PROPOSED REZONING/COMP PLAN AMENDMENT FOR
SENIOR HOUSING PROJECT.

Steve Feneis has applied for a rezoning and comprehensive plan amendment for
the planned senior housing project. The senior housing project as planned involves
several components, including a comprehensive plan amendment, rezoning, the set up of
a TIF district, special qualification as a housing district under state law, a developer's
agreement, deed restrictions, and a rental agreement. All of these items must come
together if the project is to succeed. If one of these items does not materialize, the project
may fall apart. We will not know if all components have been established until sometime
in mid-May.
Note that if the property is rezoned, but one or more of the necessary elements for
a senior housing project do not materialize, the rezoning/comp plan amendment will still
be effective. This means that the zoning for the property would allow general medium
density housing (i.e. apartments) without regard to the age of its occupants. To ensure
that the comp plan/rezoning results only in senior housing, I recommend that the City
Council table the request for comp plan/rezoning until such time as all other
documentation is prepared and all approvals have been received. At that time, the City
Council can approve all necessary items (including the Developer's/PUD agreement,
zoning changes and deed restrictions) as a package, thus ensuring that the zoning of the
property will change only if all other elements necessary for senior housing have been
obtained.
