6. Wright County Sheriff's Office — Updates, reports, etc.
Chief Bullen, Nafstad and Mayor Hendrickson noted the excellent work and of the Sheriff's
Department, especially the past week. The Council agreed.

1). Committee Updates (STMA Ice Arena, Planning, JPWB, Parks, Fire Board,
FYCC, etc.)
Council member Olson reported on the recent Parks Committee meeting and noted the
Committee is working on potential playground areas for Central Park, as well as, prioritizing
future park improvements.
B. Planning/Zoning
1). Outdoor Dining Emergency Provisions (pgs 18-23)
Brixius presented the proposed Interim Ordinance. Nafstad clarified the 50 people is per the
State's executive order. Cocking questioned if this was the best and most expansive the city
could do for the business owners. Brixius responded that he believed it was and having the
ability to approve administratively would allow expedite the process. There was further general
discussion on the interim ordinance. Olson inquired if the ordinance would change as the
executive orders change (become less restrictive). Following discussion it was suggested the
ordinance be revised to include language that terminates the ordinance the sooner of I -year from
the date of passage, or when revoked by the city council. Couri noted this is an interim
ordinance and does not need to be published.
Mayor Hendrickson inquired if businesses could apply for a loan from the city. Nafstad stated
the city has approximately $150,000 that the City could use for economic development related
programs.
Motioned by Hailing, seconded by Olson, to Adopt the Interim Ordinance 2020-03, as
amended. Ayes: Hendrickson, Cocking, Hailing, Hudson and Olson. Nays: None. Absent:

1). Letter of Resignation - City Clerk
Nafstad presented Kim's resignation letter. Halling inquired about the appointment of a deputy
clerk at a previous meeting and asked if staff new that this was coming at this time. Nafstad
replied that the deputy clerk appointment was needed do to staff working remotely. Couri stated
employee issues cannot be discussed in a public meeting.
Motion by Cocking, second by Hailing, to confirm the resignation of Kimberly Hodena's
resignation from the position of the Albertville City Clerk Ayes: Hendrickson, Cocking,
Hailing, Hudson and Olson. Nays: None. Absent: None. MOTION DECLARED
CARRIED.
2). City Administrator's Update
Nafstad noted the personnel committee will be working to fill the city clerk position.
Nafstad said he the Fire Chief will be working on various COVID reopening plans and hopes to
open City Hall's front counter on June 15.
There was general discussion on COVID related issues, elections, public meetings, etc.
Chief Bullen briefly reviewed the city's re-entry and preparedness plan.
Nafstad reviewed active construction projects and explained undergrounding the overhead
electric as part of the park project was not feasible at this time.

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the

BACKGROUND: The City processes claims on a semi-monthly basis. The bills are approved
through their respective departments and administration and passed onto the City Council for
approval.
KEY ISSUES:

key issues will be presented in the claims listing document.
POLICY/PRACTICES CONSIDERATIONS: It is the City's policy to review and approve
payables on a semi-monthly basis.
FINANCIAL CONSIDERATIONS: City staff has reviewed and recommends approval of
payments presented.
LEGAL CONSIDERATIONS: The Mayor and Council have the authority to approve all bills
pursuant to Minnesota State Law, which requires all bills to be paid in a timely manner,
generally within 30 days unless one party deten-nines to dispute the billing.

RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO: Approve a Special Event Permit for 10904 571h St NE for July 2" d, 2020
BACKGROUND: The applicant would like to hold a Birthday Party Event, on private property,
in the parking lot at 10904 571h Street Ne on July 2, 2020 from 6-9PM. He has estimated a total
of 50 people at this gathering, adults only, no children. They are going to have minor outdoor
music and possibly a mobile food unit. They are following recommendations to be socially
responsible by having this gathering in a big enough space to allow for social distancing and this
space allows them to do so. The applicant has signed approval from the property owner.
The applicant was considering allowing alcohol at the event but is not proceeding following a
discussion with the City Attorney.
Staff is recommending approval of the special event permit with the following conditions:
CONDITIONS:
Allow Fire Department access to all fire hydrants and Fire Department Connection.
o No parking or tents in the first row of parking spots on the east side of the
building. (see attached diagram).
Follow recommendations from the StaySafeMN order as it relates to outdoor gatherings.
Applicant shall be responsible for trash collection and removal at the end of the event.

e Food Units U's Criteria:
MFU's must be licensed by the Minnesota health department, and must adhere to state
regulations for food trucks as provided in food code chapter 4626.1860 mobile food
establishments; seasonal temporary food stands; seasonal permanent food stands.
Evidence of the state license must be provided to the city as part of the local license
application.
0 MFU's operations are limited to the business, industrial, and public/ institutional
districts, and are not permitted between the hours of ten o'clock (10:00 ) P.M. and
eight o'clock (8:00) A.M. Ice Cream truck vendors may operate in all zoning districts,
but must adhere to the described hours of operation.
Trash and/or recycling collection and cleanup must be provided.
�✓ MFU's must provide independent power supply which is screened from view.
Generators are permitted.
MFU's may not maintain or use outside sound amplifying equipment, televisions or
other similar visual entertainment devices, lights or noisemakers such as bells, horns
or whistles. Ice cream trucks traveling through a residential district may have
outdoor music or noisemaking devices to announce their presence.
MFU's cannot obstruct the movement of pedestrians or vehicles or pose a hazard to
public safety.

MFU's may not be located within two hundred feet (200') of existing restaurants or
coffee shops, as measured from the MFU to the food service building. However MFU's
may be permitted within two hundred feet (200') of existing food establishments
within the same shopping center, with permission from the shopping center's owner.

Music will have a small speaker. The locations I put on the info I sent you. Everything will be on the North East part of
the lot where there is a big empty lot for parking and our parking lot for people to sit in chairs. This is just a social
event. No payment for anything. I m throwing a birthday party for my employee/wife's birthday. We are trying to be
socially responsible by providing enough space for people to socially distance. If we do it in my private yard, that will
most likely be impossible. If this won't work we will just do it at my house. We will only be providing a cooler with
pop, water and beer paid by me. Basically just like you would see at a grad party. It is adults only. No kids.

Adam,
I have been in touch with the State Alcohol Enforcement Division to confirm that in fact a consumption and display
permit is required by state law if intoxicating alcohol (beer stronger than 3.2% alcohol) is served on a business
premises. If Matt Fitch serves beer to his guests at a party held at the business premises of Fitch & Strong Group, he will
need to obtain a consumption and display permit. The license fee for a consumption and display permit is $250.
As an alternative, Matt can use a food truck that has a caterer's license and have the caterer serve the alcohol, in which
case he would not need any license from the City. I called Matt earlier today and informed him of the license
requirement and the caterer's option. He will check with the food truck he is working with and will also look at other
options.

A RESOLUTION ESTABLISHING THE
ABSENTEE BALLOT BOARD FOR THE 2020 PRIMARY ELECTION AND
GENERAL ELECTION
WHEREAS, a State Primary Election will be held on Tuesday, August 11, 2020 and a
State General Election will be held on Tuesday, November 3, 2020, and;
WHEREAS, the City of Albertville is the responsible authority to conduct absentee
voting for such election and is required by Minnesota Statutes 203B.121, Subd. 1 to establish an
Absentee Ballot Board effective June 26, 2020, and;
WHEREAS, this board will bring uniformity in the process of accepting or rejecting
returned absentee ballots in Albertville, and;
WHEREAS: the Absentee Ballot Board will consist of a sufficient number of election
judges, as determined by the City Clerk, as provided in sections 20B.19 to 204B.22, and;
WHEARAS, the City Clerk shall have the authority to appoint additional election judges
as the need occurs; and,
NOW, THERFORE, BE IT RESOLVED, the Albertville City Council hereby establishes
an Absentee Ballot Board consisting of the persons named in Exhibit A.
Adopted by the City Council of the City of Albertville this 15te day of June, 2020.

A RESOLUTION APPOINTING ELECTION JUDGES
FOR THE 2020 PRIMARY AND GENERAL ELECTIONS
WHEREAS, the City Council is required by Minnesota State Statute 204B.21, Section 2,
to officially approve the appointment of election judges; and
WHEREAS, the Albertville City Council hereby adopts the judges listed on Exhibit A,
hereto attached, as the Official 2020 Election Judges for the August 11, 2020 Primary Election
and the November 3, 2020 General Election, with the understanding that amendments may be
necessary to the appointments in order to fill vacancies and meet party balance requirements, and
WHEARAS, the City Clerk shall have the authority to appoint additional election judges
as the need occurs; and,
NOW, THEREFORE, BE IT RESOLVED, the City Council appoints the individuals
listed on Exhibit A, hereto attached, the 2020 Primary and General Election at a rate depending
on qualifications.

GENERAL ADMINISTRATION
City Clerk Position: The position will be advertised and interviews are expected to take place in
mid -July.
Pandemic Response: Staff is developing a Pandemic Re-entry and Preparedness Plan per State
requirements and will be working to implement the plan in the coming days.
Parks Committee: The Parks Committee will seek interested parties for the vacant seat on the
committee and offer a recommendation to the City Council at a future meeting.
Central Park Shelter: Work on the shelter will resume in the coming weeks.
2020 Elections: Work is ramping up for the 2020 Primary Election on August 11. Absentee
voting will begin on June 26. Staff is in the process of ordering supplies, adapting the absentee
areas to fit COVID-19 guidelines, training and other preparations.
ENGINEERING/PUBLIC WORKS
1-94 Project: We are working with MnDOT and the construction group on a number of utility
conflicts with the proposed pond on the old creamery site.
Kwik Trip: Kwik Trip is progressing well and working towards a July completion.
Goddard School: It is our understanding construction will begin the second week of June.
WWTP Forcemain Project: The contractor is working on a number of restoration items and will
be completing the project this month.
2020 Overlay: The contractor is working on the 51 Street cul-de-sac and spot curb replacement
throughout the project area. Street patching will begin next week. Milling and overlaying are
scheduled for early July.
58th Street NE and Central Park Improvements: The project has been awarded and we are
working on contracts.
CSAH 19 and 70th Street: Work is occurring throughout the project corridors. 70th Street will
be paved the week of the 15tn
