RE: Albertville — Potter Property Code Violations

On July 21, 2009, the Albertville Building Official met with City staff to discuss potential
code violations related to property located at the southwest corner of County Road 37
and MacKenzie Avenue. This site is zoned B-3 and remains undeveloped. However,
loU- q,'the site is currently being used for outdoor storage of equipment, building materials,
c� debris, sand, and dirt. This outdoor storage appears to be expanding.
Most recently, a building frame was erected on the site without permit or City approval.
1 . The City Building Official has issued an inspection notice and stop work order on the
building. Our office has been directed to itemize and document the specific violations.
Zoning
The site is zoned B-3, Highway Commercial District. This district outlines the allowed
land uses, lot size, setbacks and architectural performance standards.
Outdoor Storage
In October 1997, Mr. Potter was notified that his outdoor storage was not in compliance
with City regulations at that time. We have no record on file of a conditional use permit
or efforts to bring the storage into compliance.
Section 1000.15 regulates outdoor storage for residential, commercial or industrial
districts.
Section 1000.15.A.3 allows for the outdoor storage of construction and landscaping
materials currently being used on the premises.
The ent outdoor storage may be acceptable under this provision if there was a City -
