CALL TO ORDER – ROLL CALL – ADOPT AGENDA Chair Buhrmann called the meeting to order at 7:00 pm. City Clerk Luedke conducted roll call. Present: Chair Buhrmann and Commissioners Anderson, Hayden, Huggins, Smith and Council Liaison Zagorski. Others Present: Northwest Consultant Bob Kirmis and City Clerk Luedke. Motioned by Hayden, seconded by Anderson to approve the agenda as submitted. Ayes: Buhrmann, Anderson, Hayden, Huggins and Smith. Nays: None. MOTION DECLARED CARRIED. 2. MINUTES Motioned by Hayden, seconded by Higgins to approve the September 13, 2022, Planning Commission meeting minutes as presented. Ayes: Buhrmann, Anderson, and Hayden, Huggins and Smith Nays: None. MOTION DECLARED CARRIED. 3. PUBLIC HEARINGS A. Public hearing to consider a zoning test amendment to consider limiting the size of outdoor storage lots as a ratio to the size of the principal floor space. Kirmis presented the background information on limiting the size of outdoor storage lots in relation to the building structures and the rationale behind the discussion. He said at the September 13 Planning meeting, the Commissioners agreed that either 2:1 or 3:1 would be an acceptable ratio based on the City’s current averages. Regarding the long-term parking areas, Kirmis said the Commissioners felt if an area was designed and constructed as a parking lot it that it should be treated as one and not counted against the outdoor storage ratio. Kirmis reported at the October 3 Council meeting, the Council agreed with a ratio of 3:1 but regarding the long term parking felt that any parking over the minimum requirements of the City Code should be considered as outdoor storage when calculating Planning Commission Meeting Minutes Regular Meeting of November 9, 2022 2 the total outdoor area allowed. He answered questions from the Commissioners and said the current establishment’s ratios and parking areas would be grandfathered in if the amendment was passed. City Council Liaison Zagorski answered questions from the Planning Commissioners regarding the City Council discussion on considering the excess parking stalls in calculating the outdoor storage totals. Motioned by Huggins, seconded by Smith to open the Public Hearing. Ayes: Buhrmann, Anderson, Hayden, Huggins and Smith. Nays: None. MOTION DECLARED CARRIED. No one wished to speak. ANALYSIS The proposed amendment addresses the required fees for all sign permits. The amendment also reinserts the fee requirement for the annual renewal of billboards. The billboard renewal fee was mistakenly removed from the sign code in a previous amendment. CONCLUSION The proposed amendment reintroduces language that was mistakenly removed from the sign code. We recommend approval of this attached draft code amendment. Cc. Maeghan Becker Kris Luedke Mike Couri. 4 CITY OF ALBERTVILLE COUNTY OF WRIGHT STATE OF MINNESOTA ORDINANCE NO.: 2022-___ AN ORDINANCE AMENDING THE CITY CODE, TITLE 10 BUILDING AND DEVELOPMENT REGULATIONS, CHAPTER 7 SIGN REGULATIONS, SUBSECTION 8C PERMIT FEES The City Council of the City of Albertville, Minnesota hereby ordains: Section 1. The Albertville Sign Code is hereby amended as follows: Section 10-7-8 C, Permit Fees 1. Permit Fees: For each sign requiring a permit, there shall be an initial fee, as established in section 3-1-3 of this code, which shall be set from time to time by city council ordinance. (Ord. 2017-01, 1-3-2017) 2. Advertising Device-Renewal Fee: For each advertising device there shall be an annual renewal fee which shall be set from time to time by the City Council by resolution on or before April 1st of each year to be applicable to subsequent renewal fees. Each permit shall expire on the 30th day of June following. THIS AMENDMENT SHALL BE IN FULL FORCE AND EFFECTIVE IMMEDIATELY FOLLOWING ITS PASSAGE AND PUBLICATION. These districts established use and performance standards that varied from the base zoning districts. In establishing the PUD district, the approved uses and design standards were outlined in development agreements rather than in the zoning code. Any property owner questions pertaining to how they may use or improve their property within a PUD district requires staff to research past files or the development agreement to provide direction to the property owner. This is a difficult and inefficient process for addressing property owners zoning questions. To improve on the application of all PUD district regulations; City staff is preparing a summary of the PUD Districts as a zoning text amendment to allow easy access to the zoning regulations within each of these districts. The PUD research and draft code amendment was presented to City Staff. Through staff review, we identified that additional information is needed for a complete summary. We will bring the draft code amendment to the planning commission in January. We request that the planning commission continue the public hearing to the January 10, 2023, meeting to allow staff to complete the draft code amendment and zoning map update. Cc.
