2004-08-06 Temporary Easement Agrmt TEMPORARY EASEMENT AGREEMENT This agreement is entered into this t~ ~ day of Ih./ h.ff4! , 2004 between the City of Albertville ("City"), Buyer, and Robert C. H~hristine A. Heuring (collectively "Heuring"), Seller. Purchase of Easement. Heuring agrees to provide the City with a temporary easement to facilitate the installation of the Prairie Run improvements, said temporary easement to be in the same form as that attached as Exhibit A to this Agreement. Said easement shall be granted prior to August 7, 2004. Consideration. The City agrees to pay Heuring for any crop damage which occurs over that portion of property which is shown as Lot 16, Block 1, Outlot B and Outlot C on the Prairie Run plat, excluding the approximately 44,521 square feet of pond easement area that is proposed to be located on Outlot B, provided the City acquires such pond easement from Heuring. Crop damage shall be paid for disturbed areas based on the value of the crop at harvest time using the average yield on the land over the prior three years. Special Assessments. This easement agreement shall not alter or change the Agreement For Waiver Of Objection To Special Assessment Associated With The 2004 Prairie Run Improvement Plans dated August 6, 2004 between Heuring and the City. Contingency: The City may cancel this purchase agreement if all of the conditions imposed upon the final plat approval of Prairie Run are not satisfied prior to the closing date. Time Of Essence. Time is of the essence in this Purchase Agreement. Entire Agreement. This Purchase Agreement, any attached exhibits and any addenda or amendments signed by the parties, shall constitute the entire Agreement between Heuring and the City, and supercedes any other written or oral agreements between Heuring and the City related to the purchase of the easement. Heuring and Christine A. Heuring, (collectively, Grantors) and the City of Albertville, Wright County, Minnesota, (Grantee). WITNESSETH: WHEREAS, Grantors are the entities and individuals with an ownership interest in the real estate hereinafter described. That for good and valuable consideration, the receipt of which is hereby acknowledged, Grantors have this day bargained and sold, and by these presents do bargain, sell and transfer unto the City of Albertville its successors and assigns the following: A temporary construction easement over, under and across the entire area included in the Prairie Run Final Plat as shown on attached Exhibit A-I, A-2, and A-3 and excluding the area as shown on attached Exhibit B. Said temporary construction easement expires December 31, 2005. Grantors do hereby covenant with the City of Albertville, that they are lawfully seized and possessed of the real estate above described.
