MN 55313 REo' Ditch #9 Cleanin1! within the Center Oaks Subdivision. approval for dischar1!e modification. cleanin1! between County Hi1!hwavs 119 and 118 Dear County Commissioners: Pilot Land Development Company seeks formal acknowledgment. permission, permit or other better known adjective to perform the routine maintenance task of cleaning County Ditch #9 to the plans and profiles as prepared for the County. found at the Auditor's office and prepared in 1921. Our engineers are comparing the plans to current elevation information to determine the appropriate ditch clean out elevations. We will have a second consultant perform 4 to 6 soil probes of the ditch to compare ditch bottoms to this profile. This research will satisfy the DNR regarding ditch hydrology, No further work will be performed by Pilot. We have prepared our plans according to State of Minnesota "best management practices" for storm water and have decreased runoff from the typical predevelopment rates to 1\2 the predevelopment rate. The questions of drainage basin research is the obligation of municipalities and larger regulatory bodies such as WSWCD or the County itself in an effort to plan for growth. Our professional experience is that "urbanized development" often provides better response to water quality, pollution control, storage, and rate control than the existing farm fields. This clean out is a one time operation of no charge to the County or the adiacent property owners. We will withdraw this ditch cleaning offer if we do not receive approval from the County by January 21. 1998. After this work. we urge the County and Albertville and the County and St. Michael to resolve the appropriate language to perform future ditch maintenance to keep this element of the storm drainage system functioning. We also urge the County and St. Michael to examine whether moving the ditch to a straighter line between Highway 118 and 119 would be in the greater public benefit upon any future development of these lands. Using old section lines to create ditch flow was fine for the early 1900's but could be improved today. Pilot Land Development Company on behalf of the Center Oaks LLP has received a negative declaration on an EAW, a negative declaration for an EIS on Cedar Creek from Albertvi'lle, concept PUD approval from both Albertville and St. Michael for the overall development known as Cedar Creek Golf Community, has received a NPDES permit to grade from MnPCA, and has land dev/ ditch9-I.doclalbertville 13736 Johnson Street NE . Ham Lake, MN 55304 . 757-9816 . Fax: 757-4094 executed a grading agreement with the City of Albertville. We have requested permits from Wright County previously, and have followed the direction of the City Engineers in our project development. We have worked with WSWCD, the COE and DNR on wetland permit issues. We are also using this letter to request your acknowledgment that we are changing from sheet runoff and discharge into Ditch 9 which is unabated to our existing lateral ditch's to a point source discharge after pretreatment, wetland mitigation cells, and volume control per the plans submitted and approved by Albertville and WSWCD. To date, no one has furnished a form or process outline for this change of discharge, so we presume this letter will suffice. We are the onlv land developer alonfl with the Citv of Albertville who have implemented voluntarilva 1/2 predevelopment rate of runoff for this pro;ect and all of the Cedar Creek Pro;ect. Until ditch cleaning is performed between Highway 119 and 118 no amount of work we do will create perceptible change to downstream lands. Upon completion of the several hundred acres of best management practices for storm runoff into detention, retention, and wetland restoration areas present in the Pilot Land Development projects in Albertville, sedimentation from north of Highway 118 and West of Highway 19 will be almost nil. (some will occur within the ditch itself over time. However, removal of lands from active tilling to more permanent cover of bluegrass or wetland grasses will eliminate virtually all of Albertville from being a contributor of non controlled water and sediment) At the ditch committee meeting of December 3, all adjacent property owners were present. When asked to voice objections, no one did. We are enclosing signed agreements for two of the affected property owners. Kenco can best perform the ditch cleaning during the months of January to early March 1998. Please contact us immediately if there is a problem with this letter. The ditch cleaning will create improvements for both current agricultural uses and future land uses. We would be happy to meet on site if that would clarify or expedite the approval process. In some locations. sedimentation of up to four feet may need to be removed. Most of the ditch obstructions are at the points immediately downstream from your lateral ditches. Development in Albertville is planned to construct holding ponds for both sediment and water volume in order to release water at a much slower rate than the farm fields release to date. In order to clean the ditch. please indicate your authorization to allow access within a 50 foot area either side of the ditch on or along your property by signing below. Sediment from the ditch will be smoothed out after our work. We hope to do this work between January I and March 31. 1998 to have the ditch clean before the spring runoff period. The majority of this land drains directly to County Ditch No.9. This concept plan has' preliminary approval from the City Council, and Pilot is preparing detail plans, including a grading and drainage plan, for a PUD agreement. The development is incorporating a series of storm water detention ponds throughout the golf course and residential areas that will limit the post-development storm water runoff rate to half the pre-development runoff rate, in accordance with City policy. As part of the grading plan, the developer is proposing to clean out and regrade County Ditch No. 9. Water levels in existing ponds are higher than normal because of poor drainage in County Ditch No.9. The cost of this work to be paid by the developer. The City supports this plan, and agrees that cleaning the ditch is necessary to provide proper drainage for the area. In order for th~s work to proceed, is a permit required and, if so, who should apply for it? ' With this development, the City will be acquiring the detention ponds for maintenance purposes. It seems appropriate for the City to also take over maintenance of County Ditch No.9. Is it possible for the County to "turn back" the ditch to the City and, if so, what is the process for the "turn back" to take place? Is a public hearing required? Authority to consolidate or divide. After the benefited area of a drainage system has been redetermined by the drainage authority under section l03E.351 or in connection with drainage proceedings, the drainage authority may divide one system into two or more separate systems, consolidate two or more systems, transfer part of one system to another, or attach a part of a system that has been abandoned as provided in section l03E.805 or l03E.811 to another system to provide for the efficient administration of the system consistent with the redetermination of the benefited area. Subd. 2. Initiation of action. The consolidation or division may be initiated by the drainage authority on its own motion or by any party interested in or affected by the drainage system filing a petition. If the system is under the jurisdiction of a drainage authority, the petition must be filed with the auditor. If the system is under the jurisdiction of a watershed board, the petition must be filed with the secretary of the board. Subd. 3. Hearing. (a) When a drainage authority or watershed board directs by resolution or a petition is filed, the drainage authority in consultation with the auditor or secretary shall set a time and location for a hearing. The auditor or secretary shall give notice by publication to all persons interested in the drainage system. The drainage authority may consolidate or divide drainage systems, by order, if it determines that the division of one system into two or more separate systems, the consolidation of two or more systems, the transfer of part of one system to another, or the attachment of a previously abandoned part of a system to another system: (1) is consistent with the redetermination of the benefited areas of the drainage system; (2) would provide for the efficient administration of the drainage system; and (3) would be fair and equitable.
