Dear Mr. Heuring:
According to your attorney, Mr. Andy Bond, you had some concerns with the easement agreement I
delivered to your house on August 5, 2005. Specifically, you were concerned with establishing a firm
date to complete the staking of the drainage easement on Outlot B, watering and maintaining the new sod
installed on the slope on your property, and the cost of relocating a driveway entrance on Kyler Avenue in
the event the existing entrance interferes with the existing drainage easement on Outlot B.
To address your concern about when the existing drainage easement will be staked, SEH will complete
the staking on or before August 12,2005, barring any unforeseen circumstances.
Regarding the watering and maintenance of sod, the City's contractor will be responsible for watering and
maintaining the sod for a period of 30 days after the installation is completed. This requirement is
consistent with the conditions specified in the rest of the construction contract. Once the 30-day period
has expired and the sod is determined by the City to be in acceptable condition, you will be responsible
for maintaining it.
Finally, in response to your concern about the location of the driveway entrances for Outlot B, the two
entrances were placed across from the entrances to the commercial lot on the east side of Kyler Avenue. I
compared the location of the northerly entrance to the legal description for the drainage easement and it
appears the entrance lies well outside the easement. Once the easement staking is completed, I will
review the site to determine whether a conflict exists. If there is no conflict, the City will have no reason
for relocating the entrance. In the event there is a conflict, we will work with you and/or your developer
to explore options for resolving the conflict.
