Thank you Andy for taking the time to visit the site and with helping me your concerns.
This letter is to answer your request for activities involving this site. Your letter dated 10-
23-09 asked me to respond to (4) questions. First question you asked for names
addresses & telephone #'s of contractors, engineers, or consultants involved in or
overseeing the work. For, this I answer, Michael Potter 11650 576' st ne Albertville,Mn
55301 phone # 763 497-3131 home and cell # 763 242-2038. There was no one else.
Question #2 The date work started was the week of sept.,21,2009 that's when the dirt
from the development to the west of my site was trucked to my site. On sept.,21,2009 I
applied for a permit to fill the area in question. The city was aware of what was going on.
The city rejected my original permit calling it incomplete. I resubmitted the permit
application on Oct.,1,2009 along with a check for 1,400.00 for the grading permit. The
city has cashed the check but is waiting for clarification from you before they will issue a
permit. See attached sheets showing the area were the work was conducted.
Question 43 The work is to complete and make saleable the lot referred to as Lot 1 block
2 Potters Commercial Park. The reason the work was done with out Dept of the Army
authorization is based on your letter dated March ,6,2008 Informing me that I have
adequately resolved all of the remaining Corps of Engineers related wetland fill activity
at this site. I have paid for 3.26 acres of wetland credits plus another 9,500 s.f.. For my
original Permit #88-252-12 that was for less than 3 acres of affected wetlands.
Question #4 There was approximately 400 cubic yards of material placed in about 6544
s.f. Most of the dirt is still in the upland area of the site. See attached drawings.
In closing (we) Michael & Heidi Potter believe that we have fulfilled our obligations
to the Army Corp of Engineers pertaining to this site.

1. The time limit for completing the work authorized ends on December 31, 1991 . If you find that you need
more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least
one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and condi-
tions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make
a good faith transfer to a third party in compliance with General Condition 4 below, Should you wish to cease to maintain
the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of
this permit from this office, which may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by
this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordina-
tion required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register
