Call to Order Mayor Hendrickson called the meeting to order at 7 pm. 2. Pledge of Allegiance—Roll CaII Present: Mayor Hendrickson, Councilmembers Cocking, Hudson, Olson and Zagorski Staff Present: City Administrator-PWD Nafstad, City Attorney Couri, City Planner Brixius, Fire Chief Bullen, Finance Director Lannes and City Clerk Luedke. 3. Recognitions—Presentations—Introductions -None 4. Public Forum There was no one present for the public forum. 5. Amendments to the Agenda City Administrator Nafstad requested item 9172 The Preserve at Albertville be moved from Planning and Zoning to 9A2 under the City Council section. MOTION made by Councilmember Cocking, seconded by Councilmember Hudson to approve the June 21, 2021, agenda as amended. Ayes: Cocking, Hendrickson, Hudson, Olson and Zagorski. Nays: None. The motion carried. 6. Consent Agenda All items under the Consent Agenda are considered to be routine by the City staff and will be enacted by one motion. In the event an item is pulled, it will be discussed in the order it is listed on the Consent Agenda following the approval of the remaining Consent items. Items pulled will be approved by a separate motion. A. Approve the June 7, 2021, regular City Council Meeting minutes as presented. B. Authorize the Monday, June 21, 2021,payment of claims as presented, except bills specifically pulled which are passed by separate motion. The claims listing has been provided to City Council as a separate document and is available for public view at City Hall upon request. C. Adopt Resolution No. 2021-028 authorizing the City of Albertville to apply for the Grant Funds for Coronavirus Local Fiscal Recovery Fund established under the American Rescue Plan Act. D. Approve a Two-Day Temporary 3.2%Malt Liquor License for the Church of St.Albert's Annual Parish Festival on Saturday, September 18, 2021, from 5 pm to 11 pm and Sunday, September 19, 2021, from 10 am to 5 pm. E. Approve a Lawful Gambling Exempt Permit Application for the Church of St. Albert's annual Parish Festival that will be held on September 18 and 19, 2021, at the St. Albert Parish Center. Consent Agenda - continued MOTION made by Councilmember Hudson, seconded by Councilmember Olson to approve the June 21, 2021, Consent Agenda as presented. Ayes: Cocking, Hendrickson, Hudson, Olson and Zagorski. Nays: None. The motion carried. 7. Public Hearing -None 8. Wright County Sheriffs Office—Updates, reports, etc. There were no updates from the Wright County Sheriff's Office. 9. Department Business A. City Council 1. Committee Updates (STMA Ice Arena,Planning,JPWB,Parks, Fire Board,FYCQ Councilmember Zagorski provided an update from the Planning Commission meeting which included information from the Preserve At Albertville's public hearing. 2. The Preserve At Albertville—Amend Zoning Map, Creation of PUD Zoning District,Preliminary Plat and Building Plan Review City Planner Brixius presented the staff report which included information from the Planning Commission meeting, details on the project and the proposed zoning map amendments. He also provided information on the creation of the PAA-PUD zoning district including the conditions to be followed and answered questions from Council. Mr. Ian Peterson, Integrate Properties, provided an overview of project along with specifics on the preliminary plat and the PUD conditions. He answered questions from Council regarding the tentative project schedule,proposed home designs and the rental opportunities. City Administrator Nafstad and City Attorney Couri answered questions from Council regarding the project,traffic impacts to the area, the developer's contract and possible future ownership changes. Finance Director Lannes answered questions from Council regarding the City's utility billing process. There was much Council discussion regarding the traffic study conducted, the proposed home design, the rental opportunities and possible individual future sale of the homes. City Planner Brixius provided language for amendments to the Resolution to address the possibility of the lots being individual sold in the future. MOTION made by Councilmember Cocking, seconded by Councilmember Hudson to adopt Resolution No. 2021-029 approving the request of Integrate Properties for a Zoning Map Amendment, Zoning Text Amendment,Preliminary Plat and PUD development stage site and building plans for the project entitled Preserve at Albertville as amended. Ayes: Cocking, Hendrickson, Hudson, Olson and Zagorski. Nays: None. The motion carried. Councilmember Hudson excused himself from the meeting due to a work obligation at 8:16 pm. Building 1® Lawn Maintenance Policy Discussion City Administrator Nalstad presented the staff report which included the current lawn maintenance policy,the fees the City charges for staff time and equipment usage and the number of weed letters issued per year. He answered questions from Council and stated that no action is required for this item. Public Works Supervisor Guimont provided additional information on the current policy and the procedures the City uses for handling non-compliant properties. Finance Director Lannes answered questions from Council regarding the City's fees. There was Council discussion regarding the lawn maintenance policy and possibly raising the current City fees to detour property owners from taking advantage of the City mowing their property. C. City Clerk 1® Major Temporary Outdoor Music Permit for Residential Property City Administrator Nafstad introduced the item and provided information on the outdoor music permit application submitted for a residential location, He answered questions from Council. City Planner Brixius provided the background information on the City Code section 5-5-3 regarding outdoor musical performances and answered questions from Council Mr, Justin Anderson, 10541 61s'Place NE, was in attendance. He said he had a band play on his property for 7 years and that they never played past 10 pm. He said he had only received one neighbor compliant so that was when he submitted an application to the City for a permit. City Clerk Luedke and City Attorney Couri answered questions from Council. There was Council discussion regarding outdoor music events,the required criteria for the permits and the application Mr. Anderson submitted. It was the Council's consensus not amend the Albertville City Code relating to major temporary outdoor music permits to allow outdoor music in residential areas. MOTION made by Council member Cocking, seconded by Council member Zagorski to deny the Major Temporary Outdoor Music Permit for r® Anderson located at 1054161"Place NE for July 10, 2021. Ayes: Cocking, Olson and Zagorski.Nays: Hendrickson. Absent: Hudson. The motion carried. 2. Special Event Permit Application for the Church of St.Albert Annual St.Albert Parish Festival City Clerk Luedke presented the staff report which included details on the Church of St. Albert's Parish Festival, the requested street closure and answered questions from Council. City Administrator Nafstad provided additional information on the requested street closure and answered questions from Council. MOTION made by Council member Olson, seconded by Councilmember Zagorski to approve a Special Event Permit application for the Church of St. Albert located at 11400 5 7 1h Street NE for their annual St. Albert Parish Festival on September 18, 2021 from 5 to 11 pm and September 19, 2021 from 10 am to 5 pm. Purchase of a Card Access System for City Hall Finance Director Lannes presented the staff report which included background information on the current city hall card access system,the quotes received and the proposed implementation schedule of the new card system. She answered questions from Council. City Administrator Nafstad provided additional information on the quotes received for the card system. MOTION made by Councilmember Cocking, seconded by Councilmember Zagorski to authorize the purchase and installation of a card access system for the Albertville City Hall for a total purchase amount not-to-exceed $11,000 which includes the hardware installation, software program, software license and 100 key cards. Ayes: Cocking,Hendrickson, Olson and Zagorski.Nays: None. Absent: Hudson. The motion carried. 2. Tort Liability Insurance Renewal Finance Director Lannes presented the staff report and answered questions from Council. City Administrator Nafstad and City Attorney Couri answered questions from Council. MOTION made by Councilmember Olson, seconded by Councilmember Cocking to not waive the City's monetary limits on tort liability established by Minnesota Statues, Section 466.04. Ayes: Cocking, Hendrickson, Olson and Zagorski.Nays:None. Absent: Hudson. The motion carried. E. Fire—None F. Planning and Zoning 1. Regulations for Neighborhood Park Use City Planner Brixius presented the staff report which included details on the proposed amendments for neighborhood park use and answered questions from Council. City Administrator Nafstad provided additional information on the proposed changes to the ordinance and answered questions from Council. MOTION made by Councilmember Olson, seconded by Councilmember Cocking to adopt Ordinance No. 2021-08 amending the Albertville City Code, Title 8, Chapter 3, Section 8-3-2 Regulations for all City Parks in the City of Albertville. Ayes: Cocking, Hendrickson, Olson and Zagorski. Nays: None. Absent: Hudson. The motion carried. 2. Cemetery Structure Setbacks City Planner Brixius presented the staff report which included details on the columbarium that the St. Albert's cemetery would like to install on their property. He said the Planning Commission had recommended approval of the zoning amendments related to the setbacks applicable to cemeteries. MOTION made by Councilmember Cocking, seconded by Councilmember Zagorski to adopt Ordinance No. 2021-09 amending the Albertville Zoning Chapter 4850, P/I Public/Institutional Zoning District related to setbacks applicable to Cemeteries. Thrift Store and Secondhand Store Regulations City Planner Brixius presented the staff report which included background information from the study which was conducted to examine the operations of thrift and secondhand stores. He said the Planning Commission had recommended approval of the zoning code amendments related to the regulation for thrift and secondhand stores. MOTION made by Councilmember Zagorski, seconded by Councilmember Olson to adopt Ordinance No.2021-10 amending the Albertville Zoning Code relating to the definition and regulation of Thrift Stores/Secondhand Stores within the City's Commercial Zoning Districts. Ayes: Cocking, Hendrickson, Olson and Zagorski.Nays: None. Absent: Hudson. The motion carried. G. Public Works/Engineering—None H. Legal—None I. Administration City Administrator Nafstad said the Albertville City Council had been invited to Fehn's ground breaking event which would be held on June 23, 2021, at 2 pm. City Administrator Nafstad also provided an update on the I-94 construction project.
