roadways. The ordinance may require, as a condition to obtaining a permit, that the applicant submit a certificate signed by a physician that the applicant is able to safely operate a motorized golf cart, all -terrain vehicle, utility task vehicle, or mini truck on the roadways designated. Subd. 3. Times of operation. Motorized golf carts, all -terrain vehicles, and utility task vehicles may only be operated on designated roadways from sunrise to sunset, unless equipped with original equipment headlights, taillights, and rear -facing brake lights. They shall not be operated in inclement weather, except during emergency conditions as provided in the ordinance, or when visibility is impaired by weather, smoke, fog or other conditions, or at any time when there is insufficient visibility to clearly see persons and vehicles on the roadway at a distance of 500 feet. Subd. 4. Slow -moving vehicle emblem. Motorized golf carts shall display the slow -moving vehicle emblem provided for in section 169.522, when operated on designated roadways. Subd. 5. Crossing intersecting highways. The operator, under permit, of a motorized golf cart, all -terrain vehicle, utility task vehicle, or mini truck may cross any street or highway intersecting a designated roadway. Agenda Page 58 Subd. 6. Application of traffic laws. Every person operating a motorized golf cart, all -terrain vehicle, utility task vehicle, or mini truck under permit on designated roadways has all the rights and duties applicable to the driver of any other vehicle under the provisions of this chapter, except when those provisions cannot reasonably be applied to motorized golf carts, all -terrain vehicles, utility task vehicles, or mini trucks and except as otherwise specifically provided in subdivision 7. Subd. 7. Nonapplication of certain laws. The provisions of chapter 171 are applicable to persons operating mini trucks, but are not applicable to persons operating motorized golf carts, utility task vehicles, or all -terrain vehicles under permit on designated roadways pursuant to this section. Except for the requirements of section 169.70, the provisions of this chapter relating to equipment on vehicles are not applicable to motorized golf carts, utility task vehicles, or all -terrain vehicles operating, under permit, on designated roadways. Subd. 7a. Required equipment on mini trucks. Notwithstanding sections 169.48 to 169.68, or any other law, a mini truck may be operated under permit on designated roadways if it is equipped with: (1) at least two headlamps; (2) at least two taillamps; (3) front and rear turn -signal lamps; (4) an exterior mirror mounted on the driver's side of the vehicle and either (i) an exterior mirror mounted on the passenger's side of the vehicle or (ii) an interior mirror; (5) a windshield; (6) a seat belt for the driver and front passenger; and (7) a parking brake. Subd. 8. Insurance. In the event persons operating a motorized golf cart, utility task vehicle, all -terrain vehicle, or mini truck under this section cannot obtain liability insurance in the private market, that person may purchase automobile insurance, including no-fault coverage, from the Minnesota Automobile Insurance Plan under sections 6513.01 to 65B.12, at a rate to be determined by the commissioner of commerce. Subd. 1. Motorized golf cart use by persons with mobility impairment —Permit required. Any person with mobility impairment or any person assisting a person with a mobility impairment may operate a motorized golf cart upon all streets within the city, except those expressly designated as prohibited streets by resolution of the council. It is unlawful for any person to operate a motorized golf cart under this section without first obtaining a permit therefor from the city. The fees for a permit hereunder shall be established by the council, by resolution, from time to time. Each permit hereunder shall be issued for a period of one year from its date of issuance. Subd. 2. Permit application. An application for a permit hereunder shall be filed with the city clerk upon an application form furnished by the city. The application shall include, but not be limited to, the following: A. The names and addresses of the following persons: 1. The applicant signed thereto; and 2. The person with mobility impairment for which the permit is sought if such person is not the applicant; B. The make and model and any identification number of the motorized golf cart to be operated under the permit; C. A certificate of a medical doctor, duly licensed to practice medicine in the state, which certificate shall state that the applicant, if such applicant is a person with mobility impairment, is able to safely operate a motorized golf cart on the designated street; and D. Any other and further information as the city deems necessary. Subd. 3. Granting or denying issuance of permit. The city clerk may grant a permit hereunder. No permit shall be issued hereunder until a certificate of insurance, evidencing coverage for liability in compliance with the provisions of Minn. Stat. § 65B.41-65B.71, is filed with the city clerk. The city clerk may deny a permit hereunder for any of the following reasons: A. The application is incomplete and contains false, fraudulent or deceptive statements. B. The applicant has not complied with one or more of the provisions hereunder. C. The applicant has been convicted of a violation under this section. Subd. 4. One person permit. No permit shall be issued to more than one person; the permit shall apply to the individual, not the motorized golf cart. Subd. 5. Conditions of permit. A permit granted by the council hereunder shall be subject to the following conditions and to such other conditions as the council may deem necessary and expedient for the protection of health, safety and general welfare of the city: Agenda Page 60 A. Operation by permit holder only. It is unlawful for any person other than the person to whom the permit was issued to operate a motorized golf cart under this section. Any permit holder hereunder who is not a person with a mobility impairment shall not operate a motorized golf cart hereunder unless the person with the mobility impairment for whom the permit was issued is present in the motorized golf cart during operation thereof. B. Possession of permit. The permit holder shall have in possession at all times when operating the motorized golf cart and shall produce on demand of a peace officer a valid permit for operation of the motorized golf cart. C. Operation on designated streets. It is unlawful for any person to operate a motorized golf cart on any street designated as a prohibited street for such operation, unless it is necessary to cross such prohibited street because it intersects a permitted street. Any permit holder crossing a prohibited street that intersects a permitted street must do so at the marked intersection thereof. D. Compliance with state statute. The permit holder shall comply with the provisions of Minn. Stat. § 169.045, governing the operation of motorized golf carts permitted under provisions of the City Code. E. Effective liability insurance. The permit holder shall have liability insurance coverage in compliance with the provisions of Minn. Stat. §§ 65B.41-65B.71 in full force and effect when operating the motorized golf cart under this section. F. Nontransferability of permit. Any permit issued hereunder shall be nontransferable except upon application to and with the consent of the council. An application for the transfer shall be made as an application for issuance of the initial permit and shall conform in all respects with the provisions of this section governing the filing of the original application. The application for transfer is to be accompanied by a transfer fee as to be determined by the council by resolution. G. Operation prohibited within pedestrian walkways and parks. It is unlawful for any person to operate a motorized golf cart upon any sidewalk, trailway, path or other pedestrian walkway within the city or to operate such motorized golf cart at a speed in excess of 25 miles per hour. Subd. 6. Permit renewal. A permit hereunder may not be renewed unless an application for permit renewal is filed in accordance with the provisions of this section governing the filing of the original permit application. Subd. 7 Revocation of permit. Any violation of any provision of this section or any conditions of the permit issued hereunder or any misdemeanor and petty misdemeanor conviction of the permit holder under this section shall constitute grounds for revocation of a permit issued hereunder. Agenda Page 61 Eagan Minnesota Code: Sec. 8.10. - Utility vehicle operation on city streets. Subd. 1. Authority and scope. This section is adopted under the authority of Minn. Stat. §169.045, (2014 and as may be amended), and other applicable laws of the state. This section permits the operation of a utility vehicle, as defined herein, on specifically designated public streets, or portions thereof, under the city's authority pursuant to a valid permit issued by the city. This section does not apply to or authorize the operation of a utility vehicle on any state or county highway or roadway. The lawful operation of a utility vehicle under this section is subject to all the provisions herein. Subd. 2. Definitions. As used in this section, the following terms are defined as: All -terrain vehicle means a motorized vehicle of not less than three, but not more than six low pressure or non -pneumatic tires that is limited in engine displacement of less than 1,000 cubic centimeters and has a total dry weight of less than 1,800 pounds. Designated use district means a geographic area of which the boundaries are established by expressly designated city streets by resolution of council. One or more designated use districts may be established within the city by council resolution and any designated use district may be expand or reduced from time to time by council resolution. Mini truck means a motor vehicle that has four wheels; is propelled by an electric motor with a rated power of 7,500 watts or less or an internal combustion engine with a piston displacement capacity of 660 cubic centimeters or less; has a total dry weight of 900 to 2,200 pounds; contains an enclosed cabin and a seat for the vehicle operator; commonly resembles a pickup truck or van, including a cargo area or bed located at the rear of the vehicle; and was not originally manufactured to meet federal motor vehicle safety standards required of motor vehicles in the Code of Federal Regulations, a motor vehicle that meets or exceeds the regulations in the Code of Federal Regulations, title 49, section 571.500, and successor requirements. A mini truck does not include a neighborhood electric vehicle or a medium -speed electric vehicle; or a motor vehicle that meets or exceeds the regulations in the Code of Federal Regulations, title 49, section 571.500, and successor requirements Motorized golf cart means any 4-wheeled self-propelled vehicle whose top speed is not greater than 25 miles per hour and is designed to be used to provide transportation on a golf course. Utility task vehicle means a side -by -side, four-wheel drive, off -road vehicle that has four wheels, is propelled by an internal combustion engine with a piston displacement capacity of 1,200 cubic centimeters or less, and has a total dry weight of at least 1,800 but less than 2,600 pounds. Utility vehicle means a motorized golf cart, all -terrain vehicle, utility task vehicle and mini trucks. Subd. 3. Permit required. It is unlawful for any person to operate a utility vehicle upon any public street or highway, or any portions thereof, within the city unless said operation is pursuant to a valid permit issued by the city and in accordance with the terms and conditions of the permit. It is unlawful for any permit holder to operate a utility vehicle outside the designated use district or on any street within the designated use district that is not designated for utility vehicle use. Agenda Page 62 Subd. 4. Permit application. An application for a permit under this section, along with the permit fee, shall be filed with the city clerk. The application shall be on a form furnished by the city. The application shall include, but not be limited to, the following: A. The full name, date of birth and residential address of the person seeking the permit. B. The year, make, and model of the vehicle(s) and the vehicle identification number, if any, to be operated under the permit. C. The full name and address of the owner of each utility vehicle to be operated under the permit. If the owner is a business or legal entity, the registered name and registered address of the business or entity with the Minnesota Secretary of State. D. Identification of the designated use district for which the permit is sought. E. Identification of the reason(s) for which operation on city streets within the designated use district are necessary and the business or commercial use for which the operation serves. F. Proof of liability insurance coverage (in the form and amounts set forth herein) for the applicant and all utility vehicles to be operated under the permit. G. Any other and further information as the city deems necessary. Subd. 5. Insurance coverage. Prior to issuance of a permit, the applicant must file with the city clerk the following: A. A certificate of insurance, evidencing coverage for liability of the permit holder in compliance with the provisions of Minn. Stat. §§ 65B.41-65B.71; and B. A certificate of insurance evidencing coverage for liability of the owner of the utility vehicle(s) to be used under the permit issued hereunder. The certificate of insurance shall name the city as an additional insured and shall provide that the city be notified upon expiration or cancellation of the insurance coverage. Subd. 6. Issuance of permit. The city clerk shall have the authority to grant or deny a permit under this section. The city clerk shall deny a permit under this section for any of the following reasons: A. The permit applicant is not age 18 or older. B. The permit applicant is not an employee or agent of a business or commercial use within a designated use district or abutting a city street within a designated use district on which a utility vehicle may be operated. C. The operation of a utility vehicle on city streets, as to be identified in the application, is not for the necessary or required operations of the business for which the applicant is employed. D. The application is incomplete. E. The application contains false, fraudulent or deceptive statements. Agenda Page 63 F. Proof of liability insurance coverage, as required herein, has not been filed with the city clerk. G. The applicant has been convicted of a violation under this section. Subd. 7. One person permit. One permit shall be issued to one person; the permit shall apply to an individual, not the utility vehicle. Subd. 8. Conditions of permit. A permit granted hereunder shall be subject to the following conditions: A. Operation by permit holder only. It is unlawful for any person other than the person to whom the permit was issued to operate a utility vehicle under this section. B. Possession of permit. The permit holder shall have in his/her possession at all times when operating the utility vehicle and shall produce on demand of a peace officer a valid permit for operation of the utility vehicle. C. Compliance with state statute. The permit holder shall comply with the provisions of Minn. Stat. § 169.045. D. Effective liability insurance. The permit holder shall have liability insurance coverage in compliance with the provisions of Minn. Stat. §§ 65B.41-65B.71 in full force and effect when operating the utility vehicle under this section. E. Nontransferability of permit. Any permit issued under this section shall be nontransferable. F. Operation prohibited within pedestrian walkways and parks. It is unlawful for any person to operate a utility vehicle upon any sidewalk, trail, path or other pedestrian walkway. G. Speed limit. It is unlawful for any person to operate a utility vehicle at a speed in excess of 25 miles per hour. H. Times of operation. Utility vehicles may only be operated on designated streets or in a designated district from sunrise to sunset, unless equipped with original equipment headlights, taillights, and rear -facing brake lights. I. Operation prohibited in inclement weather. Utility vehicles shall not be operated in inclement weather or when visibility is impaired by weather, smoke, fog or other conditions, or at any time when there is insufficient visibility to clearly see persons and vehicles on the street at a distance of 500 feet. J. Equipment. All equipment required by state law for the utility vehicle must be in good, working condition at all times when such utility vehicle is in operation. K. Operation on permitted designated streets. Utility vehicle shall be operated only on permitted designated streets within the designated use district for which the permit was issued and it shall be the responsibility of the permit holder to know the permitted designated streets. Agenda Page 64 L. Safe operation. The permit holder shall operate the utility vehicle in accordance with all traffic laws as applicable to motor vehicles and shall operate in a safe and prudent manner. Subd. 9. Permit term and renewal. The term of a permit issued under this section shall be from the date of issuance to June 30 of the subsequent odd -numbered year. A permit hereunder may not be renewed unless an application for permit renewal is filed in accordance with the provisions of this section governing the filing of the original permit application. The permit shall automatically terminate when: A. The permit holder ceases employment with or is no longer working for the business or commercial operation for which the utility vehicle use was operated; or B. The liability coverage required under this section lapses or is canceled. Subd. 10. Revocation of permit. The following shall constitute grounds for revocation of a permit issued under this section: A. Any violation of any provision of this section or any conditions of the permit issued hereunder; B. Upon clear and convincing evidence that the permit holder cannot safely operate the utility vehicle due to physical conditions; C. Upon clear and convincing evidence that the permit holder failed to safely operate the utility vehicle. Subd. 11. Exception. This section does not apply to the use of a utility vehicle upon streets within the city by any of the following: A. An employee or contractor of the City of Eagan operating a city -owned or contracted vehicle; or B. A person with mobility impairment or any person assisting a person with mobility impairment to whom a permit was issued and as regulated elsewhere in the City Code. (Ord. The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Insurance means motor vehicle insurance which complies with the requirements set forth in Minn. Stats. § 65B.48, subd. 5. Motorized golf cart means a vehicle usually three or four wheeled which is self-propelled and is designed to be used to provide transportation on a golf course. Physically disabled person means any person meeting the criteria set forth in Minn. Stats. § 169.345, subd. 2 that qualifies for a certificate allowing the person to park in a parking space for the physically disabled. Slow moving vehicle emblem means a sign which complies with the requirements set forth in Minn. Stats. § 169.522. (Code 1965, § 130A.01) • Sec. 11-2-2. - Limitations. Motorized golf carts may be operated within the city limits but only as expressly provided in this section. Any use which is not expressly authorized by this section is prohibited. (Code 1965, § 130A.02) • Sec. 11-2-3. - Operator permits. (a) Persons wishing to operate motorized golf carts on public roadways must obtain a permit application from the city clerk. Permits shall be valid for one year from the date of issuance. (b) Conditions for issuance of a permit are as follows: (1) Applicant must possess a valid driver's license issued by the state or some other state or foreign country. Agenda Page 66 (2) If the applicant is physically disabled, the applicant must submit a certificate signed by a licensed physician that the applicant is able to operate a motorized golf cart on the roadways designated. (3) Applicant must submit a written description of the route which the applicant proposes to take from the place where the motorized golf cart is garaged to the golf course where the applicant intends to use the motorized golf cart. (4) Applicant must submit a signed affidavit asserting that the motorized golf cart to be used has been equipped with a rearview mirror and a slow moving vehicle sign. (5) Applicant must submit a signed affidavit that the motorized golf cart is covered by insurance. (c) If an applicant satisfies the above described conditions, the city shall issue a permit. (Code 1965, § 130A.03) • Sec. 11-2-4. - Operating regulations. (a) A person who has been granted a permit shall have the permit in possession while operating the motorized golf cart. (b) Motorized golf carts shall only be operated on the specific roadways which shall be approved for use by resolution of the city council. Operators may cross any street or highway which intersects a designated roadway. Roadways which are approved shall be listed on the permit issued to the operator. In addition, a list of permit holders and the roadways on which they may drive their motorized golf carts shall be kept on file in the office of the city clerk. (c) Motorized golf carts may only be operated from sunrise to sunset. Motorized golf carts may not be operated during inclement weather or when visibility is impaired by weather, smoke, fog or other conditions or when there is insufficient light to clearly see persons and vehicles on the roadway at a distance of 500 feet. Agenda Page 67 (d) Motorized golf cart operators must obey all traffic laws while operating a motorized golf cart which can reasonably be applied to motorized golf carts. However, Minn. Stats. ch. 168, dealing with motor vehicle licensing provisions, shall not apply. In addition, with the exception of Minn. Stats. § 169.70 requiring a rearview mirror, laws governing vehicle equipment also shall not apply. (Code 1965, § 130A.04) • Sec. 11-2-5. - Penalties. (a) Violation of any of the requirements of this chapter is a misdemeanor punishable by up to 90 days in jail, a fine of up to $1,000.00, or both. (b) In addition to any criminal sanctions, the permit may be revoked if any of the following conditions occur: (1) The city is notified by any court that a permit holder was convicted of violating a state or local traffic law other than a parking law while operating the motorized golf cart. (2) An applicant is found to have made fraudulent representations in a permit application. (3) The city is notified by a physician that the applicant can no longer operate the motorized golf cart safely. Definitions. Unless the language or context clearly indicates that a different meaning is intended, the following terms shall have the following meanings: a. Motorized Golf Cart - a vehicle usually three or four wheeled, which is self, propelled and is designed to be used to provide transportation on a golf course. b. All -Terrain Vehicle (ATV) - Class 1 ATVs are motorized flotation -tired vehicles with at least three but no more than six low pressure tires that have an engine displacement of less than-1000 cubic centimeters and total dry weight of less than 1000 pounds. c. All -Terrain Vehicle (ATV) - Class 2 ATVs are motorized flotation -tired vehicles with at least three but no more than six low pressure tires that have an engine displacement of less than 1000 cubic centimeters and total dry weight of 1000 to 1800 pounds. d. Insurance - motor vehicle liability insurance, which complies with the requirements set forth in Minn. State Statutes. If a person cannot obtain liability insurance in the private market, that person may purchase automobile insurance, including no-fault coverage, from the Minnesota Automobile Insurance Plan at a rate to be determined by the commissioner of commerce. e. Slow moving vehicle emblem - a sign, which complies with the requirements set forth in Minn. Stat. § 169.522. f. Physically disabled person - any person meeting the criteria set forth in Minn. Stat. § 169.345, Subd. 2 that qualifies for a certificate allowing the person to park in a handicapped -parking space. g. Motorized Golf Cart and ATV dealers - any business that regularly sells golf carts and ATVs. Section 2. Limitations. a. Motorized golf carts and ATV may be operated within Minneota City limits but only as expressly provided in this section. Any use that is not expressly authorized by this section is prohibited. 1 Agenda Page 69 Example: Driving on designated walking/bike trails, driving on city dikes, driving on sidewalks, driving on street boulevards, snowmobile trail, and State Highways. Exceptions: Emergency vehicles in the course of their duties and vehicles authorized by the city. Section 3. Operator Permits. a. Persons wishing to operate motorized golf carts or ATV on public roadways must obtain application from the city police department and shall be issued by the city clerk. The city council will set a reasonable fee to cover the cost of issuing such permits. b. Conditions for issuance of a permit are as follows: 1) Persons at least sixteen (16) years of age and holding a driver's license recognized by the State of Minnesota as permitting the operation of motor vehicles in the state are eligible for permits. A permit issued under this section shall be valid during the time and under the circumstances that the holder's driver's license would allow operation of a motor vehicle in the State of Minnesota. Persons not holding a driver's license may apply for an initial or renewal permit. Applications shall be accompanied by a certificate signed by a physician stating that the applicant is capable of safely operating a motorized golf cart or a four-wheel all - terrain vehicle on the roadway or streets. 2) Applicant's Golf Cart or ATV must be equipped with a rearview mirror. 3) Applicant's Golf Cart or ATV must have a reflective slow moving vehicle sign on the rear of the vehicle. 4) Applicant's Golf Cart or ATV must have current vehicle insurance. 5) All Golf Carts and ATVs will have mufflers. 6) Each golf cart and ATV will be issued its own permit. Permits issued to dealers may be transferred for the purpose of test-driving a vehicle. However, vehicles used for the operation of a business will have their own permit. 7) All vehicles will be inspected by the police department at time of initial application for that particular vehicle. c. If an applicant satisfies the above -described conditions, the city shall issue a permit. Permits will be valid for the calendar year in which they were issued. Permits will be issued throughout the year however permits will not be prorated for being purchased for less than twelve months. 2 Agenda Page 70 Section 4. Oneration. a. A person who has been granted a permit shall have the permit displayed on the Golf Cart or ATV. The permit will be placed on the rear of the Vehicle in such a fashion as to be visible to following vehicles. b. Motorized golf carts and ATVs shall only be operated on city owned streets, alleys, and county roads or county state -aid highways located within the boundaries of the city. Golf carts and ATV's are permitted to cross State Highway 68. c. Golf carts may not be operated during inclement weather or when visibility is impaired by weather, smoke, fog or other conditions or when there is insufficient light to clearly see persons and vehicles on the roadway at a distance of 500 feet. d. ATVs may not be operated during inclement weather when the conditions causing them to lose traction or slide or when visibility is impaired by weather, smoke, fog or other conditions or when there is insufficient light to clearly see persons and vehicles on the roadway at a distance of 500 feet. e. Motorized golf cart and ATV operators must obey all traffic laws which can be applied to motorized vehicles. Golf Carts and ATV's may not travel at a speed on excess of 15 MPH. f. Physically disabled persons wishing to park in marked handicap parking spaces are required to display their state issued handicap -parking permit. g. A permit may be revoked at any time if there is evidence that the permittee cannot safely operate the motorized golf cart or all -terrain vehicle on the designated roadways. The city may require, as a condition to obtaining a permit, that the applicant submit a certificate signed by a physician that the applicant is able to safely operate a motorized golf cart or all -terrain vehicle on the roadways designated. h. Golf Carts and ATV's not equipped with brake lights or turn signals must use appropriate hand signals as defined by Minnesota State Statute 169.19 Subd. 8. i. This ordinance is not all-inclusive. Operators of ATV's need to comply with all Off Road Vehicle laws, which are available for review in the MN Department of Natural Resource Off -Highway Vehicle Regulations Manual. Section 5. Limitation of Liability a. Nothing in this chapter shall be construed as an assumption of liability by the city for any injuries to persons or property which may result from the operation of a motorized golf cart or ATV by a permit holder or the failure by the city to revoke the permit. 3 Agenda Page 71 Section 6. Mayor and Council Request for Action December 7, 2020 SUBJECT: PLANNING DEPARTMENT - INTERIM MORATORIUM ON THRIFT STORES RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: MOTION TO: Adopt Resolution No. 2020-041, adopting an Interim Ordinance establishing a Moratorium on new Thrift Stores within the City of Albertville. BACKGROUND: The City's zoning ordinance currently does not specifically address thrift stores, which would possibly place them under a general retail category of uses. However, since thrift stores often encompass several stages of operations, including intake of donated goods, sorting and processing of such goods, disposal of large amounts of waste and sale of marketable items, they are often viewed as having characteristics that do not fit well into a general retail zoned area. In addition, many thrift operations have caused traffic backups from cars waiting in line to donate items that impact traffic circulation on site as well as traffic circulation on adjacent roadways, necessitating additional regulation that is not normally found in a commercially -zoned district. Minnesota law allows the City to put a moratorium on specific uses for a one-year period while the City studies the need for new regulations. This gives the City time to consider potential changes without worrying about an application coming in before the City has time to fully consider the issues involved. Once the new changes are enacted, or if the City decides no changes are needed, the City can terminate the moratorium. If not terminated by the City, the moratorium will expire on its own in one year. The moratorium would prohibit new thrift operations from being established while the moratorium is in effect. KEY ISSUES: • Albertville's zoning ordinance does not directly address thrift stores. • Thrift stores may present unique challenges not normally seen in commercially -zoned district. • A moratorium will give the Planning Commission and City Staff the time needed to determine what changes to the City's zoning ordinance, if any, should be made regarding thrift stores. POLICY/PRACTICES CONSIDERATIONS: The moratorium would last one year or less and would only impact new thrift operations. The attached resolution enacts the ordinance, so passage of the resolution by motion would also enact the ordinance without the need for a second motion on the ordinance. The City Council of The City of Albertville Ordains as Follows: Section 1. Intent. It is the intent of this Interim Ordinance to allow the City of Albertville to complete review of the presently existing Comprehensive Plan and Ordinances in relation to the establishment and operation of thrift stores, and to make appropriate changes in the same in order to protect the value of properties within the City of Albertville, to insure proper land use controls, and to facilitate compatibility between such property and the surrounding property. Section 2. Authority and Purpose. The City Council is empowered by Minn. Stat. 462.355, Subd. 4 to pass an interim ordinance, applicable to all or a portion of its jurisdiction, for the purpose of protecting the planning process and the health, safety, and welfare of its citizens. Section 3. Temporary Prohibition. For one year after the effective date of this ordinance, or until such earlier time as the Albertville City Council determines by resolution that the reasons for the moratorium no longer exist: A. "Thrift stores" shall mean a shop that sells used articles of clothing or other used household goods such as furniture, decorations, and kitchenware, whether such shop shall be operated for profit or for the benefit of a charity. B. No thrift stores or thrift store operations shall be established within the City of Albertville, and no new applications for the establishment of a thrift store within the City shall be accepted or processed. Section 4. Misdemeanor. Any person, persons, firm or corporation violating any provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished pursuant to Minn. Stat. 609.02, Subd. 3, or as subsequently amended, plus costs of prosecution. Section 5. Injunctive Relief. In the event of a violation of this ordinance, the City may institute appropriate actions or proceedings, including requesting injunctive relief to prevent, restrain, correct, or abate such violations. City UF- Y December 7, 2020 SUBJECT: LEGAL — REPLACE TI WITH FIBER CONNECTION RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: MOTION TO: Direct staff to move forward with the replacement of the TI line with Fiber and approve Right of Entry Agreements with Arvig for City Hall and the Depot. BACKGROUND: In 2007, City Hall was too far away from a demark to get high speed internet via cable, there was no fiber run in the City and the only option was to install a T1 with a 3Com wireless system to connect the buildings. In 2010, the City of Albertville added the STMA Ice Arena to the wireless connection of the buildings. Later that year, the STMA School District installed fiber down Main Avenue NE. As part to that project, Albertville added 12 fiber lines and handholes for a future fiber network for the City. In 2013, the City installed I Gigabyte fiber to city buildings and therefore connecting them all to the phone system, server and internet and leaving the T1 36 Megabyte system as a back up incase of fiber cuts or failure. This past year, 2020, we have experienced several fiber cuts/failures which cause the phones and internet to switch over to the T1. Recently, Sourcewell (aka Ties) who provided the original internet service through the fiber closed that part of their business service and no longer provide internet. STMA School District switched from Sourcewell to Arvig and recommends the City make the change. In the summer of 2020, the City did switch over from Sourcewell to Arvig. There were discussions with Arvig on replacing the T1 with fiber. Arvig proposed to install a secondary fiber line to replace the T1 leaving the City with a very low chance of being down and leaving a 1 Gigabyte fiber connection at all times. For the installation of the fiber connections needed to make a separate secondary connection there is no cost to the City, Arvig is taking care of that. Removing the T1 and changing the contract from Nextera to Arvig shows a S1,000 operational cost savings annually. KEY ISSUES: • Authorizing Arvig Right of Entry to City Hall • Authorizing Arvig Right of Entry to the Depot • Authorizing Arvig Right of Entry to STMA Arena (old rink). Arvig shall bear all costs and expenses to repair any damage to the Property caused by Arvig. No Party shall be liable to any other Party for any punitive, special, indirect or consequential damages or lost revenues, rent or profits arising out of this Agreement, even if any of the Parties have been informed of the possibility of such damages. 3. Each Party will indemnify the other Parties for any costs, expenses, claims or liabilities for property damage or personal injury occurring at the Property, directly caused by such indemnifying Party's negligent act or omission, including in relation to the installation, maintenance, use, operation, protection, repair, or removal of the System, as applicable, provided however, that Grantor shall only be required to indemnify Arvig up to the maximum municipal tort liability limits set forth in Minn. Stat. 466.04, as it may be amended from time to time. 4. Arvig may access, maintain, upgrade, modify or remove their Systems on a 24/7 basis by providing reasonable advance notice and coordinating such activities with the Grantor. Mayor and Council Request for Action December 7, 2020 SUBJECT: LEGAL DEPARTMENT - MAINTENANCE OF PRIVATE ROAD SERVING ALBERTVILLE PLAZA RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: MOTION TO: Either terminate the existing agreement to maintain the private road serving Albertville Plaza properties or direct Staff to negotiate a new contract to maintain the private road. BACKGROUND: In 2001, the PUD and plat for Albertville Plaza was approved (this plat contained the Culvers, KB Toys, and ultimately Goodyear Tire lots). The service road in the plat was private (there is no public easement over the private road), and the City at the time agreed to maintain the road for the properties in the plat via a maintenance agreement under which the owners would reimburse the City for the maintenance provided. Since the road was constructed in 2001, the City has been performing all maintenance on the sewers, water, pond and road, including patching and plowing of the road. All costs have been billed back to the properties and the City has been fully reimbursed for all costs spent to date. The maintenance agreement allows the City to terminate its maintenance obligations any time after March 1, 2016, provided it gives the owners one year's notice prior to termination. If the City terminates the Maintenance Agreement, the property owners are required to create an entity (presumably a property owners' association) to maintain the sewers, water, pond and road. At this point, the road is nearly 20 years old and is in need of major reconstruction at a significant cost to the property owners and with a significant temporary disruption to traffic flow. The City has continued to patch this road but it is getting to the point where it is not cost effective to continue patching into the future. Staff has identified three alternatives to address this situation: Option 1. Terminate the Agreement and let the property owners establish a property owners' association for the maintenance of the road, pond and utilities. Pros: Less maintenance responsibility for the City and no financial risk as the City does not have to try to collect relatively large sums from each property owner for the reconstruction of the road. Cons: Increases the likelihood that road will not be properly maintained in the future if the Association is either not established or is established but one or more property owners does not financially pay their share of the maintenance cost to the Association; also increases the likelihood that sanitary sewer and water utilities will not be properly maintained. 2. Option 2. Revise the Agreement such that the City maintains the sanitary sewer and water utilities as it does for nearly all other properties in the City ensuring that the underground infrastructure that can affect the fire hydrants and inflow and infiltration into the City's Agenda Page 84 Mayor and Council Request for Action — December 7, 2020 Maintenance of Private Road Serving Albertville Plaza Page 2 of 2 wastewater treatment plant is properly maintained. Pros: Utility infrastructure remains properly maintained. Cons: Increases the likelihood that road will not be properly maintained in the future if the Association is either not established or is established but one or more property owners does not financially pay their share of the maintenance cost to the Association 3. Option 3. Keep the Agreement in force and continue to maintain the utilities and road at the property owners' expense. This would likely require some sort of modification to the Agreement to address advance payment for the reconstruction project before the City undertakes the reconstruction. Pros: All infrastructure and the road will be maintained to City standards in the future. Cons: The City will have to receive payment from the property owners in advance before rebuilding the road. If the road is not rebuilt, the road will require an increasing amount of City maintenance time and will continue to deteriorate. In that case, the City may be forced to terminate the Agreement at some point as the road becomes increasingly difficult and expensive to maintain. KEY ISSUES: The road is a private road that the City has agreed to maintain from its construction in 2001. The road needs major reconstruction. Does the City want to undertake this reconstruction project? POLICY/PRACTICES CONSIDERATIONS: The City is under no obligation to maintain the road if it does not want to, but the City is likely in the best position to perform day to day maintenance. While the City could undertake the road reconstruction project, it will require the owners to prepay the cost of the construction and will consume a significant amount of staff time bidding and administering the construction contract. FINANCIAL CONSIDERATIONS: Assuming the City requires payment from the property owners in advance of any work (including engineering design), all City costs would be fully reimbursed. In that case, none of the options listed above should have a financial impact upon the City. LEGAL CONSIDERATIONS: The Agreement is currently binding upon the property owners and the City, but can be terminated by the City with one year's notice to the property owners. A modification of the current agreement would only be effective if all property owners agreed to the modification. Of the five lots, three lots are currently owned by one company, with two different companies each owning one of the two remaining lots. All three lot owners would have to agree to any modification of the current Agreement. Said Plat consists of Lots I through 3, Block 1, and Outlot A. If Outlot A is subsequently replatted into one or more lots, it shall include such replatted Outlot A. C. PROPERTY. Property means the real property within the Plat owned by the Owner. SANITARY SEWER Sanitary sewer shall mean all sanitary sewer pipes and appurtenances constructed in the Plat but shall not include the stubs to the individual lots within the Plat. Streets shall mean those roadways installed in the Plat as presently reflected on the Plat together with any additional roadway that may hereafter be constructed on Outlot A. The legal description for the area for streets is set forth on Exhibit B. f. STORM SEWER. Storm sewer shall mean all storm sewer pipes and appurtenances constructed in the Plat. It shall also include any subsequently installed storm sewer as part of any replatting of Outlot A. MAINTENANCE BY CITY. The City shall maintain, repair, and replace the sanitary sewer, storm sewer, streets, storm water ponds, and water main in the same manner and with the same degree of care as if they were owned by the City. Such maintenance shall include snow removal, street sweeping, and other maintenance and repair typically performed by the City. 3. MAINTENANCE COSTS. The City will bill the Owner for its costs of performing the services under this Agreement on a quarterly basis. Such costs shall be reasonable and in proportion to the actual costs of the City performing such services. If any such payment is not made, the City may certify to Wright County the amounts due and payable with real estate taxes in the next calendar year; the parties agree that such certifications may be made under Minnesota Statutes, Chapter 444 or Chapter 429 in a manner similar to certifications for unpaid utility bills. The Owner hereby waives any and all procedural and substantive objections to the imposition of such charges on the respective lots. Further, the Owner hereby waives any and all procedural and substantive objections to special assessments for the aforementioned reasonable costs, including, but not limited to, notice and hearing requirements, and any claims that the charges or special assessments exceed the benefits to the lot. The Owner waives any appeal rights otherwise available pursuant to Minnesota Statutes Chapter 429.081. 4. INDEMNIFICATION OF CITY. Owner shall indemnify, defend and hold the City, its council, agents, employees, attorneys, and representatives harmless against and in respect of any and all claims, demands, actions, suits, proceedings, losses, costs, expenses, obligations, liabilities, damages, recoveries, and deficiencies including interest, penalties, and attorney's fees, that the City incurs or suffers which arise out of, result from, or relate to the City's performance of its duties hereunder. 5. ADJOINING PROPERTY. As a condition of approving the Plat and entering into this Agreement, the City has required that the adjoining property legally described in the attached Exhibit A have the right to connect to the streets located in the Plat at the option of the Owner of said adjoining property and the City. If such adjoining property utilizes the streets, then the City shall reallocate the costs of maintenance of the streets set forth in Paragraph 3 above to account for the use by the owners of the adjoining property. 6. TERMINATION OF AGREEMENT. The City may terminate this Agreement at any time after March 1, 2016 by giving the Owners one (1) year notice of such termination. The Owners shall have six (6) months from the time of such notice to form a legal entity in which all of the Owners have joined to carry on the maintenance obligations of this Agreement. Such entity and the terms of such maintenance obligation shall be subject to the approval of the City and appropriate documents shall be recorded with the Wright County Recorder to reflect such new agreement. If the Owners fail to take such action within six (6) months, the City shall form a legal entity for the Owners, which such entity shall be obligated to assume all maintenance, repair and replacement duties delineated in paragraph 2 above, and in such event, the Owners appoint the City as their attorney -in -fact for purposes of executing all necessary documentation to create said legal entity and obligate the Owners to reimburse said entity for all costs incurred by said entity in performing its duties under paragraph 2 above. In the event the City must form this entity, Owners agree to pay all costs, including all applicable attorney's fees, the City incurs related to the creation of said entity. It is understood the final plat and will come to Council in February. As part of the project, the Applicant is seeking TIF and DEED assistance. Bonding Bill: Albertville's WWTP Improvement project was included in the bonding bill for $2,500,000. Staff will be reviewing design and construction schedule requirements and funding options. The tentative project schedule is to complete preliminary design by March, final design by August, and bid in Sept/Oct with a projected construction start in Nov. 2021. City Hall Modifications: Front office and HVAC modifications at city hall are complete. The front counter window will be installed later this winter. Towne Lakes 61h Townhomes: The townhomes in the 6th Addition are required to be owner occupied. The development agreement requires the developer to file a deed restriction on each lot that prohibits rental of any of the units, which is not a requirement of the HOA. Earlier this month the city learned the developer had not recorded the deed restrictions on any of the lots. This has created issues for buyers who purchased with the intentions to rent. Website Rebuild: The contract with Granicus has been executed and work on the website underway. We expect to launch the new website late-spring/early summer of 2021. STMA Arena: The arena is currently closed to the public. Staff is working on the HockeyTV. ENGINEERING/PUBLIC WORKS 2021 Street Project: The 2021 street project will be presented to Council in January. Local Road Improvement Program: MnDOT recently announce the solicition for the 2020 LRIP. Applications are due on March 3 and awards will likely be announced in May. Staff believes Barthel Industrial Drive may be a good candidate and will be researching further. BNSF Quite Zone Study: We are working the preliminary engineering report to present at a future meeting. 1-94 Project: Staff continues to work with MnDOT on a number of drainage and utility relocating items. Next week I will be meeting with MnDOT and their Contractor/Designers to discuss options to eliminate the Creamery Pond. Agenda Page 92 581h Street NE and Central Park Improvements: Staff is working on the Source Well contract for the skate park. Construction of the skate park is scheduled to begin in the spring. CSAH 19 and 70th Street: Construction and landscaping is generally complete for the year. Final restoration and punchlist related work will be completed in the spring.
