1997-09-10 EAW Review Minnesota Pollution Control Agency September 10, 1997 Mr. Garrison Hale, City Administrator City of Albertville 5975 Main Avenue Northeast Albertville, Min..'1esota 55301 Re: Center Oaks Residential Development, Environmental Assessment Worksheet Dear Mr. Hale: The Environmental Assessment Worksheet (EA W) for the Center Oaks project has been reviewed by the Minnesota Pollution Control Agency (MPCA). The preparer(s) of this document are to be complimented for providing a clear and comprehensive presentation. The information provided appears to adequately describe the potential environmental impacts from the project. We believe that impacts from construction and post-construction phases of the project can be mitigated by adhering to applicable regulations and ordinances and that the preparation of an Environmental Impact Statement (EIS) is not warranted. Based on the information contained in the EA W, we have the following comments for consideration and response prior to the decision on the need for an EIS, and during future review by the city prior to permitting and construction. Item 8. Permits and Approvals The MPCA must also issue a Section 401 Certification in conjunction with the u.S. Army Corps of Engineers (USACE) Section 404 permit process. This will be coordinated by the USACE. Item 19 . Wastewater The city is reminded that the any future expansion of the wastewater treatment facility beyond its current design flow of 0.315 million gallons per day will be reviewed by the MPCA to determine the applicability of nondegradation review requirements. This could result in the assignment of more restrictive effluent loading limits for specific pollutants such as biochemical oxygen demand and phosphorus. Long-term, we would encourage the city to feature the restoration of Mud Lake as high quality wildlife habitat in its perspective of wastewater planning. 520 Lafayette Rd.
