Re: Acceptance of Improvements
Dear Mr. Cooper,
The homeowners association is responsible for maintenance of the common elements and
limited common elements. These elements include the landscaping, streets, curb and
gutter, etc. The purpose of this letter is to provide acknowledgement on the Association's
behalf of acceptance and approval ofthe improvements. This acknowledgement releases
Woodside of the liabilities associated with the repair and maintenance of the common
elements and limited common elements.
Woodside will finish the trail along the eastern edge of Jason Lane. Woodside will also
repair any damage to Association property that was as a result of building this trail, such
as sod damage and irrigation system damage. Once complete, this trail becomes the
responsibility of the City of Albertville for repair and maintenance.
The one other outstanding issue is the street light poles on Jason Court in front of 5493
and 5478. These poles lean slightly. These street lights are owned by Xcel Energy.
Woodside has repeated contacted Doyle at Xcel Energy regarding these poles. Doyle has
committed to fix the poles in the spring. If this is not accomplished in a timely manner,
Woodside reconL.'1.1ends the Association contact Doyle directly at 763-271-6433.
By signing the acknowledgement at the end oftrus correspondence, the Homeo"Wllers
Association accepts the improvements associated with the Cedar Creek Townhome
development, legally known as Cedar Creek South Sixth Addition and Cedar Creek
South Seventh Addition and agrees to maintain and repair the improvements as needed,
