RE.` Land Fill Application - Stop Work Orders — Previous Letter of August 6, 2009
Dear Mr. Potter.
On September 21, 2009 I again observed continuing land filling in progress without a permit for
your property on CR 37 and Mackenzie in Albertville as noted in the attached photographs. You
submitted a permit application on that day however, your permit application is incomplete and
considered after the fact. The grading and filling work is not authorized until a permit is issued
by the City Council.
Your application states 200 cubic yards of. fill. Please note it is my understanding, information,
and observation that the amount of fill placed most recently from the Albert and Emma's site
was approximately 400 cubic yards as of 9-24-09. In addition, you have previously filled for
which you received a Stop Work Order (issued by my inspection notice of 7-21-09), and this
Stop Work Order is still in effect. When considering the fill violation addressed in my
inspection notice of 7-21-09 and 9-24-09, I estimate in excess of 450 cubic yards of fill has been.
placed. Your permit application must reflect the total amount of fill.
Thank you for submitting your Application for Land Filling on 9-24-09, however, we are unable
to process your application because it.is incomplete. The following items must be submitted as
noted in the attached City Code Chapter 1800.2, Section B. City Code section 1900 regulating
grading and excavation. also applies to your project and I have attached it for your information.
1) Please submit your. total permit application fee of $1,400.00. The breakdown is as
follows; application fee of $200.00, escrow of $1,000.00, and an after the fact fee of
$200.00 (1800.2 A, and 1800.7).
2) Please state the purpose and intent of the land fill and grading and the source, type, and
amount of fill to be placed (1800.2 A 4, 5).
3) An estimate of the time required to complete the land fill (1800.2 7). Specific time limits
may be imposed on grading and filling permits, all operations shall be completed within
90 days of issuance of the permit (1800.8).
4). A survey showing the present topography and boundary lines for the adjacent wetland,
and a proposed finished grade and landscape plan. Erosion control measures shall be
provided on such plan. It is our understanding you have a previous survey which could
be modified and may be adequate for you to submit in order to meet this requirement.
(1800.2 8, 9, 10, 11).
5) Construction of shed without permit; please note my previous letter. You stated you will
be removing the shed out of the City and city staff was in agreement with your proposal
at that time and expected the shed to be removed by 8/17/09. The shed has not been
removed to date, the shed must be removed by October 5d' or you must apply for a
building and site review application and a building permit application by that date.
6) Exterior Storage; the exterior storage on your property was identified in the previous
letter and has increased. Exterior storage is allowed on your property with a Conditional
Use Permit (CUP) that may only be issued by the City Council. You indicated that you
would review this issue with the City Council and determine if you would then submit a
CUP application. This issue may be rectified by submitting a CUP application or
removing the exterior storage. Staff will discuss this issue with the Council and seek
their direction by October 5`h.
