RE: Your update of the status of your Grading and Filling Permit Application and the exterior
storage issues at your property located on the intersection of CSAH 37 and Mackenzie
Avenue NE
Dear Mr. Potter:
Thank you for taking the initiative and for your time meeting with staff on January 21, 2010
regarding the status of the above issues. You dropped off a copy of your "After the Fact Permit
Application" to the Army Corps of Engineers and this application and interagency review
automatically extends your review period from the City. I have recapped the issues and the
understanding or conclusion of our meeting to be as follows;
1) Grading and Filling — You have submitted an after the fact permit application to the
Department of Army Corps of Engineers and the requirement for interagency review and
approval automatically extends the time the City has under MN Statute § 15.99 to approve or
deny your permit application until 60 days after the Army Corps of Engineers review
process is complete. Please advise the City when this process is completed and we will
continue the review process at that time. In the event any fill is removed from the site please
contact me or City Engineer, Adam Nafstad, as the City must be consulted in order to
review any possible impacts to Mackenzie Avenue NE.
2) Construction of shed without permit; I understand you are considering moving your shed to
your house location at the above address. We discussed the application process that is
required in order to accomplish this and I look forward to your application. A C.U.P. maybe
submitted only if you remove the existing shed at the rear of your property (CUP application
is enclosed).
3) Exterior Storage; you stated you have removed some of the items and will continue to do so.
We appreciate your progress and continued cooperation to eliminate the violation and gain
compliance with your B-3 Highway Commercial zoning district.
