Dear Mr. Moberg:
Please be advised that our firm represents Gold Key Development. This letter is in
response to your letters of April 26, 2006 and November 2, 2005 to Dean Johnson. For your
convenience, J am attaching hereto a copy of said letters. You apparently want Gold Key
Development to grade and fill the area around the building which was removed from Mr.
Heuring's property. Gold Key has no obligation to provide additional grading or fill material. In
fact, the building to which YOll are referring is not even on the land that Gold Key purchased.
Rather, it is all located within Bob Heuring's property. Although Gold Key did remove the
building, it had no obligation to do so. In any event, the Purchase Agreement between Heurings
and Gold Key only provides that Gold Key would be responsible for the demolition of any
buildings located upon the property. It does not provide that Gold Key would be responsible for
grading and filling the area. after removal of any buildings. If you have any questions or
