MEMORANDUM OF DEVELOPER'S AGREEMENT
MORANDUM OF DEVELOPER'S AGREEMENT is made as of the
30 t( day of 1997, between Little Mountain Development, LLC, Floyd
Roden and Beve Roden, collectively referred to herein as "Developer"; and the CITY OF
ALBERTVILLE, County of Wright, State of Minnesota, hereinafter referred to as "City".
WITNESSETH:
WHEREAS, Developer and City have entered into a Developer's Agreement of even
date herewith (hereinafter referred to as the "Developer's Agreement") applying to that plat
known as Fairfield, located in the City of Albertville, Wright County, Minnesota; and
Developer and City desire to have a memorandum of the Developer's Agreement recorded in
the real property records of Wright County, Minnesota.
NOW, THEREFORE, Developer and City hereby state the following for recording:
1. Developer is developing a parcel of property within the City, said parcel legally
described on the attached Exhibit A.
2. Said parcel described on the attached Exhibit A is subject to the terms of the
Developer's Agreement as well as any amendments thereto duly adopted by the City
and Developer from time to time, and all of the terms and conditions of said
Developer's Agreement are hereby incorporated by reference. Said Developer's
Agreement is on file with the Clerk of the City and is available for inspection and
copying at said Clerk's office.
3. The Developer's Agreement governs the subdivision, development and use of the real
property described on the attached Exhibit A.
4. The covenants, conditions and agreements contained in the Developer's Agreement
shall be binding upon and inure to the benefit of the parties respective heirs,
administrators, executors, representatives, successors and assigns.

5. This Memorandum of Developer's Agreement is solely for recording purposes and
shall not be construed to alter, modify or supplement the Developer's Agreement.

EXHIBIT A TO MEMORANDUM OF DEVELOPER'S AGREEMENT
The Real Property subject to the Developer's Agreement is legally described as follows (prior
to platting):
That part of the East Half of the Southwest Quarter of Section 35, Township 121,
Range 24, Wright County, Minnesota lying southerly of a line described as follows:
Commencing at the southeast comer of said East Half of the Southwest Quarter;
thence north along the east line of said East Half of the Southwest Quarter, a distance
of 453.18 feet to the point of beginning of said line to be described; thence
southwesterly deflecting 123 degrees 06 minutes 09 seconds left, a distance of 171.92
feet to the north line of the South 360.00 feet of said East Half of the Southwest
Quarter; thence west along said north line, a distance of 1171.3 9 feet to the west line
of the East Half of the Southwest Quarter and said line there terminating.
The Real Property subject to the Developer's Agreement is legally described as follows (after
the filing of the Fairfield Plat):
Lots 1-5, Block 1
Lots 1-7, Block 2
Lots 1-11, Block 3
All said lots in the plat of Fairfield, City of Albertville, County of Wright, Minnesota.
