Cott.ass of Albertville Request: Cottage Builders, Inc. has submitted a preliminary plat for the development of 20 owner occupied attached single family quad-homesltown homes. This is the . second and final pnase of the Planned Unit Development plan approved by the Cjty in 1997. The 2.6 aere parcel of land is owned by Kenco and is zoned Planned Unit Development. The Comprehensive Land Use Plan designates the subject property medium density residential. City Council Meeting Date: 4 January 1999 Findings of Fact: Based on review of the application, evidence received. and recommendation of the Planning Commission, the City Council now makes the following findings of fact and decision: 1) The legal description of the subject property is as fonows: Outlot A and Out/ot B CENTER OAKS, according to the plat thereof. on file and of recotd in the Office of the County Recorder, Wright County, Minnesota. 2) The submitted preliminary plat and site plans are consistent with the concept plan submitted and approved In 1997. 3) On 8 December 1998 the Albertville Planning Commission conducted a public hearing to consider the applicant's request, preceded by a published and mailed notice. Upon review of the application and evidence received, the Planning Commission recommended that the City Council approve the project. Decision: Based on the foregoing considerations and applicable ordinances, the applicant's request for Preliminary Plat ADPfQval has been .pproved based on the most current plans and information received to date, subject to the following conditions: 1, Approval of the submltt&ld landscape plan. 2. All housing units shall contain individual refuse containers which should be stored within the garages within the garages. 5. It shall include the requirement that the Cottages of Albertville Two ije restricted as a senior-only development, with arl residents age 55 and older. 6. A property maintenance agreement or declaration of covenan~, conditions and restrictions must be preparsd by the applicant and submitted to the CitY Attorney for his review and approval. It shall include specific restrictions as discuss~d herein as well as other provisions prescrib8d by the Planning Commission, City COUflcil andlor City Attorney. An original, signed copy must be filed with the Wright County ~ecorder's Office as a deed restriction against the title of each unit lot. 7. The location(s) of signs to be used withIn the project are shown on revised site plans and the sign sizes and design are SUbmitted to the City Planner for review and approval according to the following requirements. Plans may be su~mitted following the start of construction for review and approval by the City Planner, i however, no certificates of occupancy will be granted until desired signs are accepted. i a. For 8ach dwelling unit, one name/address plat shall ibe permitted not exceeding two (2) square feet. b. Cottages of Albertville, induding the first and second Iphases, shall be allowed up to three (3) overall project identification signs (one faqing each street frontage) up to forty (40) square feet each.
