Call to Order Mayor Hendrickson called the special meeting to order at 6 pm. Present: Mayor Hendrickson, Councilmembers Cocking, Olson and Zagorski. Absent: Councilmember Hudson Staff Present: City Administrator Nafstad 2. Discuss Finance Clerk Pay Increase Administrator Nafstad presented the Request for Council Action and noted the pay request was necessary to retain Ms. Moseng as Finance Clerk II and consistent with salaries paid by other cities for similar positions. The Council discussed the position and added that Ms. Moseng also serves as the City’s Deputy Clerk. The Council noted the additional roles and responsibilities Ms. Moseng has taken on. Council discussed the proposed scale for the position and directed Administrator Nafstad to set the scale for Finance Clerk II/Deputy City Clerk at a starting step rate of $30.58/hour and step 5 rate of $34.60. Additionally, offering Ms. Moseng the step 2 rate of $32.13 MOTION made by Councilmember Cocking, second by Councilmember Olson to adjust the scale for position of Finance Clerk II/Deputy City Clerk to $30.58 to $34.60/hour and offered Ms. Moseng the step 2 rate of $32.13, as well as, adjusted her vacation benefit by 1 day. City Council Councilmember Zagorski reported at the Planning Commission meeting and said the Commissioners discussed the applications received from Lil’ Explorers Childcare Center for a new facility to be built on the Outlot B Labeaux Station. He said the Commissioners also discussed a possible zoning text amendment to limit the size of outdoor storage areas in connection with the building size. City Administrator provided addition information on the Lil’ Explorers applications and answered questions from Council. B. Building – None C. City Clerk – None D. Finance 1. Fire Relief Pension Amendment City Administrator Nafstad presented the staff report and answered questions from Council. The Albertville Fire Department thanked the City Council for their support of the department. MOTION made by Councilmember Hudson, seconded by Councilmember Zagorski to adopt Resolution No. 2022-31 amending the Annual Retirement Benefit for the Albertville Volunteer Fire Department from $3,700 to $4,200 per year of service. Administration 1. Discussion of Enforcement of Ordinance Violations City Administrator Nafstad provided background information regarding the ongoing code violations at an Albertville property. He said the property owner has already received five violation notices without a response from the owner. He explained the townhome property appeared to be empty for some years and sustained a water leak in the past which may have resulted in a mold issue. Administrator Nafstad said City staff would like Council direction whether to instruct the City Attorney to file a court action against the property owner for the ongoing code violations and to inspect the property for the presents of mold. He answered questions from Council. He said if there was mold present, it could be a health issue to the adjourning townhome. There was Council discussion the property’s code violations, the possible mold issue and the process moving forward. 2. Maeyaert Property Update City Attorney Couri provided an update on the Maeyaert property and said after the last property cleanup, the nuisance items have been brought back to the property by the owner. He said he was seeking another court order to be able to remove the items with advanced notification to the property owner and he explained the court order process. He reported at the next Council meeting, he would be requesting to set a public hearing date for the Maeyaert property assessment. BACKGROUND: As required per MN Statute 204B.21, the Council needs to approve the appointment of the Election Judges at least 25 days before the election at which the judge will serve. The City is the responsible authority to conduct absentee voting for the Albertville residents and is required by MN Statute 203B.121 to establish an Absentee Ballot Board. The Absentee Ballot Board judges will have the responsible for accepting/rejecting absentee ballots based on the criteria set by State Statute. KEY ISSUES: • The General Election will be held on Tuesday, November 8, 2022. • Minnesota Statute 204B.21 requires that persons serving as election judges must be appointed by Council at least 25 days before the election. • The City of Albertville is the responsible authority to conduct absentee voting for its residents and is required to establish an Absentee Ballot Board. The process has concluded with the request to approve the hiring of the above-named individual to the position of Reserve Firefighter. The applicant has met the requirements as outlined in Section 4.1.3 (Employment Eligibility - Requirements and Process) of the Albertville Fire Department’s (AFD) Standard Operating Policies and Procedures. He has also completed and successfully passed the complete AFD hiring process. This process includes, but is not limited to: a. Application b. Initial Interview c. Physical Ability Test d. Reference Checks e. Final Interview f. Conditional Job Offer g. MN BCA Background and Criminal History Checks h. Pre-Employment Medical Exams / Drug Testing i. Pre-Employment Psychological Exams and Interview The AFD is asking for Council authorization for the hiring of one new Reserve Firefighter. If approved by Council, the new member will be sworn in on Thursday, October 13th, at the Albertville Fire Department. KEY ISSUES: • The current AFD hiring process is ending. • One applicant has successfully completed the AFD hiring process. • If approved by Council, the new member will be sworn in on Thursday, October 13th, at the Albertville Fire Department. FINANCIAL CONSIDERATIONS: The costs associated with the hiring process are part of the annual Fire Department Operating budget. The Reserve Firefighter will start as volunteer, unpaid, member of the Fire Department. MOTION TO: Adopt Resolution No. 2202-34 vacating a portion of an existing drainage and utility easement on Outlot A Lebeaux Station. BACKGROUND: Lil Explorers Childcare has requested the approval of a number of development applications associated with the proposed construction of a 16,788 sq. ft. daycare facility on Outlot A Lebeaux Station located at the northeast corner of 57th Street and Lachman Avenue. To facilitate the development proposal, approval of the following development applications have been formally requested: 1. Preliminary and Final Plat. Changing the Outlot designation to a Lot and Block legal description to make the property eligible for a building permit. 2. Easement Vacation. The current outlot has a 20-utility easement that must be vacated to allow for the building location and construction. 3. CUP/Site and Building Plan Review. Commercial daycare facilities require a conditional use permit within the B-2A zoning district. Review of site and building plans is required for new commercial construction. City Staff has reviewed the aforementioned applications and submission materials and prepared the September 8, 2022, Planning Report. The Albertville Planning Commission held a public hearing to consider the development application and staff reports on September 13, 2022. Upon conclusion of the public hearing, the Planning Commission recommended approval of each of the development applications with the conditions outlined in the September 8, 2022, planning report. KEY ISSUES: • The subject site is zoned B-2A, Special Business. Commercial daycare facilities are allowed by conditional use permit in the B-2A zoning district. The proposed use is consistent with the purpose of the B-2A district and will be compatible with adjoining land uses. To be eligible for a building permit and construction the site has to be platted into a lot and block description. The proposed plat shows a lot that meets all the B-2A lot area and width requirements. •The existing Outlot contains a number of drainage and utility easements that impact the location of the building and site design. A portion of a 20-foot easement will have to be vacated to accommodate the building location. •That portion of the 20-foot drainage and utility easement proposed for vacation was originally created based on the original site plan for the property that included two commercial lots. Its vacation will allow for the development of the larger commercial daycare lot that will benefit the community through expanded commercial services and expanding the City’s commercial tax base. •The September 8, 2022, planning report outlines the conditions that are recommended for approval of the daycare conditional use permit and site and building plans. These conditions have been reviewed and recommended for approval by the Albertville Planning Commission. •The attached resolution outlines conditions of approval that must be satisfied to bring the preliminary plat, final plat and the CUP/site and building plan into compliance with City zoning performance standards. POLICY/PRACTICES CONSIDERATIONS: The Albertville Planning Commission held a public hearing on September 13, 2022, and agreed with the findings and recommendations outlined in the September 8, 2022, planning report and recommended that the City Council approve Lil’ Explorers Childcare’s applications for Lebeaux Station Second Addition preliminary and final plat and the Conditional Use Permit for a daycare to be located on Outlot B Lebeaux Station in Albertville. With regard to the applications for preliminary plat, site and building plan, and conditional use permit; the Planning Commission recommended approval of each application with the conditions outlined in the September 8, 2022, planning report. These conditions are outlined in the attached resolution. FINANCIAL CONSIDERATIONS: All required on-site improvements shall be the responsibility of developer. The development shall pay all City development fees and charges related to this new use. LEGAL CONSIDERATIONS: The use is allowed within the district as a conditional use permit. The lot has a total area of 202,013 square feet or 4.64 acres and has a width of 392 feet. The lot area and width exceed the B-2A district standards. There is a 20-foot utility easement located to the east that will need to be vacated to allow for the building to be constructed at the proposed location. Approval of the proposed final plat will be subject to the following conditions: 1. The plat does not identify the new Lot 1, Block 1 Lebeaux Station Second Addition. The plat must be revised to include this lot and block description. 2. The City has a 60-foot main sanitary trunk easement running north and south through the lot. The site plan proposes a parking lot and trash enclosure within this easement. This is acceptable, with the understanding that if the City needs to disrupt this easement to access the underlying utility the replacement or restoration of private improvements within the easement is the responsibility of the private property owner. 3. The 20-foot easement east of the City’s 60 wide Sewer main easement will need to be vacated to allow for construction of the building. Applicant shall provide an application and legal description of at portion of the easement to be vacated. 4. The proposed remaining easements are reviewed by the City Engineer and found to be adequately sized and located for proposed utilities. CONDITIONAL USE PERMIT/SITE PLAN Zoning. The site is zoned B-2A Special Business District. The commercial daycare is permitted with a conditional use permit. Lot Area and Setbacks. The proposed daycare is designed for 189 child enrollment and 28 adult staff members. The City parking standards do not specify the amount of parking required for the proposed use. The ITE standard for daycare centers range from 2.7 to 3.6 parking stalls per 1,000 feet of gross floor area. The ITE standard would require 45 to 60 parking spaces. The site plan shows 44 total stalls, and with the indicated proof of parking, would fall within the specified range. The applicant agrees that the City may require the proof of parking to be constructed upon display of inadequate parking. The parking lot shows bituminous surfacing, concrete curbing, and striping meeting the City zoning standards. Parking spaces are required to be 20 feet in length and 9 feet in width. Loading. The proposed floor plan shows a kitchen in the rear portion of the building. The applicant must identify the type and size of vehicles that will be servicing or delivering to the facility and show on-site turning movements for delivery vehicles and garbage trucks that will service the site. The applicant shall provide a site plan showing the service vehicles maneuvering through the site. Trash Enclosure. The trash enclosure is located to the northeast corner of the parking lot. This location is acceptable upon successful demonstration of service vehicles maneuvering through the parking lot. Plans for trash enclosure including elevations showing materials, gate, and design compatibility with the principal structure, to be approved by City Staff. Outdoor Lighting. The provided photometric plan shows that lighting levels at the property lines are compliant with City standards. Light fixtures should be installed above each entry door. Freestanding light poles shall not exceed a height of 30 feet. Applicant shall provide cut sheets of the proposed exterior fixtures that demonstrate a 90-degree cut off and screened light source. Fence. The site plan indicates that there will be fencing around the outdoor play areas and more details will need to be provided. The play areas on the South side of the building are only 10 feet from the street, which poses concerns of projectiles leaving the play area as well as the security and safety of the children. A minimum fence height of 5 feet or higher and self-latching gates will be required. Fence details, indicating materials used, height, exterior gates and latches, shall be submitted for City approval. Building/Architecture. Exterior materials consist of manufactured stone veneer at the base, LP siding on the remaining portion of exterior wall, and a fiberglass shingled roof. The exterior is composed of preferred materials or replicants and meets City standards. Any ground mounted or rooftop mechanical equipment must be screened from view of adjoining properties and public streets. Agenda Page 20 Landscape Plan. The planting locations on the landscaping plan are not consistent with the planting locations on the site plan. The perimeter of the parking lot is required to be screened with landscaping such as hedges to prevent headlight glare from going into the nearby streets. A revised landscaping plan showing location, species, size, and number of plantings shall be submitted. The sod in the front of the building shall be continued along the south side to the back of the building and the low maintenance turf around the outside edges of the lot. Utilities. The sanitary sewer, electrical, and storm water systems are subject to the review and approval of the City Engineer. The parking area and trash enclosure lay within a City main sewer trunk and utility easement. In the event that the City needs to access the area, any repairs/replacements of private improvements within required as a result of that access will be at the expense of the property owner. The building is proposed to be placed over a 20-foot easement, which will need to be vacated. The vacation of this easement does not pose any issues with utility services. Water Service. Potable water and fire suppression will require separate service lines and valves up to the building. CONCLUSION Subdivision. In review of the subdivision, we find that the proposed lot meets the area and width standards of the B-2A zoning district and staff recommends approval subject to the following conditions: 1. The applicant label the plat of Lot 1 Block 1 Labeaux Station Second Addition. 2. Applicant shall provide a legal description and petition to vacate the 20-foot easement underlying the building. 3. The applicant understands that in placing the parking lot and trash enclosure in the utility easement they are subject to removal in the event that the City needs to access the utility under the easement. Any repairs required as a result of that access will be at the expense of the property owner. Conditional Use Permit. In review of the site plan and architectural building plan, staff recommends approval of the conditional use permit with the following conditions: 1. Approval of the requested subdivision and implementation of the subdivision conditions of approval. 2. The applicant agrees that the City may require the proof of parking to be constructed upon display of inadequate parking. 3. The applicant shall provide a description of the service vehicles that will typically visit the site and a revised site plan demonstrating that the parking lot has sufficient maneuvering area to accommodate such vehicles without interfering with other parked vehicles. The applicant understands that in placing the proof of parking and trash enclosure in the utility easement they are subject to removal in the event that the City needs to access the area. 5. The lighting plan shall provide details of exterior light fixtures, poles, and mounting methods. 6. The applicant shall provide a detailed fencing plan that includes design, location, materials, minimum height of 5 feet, and all self-latching gates and access points. 7. The applicant provides a revised landscaping plan that matches the site plan and includes the screening of the parking lot, the sod in the front of the building continued along the south side to the back of the building, and information such as species, number of, and size of the plantings. 8. The site plan proposes a parking lot and trash enclosure within this easement. The applicant shall provide a description of the service vehicles that will typically visit the site and a revised site plan demonstrating that the parking lot has sufficient maneuvering area to accommodate such vehicles without interfering with other parked vehicles. 4. The applicant understands that in placing the proof of parking and trash enclosure in the utility easement they are subject to removal in the event that the City needs to access the area. 5. The lighting plan shall provide details of exterior light fixtures, poles, and mounting methods. 6. The applicant shall provide a detailed fencing plan that includes design, location, materials, minimum height of 5 feet, and all self-latching gates and access points. 7. The applicant provides a revised landscaping plan that matches the site plan and includes the screening of the parking lot, the sod in the front of the building continued along the south side to the back of the building, and information such as species, number of, and size of the plantings. 8. The applicant shall revise the utility plan to provide separate water service lines and valves for potable water and fire suppression into the building. BACKGROUND: Mr. Gary Fehn is purchasing land in St. Michael (PID 114-500-421-10_). As part of the land purchase, he wants to also purchase the south end of (PID 101-500-121-208) in Albertville (See Exhibit B). The plan is to assemble this parcel to allow for the construction of a new home, but also to allow for a future single family residential subdivision. With the majority of the land in St. Michael, and all street and utility access from St. Michael. Mr. Becker (owner) and Mr. Fehn (applicant) are requesting the City of Albertville to approve a resolution to allow a portion of parcel (PID 101-500-121-208) to be detached from Albertville and annexed into St. Michael. KEY ISSUES: • Parcel (PID 101-500-121-208) 11703 50th Street NE is a single-family residential property within Albertville. • Exhibit C is the survey showing the parcels under consideration for detachment /annexation. The current property is 1.93 acres in total land area. That portion (Parcel B) proposed to be detached and annexed is 1.07 acres in area. That portion of the property remaining in Albertville (Parcel C) is .86 acres which exceeds the lot area and width requirements of the R-1A zoning district. • The property is currently reliant on on-site well and septic system. Ende Septic Service has provided a study (Exhibit D) that demonstrates the parcel remaining in Albertville has sufficient land area to provide a secondary site for a Type 1 septic system to be installed that will effectively treat effluent if the current system would fail. • The property displays steep topography that divides the house site along 50th Street from the portion of the lot requested to be detached and annexed into St. Michael. • The City of Albertville does not have municipal utilities in the area to serve the property. Any future subdivision in this area will be accessed via public streets and served by utilities through St. Michael. • The parcel to be detached is an undeveloped .5 acres, the loss of this land will not significantly impact the City of Albertville financially. POLICY/PRACTICES CONSIDERATIONS: Action on any detachment/annexation is a policy decision for the City Council. The attached resolution outlines findings in favor of the requested detachment/annexation. What ratio should be established between the amount of allowed outdoor storage and the size of industrial building? 2. Should long-term parking areas (durations extending beyond 24 or 48 hours) be treated as outdoor storage. BACKGROUND: Recently, the City has been approached by several businesses interested in industrial properties in close proximity to I-94, that would allow large areas of outdoor storage accessory to their businesses. In review of these requests, City staff believes that the Planning Commission and City Council may consider limiting the size of accessory outdoor storage areas to a ratio related to the size of the principal building on the site. The rationale for this discussion is as follows. 1. Albertville is 4 square miles and is limited in the amount of vacant buildable land. The City wishes to be most efficient in the use of its remaining Commercial and Industrial vacant land. 2. Albertville is located along I-94 and has two major interchanges. These locational elements provide Albertville with strong locational advantages in Commercial and Industrial growth. 3. In the continued pursuit of economic development, the City’s goals, are to expand local job opportunities, quality jobs with livable wages, and grow its commercial and industrial tax base. Large outdoor storage yards run contrary to these expressed goals. KEY ISSUES: • An inventory of the Albertville industrial area illustrates that the most industries need outdoor storage. The inventory illustrates that most of the City’s industries have less than 2 to 1 ratio of outdoor storage compared to the floor space of the principal building. • The City’s industries having a higher ratio of outdoor storage to building size include Fehns and Oman Bros. These are large contractors have a need for storage of large equipment and materials. In discussing this with the Planning Commission, it was pointed out that these are long-time local industries and were encouraged to grow in- place, the Planning Commission would not have been as receptive to a similar industry moving into the community. • Outdoor storage yards do little to expand the local tax base or created new job opportunities compared to industrial buildings. The long-term parking areas may be treated as outdoor storage or may be treated as parking. POLICY/PRACTICES CONSIDERATIONS: This issue was presented to the Planning Commission at the September meeting for discussion only. They expressed the following findings and would like to know if the Council agrees with their findings before proceeding to a public hearing on a code amendment. 1. The Planning Commission agrees that we should limit the outdoor storage to a ratio related to the size of the principal building. 2. In discussing the ratio, the Planning Commission felt a ratio between 2:1 to 3:1 would be acceptable based on the averages in the City currently. They did express some concern over being too restrictive may discourage industrial growth. 3. With regard to the long-term parking areas, the Planning Commission felt that if the area is designed and constructed as a parking lot for automobiles per City design standards, it should be treated a parking and not counted against the outdoor storage ratio. FINANCIAL CONSIDERATIONS: The financial considerations related to this issue is how the City wishes to direct the land use on the remaining industrial land in Albertville. Albertville’s industrial projects, AVA, Scherer Bros, Oldcastle Glass, Frazer Steel and Mold Tech have demonstrated that the City can attract production industries that work with limited outdoor storage. These industries have significant buildings on their lots. LEGAL CONSIDERATIONS: The City Council may amend its zoning regulations to reflect the economic development goals of the City. Agenda Page 54 Reflective of the City is limited land supply, large outdoor storage yards do not the accomplish the City’s economic development goals. The City wishes to be efficient with its remaining land supply in this regard the Planning Commission and City Council are being requested to consider limiting the amount of outdoor storage in the commercial and industrial zoning districts to a ratio relative to the size of principal building on the lot. The following pages provide an investigation of the city’s existing outdoor storage sites to provide examples of existing conditions. The Planning Commission and City Council is requested to consider the attached zoning text amendment that would limit outdoor storage within the industrial zoning districts. EXHIBITS Exhibit A: Long Haul Trucking Plan Exhibit B: Existing Industrial Outdoor Storage Calculations and Map Exhibit C: Draft Zoning Text Amendment ANALYSIS There have been inquiries from trucking and transportation businesses with small buildings and large outdoor storage needs. See Long Haul Trucking Plan, Exhibit A as an example. Long-Haul Trucking: Examining the Long-Haul trucking concept plan, we estimate that the semi-truck and trailer storage occupies approximately 3.3 acres of the site. This storage area would be a 3:1 ratio compared to the proposed building size. The Long-Haul concept plan shows 170 parking spaces. Evaluation of the uses within the building against city code required parking counts, the building would require approximately 74 parking spaces. The additional parking would be for longer term parking for the truck drivers. This raise the question as to whether the 100 long-term parking (24+ hours) stalls should be treated as parking or be considered outdoor storage. If the long-term parking is included in the outdoor storage area calculation the storage area is approximately 4. Acres resulting in a ratio of 3.6: 1 ration compared to the proposed building footprint. The Planning Commission and Council must discuss whether the limits of outdoor storage should include locations designed as long-term parking. Agenda Page 55 Survey of Existing Industrial Sites. Exhibit B selected 17 different industrial sites with outdoor storage and prepared calculations comparing the principal building size to the existing outdoor storag e areas. The average of all 17 sites results in a 3.2: 1 outdoor storage ratio to principal building floor area. However, this average is greatly skewed by the largest outdoor storage are sites. Sites 4, 10, 11, 12, and 17 are existing industrial sites have the largest outdoor storage areas in proportion to the principal building. These are contractor yards with larger areas of equipment and material storage in relation to a principal building. The services provided by these businesses occurs off-site with limited employee count on-site. The average ratio of outdoor storage to principal building floor area without Lots 4,10.11,12,17, is 1.64 :1. This suggests that establishing a ration of 2:1 for the City’s commercial and industrial district may be in-line with most of the current development. The City’s most recent industrial approvals (AVA 1, Albertville Self Storage 2, and Scherer Bros 3) all included an outdoor storage component. AVA and Albertville Self - Storage have outdoor storage ratio of less than 1:1 when compared to their principal building footprints. Scherer Bros outdoor storage ration is greater than 4:1. Currently Section 1000.15 B reads as follows. Staff recommendation of code language change is in bold. B.Except as allowed by district use provisions, outside storage of equipment, materials and inventory as an accessory use for commercial and industrial uses shall require a conditional use permit subject to the provisions of chapter 400 of this ordinance. In addition, all nonresidential outside storage shall conform to the following conditions: 1.The area occupied is not within a required front or required side yard. 2.The storage area is totally fenced, fully screened and landscaped according to a plan approved by the zoning administrator, and a landscape guarantee, as determined by the zoning administrator, is provided. 3.If abutting a residential district or use, screening and landscaping is provided according to a plan approved by the zoning administrator. 4.The storage area is grassed or surfaced with asphalt, concrete, or crushed rock (concrete or granite) to control dust. Should an area surfaced with anything other than hard surfacing prove to be unmaintainable, the city shall require that a hard surface be installed within three (3) months of formal written notice to the property owner. 5.All lighting shall be hooded and so directed that the light source shall not be visible from the public right of way or from neighboring residences and shall be in compliance with section 1000.10 of this chapter. 6.The storage area does not encroach upon required public or employee parking space(s), required loading space, or snow storage area as required by this ordinan ce. STORAGE, COMMERCIAL AND INDUSTRIAL USES, OF THE ALBERTVILLE MUNICIPAL CITY CODE, ENFORCING OUTDOOR STORAGE RATIOS RELATIVE TO THE PRINCIPAL BUILDING AND DEFINING LONG-TERM PARKING AS OUTDOOR STORAGE. THE CITY COUNCIL OF THE CITY OF ALBERTVILLE, MINNESOTA ORDAINS: SECTION 1. Section 1000.15 B. of the Albertville zoning code is amended as follows: B. Except as allowed by district use provisions, outside storage of equipment, materials, and inventory as an accessory use for commercial and industrial uses shall require a conditional use permit subject to the provisions of chapter 400 of this ordinance. In addition, all nonresidential outside storage shall conform to the following conditions: 1. The area occupied is not within a required front or required side yard. 2. The storage area is totally fenced, fully screened and landscaped according to a plan approved by the zoning administrator, and a landscape guarantee, as determined by the zoning administrator, is provided. 3. If abutting a residential district or use, screening and landscaping is provided according to a plan approved by the zoning administrator. 4. The storage area is grassed or surfaced with asphalt, concrete, or crushed rock (concrete or granite) to control dust. Should an area surfaced with anything other than hard surfacing prove to be unmaintainable, the city shall require that a hard surface be installed within three (3) months of formal written notice to the property owner. 5. All lighting shall be hooded and so directed that the light source shall not be visible from the public right of way or from neighboring residences and shall be in compliance with section 1000.10 of this chapter. 6. The storage area does not encroach upon required public or employee parking space(s), required loading space, or snow storage area as required by this ordinance. 7. A site plan documenting the location and grading of the storage operation shall be submitted and shall be subject to the approval of the city engineer. 8. The Long-term parking of forty-eight (48) hours or greater shall be considered Outdoor Storage and shall be calculated against the maximum outdoor storage ratio of the code 9. BACKGROUND: At its September 6 meeting, the City Council approved an ordinance setting up the mechanism for imposing a franchise fee on natural gas revenues generated by CenterPoint Energy within the City of Albertville. The attached ordinance actually imposes the franchise fee at 5% of CenterPoint Energy’s gross revenues within the City of Albertville (State law limits franchise fees for gas to no more than 5% of gross revenues). Staff has estimated that the revenues from this franchise fee would raise approximately $120,000 in revenue for the City. Staff originally anticipated that the franchise fee would take effect in mid-October, having given CenterPoint Energy several months’ notice of the City’s intent to adopt the fee. Staff has very recently heard from CenterPoint that it needs 60 days after the ordinance is passed for the Public Utilities Commission to process CenterPoint’s request to pass the fee on to the consumer as part of CenterPoint’s rate structure, and a few weeks after that to begin implementing the fee in its billing system. As a result, CenterPoint has asked that the City make the ordinance effective on January 1, 2023. KEY ISSUES: • The City has a franchise ordinance in place with CenterPoint and the ordinance allows the City to impose a franchise fee. • The fee proposed is five percent (5%) of company revenues, with a projected collection of an estimated $120,000-$129,000 annually. • Collection will begin January 1, 2023. •This franchise fee will likely show up as a line item on CenterPoint’s billings as the City of Albertville Franchise Fee. FINANCIAL CONSIDERATIONS: The gas franchise fee is estimated to generate $120,000- $129,000 in revenue annually for the City of Albertville. LEGAL CONSIDERATIONS: The Mayor and Council have the authority to implement a Gas Service Franchise Fee on CenterPoint Energy via enactment of an ordinance. Stat. 216B.36 allows a municipality to require public utilities that occupy public property to obtain a franchise; and WHEREAS, Minn. Stat. 216B.36 also allows a municipality to require a public utility that operates within the municipality to pay a fee in order to raise revenue or defray costs of operation of the utility or both; and WHEREAS, fees under Minn. Stat. 216B.36 may be based on gross operation revenues or gross earning of the public utility so long as the public utility continues to operate in the municipality; and WHEREAS, the franchise agreement between the City of Albertville and CenterPoint Energy provides the terms under which the franchise fee will be collected. NOW, THEREFORE, THE CITY COUNCIL OF ALBERTVILLE HEREBY ORDAINS: Section 1. The City of Albertville hereby imposes a franchise fee on CenterPoint Energy in connection with the provision of the gas utility service in the City of Albertville in the amount of five percent (5%) of the Company's gross revenues derived from the provision of gas service within the borders of the City of Albertville.
