Pledge of Allegiance — Roll Call Present: Acting Mayor Olson, Councilmembers Hudson and Zagorski Absent: Mayor Hendrickson and Councilmember Cocking September 19, 2022 — 7 pm Council Chambers Albertville City Hall Staff Present: City Administrator Nafstad, City Attorney Couri, Finance Director Lannes and City Clerk Luedke 3. Recognitions — Presentations — Introductions — None 4. Public Forum — None 5. Amendments to the Agenda MOTION made by Councilmember Hudson, seconded by Councilmember Zagorski to approve the September 19, 2022, agenda as submitted. Ayes: Hudson, Olson and Zagorski. Nays: None. Absent: Cocking and Hendrickson. The motion carried. 6. Consent Agenda All items under the Consent Agenda are considered to be routine by the City staff and will be enacted by one motion. In the event an item is pulled, it will be discussed in the order it is listed on the Consent Agenda following the approval of the remaining Consent items. Items pulled will be approved by a separate motion. A. Approve the August 15, 2022, City Council Meeting minutes as presented. B. Approve the September 6, 2022, City Council Workshop minutes as presented. C. Authorize the Monday, September 19, 2022, payment of claims as presented, except bills specifically pulled which are passed by separate motion. The claims listing has been provided to City Council as a separate document and is available for public view at City Hall upon request. D. Approve the Memorandum of Understanding between Wright County and the City of Albertville for the Purchase of Salt for the 2022-2023 Snow and Ice Removal Season at a cost of $95.34 per ton. E. Approve Pay Estimate #2 to Omann Contracting for 2022 Street Improvements in the amount of $710,222.85. F. Approve the quote from Cobalt Companies in the amount of $6,700 to prep and paint the signal systems at I-94 and CSAH 37. MOTION made by Councilmember Hudson, seconded by Councilmember Zagorski to approve the September 19, 2022, Consent Agenda as submitted. Ayes: Hudson, Olson and Zagorski. Nays: None. Wright County Sheriffs Office — Updates, reports, etc. There were no updates from the Wright County Sheriffs Department, 9. Department Business A. City Council Councilmember Zagorski reported at the Planning Commission meeting and said the Commissioners discussed the applications received from Lil' Explorers Childcare Center for a new facility to be built on the Outlot B Labeaux Station. He said the Commissioners also discussed a possible zoning text amendment to limit the size of outdoor storage areas in connection with the building size. City Administrator provided addition information on the Lil' Explorers applications and answered questions from Council. B. Building — None C. City Clerk — None D. Finance 1. Fire Relief Pension Amendment City Administrator Nafstad presented the staff report and answered questions from Council. The Albertville Fire Department thanked the City Council for their support of the department. MOTION made by Councilmember Hudson, seconded by Councilmember Zagorski to adopt Resolution No. 2022-31 amending the Annual Retirement Benefit for the Albertville Volunteer Fire Department from $3,700 to $4,200 per year of service. Ayes: Hudson, Olson and Zagorski. Nays: None. Absent: Cocking and Hendrickson. The motion carried. E. Fire — None F. Planning and Zoning — None G. Public Works/Engineering — None H. Legal I. Administration 1. Discussion of Enforcement of Ordinance Violations City Administrator Nafstad provided background information regarding the ongoing code violations at an Albertville property. He said the property owner has already received five violation notices without a response from the owner. He explained the townhome property appeared to be empty for some years and sustained a water leak in the past which may have resulted in a mold issue. Administrator Nafstad said City staff would like Council direction whether to instruct the City Attorney to file a court action against the property owner for the ongoing code violations and to inspect the property for the presents of mold. He answered questions from Council. City Council Meeting Minutes Regular Meeting of September 19, 2022 Page 3 City Attorney Couri provided additional information on the process if the violations were to go through the court order process. He said if there was mold present, it could be a health issue to the adjourning townhome. There was Council discussion the property's code violations, the possible mold issue and the process moving forward. 2. Maeyaert Property Update City Attorney Couri provided an update on the Maeyaert property and said after the last property cleanup, the nuisance items have been brought back to the property by the owner. He said he was seeking another court order to be able to remove the items with advanced notification to the property owner and he explained the court order process. He reported at the next Council meeting, he would be requesting to set a public hearing date for the Maeyaert property assessment.
