RE: Inspection notice of 7/21/09 for PID 101-800-062-200, located on the intersection of
CSAH 37 and Mackenzie Ave. NE
Dear Mr. Potter:
Thank you for your time meeting with staff today regarding my inspection notice of 7/21/09. I
have recapped the issues and the understanding or conclusion of our meeting to be as follows;
1.) Construction of shed without permit; you stated you will be removing the shed out of the
City in about a week or two and that you would need to add some additional bracing in
order to stabilize and facilitate the moving of the structure. City staff is in agreement
with this as proposed. Please contact the Building Department when you have
completed the removal of the shed from the property. We are assuming the shed will be
removed by 8/17/09. Please let us know if this is not a sufficient time frame.
2) Constructing the shed without the required zoning application, review and approval of the
City Council was a violation of the Ordinance; this violation will be rectified with the
removal of the shed. In the event you wish to construct a building in the future an
application would need to be submitted that would identify the use and be in
conformance with the City Ordinance for your property. Your property is zoned B-3
Highway Commercial. I have attached a Building and Site Review Application
Checklist, The City Code Section entitled: Site/Building Plan Review and a Zoning
Application for your use or information.
3) Grading and Filling without a permit; grading and filling in excess of 50 cubic yards has
occurred over an extended time period of time within the last year and was not previously
permitted. As depicted in the attached photographs from 3/16/09 and 7/16/09, this work
consisted of, but is not limited to, the installation of drainage culverts, filling in the ditch
over the culverts apparently to accommodate a future driveway approach or vehicular
access over the ditch, filling to construct a berm, filling adjacent to the old haul road,
filling in undisclosed areas, as fill was placed and redistributed on the site. I have
attached a permit application for grading and filling as regulated by Chapter 1800 and
1900 of the Ordinance. You only need to submit one application for both grading and
filling. Please note the applications for required submittals state specifically that a
certificate of Survey is required by 1800.2 A. 8. The applications identify the
information that is needed on your survey. You may consider identifying the areas on
your existing survey. Please submit your permit application no later than September 1st
2009.
4) Exterior Storage; there is a variety of exterior storage on your property as identified in the
photographs. Exterior storage is allowed on your property with a Conditional Use Permit
(CUP) that may be issued by the City Council. You indicated that you would review this
issue with the City Council at the next Council meeting (8/17/09) and determine if you
would then submit a CUP application. If a CUP Application is not submitted; the
exterior storage would need to be removed. We look forward to discussing this issue
further after the input is received from the Council.

RE: Albertville — Potter Property Code Violations
FILE NO- 163.05 — General
On July 21, 2009, the Albertville Building Official met with City staff to discuss potential
code violations related to property located at the southwest corner of County Road 37
and MacKenzie Avenue. This site is zoned B-3 and remains undeveloped. However,
the site is currently being used for outdoor storage of equipment, building materials,
debris, sand, and dirt. This outdoor storage appears to be expanding.
Most recently, a building frame was erected on the site without permit or City approval.
The City Building Official has issued an inspection notice and stop work order on the
building. Our office has been directed to itemize and document the specific violations.
Zoning
The site is zoned B=3, Highway Commercial District. This district outlines the allowed
land uses, lot size, setbacks and architectural performance standards.
Outdoor Storage
In.October 1997, Mr. Potter was notified that his outdoor storage was not in compliance
with City regulations at that time. We have no record on file of a conditional use permit
or efforts to bring the storage into compliance.
Section 1000.15 regulates outdoor storage for residential, commercial or industrial
districts.
Section 1000.15.A.3 allows for the outdoor storage of construction and landscaping
materials currently being used on the premises.
The current outdoor storage may be acceptable under this provision if there was a .City -
approved site plan for this B-3 zoned property per Section 1500.3 of the Albertville
Zoning Ordinance. Absent an approved site plan; Section 1000.15.A.3 will not be
applicable.
Section 1000.15.B requires a conditional use permit for all outdoor storage within a
commercial zoning district. We have no record of a conditional use permit being
approved for this site.
Building
Recent site inspection reveals that a building is being constructed on the site without a
building permit. Section 1500.3 requires building and site plan approval from the City
Council for all commercial buildings. No site plan approval has been given for this
building.
Buildings constructed in the B-3 Zoning District are subject to the architectural
standards of Section 4400.8 of the Albertville Zoning Ordinance.
Fill and Grading
Sections 1800 and 1900 regulate landfilling and site grading. These sections stipulate
that a landfilling or grading permit is required if 50 cubic yards of fill is deposited on the
site or 50 cubic yards is moved within a site.
Site inspection reveals that there are dirt and gravel piles on the site. There also
appears to be active grading and drainage improvements on site.
The fill quantities should be verified and a grading permit be pursued in conjunction with
the submission of a grading plan that would be approved by the City Engineer.
Conclusion
The aforementioned items are code violations that were identifiedby the City Building
Official. The property owner may demonstrate any past approvals that allow the
present activities. Without evidence of any past approvals, these activities should be
removed from the site.
