Woodside Communities, the developer of the subject project, is requesting release of the outstanding
letter of credit (see attached letter).
As a condition to release of the letter of credit, the developer is proposing to establish an escrow account
to cover the cost of seal coating Karston Court.
There are some remaining lots in the development that have not been built. By delaying a seal coat on the
street to a future date, it is probable that some, if not all, of the remaining construction activity will be
completed. Surface area of the street is approximately 50,500 square feet, or 5,610 square yards. The cost
to seal coat the street (including construction contingency and engineering) is estimated to be $6,000.
Our recommendation is for the City to agree to establishment of an escrow account in the amount of
$6,000. Seal coating of the street should be included with a future City project.

Dear Mr. Moberg:
We have received your letter dated July 1, 2005 for Cedar Creek South 5th Addition.
The letter stated that there was some needed repair to the project. We have scheduled the
curb repair to be done on August 11th, 2005. Since we contracted to complete the curb
repair there will be no need to draw on the letter of credit.
In our phone conversation on July 13th, we talked about Woodside paying into an escrow
account for the seal coating to be contracted by the City next year. The City would have
the righ hto draw on this escrow money for the costs associated with seal coating Cedar
Creek 5 Addition.
We are prepared to escrow $ 5,445 for the seal coating; this estimate is based on 5,445
square yards of road and $1.00 per square yard for seal coating. When this escrow
amount is received, we ask for our outstanding letter of credit #06-02 in the amount of
$14,825 to be released.
If this solution is agreeable please let us know and we will issue an escrow check right
away.
We are committed to work with the City on completing this project and other projects in
the City.
