1. Call to Order
Mayor Hendrickson called the workshop to order at 6:15 pm.
Present: Mayor Hendrickson, Councilmembers Cocking,Hudson, Olson and Zagorski.
Staff Present: City Administrator-PWD Nafstad, Finance Director Lannes and City Clerk Luedke.
Others Present: STMA Superintendent Dr. Foucault, and STMA Director of Business Services
Crocker.
2. STMA School District Finance Presentation
STMA Director of Business Services Crocker presented information on STMA School District's
current finances, the 2022 and 2023 preliminary budget projections and the creation of an operating
referendum steering team tasked with exploring a possible levy for this year. She said that STMA
School District is the least funded district per student revenue in the state and answered questions
from Council.
STMA Superintendent Dr. Foucault provided information on the steps that the school district has
already taken to reduce expenses,why the operating referendum was being considered and possible
question options if the operating levy is held this November. She answered questions from Council.

Councilmember Zagorski provided an update from the Planning Commission meeting which included
information from the Preserve At Albertville's public hearing.
2. The Preserve At Albertville—Amend Zoning Map, Creation of PUD Zoning
District, Preliminary Plat and Building Plan Review
City Planner Brixius presented the staff report which included information from the Planning
Commission meeting, details on the project and the proposed zoning map amendments. He also
provided information on the creation of the PAA-PUD zoning district including the conditions to be
followed and answered questions from Council.
Mr. Ian Peterson, Integrate Properties, provided an overview of project along with specifics on the
preliminary plat and the PUD conditions. He answered questions from Council regarding the tentative
project schedule, proposed home designs and the rental opportunities.
City Administrator Nafstad and City Attorney Couri answered questions from Council regarding the
project,traffic impacts to the area,the developer's contract and possible future ownership changes.
Finance Director Lannes answered questions from Council regarding the City's utility billing process.
There was much Council discussion regarding the traffic study conducted, the proposed home design,
the rental opportunities and possible individual future sale of the homes.
City Planner Brixius provided language for amendments to the Resolution to address the possibility of
the lots being individual sold in the future.
MOTION made by Councilmember Cocking, seconded by Councilmember Hudson to adopt
Resolution No. 2021-029 approving the request of Integrate Properties for a Zoning Map Amendment,
Zoning Text Amendment, Preliminary Plat and PUD development stage site and building plans for the
project entitled Preserve at Albertville as amended. Ayes: Cocking, Hendrickson, Hudson, Olson and
Zagorski.Nays: None. The motion carried.
Councilmember Hudson excused himself from the meeting due to a work obligation at 8:16 pm.

B. Building
1. Lawn Maintenance Policy Discussion
City Administrator Nafstad presented the staff report which included the current lawn maintenance
policy,the fees the City charges for staff time and equipment usage and the number of weed letters
issued per year. He answered questions from Council and stated that no action is required for this item.
Public Works Supervisor Guimont provided additional information on the current policy and the
procedures the City uses for handling non-compliant properties.
Finance Director Lannes answered questions from Council regarding the City's fees.
There was Council discussion regarding the lawn maintenance policy and possibly raising the current
City fees to detour property owners from taking advantage of the City mowing their property.
C. City Clerk
1. Major Temporary Outdoor Music Permit for Residential Property
City Administrator Nafstad introduced the item and provided information on the outdoor music permit
application submitted for a residential location. He answered questions from Council.
City Planner Brixius provided the background information on the City Code section 5-5-3 regarding
outdoor musical performances and answered questions from Council
Mr. Justin Anderson, 10541 61st Place NE, was in attendance. He said he had a band play on his
property for 7 years and that they never played past 10 pm. He said he had only received one neighbor
compliant so that was when he submitted an application to the City for a permit.
City Clerk Luedke and City Attorney Couri answered questions from Council.
There was Council discussion regarding outdoor music events, the required criteria for the permits and
the application Mr. Anderson submitted. It was the Council's consensus not amend the Albertville City
Code relating to major temporary outdoor music permits to allow outdoor music in residential areas.
MOTION made by Councilmember Cocking, seconded by Councilmember Zagorski to deny the
Major Temporary Outdoor Music Permit for Mr. Anderson located at 10541 61st Place NE for July 10,
2021. Ayes: Cocking, Olson and Zagorski.Nays: Hendrickson. Absent: Hudson. The motion carried.
2. Special Event Permit Application for the Church of St. Albert Annual St. Albert
Parish Festival
City Clerk Luedke presented the staff report which included details on the Church of St. Albert's
Parish Festival, the requested street closure and answered questions from Council.
City Administrator Nafstad provided additional information on the requested street closure and
answered questions from Council.
MOTION made by Councilmember Olson, seconded by Councilmember Zagorski to approve a
Special Event Permit application for the Church of St. Albert located at 11400 57th Street NE for their
annual St. Albert Parish Festival on September 18, 2021 from 5 to 11 pm and September 19, 2021
from 10 am to 5 pm. Ayes: Cocking, Hendrickson, Olson and Zagorski. Nays: None. Absent: Hudson.

1. Purchase of a Card Access System for City Hall
Finance Director Lannes presented the staff report which included background information on the
current city hall card access system, the quotes received and the proposed implementation schedule of
the new card system. She answered questions from Council.
City Administrator Nafstad provided additional information on the quotes received for the card system.
MOTION made by Councilmember Cocking, seconded by Councilmember Zagorski to authorize the
purchase and installation of a card access system for the Albertville City Hall for a total purchase
amount not-to-exceed$11,000 which includes the hardware installation, software program, software
license and 100 key cards. Ayes: Cocking, Hendrickson, Olson and Zagorski. Nays: None. Absent:
Hudson. The motion carried.
2. Tort Liability Insurance Renewal
Finance Director Lannes presented the staff report and answered questions from Council.
City Administrator Nafstad and City Attorney Couri answered questions from Council.
MOTION made by Councilmember Olson, seconded by Councilmember Cocking to not waive the
City's monetary limits on tort liability established by Minnesota Statues, Section 466.04. Ayes:

1. Regulations for Neighborhood Park Use
City Planner Brixius presented the staff report which included details on the proposed amendments for
neighborhood park use and answered questions from Council.
City Administrator Nafstad provided additional information on the proposed changes to the ordinance
and answered questions from Council.
MOTION made by Councilmember Olson, seconded by Councilmember Cocking to adopt Ordinance
No. 2021-08 amending the Albertville City Code, Title 8, Chapter 3, Section 8-3-2 Regulations for all
City Parks in the City of Albertville. Ayes: Cocking, Hendrickson, Olson and Zagorski.Nays: None.
Absent: Hudson. The motion carried.
2. Cemetery Structure Setbacks
City Planner Brixius presented the staff report which included details on the columbarium that the St.
Albert's cemetery would like to install on their property. He said the Planning Commission had
recommended approval of the zoning amendments related to the setbacks applicable to cemeteries.
MOTION made by Councilmember Cocking, seconded by Councilmember Zagorski to adopt
Ordinance No. 2021-09 amending the Albertville Zoning Chapter 4850, P/I Public/Institutional
Zoning District related to setbacks applicable to Cemeteries. Ayes: Cocking, Hendrickson, Olson and
Zagorski. Nays: None. Absent: Hudson. The motion carried.

City Planner Brixius presented the staff report which included background information from the study
which was conducted to examine the operations of thrift and secondhand stores. He said the Planning
Commission had recommended approval of the zoning code amendments related to the regulation for
thrift and secondhand stores.
MOTION made by Councilmember Zagorski, seconded by Councilmember Olson to adopt
Ordinance No. 2021-10 amending the Albertville Zoning Code relating to the definition and
regulation of Thrift Stores/Secondhand Stores within the City's Commercial Zoning Districts. Ayes:
Cocking, Hendrickson, Olson and Zagorski. Nays: None. Absent: Hudson. The motion carried.

SUBJECT: CONSENT—FIRE —AUTHORIZE THE HIRING OF A RESERVE FIREFIGHTER
RECOMMENDATION: It is respectfully requested that the Mayor and City Council authorize
the following:
MOTION TO: Authorize the hiring of Sharon Olson for the position of Reserve Firefighter with
the Albertville Fire Department.
BACKGROUND: The Fire Department began its current hiring process in February 2021. The
process has concluded with the request to approve the hiring of the above-named individual to the
position of Reserve Firefighter.
The applicant has met the requirements as outlined in Section 4.1.3 (Employment Eligibility -
Requirements and Process) of the Albertville Fire Department's (AFD) Standard Operating
Policies and Procedures. She has also completed and successfully passed the complete AFD hiring
process. This process includes, but is not limited to:
a. Application
b. Initial Interview
c. Physical Ability Test
d. Reference Checks
e. Final Interview
f. Conditional Job Offer
g. MN BCA Background and Criminal History Checks
h. Pre-Employment Medical Exams /Drug Testing

The Fire Department is asking for Council authorization for the hiring of the new Reserve
Firefighter.
KEY ISSUES:
• The current Fire Department hiring process has ended.
• One applicant has successfully completed the AFD hiring process.
FINANCIAL CONSIDERATIONS: The costs associated with the hiring process are part of the
annual Operating budget of the Fire Department. The Reserve Firefighter will start as volunteer,
unpaid, member of the Fire Department.
LEGAL ISSUES: The City Council has the authority to establish new positions and hire
personnel.

the Rockford Lions Club for Cedar Creek Golf Course on September 11, 2021.
BACKGROUND: The Rockford Lions Club has submitted an application to conduct off-site
gambling for their event at Cedar Creek Golf Course, located at 5700 Jason Avenue NE in
Albertville,for Saturday, September 11, 2021.
KEY ISSUES:
• City approval is required prior to the Rockford Lions Club submitting the application for
lawful gambling to Minnesota Alcohol and Gambling Enforcement Division.
• This is a permit for a one-time off premise event.
• The type of gambling to be conducted is a raffle.
POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority
to either approve or deny any gambling license application received by the City.

WHEREAS,the Rockford Lions Club has submitted an application for an off-site
gambling permit to conduct lawful gambling activities within the City of Albertville,Minnesota;
and
WHEREAS,the purpose of the lawful gambling is to raise funds; and
WHEREAS,the lawful gambling permit will be for a raffle to be held on September 11,

RECOMMENDATION: It is respectfully requested that the Mayor and City Council authorize
the following:
MOTION TO: Adopt Resolution No. 2021-031 ending the declaration of the City's local
emergency and rescinding Resolution No. 2020-12 authorizing paid administrative leave during
the local emergency.
BACKGROUND: On March 13, 2020, Governor Walz declared a State of Minnesota
peacetime emergency due to the COVID-19 health pandemic through Executive Order 20-01. On
March 30, 2020, the Albertville Mayor and City Council declared a local emergency and adopted
the City's Continuity of Operations and Pandemic Emergency Response Plans. Also,the Council
adopted Resolution No. 2020-12 which authorized the City Administrator to implement paid
administrative leave with the discretion consistent within the adopted budget.
The conditions in which the state and local emergency declarations have ceased and the State of
Minnesota ended the peacetime state emergency effective July 1, 2021.
KEY ISSUES:
• On March 13, 2020, due to the COVID-19 health pandemic,Minnesota Governor Walz
declared a State peacetime emergency.
• On March 30, 2020, the Albertville Mayor and City Council declared a local emergency
and adopted the City's Continuity of Operation and Pandemic Emergency Response

WHEREAS, Governor Walz issued Executive Order 20-01, declaring a State of

WHEREAS, on March 30, 2020, the Albertville City Council found under the authority
provided by Chapter 12 and related laws of the State of Minnesota that a peacetime emergency

have ceased; and
WHEREAS,the State of Minnesota has rescinded its peacetime state of emergency

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider
approval of the following motion:
MOTION TO: Release $2,500 escrow for Karston Cove 51h Addition, conditioned on any
outstanding balances owed to the City being paid in full.
BACKGROUND: Centra Homes, LLC has requested a release of the $2,500 escrow held for
Karston Cove 5th Addition. The escrow was held as surety for sidewalk repairs, which are now
complete.
Assuming the developer is current with all fees owed to the City, it is recommended the escrow
be returned in full.
POLICY CONSIDERATIONS: It is City policy to have all Letter of Credit reductions
approved by the City Council.
FINANCIAL CONSIDERATIONS: There are no financial implications for this request.
LEGAL CONSIDERATIONS: The City has the legal authority under the development
agreement to reduce the Letter of Credit upon completion of the required improvements or deny

COMMUNITY CONNECTIONS OPEN STREETS EVENT
RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider the
following:
MOTION TO: Approve a Special Event Permit for Family Youth Community Connections
(FYCC) for their 7th Annual Open Streets event on September 11, 2021 from 10 am to 2 pm.
BACKGROUND: FYCC submitted a special event permit application for their 7th Annual Open
Streets event to be held on Saturday, September 11, 2021. The Open Streets event is a national
initiative to temporarily close streets to automobile traffic and promote healthy living and physical
activity. There will be local vendors at the event as well as free family activities.
KEY ISSUES:
• The event will take place on the streets, which include Main Avenue NE from 60th and Main
to 58th and Main, and include all of 58th Street NE extending to Lander and ending at the
Berning's residence. FYCC is requesting to close these streets during the event.
• The Open Street is an annual event that has been held on the same streets since 2014.
• The estimate attendance including staff and entertainment will be between 2,500 and 6,000
people.
• FYCC has contacted the Wright County Sheriff's Office for security and traffic control.
• FYCC has confirmed there are no large events scheduled at St. Albert's for that day and will
contact the Main Avenue businesses of the Dance Studio, 152 Club, Geez, and Neighbors.
• FYCC will be renting port-a-potties for the event.
• FYCC has provided the City with a certificate of liability insurance for the event.
• A mailing to all surrounding residents will be sent prior to the event.
• Outdoor special events shall only occur between April 1 to November 1 of each year.
POLICY/PRACTICES CONSIDERATIONS: Special events permits and street closure requests
are subject to the approval of the Albertville City Council.
LEGAL CONSIDERATIONS: The applicant shall comply with the regulations for a special
event permit.

Please find attached FYCC's Special Event Permit to hold Open Streets
202.This event will take place on the streets, which include Main Ave. NE
from 601 & Main to 58th & Main, then turning and including all of 58th
Street NE and extending on to Lander ending just short of Gordy &
Theresa Berning's residence. The event would also include the Farmer's
Market Pavilion and the Depot. This event will be held on Saturday,
September 11, 2021 from 10:00 a.m. to 2:00 p.m. with Local Businesses
each hosting a game or fun activity for families; there will also be Live
Music, Square Dancing, DJ, Face Painting, Crazy Hair and much more
adding to the fun. The Lion's will offer their food trailer and E1Bamba
will have tacos and Nachos. We will have outdoor biffies (Red's =
company the city uses) available on the route for public use.
This event is an annual event held by Family Youth Community
Connections (FYCC) that has been held on the same streets since 2014.
The event will have between 2,500 and 6,000 people in attendance
including staff and entertainment. Set up and take down of this event will
all be on Saturday, September 11, 2021.
FYCC has sent Chief Bullen a email and a letter detailing our plan and
asking if he needs any additional information from FYCC. Albertville Fire
Department has been part of this event since 2014.
FYCC has also contacted Wright County Sheriff's Department requesting
they also be part of the event like they have since 2014.

City of Albertville Public works agreed to order the portable biffies from
Red's for this event and FYCC will pay the bill.
Vendors will be asked to park in the ball field parking lot as there are no
ball games scheduled for that day; with participant parking at FYCC
building entering off of 60th Street.
Only signage for this evening will be posted on A-Frame signs thanking
our sponsors and identifying locations of special areas i.e. Face Painting,
Crazy Hair, Food, Restrooms, etc. Trash from this event will be hauled
away and put in FYCC or Public Works trash.
Insurance is through League of Cities and you will find attached a copy
of our event insurance from Zachman Insurance naming City of
Albertville as additionally insured.

SUBJECT: PLANNING AND ZONING-PRESERVE AT ALBERTVILLE—AMEND
ZONING MAP CREATE PAA-PUD ZONING DISTRICT,FINAL PLAT,
AND PUD FINAL STAGE
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Adopt Resolution No.2021-032 approving the request of Integrate Properties
for a zoning map amendment, zoning text amendment, final plat and PUD final stage for the
project entitled Preserve at Albertville.
BACKGROUND:
On June 21, 2021, the City Council approved the development applications from Integrate
Properties LLC. that included a zoning map amendment, Preliminary Plat and Development
Stage PUD for a 70 lot single family subdivision entitled Preserve at Albertville. The
development of this 40.39 acre site is proposed to include; 70 rental single family homes, a
private neighborhood community building and recreational amenities and a private street. The
40.39 acre site is located along the north side of 50th Street between Main Avenue and County
Road 19. The Council approval of the preliminary plat/PUD Development Stage included
conditions outlined in Resolution No. 2021-029 that were required to be addressed as part of the
PUD final stage submission.
Integrate Properties LLC has now filed an application and submitted plans for the Final Plat and
Final Stage PUD in accordance with the Albertville Zoning Code. The final plat and plans have
been reviewed against the conditions imposed with the development stage approval and outlined
in the July 15, 2021 Planning Report.
The subdivision proposes lots having a minimum lot width of 50 feet and minimum lot area of
6000 sq. ft. These lot dimension are smaller than the City's standard residential zoning district.
To facilitate the development proposal, the following development applications have been
requested,
1. Zoning Map Amendment: Changing the zoning from R-1 Single Family Residential District
to PUD Planned Unit Development. The PUD district is needed to allow flexibility in lot
size and setbacks.
2. The Creation of a PAA- PUD zoning district which will overlay the proposed subdivision
and regulate land uses and performance standards within this PUD district.
3. PUD Final Stage.
4. Final Plat.

City Staff has reviewed the submitted application and plan sets dated July 1, 2021 and prepared
the planning report dated July 15, 2021. .
KEY ISSUES:
The Albertville Council approved the Preserve at Albertville Development Stage PUD and
preliminary plat on June 21, 2021 with a list of conditions to be addressed with the final plat
submission. The Applicant has submitted the final plat and final stage PUD plans dated July 1,
2021 which responded to the City approval conditions. The July 15, 2021 Planning Report
provides and evaluation of the final plan sets against the June 21, 2021 approval. The Planning
Report outlines the key issues that needed attention. The following findings were made with the
preliminary plat to support the change in zoning and the proposed development.
• The Albertville Comprehensive Plan guides this site for low density residential use
having a density range of 1 to 4 units per acre. The proposed subdivision has a net
density of 3.27 units per acre of buildable land exclusive of wetlands. This proposed land
use is consistent with the Albertville Comprehensive Plan.
• The proposed development site is isolated from other land uses due wetlands and street
corridors. These features provide physical separation from other neighborhoods allowing
the change in lot size and density to occur in a manner compatible with surrounding land
uses.
• The PUD allows the City to establish zoning land use and performance standard specific
to the subdivision which must be adhered to. Based on the small lot sizes Staff review
includes recommendations on prohibited uses and additional minimum performance
standards.
• The new development will not depreciate the area.
• The subdivision will not overburden existing public services or utilities.
• The subdivision is subject to the review of Wright County with regard to plat design and
site access. The Developer is responsible for any and all street improves required by the
County or internal to the subdivision. A traffic study is being conducted which may offer
additional recommended transportation improvements that must be addressed with the
subdivision.
• The Planning Report and Resolution outline needed changes and conditions
recommended for the PUD and plat approval.
POLICY/PRACTICES CONSIDERATIONS: In review of the submitted final plat and the
PUD final stage plans, Staff finds that they are consistent with the approved preliminary plat
and the conditions of approval.
FINANCIAL CONSIDERATIONS: The approval of the subdivision will expand the local tax
base and include payment of development fees associated the development of the site.
LEGAL CONSIDERATIONS: In accordance with Council procedures, the Mayor and City
Council have the authority to consider land use and zoning changes, and subdivisions.

RESOLUTION APPROVING A REQUEST FOR A ZONING MAP AMENDMENT TO
CHANGE ZONING FROM R-1 DISTRICT TO PUD DISTRICT,THE CREATION OF
THE PPA-PUD ZONING DISTRICT,A FINAL PLAT AND A PUD FINAL STAGE
PLANS FOR A 70 LOT SINGLE FAMILY SUBDIVISION ENTITLED PRESERVE AT
ALBERTVILLE ALONG 50 STREET NE.WITHIN THE CITY OF ALBERTVILLE
WHEREAS,Integrate Properties LLC have filed an application and submitted plans
pursuing a 70 lot single family lot subdivision and a PUD Planned Unit Development zoning to
allow for flexibilities for lot widths, lot areas and setbacks smaller than the City's standard
residential zoning districts. Said site is 40.39 acres, located along the north side of 50th Street
between Main Avenue and County Road 19 ("Property").
This 70 lot single family development is intended to be under single ownership and single
management offering single family rental options with the City of Albertville. To facilitate the
development proposal the following development applications were requested,
1. Zoning Map Amendment: Changing the zoning from R-1 Single Family Residential District
to PUD Planned Unit Development. The change in zoning is to allow for design flexibility
in lot area, lot width and setback and to allow for private street,private
playground/clubhouse.
2. Zoning Code Text Amendment: Creating the approved PAA-PUD zoning district
3. PUD Development Stage site and building review.
4. Preliminary Plat.
WHEREAS,the Albertville City Council approved the PUD Development Stage plans,
and preliminary plat on June 21, 2021; and
WHEREAS, Integrate Properties LLC have filed an application and submitted plans
pursuing approval of a final plat and PUD final stage for the 70 lot single family lot subdivision
entitled Preserve at Albertville; and
WHEREAS, City Staff has reviewed the submitted plans dated July 1, 2021 and
prepared a planning report dated July 15, 2021; and
WHEREAS,the Albertville City Council met on July 19, 2021 to consider the Preserve
at Albertville development applications; and
WHEREAS,the Albertville City Council has received the Preserve at Albertville
application materials, final plat and PUD Final Stage construction plans, staff review documents
and recommendation, and agrees with the findings and recommendation of the City Staff.

NOW,THEREFORE BE IT RESOLVED,that the City Council of Albertville,
Minnesota hereby approves the Integrate Properties request for a zoning map amendment to
change the zoning from R-1 district to PUD district, the zoning text amendment creating the
PAA-PUD zoning District, final plat and the PUD final stage plans for the subdivision entitled
Preserve at Albertville dated July 1, 2021 with on the following conditions.
PUD Final Stage: The City approves the creation of the PAA-PUD zoning district which
will overlay the entire Preserve at Preserve subdivision and will regulate the use and
performance standard within this zoning district. Said zoning district shall include the
following PUD conditions.
1. All lots shall be a minimum width of 50 feet in width and 120 feet in depth.
2. All lots shall have a minimum of 6,000 square feet in buildable lot area exclusive of
wetlands,wetland buffer yards and storm water ponds.
3. All homes within the subdivision shall be subject to the following minimum setback
requirements:
Front Yard: 25 feet
Side Yard(garage side): 5 feet
Side Yard(house side): 5 feet
Side Yard(along street): 20 feet
Rear Yard (primary): 25 feet
Rear Yard (along 50th Street): 50 feet
Building Separation: 10 feet
4. All lots shall have a minimum of 25 feet of usable rear yard.
5. All buildings,patios, decks shall meet the required building setbacks of the PUD District.
6. The following shall be prohibited within the subdivision:
a. Detached accessory buildings.
b. Outdoor storage as regulated by Section 1000.15.A of the Albertville Zoning
Ordinance.
c. Fences.
7. Curb cuts shall not exceed 16 feet in width as measured at the street curb line.
8. The home design shall be limited to the models submitted as part of this PUD application
with the following information to be provided and approved by the City.
• Intended home finish materials shall be specified.
• Minimum garage size shall 480 sq. ft.
• The applicant shall address storm protection concerns (related to homes without
basements)to the satisfaction of the City.

9. Detailed plans of the clubhouse are pool area shall be submitted subject to review and
approval by the City prior to any construction on Lot 21 Block 2 of the Preserve at
Albertville.
10. The sale of individual lots within the subdivision shall be prohibited unless the Developer
establishes a Common Interest Community CIC with rules and maintenance requirements
which will be applied to each lot, the private street and the common areas of the plat. The
CIC and all rules, bylaws and recording documents shall be subject to the review and
approval of the City Attorney prior to their recording. A change to allow individual lot
ownership shall be subject to PUD amendment processing (to ensure that issues related to
outdoor storage, accessory structures etc. are addressed to the satisfaction of the City.
11. The applicant shall enter into a PUD development agreement with the City which
outlines the conditions of development approval.
12. The PAA-PUD Zoning district shall be finalized and become effective with the approval
of the PUD Final Stage and Final plat.
The City Approves the Preserve at Albertville Final Plat and plans dated July 1, 2021
subject to the following conditions:
1. Wright County approval of the final plat and access permits.
2. The applicant is responsible to all costs associated with design and construction of
required improvements to 50th Street.
3. The private street shall be constructed to City street standards. The street construction
plans shall be reviewed and approved by the City Engineer.
4. The recommendations of the Traffic Study shall be implemented with the development of
the subdivision. The cost of Traffic Study improvements shall be borne by the developer.
5. The developer shall participate in the design and construction of a pedestrian crossing at
50th Street connecting the subdivision with the school if approved by Wright County.
6. Outlots C shall be conveyed to the City in fee title.
7. Outlot A shall be under private ownership but be covered by a drainage and utility
easement. The Applicant shall establish an access route through Lot 21, Block 2 to access
Outlot A for maintenance.
8. Outlot B is a private street and shall remain under private ownership but must be covered
with a drainage and utility easement.
9. Outlot C be covered with a drainage and utility easement.
10. Outlots D and F are the parcels that will be made available for purchase by the Water
Treatment Plant.

11. Outlot E shall be under private ownership but be covered by a drainage and utility
easement. The Applicant shall establish a route to access Outlot E for future maintenance.
12. The applicant shall pay a cash fee in lieu of a land dedication to satisfy the City's park
dedication requirements.
13. The landscape plan shall be approved subject to the following conditions:
• The City Engineer shall review the fence location to determine if the fence will
interfere with storm water drainage or access to the storm water pond in Outlot
E for pond maintenance.
• The buffer yard plant locations are acceptable provided the applicant can
provide a minimum of 25 feet of usable rear yard space between the house and
buffer yard.
• The Coniferous trees in the buffer yard must have a height of 6 feet or greater.
14. The final grading and drainage plans approval shall be subject to the review and
recommendations of the City Engineer.
15. The final street and Utility plans approval shall be subject to the review and
recommendations of the City Engineer.
16. The applicants shall enter into a development agreement/PUD agreement with the City
and post all the necessary securities for plat development.
17. The City approves the rezoning of the subject site from R-1, Residential Single Family to
PUD, Planned Unit Development district and all terms of PUD approval are satisfied.

BACKGROUND
On June 21, 2021 , the City Council approved development applications of Integrate
Properties LLC. that includes a zoning map amendment, Preliminary Plat and
Development Stage PUD for a 70 lot single family subdivision entitled Preserve at
Albertville. The development of this 40.39 acre site is proposed to include; 70 rental single
family homes, a private neighborhood community building and recreational amenities and
a private street. The 40.39 acre site is located along the north side of 501" Street between
Main Avenue and County Road 19. The Council approval included conditions outlined in
Resolution No.2021-029 that were required to be addressed as part of the PUD final stage
submission.
Integrate Properties LLC has now filed application and submitted plans for Final Plat and
Final Stage PUD in accordance with the Albertville Zoning Code. The final plat and plans
have been reviewed against the conditions imposed with the development stage approve
and outlined in the body of this report.

ANALYSIS
Consistency with the Preliminary Plat:
The submitted final plat is consistent with the approved preliminary plat in lot count, lot and
block layout and street configuration. The final plat has revised to address the conditions
of preliminary plat approval. The following review evaluated the applicant's response to
each of the specific conditions the City imposed on the PUD Development Stage and
preliminary plat approval.
PUD Zoning Amendment Conditions:
1. The City adopts ordinance No. 2021 - establishing the "PAA-PUD" zoning
district which will overlay all of the Preserve on Albertville Final plat. The
Albertville zoning map will be amended to illustrate the zoning change with the
approval of the final plat.
Comment: The City approved this zoning map amendment on June 21, 2021
with the condition that the map change will occur with the approval of the final
plat.
2. All lots shall be a minimum width of 50 feet in width and 120 feet in depth.
3. All lots shall have a minimum of 6,000 square feet in buildable lot area exclusive
of wetlands, wetland buffer yards and storm water ponds.
Comment: The plat has been revised to demonstrate compliance with conditions 2
and 3. Exhibit D is a summary of the lot are calculations showing all lots having a
minimum lot area of 6000 sq. ft. and lot width of 50 feet.
4. All homes within the subdivision shall be subject to the following minimum setback
requirements:
Front Yard: 25 feet
Side Yard (garage side): 5 feet
Side Yard (house side): 5 feet
Side Yard (along street): 20 feet
Rear Yard (primary): 25 feet
Rear Yard (along 501" Street): 50 feet
Building Separation: 10 feet
5. All lots shall have a minimum of 25 feet of usable rear yard.
6. All buildings, patios, decks shall meet the required building setbacks of the PUD
District.

Comment: Conditions 4, 5, and 6 are included in the PAA-PUD draft zoning district
that will overlay the entire Preserve at Albertville final plat. This will be the zoning
standards for the plat and will be enforced by the City.
7. The following shall be prohibited within the subdivision:
• Detached accessory buildings.
• Outdoor storage as regulated by Section 1000.15.A of the Albertville
Zoning Ordinance.
• Fences.
Comment: This prohibition will be part of the PAA-PUD zoning district and will be
imposed solely within the Preserve at Albertville neighborhood.
8. Curb cuts shall not exceed 16 feet in width as measured at the street curb line.
Comment: This will be a driveway design standard within the PAA-PUD zoning
district and will be imposed solely within the Preserve at Albertville neighborhood.
9. The home design shall be limited to the models submitted as part of this PUD
application with the following information to be provided and approved by the City.
• Intended home finish materials shall be specified.
• Minimum garage size shall 480 sq. ft.
• The applicant shall address storm protection concerns (related to
homes without basements) to the satisfaction of the City.
Comment: Integrate properties has submitted specific house models to fit the 50 ft.
wide lots. The models will be incorporated into the PUD/Development agreement.
The submitted model homes have not met the aforementioned design standards
and must be revised to comply with the conditions of approval.
10.Detailed plans of the clubhouse are pool area shall be submitted subject to review
and approval by the City prior to any construction on Lot 21 Block 2 of the
Preserve at Albertville.
Comment: This shall remain a condition of PUD final stage approval.
11.The sale of individual lots within the subdivision shall be prohibited unless the
Developer establishes a Common Interest Community CIC with rules and
maintenance requirements which will be applied to each lot, the private street and
the common areas of the plat. The CIC and all rules, bylaws and recording
documents shall be subject to the review and approval of the City Attorney prior to
their recording. A change to allow individual lot ownership shall be subject to PUD
amendment processing (to ensure that issues related to outdoor storage,
accessory structures etc. are addressed to the satisfaction of the City.
Comment: The condition will be specifically addressed in the Preserve at
Albertville PUD/Development agreement to ensure that this condition is met if the
subdivision converts to individual home ownership.

12.The PAA-PUD Zoning district shall be finalized and become effective with the
approval of the PUD Final Stage and Final plat.
Comment: The final draft PAA-PUD zoning district is prepared for Council review
and can be adopted with the final plat. With the recording of the final plat and the
development and PUD agreement City Staff with change the Albertville Zoning Map
13.The Developer will enter into a PUD agreement that will be recorded with the
property that will outline the terms and conditions of the PUD zoning.
Comment: The City Attorney has prepared a development and PUD agreement
for council consideration and approval.
Final Plat: The Preliminary Plat and PUD development Stage plans dated 05/18/2021
was approved on June 21, 2021 with the following conditions needing to be
addressed with the submission of the final plat.
1 . The City approves the rezoning of the subject site from R-1, Residential Single
Family to PUD, Planned Unit Development district and all terms of PUD approval
are satisfied.
Comment: The City approved this zoning map amendment on June 21, 2021
with the condition that the map change will occur with the approval of the final
plat.
2. Subject to the plat and access review comments and recommendations of Wright
County.
Comment: The County has sent a letter dated June 30, 2021 outlining conditions
to be imposed on the final plat as follows:
• An access permit will be required. The permit will require the existing right
turn lane/bypass lane configured intersection to be reconstructed with
dedicated right and left turn lanes for both directions of traffic. Final
construction plans will be reviewed as part of the access permit.
• Fifty-five (55) feet (measured from CSAH 18 centerline) of right-of-way shall
be dedicated as part of the project.
• Any proposed work within the Wright County right-of-way will require a right-
of—way permit.
• The proposed development drainage must not exceed the existing drainage
rates into the County highway system. The City or project developer will
need to verify that all existing drainage patterns and system affecting the
Wright County Highway right-of-way will be perpetuated.

The final plat shows the required 55 foot County Road 18 right-of-way dedication.
The County highway permitting and road design shall be reviewed and approved by
the City Engineer and the County Highway Department.
3. Applicant shall be responsible for any and all improvements to 501" Street required
by the County or City.
Comment: This will be a stipulation of the PUD/Development agreement for the
Preserve at Albertville final plat.
4. Street improvement recommendations of the traffic study shall be implemented
with this subdivision.
Comment: The City has not received the final Traffic Study to date. This shall
remain a condition of final plat approval.
5. The private roadway shall be platted as an outlot and overlaid with drainage and
utility easements. The street pavement width, street design and construction
details shall meet city standards and shall be subject to review and approval by the
City Engineer.
Comment: The final plat labels the private street as Outlot B. The private street
design shall be reviewed and approved by the City Engineer.
6. The following lots shall be increased to 6,000 square feet in size. It is understood
that such modification may result in the loss of a lot or lots
Lot 15, Block 1 — 5,997 square feet
Lot 24, Block 1 — 5,988 square feet
Lot 25, Block 1 — 5,997 square feet
Lot 33, Block 1 — 5,674 square feet
Lot 34, Block 1 — 5,838 square feet
Comment: The plat has been revised to demonstrate compliance with provision 6
(above). Exhibit D is a summary of the lot are calculations showing all lots having a
minimum lot area of 6000 sq. ft. and lot width of 50 feet.
7. Outlots E and F shall be combined with Outlot B to form a single outlot which
overlays the wetlands.
8. Outlot C and D shall be available for purchase by the Water Treatment Site for a
price to be negotiated.
9. Applicant shall revise the plat to provide a new outlot along 53rd Street for the
creation of a new single family R-1 lot.
10.Outlots A and revised Outlot B shall be conveyed to the City in fee title.

Comment: The final plat has been revised to address the aforementioned
recommendations, however, the Outlots have been relabeled on the final plat.
• Outlot A is the ponding area in the center of Block 2. This outlot will be
covered by a drainage and utility easement. Outlot A shall remain under
private ownership and be privately maintained. Applicant must identify a
route to access Outlot A for future maintenance.
• Outlot B, is the private street. This will remain in private ownership but will be
covered by a drainage and utility easement to cover the municipal utilities
that will serve the plat. The Street will remain private and the responsibility
for plowing, maintenance and repair shall run to the property owner.
• Outlot C overlays the large wetland that surrounds the plat on the north and
west. Per the conditions of preliminary plat approval, the previous Outlot E
has been combined within new Outlot C. Previous Outlot F has been
combined with Lot 19, Block 1.
• Outlots D and F are the parcels that will be made available for purchase by
the Water Treatment Plant.
• Outlot E is a new outlot. Outlot E will contain a storm water pond and will be
covered with a drainage and utility easement. Outlot E will remain under
private ownership and will be privately maintained. Applicant must identify a
route to access Outlot E for future maintenance.
• Outlot G is a new outlot which will be retained by the original property owner.
The intent of this outlot is to subdivide this area in to R-1 single family lots
that front on 53rd street in the future.
The changes to the plat's outlots responded to the conditions of approval for the
preliminary plat and are acceptable.
11. Sidewalks measuring 5 feet in width shall be provided in the following areas:
a) Around the perimeter of proposed Block 2 (to provide a pedestrian access
route to the centrally located clubhouse/pool area).
b) On the east side of Lot 1, Block 1(to connect the subdivision to a possible
future 50t" street trail/sidewalk and provide a continuous pedestrian route
to the middle school to the south).
c) A pedestrian crossing over 50t" Street, connecting the subdivision to the
Middle School shall be designed and installed. The location and design
of any crosswalk shall be reviewed and approved by the County.
Comment: The revised plans show the required sidewalk around Block 2.
The sidewalk's extension to 50t" Street is located on the west side
of Lot 50 Block 1. In review of this layout, Staff recommends approval.

There remains a need for the pedestrian crossing over 50t" Street; as such
condition c) above remains a condition that must be addressed.
12. The applicant shall pay a cash fee in lieu of a land dedication to satisfy the
City's park dedication requirements. Park dedication fees shall be paid at the
time of final plat processing.
Comment: This is a condition of final plat approval and will be specifically
addressed as part of the PUD/Development agreement.
13. A revised landscape plan shall be submitted for City approval that includes
the following information:
a) A landscaped buffer yard shall be provided in the rear yards of lots which
abut 501h Street. Such buffer strip may consist of plantings, berms,
uniform fencing or a combination thereof meeting the design standards of
Section 1000.7 of the Albertville Zoning code. The landscape plan shall
be revised to show the proposed planting and design for approval by the
City. The buffer yard landscaping shall be installed with the completion of
subdivision grading and prior to issuance of any building permits for Lots
1-8 and 47- 50, Block 1.
b) Detailed plans of the clubhouse/pool area shall include a landscape plan
which shall be subject to City review and approval.
Comment: The applicant has provided a landscape plan for the
subdivision that addressed the following conditions.
• The required buffer yard along 50th Street has been addressed
providing a 5 foot tall black aluminum fence with stone columns. The
fence location appears to be located within a drainage swale along
50t" Street. The fence also surrounds the storm water pond in Outlot
E. The City Engineer shall review the fence location to determine if the
fence will interfere with storm water drainage or access to the storm
water pond in Outlot E for pond maintenance. An alternative design or
location may be appropriate.
• The landscape plan provides a staggered row of coniferous trees on
the lots abutting the 50t" street right-of-way. The buffer yard trees are
planted approximately 30 feet north of the 50t" Street right of way to
accommodate a drainage swale. This brings the tree planting in close
proximity of the building pads. The buffer yard plant locations are
acceptable provide the applicant can provide a minimum of 25 feet of
usable rear yard space between the house and buffer yard.
• The landscape plan shows a front yard tree for most of the single
family lots. This will add to the streetscape appeal.

• The ponding areas and wetland buffers will be planted with a seed mix
appropriate for the open space's use.
• The deciduous trees will be 2.5 inch caliper meeting the City
standards.
• The coniferous trees are also described as have a 2.5 inch caliper.
Applicant shall verify that this measurement results in a tree having a
height greater than 6 feet.
• The future development of the club house and pool will be processed
as a separate site and building review application and will address
landscaping for this site with the future application.
14. Issues related to wetlands will be subject to comment and recommendations
of the City Engineer. Applicant shall design, locate and install wetland buffer
demarcation posts that delineate the boundary between the lot lines and
wetland buffers. Said demarcation design and locations shall be submitted
to the City for approval prior to installation.
Comment: The Wetland Management Plan show the placement of
wetland buffer markers along the rear yards of lots in Block 1 abutting
Outlot C the wetland. The intervals between markers vary from 50 feet to
150 feet with an average of 100 foot separations. The proposed location
and frequency appear to be acceptable. The marker design is detailed in
the submitted construction details, and will consist of a wetland buffer
demarcation sign mounted on a metal fence post.
15. Issues related to grading, drainage and utilities shall be subject to review and
approval by the City Engineer. As part of such review, a specific
determination shall be made that easements are appropriately depicted on
the preliminary plat drawing.
Comment: Final plat approval will be subject to the recommendations of
the City Engineer with regarding his review of the final grading and
drainage plans and Utility plans.
16. Water service lines to individual houses shall be located outside of the
d riveway.
Comment: The Utility plan show the house and driveway placement on
each lot and also shows the utility services to each house outside the
driveway.
17. As a condition of final plat approval, the applicants will be required to enter
into a development agreement / PUD agreement with the City and post all
the necessary securities for plat development.

Comment: This remains a condition of final plat approval. The City
Attorney has prepared a PUD/development agreement for Council
consideration.
CONCLUSION
Based on our review of the Preserve at Albertville PUD plans and Final plat; we find them
to be consistent with the approved development stage plans and preliminary plat. We
recommend approval with the following conditions:
Final Plat: : Final plat approval is recommended based on Preserve at Albertville Final
plat and plan set dated 07/01/2021 which dictate the land uses, development patterns,
amenities and building design with the following conditions:
1. Wright County approval of the final plat and access permits.
2. The applicant is responsible to all costs associated with design and
construction of the site access to 501" Street.
3. The private street shall be constructed to City street standards. The street
construction plans shall be reviewed and approved by the City Engineer.
4. The recommendations of the Traffic Study shall be implemented with the
development of the subdivision. The cost of Traffic Study improvements

dictates the land uses, development patterns, amenities and building design with the
following conditions:
1 . The City adopts ordinance No. 2021 - establishing the "PAA-PUD"
zoning district which will overlay all of the Preserve on Albertville Final
plat. The Albertville zoning map will be amended to illustrate the zoning
change with the approval and recording of the final plat.
2. All lots shall be a minimum width of 50 feet in width and 120 feet in depth.
3. All lots shall have a minimum of 6,000 square feet in buildable lot area
exclusive of wetlands, wetland buffer yards and storm water ponds.
4. All homes within the subdivision shall be subject to the following minimum
setback requirements:
Front Yard: 25 feet
Side Yard (garage side): 5 feet
Side Yard (house side): 5 feet
Side Yard (along street): 20 feet
Rear Yard (primary): 25 feet

5. All lots shall have a minimum of 25 feet of usable rear yard.

• Outdoor storage as regulated by Section 1000.15.A of the
Albertville Zoning Ordinance.
• Fences, other than the approved buffer yard fence.
8. Curb cuts shall not exceed 16 feet in width as measured at the street curb
line.
9. The home design shall be limited to the models submitted as part of this
PUD application with the following information to be provided and
approved by the City.
• Intended home finish materials shall be specified.
• Minimum garage size shall 480 sq. ft.
• The applicant shall address storm protection concerns (related to
homes without basements) to the satisfaction of the City.
10.Detailed plans of the clubhouse are pool area shall be submitted subject
to review and approval by the City prior to any construction on Lot 21
Block 2 of the Preserve at Albertville.
11 .The sale of individual lots within the subdivision shall be prohibited unless
the Developer establishes a Common Interest Community CIC with rules
and maintenance requirements which will be applied to each lot, the
private street and the common areas of the plat. The CIC and all rules,
bylaws and recording documents shall be subject to the review and
approval of the City Attorney prior to their recording. A change to allow
individual lot ownership shall be subject to PUD amendment processing
(to ensure that issues related to outdoor storage, accessory structures
etc. are addressed to the satisfaction of the City.
12.The Developer will enter into a PUD agreement that will be recorded with
the property that will outline the terms and conditions of the PUD zoning.

Existing Site Description
The development site consists of 1 parcel, 40.4 acres in size and currently is used for agriculture with
no existing structures on the site and no significant trees within the proposed development area. The
site does contain a significant amount of wetland. The property is bound by 50t" St/ County Road 18
and St. Michael-Albertville Middle School West to the south, existing residential to the east and north,
an existing church property to the southeast, existing agriculture use to the west and a City owned
water treatment plant to the southwest. There is drainage area from CR 18 and the Middle School that
is routed through the property by way of swale to the internal wetland as well as drainage conveyed
across the property from the Life in Christ Lutheran Church's stormwater pond. The site is generally
flat, with clayey soils, adjacent to existing public utility and right of way and suitable for development.
DEVELOPMENT APPROVAL REQUEST
The applicant's proposed development request consists of a Planned Unit Development and
Preliminary Plat with 70 single family home lots and 1 clubhouse/amenity area lot.
Land use and Zoning Designations
The development property is guided as Low Density Residential within the City's land use plan. The
proposed development will provide a low-density subdivision that aligns with the City's guiding for
the property.
The Developer previously requested and was granted approval for rezoning of the site as a PUD
zoning for the entire development site, compatible and consistent with the City's goals and objectives
for the property.

Proposed Residential PUD Development Plan
The applicant proposes to provide the City of Albertville with a residential development including a
variety of housing styles within a neighborhood of 50' wide lots surrounding a private club
house/amenity area, preservation of natural wetlands, provision of stormwater management goals and
infrastructure improvements to the adjacent offsite roadway.
It is the applicant's respectful opinion that the proposed development plan is consistent with the City
of Albertville's goals for the property. The following is a summary of primary project elements
currently proposed:
• 70 new single-family homes with a variety in architecture
• Central club house &amenity area
• Infrastructure improvement to adjacent County roadway
• Public right of way dedication for 50t'St.NE/CR 18
• Preservation of onsite wetland areas and dedication of open space.
• Wetland buffer creation in accordance with City requirements.
• Placement of wetlands within an outlot or public drainage and utility easement
• HOA maintained community and private open space areas
• Extension of sanitary sewer and water for future development to the north and east
• Installation of stormwater management facilities to provide volume control, water quality and
rate control for runoff from the new roadway surfaces prior to discharging to the existing
wetland.

Architecture and Demographic Estimate
The proposed homes will include a mix of one- and two-story homes with heights not to exceed 35 ft.
The homes will be a mix of slab on grade homes and full basement walkouts, current plan has 29
walkouts and 41 slab units. The ratio of housing styles, slabs vs walkouts might change depending on
the market or design requirement. See architectural drawings for detailed building information. The
applicant estimates the potential population of the development at 245 new residents based on an
average of 3.5 people per home (3.5 x 70). The proposed architecture for the clubhouse amenity area
will be compatible between the residential housing styles.
Site Access,Pedestrian Circulation and Parking
Vehicular access from public right of way to the proposed development will occur via a new road
access to 50'11 St NE/CR 18. The new access is proposed in direct alignment with the existing Middle
School access to the south and will create a 4-legged intersection.
The proposed internal roadway network is designed with a 50' wide outlot with a 28' back of curb to
back of curb road width with on street parking allowed. The development does not propose a sidewalk
along one side of the internal road frontage. There will be some other private sidewalks/trails within
the clubhouse area and possibly in other private community areas.
Grading
The existing site area will be mass graded to shape in the proposed roadways, lot configurations,
stormwater management basins and common areas. The site is graded to match elevations at the site
perimeter and to provide the necessary drainage for the development. Low floor elevations satisfy all
requirements for freeboard from emergency overflow elevations and estimated 100-year flood
elevations.
Sanitary Sewer and Watermain
The development site currently contains a 12" sanitary sewer trunk line that flows from the south (CR
18) to the north plat limits through the existing wetland. The development plan proposes to remove
and reinstall a portion of the existing sewer line to move the existing sewer to the center of the
proposed roadway system. The development will extend an 8" public sewer within the development
to serve all lots and connect to the existing trunk sewer and discharge north as previously planned for
by the City.
The development will connect to an existing 16" watermain that parallels CR 18 on the north side of
the roadway. An 8"public watermain will be extended throughout the development within the public
roadway to provide service to all proposed lots and clubhouse.
Stormwater Management
The development site falls within the City's County Ditch No. 9 watershed management area and thus
the City requires that the proposed stormwater management plans cut peak discharge ratees by 50%.
The plan does propose to route untreated offsite stormwater runoff from 50'h St and the Middle School
to a new stormwater pond providing additional treatment benefits. Runoff from the proposed

roadways and front yards of all homes and the rear of many homes will be routed to 2 stormwater
ponds for treatment prior to discharging to the wetland. One of the stonnwater ponds will be used for
stormwater reuse for irrigation of the development site. The reuse irrigation system will also have a
backup connection to the municipal water supply for use during periods where rainfall is lacking to
supply the pond. The proposed development's stormwater management plan does provide the required
volume control,water quality, and peak rate control.
Wetland Management
Three wetland areas have been identified on the site by Kjolhaug Environmental Services. The City
requires buffering of the wetland areas with an average width of 30 ft and minimum width of 16 ft.
The proposed development plan does propose buffer averaging for wetland 1 where it abuts the
proposed development but then proposes a typical 30' wide buffer for all other wetland frontages
within the development site. See the wetland management plan for buffer averaging calculation.
Wetland Area Summary:

Tree Preservation/Replacement
The development site has been historically used for agriculture and currently has no significant tree
removal required to construct the development.
Landscaping and Amenities
The landscape plan for the project includes boulevard trees and seeding of disturbed areas and
stormwater management areas. The proposed single family yards will be vegetated with typical
residential turf grass, disturbed outlot areas seeded with native seed mix, and the pond and filtration
basin with appropriate seed mixes.
TIMING/PHASING
The Applicant will mass grade and construct the infrastructure for the project in one phase. If the City
reviews and approves the final platting request, it is the Applicant's desire to proceed construction of
the project in summer/fall 2021.
CONCLUSION
The applicant respectfully concludes that the request for a final will allow for a residential land use
consistent with City's goals and objectives for this area. The single-family community will provide a
unique housing option for the City of Albertville.

OUTDOOR DINING
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following motions:
MOTION TO: Adopt Resolution No. 2021-033 approving Conditional Use Permit for outdoor
dining for Hen and Hog Restaurant/Shoppes at Prairie Run located at 5262 Kyler Avenue.
BACKGROUND: The Hen and Hog restaurant occupies the southern tenant bay of the Prairie
Run Shopping Center at 5262 Kyler Avenue NE. The restaurant and the shopping center owner
have submitted an application to establish and outdoor dining area accessory to the restaurant.
This is intended to expand their dining area and to promote additional business. The site is zoned
B-2 Limited Business District which allow restaurants as a permitted use and outdoor dining as a
conditional use.
The Albertville Planning Commission held a public hearing on July 13, 2021 and reviewed the
development application and staff reports. At the close of the public hearing, the Planning
Commission recommended that the City Council approve the conditional use permit with
conditions outlined in the July 6, 2021 planning report.

POLICY/PRACTICES CONSIDERATIONS: In accordance with State Law, public notice
was published and a public hearing held by the Planning Commission on July 13, 2021. The
Planning Commission recommended the City Council approve the requested conditional use
permit for outdoor dining with the conditions outlined in the July 6, 2021 planning report.
FINANCIAL CONSIDERATIONS: The expansion of the available dining area for the Hen
and Hog Restaurant will increase their sales and opportunity to grow their business. This
economic development is consistent with the City's Vision Study goals.

RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR ACCESSORY OUTDOOR DINING FOR HEN AND HOG RESTAURANT/
SHOPPES AT PRAIRIE RUN LOCATED AT 5262 KYLER AVENUE WITHIN
THE CITY OF ALBERTVILLE
WHEREAS,the Hen and Hog Restaurant/Shoppes at Prairie Run has submitted
application for Conditional Use Permit to allow for outdoor dining at 5262 Kyler Avenue in
Albertville; and
WHEREAS,the property is zoned B-1 Limited Business District which allows
restaurants as a permitted use and outdoor dining by conditional use permit: and
WHEREAS, City staff has reviewed the submitted plans and prepared a planning report
dated July 6, 2021; and
WHEREAS,the Albertville Planning Commission met on July 13, 2021 to hold a public
hearing and consider the outdoor dining Conditional Use Permit for Hen and Hog Restaurant/
Shoppes at Prairie Run; and
WHEREAS,upon review of staff reports and public hearing testimony, the Planning
Commission recommended that the City Council approve the Conditional Use Permit for Hen
and Hog Restaurant/Shoppes at Prairie Run at 5262 Kyler Avenue in Albertville, Minnesota with
the findings and conditions outlined in the July 6, 2021 Planning Report; and
WHEREAS,the Albertville City Council met on July 19, 2021 to consider the application
for a conditional use permit for outdoor dining for Hen and Hog Restaurant/Shoppes at Prairie;
and
WHEREAS,the Albertville City Council received the application, staff review
documents, the Planning Commission recommendation and agrees with the findings and
recommendations of the Planning Commission.
NOW,THEREFORE BE IT RESOLVED,that the City Council of Albertville,
Minnesota hereby approves the Conditional Use Permit for outdoor dining for the Hen and Hog
Restaurant/Shoppes at Prairie Run based on the plan dated June 17, 2021 and the project
narrative with the following condition being met:
1. The outdoor dining area shall be configured and designed in accordance with the plans
submitted dated June 17, 2021.
2. The applicant receives a building permit for the new doorway between the building and
the outdoor dining area.

3. The outdoor dining area is approved as being 20% or less than the entire Shoppes at
Prairie Run shopping center total floor area. This will be counted against any future

5. The proposed string of light within outdoor dining area. Applicant shall provide a plan
illustrating how the lights will be installed and demonstrate how electricity will be
provided to the outdoor light fixture. Said lighting plan shall be approved by the City
Building Inspector.
6. With the Conditional Use Permit,the City finds that the existing parking is adequate for
the outdoor dining area.
7. Applicant shall be responsible for the litter and trash clean-up from the outdoor dining
area.
8. Outdoor music events shall not be allowed except upon receipt of a permit per Section 5-
5-3 of the Albertville City Code.
9. No electronic amplified outdoor music, intercom, audio speakers, or other noise
generation devices shall be allowed within the outdoor dining area.

BACKGROUND
The Hen and Hog restaurant occupies the southern tenant bay of the Prairie Run
Shopping Center at 5262 Kyler Avenue NE. The restaurant and the shopping center owner
have submitted an application to establish and outdoor dining area accessory to the
restaurant. This is intended to expand their dining area and to promote additional
business. The site is zoned B-2 Limited Business District which allow restaurants as a
permitted use and outdoor dining as a conditional use.

ANALYSIS
Within the B-2 zoning district outdoor dining is allowed by conditional use permit provided
the development can meet the following performance standards.
Outdoor dining facilities
A. The applicant shall be required to submit a site plan and other pertinent information
demonstrating the number, location and type of all tables, refuse receptacles, and wait
stations.

Comment: The attached site plan shows the layout of the proposed outdoor dining area
including fencing, access, aisles, table placement and total seating. Eight tables are
proposed for the outdoor dining area with a total seating of 34 people.
B. Access to the dining area shall be provided only via the principal building if the dining
area is a full service restaurant or tavern, including table waiting service. All exit gates shall
be marked "Exit Only" and shall meet all building code requirements.
Comment: The site plan proposes altering the building to provide a door access directly
into the fenced outdoor dining area. This is required to control access into the dining area
for the service of food and alcoholic beverages.
The applicant's narrative indicates that the dining area will be enclosed with an attractive 4
foot tall black steel fence. Applicant will be required to provide a crash bar latch for each
fence gate exit only. Additionally, Staff recommends that the fence be installed a minimum
of 2 feet inside the parking island curb to reduce the potential damage to the fence from
automobiles traveling through the site and door swings from automobiles parked next to
the dining area.
C. The size of the dining area is restricted to twenty percent (20%) of the gross area of
the current building, and shall maintain the lot requirements of the district.
Comment: The proposed dining area is 1086 sq. ft. in area exclusive of the south
sidewalk. The dining area exceeds 20% of the floor area of the Hen and Hog tenant bay.
However, the code allows the dining area to be 20% of the gross floor space of the current
building. The entire shopping center building is 12,000+ sq. ft. in area. The proposed
dining area is 9% of the total shopping center. With the tenant mix having limited sit-down
food service the dining area may be approved, with the condition that this outdoor dining
area may limit the opportunities for additional outdoor dining on this site in the future.
D. The dining area is screened from view from adjacent residential uses.
Comment: The site is surrounded by commercial zoning and does not abut any residential
land uses.
E. All lighting shall be hooded at ninety degrees (900) and directed away from adjacent
properties. No luminaries shall extend beyond the ninety degree (900) cutoff.
Comment: The applicant is proposing a string of bulb lighting. This does not meet the 90
degree cutoff requirement. The proposed lights with be low intensity and will not cast glare
beyond the site. In review of the applicant's requested lighting Staff does not believe this
will create nuisance light issues and maybe acceptable. The applicant will need to provide
a plan showing the light mounting and demonstrate how electricity will be provided to the
light fixtures. The lighting plan must be approved by the City's Building inspector.
F. No outdoor dining shall be allowed on the public sidewalk.
Comment: While the dining area will use portions of the private sidewalk. No public
sidewalks will be impacted.

G. The dining area is surfaced with concrete bituminous or decorative pavers or may
consist of a deck with wood or other flooring material that provides a clean, attractive, and
functional surface.
Comment: The proposed dining area is located on an existing parking lot island. The
dining area will have a concrete surface.
H. A minimum width of thirty six inches (36") shall be provided within aisles of the
outdoor dining area.
Comment: The site plan and project narrative indicate that the outdoor dining area will
have 5 feet spacing between tables. The site plan shows a minimum 3 foot aisle and the
perimeter of the dining area.
I. Off street parking shall be adequate for both indoor and outdoor seating areas.
Comment: Based on the City zoning a 1086 dining area would require 27 parking stalls.
The City Code also requires shopping centers to provide 5.5 parking stalls per 1000 sq. ft.
of leasable floor space. By ordinance the 12,000 sq. ft. shopping center requires 66
parking stalls The current site has 81 parking spaces counting the shared parking with
Sunny Days Therapy to the south and space for 15 stalls on the north end of the site. This
exceeds the City's parking requirement.
Considering that the outdoor dining area is only offers seasonal dining, the current
shopping center tenant mix and the available on-site parking; staff finds the site offers
adequate parking to accommodate the proposed outdoor dining area.
J. Refuse containers are provided for self-service outdoor dining areas. Such
containers shall be placed in a manner which does not disrupt pedestrian circulation, and
must be designed to prevent spillage and blowing litter.
Comment: The applicant must confirm that the all dining in the outdoor area will have wait
staff service and will not include disposable packaging, plates and utensils that require a
trash can. An alternative would be to provide a trash receptacle within the dining area.
K. Property owners shall pick up litter within one hundred feet (100') of the patio area.
Comment: this will be a condition of CUP approval.
L. Live outdoor music performance shall meet the requirements of section 5-5-3 of the
city code.
Comment: This will be a condition of CUP approval.
M. No electronically amplified outdoor music, intercom, audio speakers, or other such
noise generating devices shall be allowed in the outdoor sales area.
Comment: This will be a condition of CUP approval
N. No outdoor bar, cooking facility, food preparation or holding area shall be established.

CONCLUSION
The Hen and Hog restaurant wishes to expand the seating capacity to grow their customer
base. In review of their application Staff recommends approval of a conditional use permit
for outdoor dining for the Hen and Hog restaurant located at Suite 111 Prairie Run
shopping center per the plans and narrative submitted dated 06/17/2021with the following
conditions.
1. The outdoor dining area shall be configured and design in accordance with the
plans submitted dated 06/17/2021.
2. The applicant receives a building permit for the new doorway between the building
and the outdoor dining area.
3. The outdoor dining area is approved as being 20% or less than the entire shopping

We will be using German Quality Fencing. They are putting up 4ft x 8ft Black Steel fencing
panels, along with two black steel gates, for exit-only purposes. They will be drilling into the
concrete slab, about a foot to a foot and a half in from the curb. We are also putting up curb
stoppers into the ground on the South side of our building in front of the fence,to stop guests
from hitting our fencing when they park. They are extending some posts to about 8 feet tall,
where Edison bulb string lights will be strung across the patio. There isn't any permanent shade,
so we will have umbrellas at the center of each table. Our plan is to have at least eight tables on
the patio, seating 30 people. We will have seven,four-person tables and one, six-person table.
Each table is placed 5 feet apart,and there is also a distance of 5 feet from the fencing to the
tables. Our architect, Bill Rust, from Rust Architects has already come out to look at the space
and gave us great feedback on our plans for the door installation and fencing.

GENERAL ADMINISTRATION
Update to Dog Licensing Ordinance: City Staff is working on the amendments to the current
City Code section regarding Animal Control and will present the proposed amendments in
August.
Advanced Volumetric Alliance: AVA has is working with the St. Paul Port Authority for project
financing through the Port Authority's PACE Program, which uses special assessments on the
property to repay the loan. As part of the program, the City will be asked to enter into a joint
powers agreement with the Port Authority. I expect to have an agreement from the Port
Authority for the Council to consider at the next meeting. AVA is working to finalize
construction plans, the plat, and development agreement.
Joint Governance Meeting: The STMA School District has requested a joint meeting for August
30, 6:00 pm at Middle School West.
American Rescue Plan Act: Staff has started the application for receiving the grant and expects
to receive the first half of the distribution in July and the second distribution a year later. The
projected amount the City would receive is $105 per capita based on 2019 population which
would be an estimated $780,780. The funds must be spent by December 31, 2024. Currently
the use of funds needs to be for: responding to public health emergency, addressing negative
economic impacts, serving the hardest hit, improving access to infrastructure. Once the funds
are received there should be a discussion on options of choice for spending the money prior to
our first required submission to the US Treasury October 31, 2021.
ENGINEERING/PUBLIC WORKS
2021 Street Project: The project is progressing with curb patching complete and milling and
utility adjustments nearing completion. Paving is scheduled to begin this week and be
complete by the end of next week.
The Preserve at Albertville: The final plat approvals will be considered at Monday's meeting.
We are waiting on the traffic report, which will be presented as soon as we receive it.
Skate Park/Basketball Court: The skate park concrete work will be complete this week and
Omann's Bros. will begin grading around the skate park and basketball court construction next
week.
