Our agent for the LGU, Mr. Dan Donayre of Bolton & Menk, Inc., along with Mr. Karl Hammers of the Wright County SWCD reviewed the delineation on October 5, 2007. Mr. Donayre and Mr. Hammers agreed with the boundaries of the wetlands staked and reported in the report. The report refers to these wetlands as incidental. After a FSA aerial photo review conducted by Mr. Hammers, there is no indication of these wetlands existing prior to construction surrounding the site, qualifying these wetlands for an incidental exemption. If further action is considered, please be advised that you are required to follow the rules set forth by the Minnesota Wetland Conservation Act. Please also note that the U.S. Corps of Engineers (COE) has a separate, federal role in wetland issues in Minnesota. We recommend you forward any delineation documentation to Dan Seemon, the local COE representative to ensure COE concurrence. Please be advised that any wetland activity that is approved by the City of St. Francis is in accordance with the Minnesota Wetlands Conservation Act; the COE provides permitting in accordance with federal laws. NOTE: Approval of Wetland Replacement Plan Applications involving the use of wetland banking credits is conditional upon withdrawal of the appropriate credits from the state wetland bank. No wetland impacts may commence until the applicant receives a copy of the fully signed and executed "Application for Withdrawal of Wetland Credits," signed by the BWSR wetland bank administrator certifying that the wetland bank credits have been debited.
