CALL TO ORDER-PLEDGE OF ALLEGIANCE Acting Mayor Vetsch called the meeting to order at 7:05 p.m. 2. ROLL CALL Present: Council members Hudson, Olson, Sorensen, and Vetsch Absent: Mayor Hendrickson Staff Present: City Administrator-PWD Adam Nafstad, City Planner Al Brixius, Finance Director Tina Lannes, City Clerk Kimberly Olson, Fire Chief Eric Bullen, Public Works Supervisor Tim Guimont, Maintenance Worker Mike Jenkins, Water/Wastewater Supervisor John Middendorf, and Maintenance Worker Ryan Zachman Others Present: Robert Zagorski, BJ Lawson, and Kris Jenkins 3. RECOGNITIONS—PRESENTATIONS—INTRODUCTIONS A. Years of Service Recognition for Mike Jenkins and Ryan Zachman Nafstad recognized two Public Works employees for their outstanding service: Mike Jenkins for fifteen years of service and Ryan Zachman for ten years of service. Guimont stated they have a really good team and it makes the job much easier when you have such a good team. Vetsch stated that having such a good staff means a lot and he also thanked the families of the Public Works Department for the odd hours the employees work due to plowing and being on call. 4. PUBLIC FORUM BJ Lawson, 10607 56th Street NE, was present at the forum. Lawson stated she saw the article on the proposed Mall of Entertainment and felt it was a surprise to the community. She inquired if there had been any research and had concerns about traffic and additional services the mall would require. Hudson stated that the City had been aware of a possible development for a number of years, but no specifics. He stated they also learned of the development in the paper as well. He reported that no development application has been submitted to the City, so there is no trigger for the City to begin Page 1 Agenda Page 4 any type of action. Vetsch clarified that the property in question had been rezoned a few years ago to help with a potential project. Nafstad stated that the City had entered into a confidentiality agreement with the land owners to discuss process,potential costs, and zoning; essentially big picture questions for a future development. He stated that agreement was needed because of competition in the industry. Nafstad stated that there are impact studies to be done and the public process will commence once an application is received and they move through the steps for approval. The public process will include public hearings and publications. Hudson informed Lawson the Council is cognizant of the community's heightened interest in the potential development and they realize there is a higher expectation for relaying information to the community. Lawson felt communication is very important and she would like to see a survey sent out to the community.Nafstad stated they have not done surveys in the past due to cost,but that could be considered once they receive a development application. He inquired how Lawson likes to receive information. Lawson replied that the web is good, but mail and newsletters are effective too. Brixius stated that he has encouraged the landowner to present their development concept to the City Council. 5. AMENDMENTS TO THE AGENDA There were no amendments to the agenda. Committee Updates (STMA Ice Arena, Planning, JPWB, Parks, Fire Board, FYCC, etc.) Vetsch reported the Parks Committee discussed Parks Night Out and set the date for Friday, May 20, 2016. They discussed lights for ballfield three and improvements to Westwind Park. Nafstad reported that he would like to work with the City's Planner's office to create some designs for the improvements. B. Public Works/Engineering 1). Toro Mower Purchase Nafstad reported the purchase would replace equipment that is ten years old. Guimont stated they have been budgeting for the mower's replacement for ten years and it is a budgeted purchase. Guimont stated they receive good pricing off the National IPA Contract. Hudson reported that he was questioned by a resident about the price tag ($62,179.94) for the mower and why the City doesn't purchase a less expensive piece of equipment. He stated that he did see the equipment online for less, but it was used. Guimont stated if the current mower should fail, it would definitely cause issues. The current mower could also be used as backup. Hudson stated there is value to purchasing new equipment, i.e. warranty. Nafstad stated they have purchased used equipment, but usually it is for equipment they are not so dependent on and don't use so extensively. Guimont stated they frequently look at the auction sites for other equipment that is not frontline equipment. Guimont stated that one larger mower is more efficient than two staff members with smaller mowers; Hudson stated he viewed the mower online and stated it is impressive how quickly it mows. Vetsch stated the committee had discussed that the Wastewater Treatment Facility could use the other mower. Motioned by Hudson, seconded by Olson, to approve purchasing a new Toro Groundsmaster 41 00 D for the amount of S62,179.94. Ayes: Vetsch,Hudson, Olson, and Sorensen. Nays:None. Absent.Hendrickson. MOTIONDECLARED CARRIED. C. Fire 1). Fire Department Update Bullen reported on the statistics for the Fire Department for 2015. He reviewed the number of hours of training the department received as well as the number of volunteer/community service hours the department has provided. He stated the volunteer hours were above 1,000 hours since April of 2015 and he felt it is important to track those hours. Sorensen stated the amount of volunteer hours is impressive. Bullen reviewed the grants received in 2015. Bullen reported on the recipients of the City Council Meeting Minutes Page 3 Regular Meeting of February 1,2016 Agenda Page 6 Fire Service awards that will be before Council in March. He stated that eleven members were nominated for the Paul Heinen Above and Beyond award, which was quite impressive and a testament to the Fire Department. He reported that Firefighter Tim Daly has announced his retirement and will be present at the Fire Service Awards. 2). Albertville/Otsego Fire Service Bullen reported that both Otsego and Albertville had signed support letters to submit an application to the MN DPS/State Fire Marshal Division for a grant to evaluate potential shared fire services for Albertville and Otsego. He reported they applied for$40,000 and received $23,000 with a match of $2,555 from the City, which will be paid from fire capital. He stated that the guideline for the joint fire service evaluation is listed directly in the grant, specific to Albertville and Otsego. Springsted, Inc. is a local company that has done previous evaluations of fire shared services in Minnesota. Springsted has agreed to complete the specifications listed in the grant. Vetsch inquired about the study timeline and Bullen stated the evaluation must be done by June 30, 2016. Nafstad clarified the City does not need to make any decisions by that time; Sorensen stated this does not bind the department at all. Bullen reported the Joint Fire Committee has suggested a Memorandum of Understanding from both Albertville and Otsego to continue to explore a potential joint fire service. Nafstad stated that the City Attorney has reviewed the agreement with Springsted and scope of the services. Sorensen stated that the City may not agree with the recommendation from Springsted and they are not bound to follow any recommendations. Bullen indicated that Springsted has worked with other surrounding communities and has seen what has worked and what has failed. Nafstad stated it is not approval of the Joint Powers Agreement. Olson inquired if there was any internal feedback from the Albertville Fire Department and Bullen indicated the department has been kept informed and he has not heard any opposition. Motioned by Sorensen, seconded by Olson, to approve the Memorandum of Understanding with the City of Otsego to continue to explore a potential Joint Powers Agreement(JPA)for Fire Services, approve the State of Minnesota Shared Services Grant Contract, and approve the proposal from Springsted,Inc. to study shared fire service. Finance 1). 4tb Quarter Budget to Actual [Un-audited] Lannes reported that the report is a very preliminary snapshot of the budget to actual totals. There are still many moving parts to take into consideration such as journal entries, payments, etc. for 2015. 2). Server Monitoring/Maintenance Contract Lannes reported the City has previously purchased blocks of time for as needed assistance on server maintenance and IT issues from BusinessWare Solutions. She indicated the server is nearly four years old and there was a recent hard drive failure that was under warranty; as the equipment gets City Council Meeting Minutes Page 4 Regular Meeting of February 1,2016 Agenda Page 7 older, it will require more maintenance. Staff is suggesting entering into a server monitoring and maintenance agreement with BusinessWare Solutions rather than purchasing blocks of time. Motioned by Hudson, seconded by Olson, to approve entering into an annual contract with Business Ware Solutions to monitor the City's server starting in 2016. City Administrator's Update Nafstad reported the Arena Design Committee will be meeting from 4:00-7:00 p.m. for the ice arena tour and the Board meeting will be moved up to 7:00 p.m. Nafstad stated that Burger King is planning an interior remodel of their building which will impact parking requirements. The Planning Commission will hold a public hearing at their next meeting for a variance in regards to the additional stalls that are needed. Brixius reported Burger King has also re-submitted an improved pedestrian crossing and management at the Albertville Premium Outlet mall was supportive of the concept. Nafstad reported that they may want to cancel the Joint Governance meeting tentatively scheduled for February 29, 2016. Olson reported that he would be absent on that date. Sorensen stated that a topic to discuss could be representation from Albertville on the School Board. He stated that all School Board members reside in St. Michael. Nafstad reported the Guardian Angels Gala is scheduled for Saturday, March 12, 2016. If there are other Council members interested, they could reserve a table. Vetsch felt this is a good fundraiser for Guardian Angels and wants to show them support in the community. Nafstad asked to be excused from the February 16, 2016 meeting as he will be on vacation and since it is a Tuesday meeting due to a holiday, there will be no consultants present. There are very few items slated for the meeting and inquired if the Council would like to cancel the meeting. At this point,the only item would be payment of claims. Sorensen's only concern would be delay on any development or action items. Nafstad stated he would let Council know the week before the meeting if the meeting is going to be cancelled. Olson inquired if they City has seen any invoices for Trailblazer Transit. Nafstad stated that Trailblazer has been operating for two years and they have yet to see an invoice. Nafstad stated ridership has been doing well and they will be opening a new facility in Buffalo next year. Nafstad stated there are no changes to the Personnel Policy, although he is having the City Attorney review how they do background checks. Nafstad stated that the administrator and consultant reviews were scheduled for directly after this meeting, and with the Mayor and City Attorney absent, inquired if they should be rescheduled. Mayor and Council Request for Action March 3, 2016 SUBJECT: FINANCE DEPARTMENT—RESOLUTION APPROVING EMPLOYEE CITY CREDIT AND GAS CARD HOLDERS AND DESIGNEES RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider the following motion: MOTION TO: Motion to adopt Resolution No. 2016-XXX approving employee use of City credit and gas cards. BACKGROUND: The City's financial auditors have recommended that Council approve an annual resolution establishing which employees possess and use City credit cards and which employees use gas cards at the local gas stations for Public Works and Fire vehicles. KEY ISSUES: • The attached resolution is a recommendation from the City's financial auditors and should be revised anytime there is a change in cardholder or designee. • The resolution identifies staff that currently possess City credit or gas cards and designated employees allowed to use those cards. • Active members of the Albertville Fire Department are listed as a whole on the resolution as it difficult to know who will fuel the fire trucks after a fire call. • Purchases made on City credit or gas cards are ultimately the responsibility of the individual card holder. LEGAL CONSIDERATIONS: According to Minnesota Statute 471.382, cities must prove if a city officer or employee made a purchase on behalf of the City by credit card, that the following criteria have been met: • Had the City Council authorized the use of the credit card by the officer or employee? • Was the officer or employee otherwise authorized to make a purchase on behalf of the city? • Did the purchase otherwise comply with all statutes, rules, and City policies applicable to City purchases? Mayor and Council Request for Action Y q March 3, 2016 SUBJECT: FINANCE—DELTA SYSTEMS TSA/MAINTENANCE CONTRACT RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: MOTION TO: Approve entering into an annual contract with Legend Companies in the amount of$1,975 to provide technical support for Delta Systems (HVAC software and controllers). BACKGROUND: The City of Albertville has contracted annually with SetPoint Systems for the past several years to provide these services. SetPoint systems have moved their corporate office and service department to Colorado. Over the last year there have been issues with service. Staff has requested quotes for the same service from three vendors who are certified to work on Delta Systems,but only received two back. Legend Companies is based in Minnesota and the main service technician used to work for SetPoint and was Albertville's technician until SetPoint moved its headquarters to Colorado. SetPoints TSA quote is for$1,220 which offers two annual onsite visits for maintenance of the software and controllers. Legend Company's TSA quote for$1,975 offers quarterly onsite visits for maintenance of software and controllers. KEY ISSUES: • Legend is located in Minnesota and offers 2 hour phone response/remote log in and within 24 on-site response • Quarterly visits for maintenance and service POLICY/PRACTICES CONSIDERATIONS: FINANCIAL CONSIDERATIONS: The request to change vendors and the slight increase in the contract falls in the annual amount budgeted for this service. PHONE and ON-LINE SERVICES Phone and/or Internet and Web Access Setpoint will respond via Phone and/or web or internet within ONE (1) hour after initial notification by an authorized representative of the customer's facilities operations team. If the Setpoint Technician determines a site visit is required to complete diagnostics or to make corrections, Setpoint will be on-site within TWENTY-FOUR(24) hours of the call. Service calls are subject to the labor rates described herein—See Service Rates. System Consultation Setpoint will provide telephone consultation to the customer regarding system hardware and software operation and database changes. Phone consultations will not exceed fifteen (15) minutes. Corrective maintenance and system repairs of other Setpoint contract customers shall take priority over remote web access and/or phone consultations. On-Line Documentation Setpoint will document each on-line service call and furnish a copy showing time, date, operator, and a brief description of the activity along with recommendations (if any)to the customer. On-Line Equipment Setpoint will remotely log into a system providing the customer has an existing modem or ORCAweb software via an approved network login provided to Setpoint by the customer. Internet/Web Access The customer shall maintain and be responsible for the cost of any web access requirements connected to and/or required to maintain and troubleshoot the Setpoint Systems Building Automation System (BAS). Components suspected of being faulty may be repaired or replaced at Setpoint's option to restore system integrity. On-Site Documentation Setpoint will document each on-site service call and/or TSA visit in the Setpoint provided Log Book on site showing time, date, operator, and a brief description of the activity along with recommendations (if any). Software Protection Setpoint will back up the system's database, including the host and each field computer on each visit. In the event of memory loss on any of the servers/computers (Operator Workstation -OWS), Setpoint will reload the affected databases from the current backup copy that is stored in the Log Book. System Performance Reviews In addition to performing the Technical Support Agreement(TSA)tasks described herein, a Setpoint Account Manager will be available on a regular basis for system consultation, energy management recommendations; system upgrades strategies, performance reviews, and other DDC system and TSA consultation. Software/Firmware Revisions Setpoint Systems Corporation will inform the customer of all applicable software/firmware revisions to the system within its functional capabilities. Setpoint will, when necessary and approved, upgrade firmware/software at the preferred discount rates during the TSA period. Operator Training Setpoint Systems Corporation's training program includes on-site and in- house training as defined below: Unlimited FREE training per Setpoint's training schedule to be available at Setpoint System's Colorado corporate office, California and Minnesota. Classes will be hands-on, two-day classes taught by factory- trained instructors. Class material and lunch will be provided. To achieve your desired level of operator competency, customer may schedule as many people as necessary for training at the Setpoint Systems Corporate office at no additional costs. Additional and/or onsite training can be provided at Setpoint TSA discount rates. Agreement Coverage Reviews The Technical Support Agreement performance will be reviewed with the customer annually.The review will include a summary of the past years activity under the contract and an evaluation of the coverage required to meet customer's needs. MATERIALS.If the materials or equipment included in this proposal become temporarily or permanently unavailable,the time for performance of the work shall be extended to the extent thereof,and in case of permanent unavailability,Setpoint shall(a)be excused from furnishing said materials or equipment,and(b)be reimbursed for the difference between the cost of the materials or equipment permanently unavailable and the cost of a reasonable substitute therefore. 4. DELAYS.Setpoint shall not be liable for any delay in the performance of the work resulting from or attributed to acts of circumstance beyond Setpoint's control,including but not limited to acts of God,fire,riots,labor disputes,conditions of the premises,acts or omissions of the Purchaser,Owner or other Contractors or delays caused by suppliers or subcontractors or Setpoint,etc. 8. COMPLIANCE WITH LAWS.Setpoint shall comply with all applicable federal,state,and local laws and regulations.All licenses and permits required for the execution of the work shall be obtained and paid for by the purchaser unless stated otherwise in this proposal. 9. DISPUTES.All disputes involving more than$15,000 shall be resolved by arbitration in accordance with the rules of the American Arbitration Association.The prevailing party shall recover all legal costs and attorney's fees incurred as a result.Nothing here shall limit any rights under construction lien laws. 10. INSURANCE.Insurance coverage in excess of Setpoint's standard limits will be furnished when requested and required and at Setpoint's discretion the costs of this additional insurance may be passed on to the Purchaser.No credit will be given or premium paid by Setpoint for insurance afforded by others. 11. INDEMNITY.The Parties hereto agree to indemnify each other from any and all liabilities,claims,expenses,losses or damages,including attorney's fees which may arise in connection with the execution of the work herein specified and which are caused,in whole or in part by the negligent act or omission of the indemnifying Party. 12. OCCUPATIONAL SAFETY AND HEALTH.The Parties hereto agree to notify each other immediately upon becoming aware of an inspection under,or any alleged violation of,the Occupational Safety and Health Act(OSHA)relating in any way to the project or project site. 13. BACKGROUND: Dolphin Real Estate has filed an application requesting a variance from the City's required amount of parking for their site located at 6495 Labeaux Avenue NE. The applicants wish to remove an indoor play structure and convert this area to seating. The site is fully developed and does not have area for additional parking for the expanded seating. The property owner is requesting a variance from the number of parking stalls due to the significant amount of walk-in customers from the Outlet Mall. Burger King's original site and building plan was approved in 2000. The building plan included the play system which was deducted from the dining room for the parking calculation. The original approved site plan included 56 parking stalls, meeting the City ordinance. The applicant is seeking a variance to allow 56 parking stalls instead of the required 60 stalls. KEY ISSUES: The play equipment occupies approximately 180 square feet of floor area in the northern portion of the building. With the building renovation, the applicant proposes to convert this area to accommodate up to 20 additional seats. By ordinance, the 180 square feet of additional dining area would require five parking stalls, for a total site parking count of 60. The site plan shows a parking arrangement of 56 stalls, resulting in a shortage of four parking stalls. • The site has a high percentage of pedestrian traffic due to its proximity to the Outlet Mall. The variance is supported by the Outlet Mall. • All alterations are internal. There will be no expansion of the building footprint. The site size and design does not allow for the expansion of the parking lot. Variance. Section 500.13 of the Albertville Zoning Ordinance outlines the following criteria for granting a variance: I. The property owner is requesting a variance from the number of parking stalls due to the significant amount of walk-in customers from the Outlet Mall. Burger King's original site and building plan was approved in 2000. The building plan included the play system which was deducted from the dining room for the parking calculation. Play Equipment. The play equipment occupies approximately 180 square feet of floor area in the northern portion of the building. With the building renovation, the applicant proposes to convert this area to accommodate up to 20 additional seats. By ordinance, the 180 square feet of additional dining area would require five parking stalls, for a total site parking count of 60. Parking Stalls. The site plan shows a parking arrangement of 56 stalls, resulting in a shortage of four parking stalls. Variance. In meeting with Burger King representatives, they identified their proposed renovations and City staff directed them to pursue a variance to accommodate the reduced parking count. Section 500.1.13 of the Albertville Zoning Ordinance outlines the following criteria for granting a variance: 1 . Variances shall only be permitted when they are in harmony with the general purpose and intent of the City Code and consistent with the Comprehensive Plan. Finding. The site is zoned PUD/B-3 which allows for restaurant uses as a permitted use. The Burger King site and building plan was approved as part of the larger Albertville Outlet Mall PUD, which was designed to promote complementary business uses and business interchange between the Burger King site and the larger shopping center. The restaurant renovations propose to remove the play structure and expand dining room seating in response to their customer type and demand. They have indicated that this is due to its proximity to the Outlet Mall and has significantly higher incidences of pedestrian traffic than their other 19 Burger Kings. In light of the site zoning, its approval was part of a larger PUD and its operational characteristics of the reduced parking count is consistent with the general purpose of the City Code and approved PUD. The variance will allow further renovation on an existing business, which is consistent with the goals and policies of the City's Vision Study. The Vision Study promotes the expansion and growth of Albertville businesses in areas guided for commercial. The study also promotes high design in building architectural and site design. 4 Agenda Page 34 2. Variances may only be permitted when the applicant establishes that there are non-economic practical difficulties in complying with the Zoning Ordinance, meaning the property owner proposes to use the lot or parcel in a reasonable manner not permitted by the Zoning Ordinance. Finding. The non-economic practical difficulties that are applicable to the site in support of the variance include: a. The site is part of a larger PUD and provides an ancillary food service for the larger Outlet Mall. b. The site's proximity to the Outlet Mall results in a higher incidence of pedestrian customer traffic patronizing this restaurant than typical restaurants. Customers park at the shopping center and walk to Burger King. This is documented by the applicant's traffic study and verified by the Outlet Mall. Based on this information, the four additional stalls are not needed. C. The building's footprint is not being expanded. All floor area modifications are designed within the existing building. d. The site layout will not physically allow the addition of four stalls without being a detriment to the current site design. In light of the current site's operation and the practical difficulties associated with the site, the variance will allow the dining room to expand and operate in a reasonable manner not otherwise permitted by the Zoning Ordinance. 3. The plight of the property owner must be due to circumstances that are unique to the lot or parcel and is not created by the property owner. Finding. The uniqueness of this lot is location and proximity to the Albertville Outlet Mall. No other lot in the community shares these characteristics. The physical characteristic generates a higher volume of pedestrian business interchange between the restaurant and the shopping center, resulting in a demand for more restaurant seating without the greater demand for on-site parking. 4. The variance must not alter the essential character of the locality including all zoning district and overlay district provisions. Finding. The variance will not change the character of the locality. Currently, Burger King and the Outlet Mall are exploring the means to improve pedestrian safety between the two sites. We benefit from traffic that is strongly linked to nearby retailers. People come to shop and they need to eat in order to recharge their batteries, then they shop some more. Our business relationship is mutually beneficial. Because of our shared patrons and proximity to the Outlet Mall parking lot, we have a significantly higher incidence of pedestrian traffic here than at any of our other 19 Burger King locations. The Albertville Burger King averages 10% more in foot traffic than the rest of our company. Considering that this location is our fourth largest in total sales volume, this translates into significant foot traffic beyond what was originally anticipated when the site was developed. To accommodate our higher capacity of dine-in and take-out guests, we want to remove the existing playground structure and replace it with additional seating. There will be no change to the footprint of the building (see enclosed site plan). The preliminary floor plan shows the layout of both the main and dining room seating. The interior changes would result in 12, up no more than 20 additional seats depending on the final layout plan. Considering the foot traffic patterns outlined in this narrative, as well as documented in historical submittals that are also attached, we hope you agree that this works in the best interest of existing guests, as well as those in the future with the recent Darkenwald announcement. The grass area had been worn down at the location where the sidewalk was installed. The following steps were reviewed to consider the installation of the proposed Pedestrian Crossing(According to the MnDOT"Guidance for Installation of Pedestrian Crosswalks on Minnesota State Highways") at the location of the newly installed sidewalk: 1. The location is not at a controlled intersection. 2. Field review shows there is adequate stopping sight distance. There is minimal truck traffic, minimal turning movements and minimal driver distractions. a. Stopping sight distance—For a 30 mph design speed, the stopping sight distance should be a minimum of 132'. Field inspection verifies that the sight distance at the proposed location is greater than 132' required. A 200' sight distance is available as long as the right-of-way is kept clear of plantings and any other obstructions that may hinder or distract drivers approaching the proposed crossing. b. Minimal truck traffic—The majority of truck traffic for this area are deliveries to retail businesses which are made at a separate access behind the businesses except for the Burger King and the furniture store to the east of the proposed crossing. c. Minimal turning movements—The only turning movements at the proposed location are at the center access into and out of the Burger King parking lot. d. Minimal driver distractions—No significant driver distractions are in the area of the proposed crossing. 3. The posted speed is 30 mph which is less than the maximum 40 mph recommended. The horizontal curve radius for the Outlet Mall access road is approximately 200'. This is an inadequate radius for the 30 mph posted speed but does slow traffic speeds around the curves. Observed traffic speeds were within the posted speed limit. 4. Based on the comments by Burger King staff and field observations, more than 20 pedestrians cross at the sidewalk location in an hour. 5. Although there are no daily traffic counts available,peak hourly counts ranged from 655 to 2,203. In January, 2006 weekday counts were 3,465 between 6:30 am and 6:00 pm and 8,272 on a weekend between 10:00 am and 5:00 pm. This data would indicate total average daily traffic (ADT) does not exceed 12,000 at this time. 6. There are 3 lanes of traffic for pedestrians to cross. Agenda Page 43 Alternatives: No Action Alternative—Pedestrian will continue to cross the outlet mall access road at various locations. All crossing locations carry some risk to the safety of pedestrians. By allowing pedestrians to cross at random locations on a reverse curve roadway is considered unsafe and unpredictable pedestrian movements will occur increasing the probability of accidents. Since pedestrians have a right to facilities where they can cross a road safely and without unreasonable delay, a defined and maintained corridor to guide pedestrians where they may more safely cross is the appropriate solution. Pedestrians could not reasonably be prevented from crossing the road. Therefore, no action would not provide pedestrians guidance to a safer crossing location especially during higher volumes of vehicular traffic. Although no official pedestrian counts were recorded, it was observed on site and comments by Burger King staff that more than 20 people per hour crosses the road, therefore,placing a high priority on providing a marked crosswalk. Geometric Changes such as shortening the width of the roadway by reducing the lanes from 3 to 2 were considered unacceptable. This would increase congestion of vehicular traffic and result in reduced pedestrian safety. Narrowing the road or providing curb extensions were not feasible as the crossing has no shoulder to extend a curb into. The crossing distance is already as short as it can be for the existing 3 lane road. Recommendation: Installing a marked pedestrian crossing is recommended at the location proposed on Figure 1 under the following conditions. The pavement marking should be installed according to the Minnesota Manual on Uniform Traffic Control Devices (MMUTCD) using the continental pattern 3'x 6' placed to avoid vehicle wheel paths. Florescent flags and plaques should be installed at the top of the setting at timed intervals to draw attention to the signs. Replacing the flag with a blank florescent plaque after 6 months will facilitate recognition by motorists. The following sign placement shall be installed according to the MMUTCD. Right-of Way within 200' of the crossing shall be kept free from obstructions and any distractions that may detract or hinder sight lines for the pedestrian crossing. Redesign of access points along the Outlet Mall access drive should be reviewed along with provision for pedestrian movements. Consolidating approaches to a controlled(all-way stop or signalized) intersection would allow for safer pedestrian crossing and vehicle movement. However, during peak traffic, mainly on weekends, it has been observed that stacking in the exit queue for the signal at CSAH 19 backs up vehicles to and past the proposed Agenda Page 45 pedestrian crossing. This is mainly due to the fact that there is only one access into and out of the Outlet Mall. This could pose seriously delays to emergency vehicles. Any construction that would close the road would not only hinder emergency vehicles but also cause economic hardship to the businesses. A second access should be considered in future planning. Realignment of the road to increase the curve radii would improve sight distance The crosswalk should be routinely monitored to determine if any additional improvements may be needed such as overhead pedestrian signs. The State is asking the City to obtain I-94 ramp easement from Albertville Marketplace using a revised legal description as the State wants clearer language in the deed from the City to the State for the ramp easement. The easement area remains unchanged—the State simply wants its specific language used in the easement document. Adam is trying to reach the owner to get the new deed signed. • Charter Cable. Charter Cable has replied to our request regarding the free cable service it is to provide to the City. Their contention is that the City is only entitled under Federal law to collect a maximum of 5% in franchise fees, which we are already collecting. Charter believes that provision of free cable service to municipal buildings over and above that 5% is prohibited under Federal law. I will check the law on this and see if Charter's interpretation is correct. • Prairie Run. Fieldstone is scheduled to close on the 6th of the ten lots on the private road in the next week or two. We are still waiting to hear from Fieldstone as to whether the 13th home has joined the Association. • City Hall Cleaning Contract. I have been working with Adam on preparing a new City Hall cleaning contract. Page 1 of 2 Agenda Page 50 • Oldcastle TIF. It appears that the Developer of the Old Castle Glass building has met all of its construction obligations required by the TIF agreement. As long as it continues to use the building for its intended use and pays its taxes, it will be eligible to receive TIF reimbursement from the City. Page 2 of 2 Agenda Page 51 1bcrtvi11- City Administrator's Update Smallown Living.Big CRy Llfe March 3, 2016 GENERAL ADMINISTRATION Ice Arena: Ice was taken out on March 1 and the Knight to Remember event is on Saturday, March 12. The field work for the arena's audit is complete and the audit is scheduled to be presented on April 11 to the Arena Board. The Arena Design Committee will be meeting on March 14 prior to the Arena Board meeting. Planning Commission: To date, we have received five letters of interest for the Planning Commission in addition to the interest expressed by current Commissioners Klecker and Lindberg. Council will need to decide the specifics for the selection process, which we can discuss at the meeting on March 7. Council Emails: We have City email accounts set up for all Council members. I will have instructions and login information available at the meeting. The LMC advises the use of these accounts for all your City-related business. Local Board of Appeals and Equalization: This meeting date is included on the agenda to be set for April 18 prior to the City Council meeting. We now have three certified and trained members on the Council: John, Larry, and Rob. Shared Fire Service Study: In February, the Council approved an MOU regarding the study of shared fire service. Since then Otsego has also approved the MOU, but with a slight revision. The version Otsego approved excluded Springsted's evaluation on the location and timing of an Otsego fire station. It is assumed that this work will be done by Otsego's staff. Springsted will be meeting with each City's Joint Fire Committee members to discuss options for shared service. 2015 Audit: This past week, the auditors (KDV) completed their on-site field work. Currently, we are planning to have the audit presented at the April 18 Council meeting. Main Avenue NE & CSAH 37 Entrance Sign: We are currently reviewing multiple proposals. Wireless Network: Currently, we do not have a wireless option for public use or by those renting the building. We are looking into options and cost for a public wireless network at City Hall. To add this network, we need to extend CAT5 cable to the upper level, Council chambers, and multipurpose room, as well as purchase and program routers. STMA Capital Projects Advisory Committee: The School District would like a Councilmember from each City to serve on the District's Capital Projects Advisory Committee. Attached is a memo from Dr. Behle regarding the potential bond election and the charge to the Advisory Committee. The Council will need to choose its representative. Agenda Page 52 1-94 West Coalition Membership: Albertville's 2016 membership fee is $3,640.50. The annual calculation for cities is $0.50 per capita. Attached please find the Coalition's 2016 Legislative Priorities and summary of highlights from 2015. ENGINEERING/PUBLIC WORKS CSAH 19 Funding: Last fall Albertville, Otsego, and Wright County submitted an application for FY 2020 Federal transportation funding to improve CSAH 19 from the Outlet Mall to 70th Street NE. The Region 7W TAC recommended a funding amount of$2.3 million and last week the Policy Board approved the recommendation. The County is currently working on its 5-year plan and it is proposed that 70th Street (Maclver Avenue NE to CSAH 19) and CSAH 19 (Outlet Mall to 70th Street NE) be constructed together in 2019. 2016 Projects: Staff has identified several smaller projects for 2016, which we will be discussing with Council at the meeting. Lachman Avenue NE Rear Yard Drainage: I have only received one of the five easement agreements. 54th Street NE and Barthel Industrial Drive NE: We are in the process of closing out this project. 57th Street NE/Church of St. Albert Improvement Project: St. Albert's church has been invoiced for their portion of the project. A Hockey Arena Design Committee is preparing a schematic design for an addition to the hockey arena and cost estimates. The School Board approved a Capital Projects Task Force to research and prepare recommendations of district facility needs that are identifiable, necessary and timely that would warrant voter approval. The School Board determined that a special election in January or February of 2017 would allow time to prepare a well-researched capital improvement bond proposal and engage in open, informed discussion on the capital improvement bond proposal.The new superintendent would have time to settle in the position and become familiar with the district before needing to commit significant time to a voter approved capital projects bond election. School Board authorization for a capital improvement bond election will be made no later than November 21, 2016 and will be based upon a sound proposal based upon need with reasonable cost. CHARGE TO THE CAPITAL PROJECTS TASK FORCE Review capital project needs and make recommendations to the School Board on capital projects for a capital projects bond for voter approval using criteria and an aggregate amount selected by the School Board. The Corridors of Commerce program was a key contributor to realizing this success and it is anticipated that future improvements along 1-94 will require similar dedication, commitment and involvement with the Corridors of Commerce program. Comprehensive Transportation Funding Bill • Support passage of a 10-year,comprehensive funding package that delivers projects efficiently,cost effectively,transparently and renews Corridors of Commerce. This includes an efficient freight system that enhances Minnesota's economic competitiveness in national and international markets. The state should use General Fund revenues generated from the statewide sales tax on auto parts and rental cars to fund increased investment in our transportation system. If necessary to address concerns about predictability of General Fund investments in transportation,the state should consider asking Minnesotans to constitutionally dedicate these revenues for transportation purposes. Future Funding for Corridors of Commerce • The Corridors of Commerce program utilized a more comprehensive approach to transportation funding than is often promoted.Securing funding for the future of the Corridors of Commerce program is imperative for Interregional Corridors such as expanding capacity to six lanes from Rogers to St.Cloud and eight lanes from the Fish Lake Interchange to Rogers. The Coalition supports a minimum funding level of$300 million,similar to the level when the program was created. Phase 11 Expansion of 1-94 • 1-94 is a vital artery for moving and supporting Minnesota's economy.Since the inception of the Corridors of Commerce program I-94 has received critical funding to expand overall capacity improving economic development with of over 2.5 million square feet of industrial development in the region since the announcement of Phase I. Phase 11,from St.Michael to Albertville,is a critical next step in the continued improvement of this vital corridor.The Coalition will work with MnDOT District 3 to continue expansion and improvements efforts west along the I-94 Corridor by seeking additional funding for the Corridors of Commerce program. Brockton Interchange • The Coalition will work with local leaders to help facilitate the Brockton Interchange project.The Brockton Interchange represents an access and exit point along a six mile stretch of I-94 that is beneficial to the surrounding communities,but that also would provide relief to 1-94 in the form of auxiliary lanes. The I-94 West Corridor Coalition expects that all decisions relating to transportation funding will be based on factual analyses in a fair and transparent manner with an emphasis on reducing congestion caused by freight and commuter traffic on I-94.Any project should be valued based on Return on Investment and merit,rather than political gains. Agenda Page 56 �II - � I t4t4 West C O R R I D O R Hits of 2015 ,(Phase 1 Completion The expansion project from Hwy. 101 in Rogers to Hwy. 241 in St. Michael was completed and the additional lanes were opened in October. ,(Grand Opening event The 1-94 Coalition, elected officials and local supporters joined together on October 13,for the Grand Opening event at the new FedEx Distribution Facility to celebrate the opening of the additional lanes. Speakers featured Governor Mark Dayton and Congressman Tom Emmer and numerous State Legislators. ✓Economic Development Over 2.5 million square feet of industrial development has been completed in the region since the I-94 Phase I funding was announced. 1.418 million square feet in Rogers [including the new FedEx Distribution Center] and 1,178 million square feet in Otsego and Dayton. *(Future Capacity Expansion In late 2014, Governor Dayton announced that the 1-94 expansion project will receive additional Corridors of Commerce funding.The next phase, from St.Michael to Albertville will receive $1.4 million for design options for mobility.This is a critical next step in the overall expansion plans for 1-94.While this planning is underway, the 2015 legislative session ended without a comprehensive transportation bill or additional funding for the corridors of commerce program. The 2016 legislative session will be critical for the future of 1-94 capacity expansion and Minnesota's transportation system. ✓Membership During 2015,the Coalition gained numerous new members and supporters. Addition of the third lane will be completed in the winter of 2015-2016.
