Present: Chair Buhrmann and Commissioners Anderson, Hayden, Huggins, Smith and Council Liaison Zagorski. Absent: None. PUBLIC HEARINGS A. Public hearing to consider a request of Konz Crossing for a conditional use permit for drive through service lane, a variance from the stacking length requirement for a drive through service lane and a conditional use permit for outdoor dining for the property at 5703 Lachman Avenue Ne. Brixius presented the Albertville - Konz Crossing application to the Commissioners. He went through the conditional use permit for accessory drive-through service lane, the variance from stacking space requirement for an accessory drive-through service lane, and the conditional use permit for accessory outdoor dining. Due to the unique drive-through lane being proposed (meaning pre-ordering your food and then being just a pick window rather than normally you order your food when get to the drive-through), Commissioner Huggins asked what would happen if someone came up to the drive-through that didn't pre-order or if their food was not ready,where would they go to wait. Brixius stated that they would circle around and get back in line, or they would be directed to wait in a parking stall. Commissioner Smith asked how long the average meal prep time is per meal. Owner of the proposed building, Christine Konz, approached the podium. She informed Raw Table is the proposed tenant going into this space with the drive-through. Christine informed that Raw Table's vision is more of a meal prep type of place, for example, if someone would like to order S lunches for the week, they can order those and pick them up. This is more of a Crisp n' Green or a Chipotle. They will have seating available. Andy Konz, Owner of proposed building as well, approached the podium and stated that this is more of a quick service type of meal prep. They will primarily focus on morning and lunch hours for service. Christine Konz stated that they still have more room available for future tenants as well. They are hoping to break ground by April. Anderson asked about the width of the drive-through. Brixius and Dahlke said it was 11ft wide.Anderson is wondering how close the pergola is to the curb and if the fence is strong enough to stop a car if it jumps the curb. Brixius informed Commissioners that there is a 2 feet setback from the curb to the outdoor dining fence that is listed in the conditions for the applicant to follow. Commissioners discussed the commercial outdoor music ordinance. Anderson asked if there could be signs put up so customers know that the drive-through is a pre-order and pick up only line, so they don't think they can go in the line and order. Brixius said that there can be signs placed out. Commissioners asked about the drive- through line and if this switched tenants. Brixius stated that they are requesting this four car pileup drive-through with pick up only (not ordering) and they are comfortable with this based on the tenant that is going in the building. Huggins asked if the current proposed tenant does not work out and a coffee shop would like to go in, what would they need to do. Brixius said that the CUP runs with the property, but they would need to amend the CUP and resubmit plans to meet all code requirements. A condition of the approval included: "Outlots D and F are the parcels that will be made available for purchase by the Water Treatment Plant." The final plat has progressed into site development. Integrate Properties LLC and the Joint Water Board has entered into a purchase agreement for the sale of Outlots D and F of Preserve at Albertville. The outlots are currently contained within the PAA-PUD zoning district which was approved for the Preserve at Albertville plat. As a condition of purchase the Joint Waters wants Outlots D and F to be taken out of the PAA-PUD zoning district and removed from the Preserve at Albertville PUD agreement. The Joint Water Board wants Outlots D and F to be zoned P/I Public / Institutional zoning district to be consistent with the balance of their property and to allow for the expansion of the water plant facilities located at their site. ANALYSIS The sale of Outlots D and F to the Joint water was a condition of the Preserve at Albertville approvals. The intent of this condition is to provide sufficient land area for the operation and expansion of Joint Powers Water facilities at their present location. Expansion of this facility is needed to serve its continually growing service area and population. In this regard the acquisition of the Joint waters site provides opportunity for it to grow in-place. The change in zoning from PAA-PUD district to P/I district establishes a zoning district to facilitate the expansion of the Joint Waters facilities. In review of the change in zoning the following findings are offered. 1 . The change in zoning is consistent with the Albertville Visioning Study polices. • Promote long range planning of utility infrastructure to keep pace with growing service needs. • Continue to investigate opportunities to share facilities, services and programs with surrounding communities as a means of expanding services, avoiding duplication and reducing costs for Albertville residents. 2. The land use is compatible with surrounding land uses. The outlots will be joined with the existing Joint Waters property. The outlots are physically separated from the Preserve at Albertville single family neighborhood by a large wetland. Appropriate site planning and screening of the Joint Water facilities will be required with future site development. 3. The change in zoning will not overburden City utilities or services. 4. The change in zoning will not result in traffic generation beyond the capacity of streets serving the property. CONCLUSION Based on the aforementioned findings, City Staff recommends the zoning map amendment changing the zoning of Outlots D and F Preserve at Albertville from PAA- PUD district to P/I Public /Institutional district. NOW, THEREFORE BE IT RESOLVED, that the City Council of Albertville, Minnesota hereby approves Ordinance 2021- zoning map amendment to change the zoning for Outlots D and F, Preserve at Albertville from PAA-PUD zoning district to P/I Public/ Institutional district and releases Outlots D and F from the Preserve at Albertville development /PUD agreement. City Council directs the City Staff to take the necessary actions to release Outlots D and F from the Preserve at Albertville development/PUD agreement.
