2008-03-06 Letter from Dept of Arm regarding purchase of propertyREPLY TO ATTENTION OF Operations Regulatory (2004-3076-TJF) Mr. Michael Potter 11650 571h Street Northeast Albertville, Minnesota 55301 Dear Mr. Potter: DEPARTMENT OF THE ARMY St. Paul District Corps of Engineers 190 Fifth Street East St. Paul, Minnesota 55101-1683 March 6, 2008 RECEIVED OCT , 1 200 Building Inspections Thank you for providing a copy of your purchase agreement of wetland mitigation bank credits. This purchase, as well as other mitigation, was done in reference to a project site along Mackenzie Avenue in Albertville, in the NW1/4 of Section 6, T120N, R23W, Wright County, Minnesota. Our records indicate that you had adequately mitigated the majority of the wetland filling that occurred on your site. Mitigation bank credits (1.18 acres of new wetland and 2.08 of public value credits) were purchased from the Stanley Held bank for the impacts in the north portion of the site. You also removed two small fill areas along Mackenzie Avenue. The purchase agreement just provided addresses the resolution of the last small fill area (about 6,500 square feet) along Mackenzie Avenue. We have determined that your purchase of 9,750 square feet of new wetland credit from the Judith Potter bank (BWSR account 198) adequately resolves all of your remaining Corps of Engineers related wetland fill activities at this site. V. If you propose to conduct any work within waters or wetlands you should contact our office, as well as the appropriate local and State wetland resource agencies, prior to conducting any such work to avoid violating State and Federal laws. We recommend that if you intend to develop this site it may be beneficial to schedule a meeting and/or site visit so that the extent of jurisdiction of the various agencies can be clearly explained.
