Dear Mr. Bond:
This letter is to follow up on two requests made by your client, Bob Heuring, with regard to the subject
project. The two requests are:
1. Turf restoration of property owned by Mr. Heuring that lies north of 51st Street and east of Kyler
Avenue.
2. Grade restoration in an area on Lot 16, Block 1, where an existing farm building was removed.
Regarding the first request, the area in question was seeded and mulched by the City's contractor in the
fall of 2004. In 2005, Mr. Heuring chose to plant a crop in this area and plowed under all of the vegetation
established by the City's contractor. As a result of this action, the City's contractor was relieved of any
obligation to restore the property. If Mr. Heuring is now seeking to re-establish turf on the property, he
must do so at his own expense.
With regard to the second request, the developer's agreement executed between Mr. Heuring and the City
indicates that building removal and associated activities on Lot 16, Block 1, are the responsibility of
Mr. Heuring. Under the terms of this agreement, the City has no obligation to restore the ground where
the building was removed.
