2005-05-16 CC Findings of Fact CITY OF ALBERTVILLE City Council Findings of Fact & Decision Albertville- Quality Title Building Site and Building Plan Review Applicant's Name: Mainstream Properties, LLC Request: Mainstream Properties, LLC is requesting site and building plan approval to construct an office building. 1. Site and Building Plan approval Planning Commission Public Hearing Date: April 12, 2005 City Council Meeting Date: May 16, 2005 Findings of Fact: Based on review of the application and evidence received, the City Council now makes the following finding of fact and decision: A. The property is legally described as Lot 1, Block 5 Heuring Meadows. B. The planning report dated April 6, 2005 from Northwest Associated Consultants as well as the engineering report dated March 30, 2005 from SEH were reviewed and presented to the Planning Commission. C. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. C. Traffic generated by the proposed use is within capabilities of streets serving the property as proposed. <If'''''' " , E. The requirements of the Albertville Zoning Ordinance have been reviewed in relation to proposed plans. F. The proposed actions have been considered in relation to the specific policies and provisions of and have been found to be consistent with the Comprehensive Plan. G. The proposed development will be compatible with present and future land uses of the area. H. The proposed use conforms to all applicable Zoning Ordinance performance standards. 1. The proposed use will not tend to or actually depreciate the area in which it is proposed. Decision: Based on the foregoing information and applicable ordinances, the City Council APPROVES the Site and Building Plan based on the most current plans and information received to date subject to the following conditions: 1. The applicant shall revise the size of the building to meet the required setbacks. 2. All parking stalls shall be nine (9) feet by twenty (20) feet. 3. The applicant shall be required to provide a cross access easement with Shoppes at Prairie Run to the south. 4. The grading and drainage plan shall be subject to the review and approval of the City Engineer's report dated March 30,2005. 5. All landscaping shall be required to be irrigated with a one year landscaping guarantee. 6. The applicant shall submit details of the trash enclosure. The exterior materials of the trash enclosure shall consistent with those used for the main building. 7. The applicant shall submit a lighting and photometric plan for review of the City. 8. The applicant will be required to apply for a sign permit for all signs proposed for the building. 9. A development agreement shall be entered into between the developer and the City. 10.
