Dear Mike: I am writing this letter as a follow up to our brief discussion yesterday evening, April 29t", regarding the status of the above referenced grading permit. It was my intention to address this permit request after a decision is made on your sign variance request, and potentially issue one grading permit instead of two. To avoid any questions relating to MN State Statute 15.99, and as we discussed, I feel it is best to address this permit at this time. Understand of Filling/GradingFilling/Grading Application Per the 10-1-09 permit application, it is understood that approximately 1,400 CY of material will be imported and placed within the boundaries of the un-platted Lot 1, Block 2 of Potter's Commercial Park, which is depicted on the Preliminary Plan and Screen Plan, prepared by Meyer Roblin Inc., as a 58,308 SF area in the southeast corner of the subject property and directly adjacent to Mackenzie Avenue NE. It is understood that the fill material is that of excess and/or unsuitable material generated from the development of the Emma's Express convenient store. As of current, it is understood that all fill material has been delivered to the site and stockpiled and no additional fill will be hauled in as part of this application. Since the application was made, it was learned that portions of the proposed fill area are deemed to be wetland per the US Army Corps and compensatory mitigation through the purchase of wetland credits will be required prior to the any further grading activity. It is understood that you intend to fill the proposed area to an elevation that approximates that of the adjacent Mackenzie Avenue NE and will establish turf over all disturbed areas upon completion of grading. Conditions of Approval The 10-1-09 Grading/Filling Permit Application, is approved subject to the following conditions: 1. No additional fill is imported to the site and only the material on -site as of this date is used in the proposed filling/grading activity. The importing of any and all additional fill and all future grading activity will need to be permitted through a separate application. vX 2. Fill and grading activity only take place within the boundaries of the area described above (Potter Commercial Park Lot 1, Block 2). Proof of purchase of required wetland credits as described in the Department of the Army's March, 4, 2010 letter. 0�,4. The final grading and contouring shall not obstruct drainage and shall replicate that of the natural or pre -application drainage patterns. Rerouting of the adjacent ditches/streams is not permitted. Erosion and Sedimentation best management practices shall be implemented, in -place and intact throughout construction and as required by the City. At minimum, silt fence shall be placed own gradient from all disturbed soil areas. e�.'b. If the construction activity will disturb more than 1-acre (43,560 SF) of land area, an MPCA NPDES Construction Stormwater Permit will have to be secured through the MPCA. Please note the proposed work site (Lot 1, Block 2) exceeds 1-acre. p►�9. Upon completion of grading, all disturbed areas shall be restored to a smooth and "mow -able" yj grade and all slopes shall be contoured to that of a 3:1 or less. �fit 8. During delivery of the fill material from the Emma's Express site, the pavement of Mackenzie Avenue NE was damaged. Upon completion of the proposed work, the Applicant shall p coordinate a meeting with the City to review and assess the condition of the damage to Mackenzie Avenue NE caused by this work. The costs associated with any repairs deemed necessary by the City will be the responsibly of the Applicant/Owner. 9. Upon reasonable advanced notice, Owner shall permit the City and/or its agents access to the site for review and inspection purposes. C?1. All grading and filling activity shall be completed within 90-days of issuance of permit. �� Prior to the commencement of grading/filling activity, Applicant shall provide the City with a t. statement that he will comply with the conditions prescribed above.
