MARQUE'ITE Right of Way Agent (763) 682-7386 Don Jensen Pilot Land Development Company 13736 Johnson Street NE Ham Lake, MN 55304 RE: Utility Permit No. 98-010, Cedar Creek South Development along CSAH 18 City of Albertville Dear Mr. Jensen: We have requested your engineer, Meyer-Rohlin, Inc., to provide us with the following information (for the right turn lane as part of the above mentioned permit) on two (2) separate occasions without success. 1) What date was the right-turn lane work started, and what date was the work "completed"? 2) Who were the prime and subcontractors that performed the work? 3) Inspection reports for the work performed that documents what work was completed. To date, we do not have any of this information, which prevents us from completing the repairs needed on the right turn lane for the access to Cedar Creek Golf Club from CSAH 18. Capitol Indemnity Corporation will honor the bond of D&M of Buffalo, Inc., provided that the work was done within the period that the bond was valid. Therefore, we need to have the above information, in writing, in order collect from the bond so that we can proceed with the needed repairs to the turn lane (since you have chosen not to deal with this matter directly and requested we take care of it). The completion form for permit No. 98-010 has not been received yet by our office which would indicate that the work is completed and ready for inspection by our office. In our view, the work is not yet completed or accepted and it is your responsibility Gointly with Meyer-Rohlin) to make repairs to the right turn lane. Please provide us with the above information so that we can proceed to repair the right turn lane, which we have previously identified in our June 29, 2000 correspondence to you, which is breaking up in several locations and needs to be patched. We would appreciate your assistance in this matter, and look forward to working with you in future Pilot Land Development ventures in which County access & utility permits will be required.
