Dear Joseph & Dolores:
Pilot Land Development Co. has talked with Gary Gutzwiller about cleaning Ditch 9 on their
property. I have enclosed a copy of their agreement for your review. You ace the last property
owner to execute an agrrement with Pilot to allow us to clean the ditch to its original flow
elevations as determined by Wright County. No signing of the letter could trigger the need for the
County to use an assessment process for cleaning. Feel free to talk to Gary about our discussions
with them. Work on their property is contingent on your consent to work on your land.
We would need to lower the ditch bottom up to three feet on your land. We would spread the
material on the east side of the ditch. The highway department has agreed to allow us the ability
to clean both sides of the pipe. They will review and clean any sediment in the pipe with their
staff this year. Development in Albertville is planned to construct holding ponds for both
sediment and water volume in order to release water at 1/2 the predevelopment rate that the Farm
fields used to. There is no more water created by development than falls from the sky. New
projects such as ours design storage ponds to hold nmoff before it enters the ditch. The release
of water from these storage ponds affects ditch flow similar to the drain~[ile in the fields, aver a
longer period, which helps keep flow in the ditch more often.
In order to clean. the ditch, please indicate your authorization to allow access within a 50 foot
area either side of the ditch on or along your property by signing below. Sediment from the ditch
will be smoothed out after our work. We had hoped to do this work before March 31, 199$ to
have the ditch clean before the spring runoff period. However, your delay in signing may cause
the project to go throughout the year and enter 1999. This work will restore the ditch to the
levels achieved during the last clean out in 1979 or there about.
Please contact me with any questions. Again, work by Pilot will not generate any direct
assessment, we will smooth out the ditch muck upon completion on your property near the ditch.
we will pile any trees needing removal in the same area for you to use as fire wood, etc. We can
also meet on site to review the work once we get County approval.
