1). Planning Commission Appointment
Nafstad reported that the Planning Commission term expirations needed to be realigned to stagger
term ending dates so that there is at least one seat expiring every year. He explained there are
currently no term expirations in 2018, so there would be a year where there are no appointments
made. Nafstad said Council options would be to hold off a year on the 4-year appointment of the
alternate seat or to appoint an alternate to a one-year term for 2018. Hudson felt it was important to
fill the alternate seat and thought a one-year term would sufficiently address the technicality. He felt
all applicants were well qualified.
The Council discussed the terms and it was suggested that Ms. Halling be appointed to a one-year
alternate seat on the Commission and Ms. Wegner be appointed to a four-year term ending in 2021.
Motioned by Hudson, seconded by Olson, to approve and amend Resolution 2018-002 to appoint
Planning Commissioners as follows:

Council discussed the proposed 2018 Fee Schedule. Cocking inquired about the increase in room
rental fees. Nafstad explained that Albertville’s fees for rental rooms are, by design, low compared
to other cities and even with fee increases the city will not make money on its room rentals. The
slight increase in fees will help with overall maintenance and professional cleaning of the
commercial kitchen. Nafstad explained that when City Hall was built about ten years ago, one of the
goals was for City Hall to be a resource to be used by the residents and community groups. Cocking
agreed with that. There were no further questions on the fee schedule.
Motioned by Olson, seconded by Hudson, to Approve Ordinance No. 2018-01 An Ordinance
Amending Title 3, Chapter 1, Section 3-1-3 (City Fees, Fines and Rates Schedule and Other
Various Titles in the Albertville Municipal Code. Ayes: Hendrickson, Cocking, Hudson, and

1). Municipal State Aid Revocation
Nafstad reported that 70th Street NE from CSAH 19 to MacIver Ave NE has been scheduled to be
turned over to Wright County and will become CSAH 38. He indicated he had held off on this item
until the plats for Hunters Lake Estates and Towne Lakes 7th Additions were platted. The resolution
will revoke that portion of 70th Street NE as a Municipal State Aid road. Otsego has already
approved its revocation and Wright County has approved taking the road over. Once Albertville
approves the revocation, MnDOT State Aid will designate the road a County State Aid Highway.
Motioned by Cocking, seconded by Hudson, to approve Resolution 2018-003 revoking the portion
of 70th Street NE from CSAH 19 to MacIver Avenue NE as a Municipal State Aid Street. Ayes:

School Board. Council felt the meeting could be cancelled.

SUBJECT: CONSENT - FIRE DEPARTMENT- PURCHASE OF A NEW FIRE ALARM SYSTEM FOR
THE FIRE HALL
RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO: Authorize the purchase and installation of a new fire alarm system for the
Albertville Fire Hall, based on low quotes, for a total purchase amount not-to-exceed $5,454.
BACKGROUND INFORMATION: The Albertville Fire Hall was constructed in 2000 and a
fire alarm system was installed per building and fire codes. The fire alarm system has recently
had some hardware malfunctions and resulting false alarm calls to the Fire Hall. While
examining the hardware issues, it was found that some of the hardware that was installed in the
Fire Hall, at the time of construction, was already over 6-years old at the time of installation.
Current fire system hardware which would be used to replace the malfunctioning hardware is not
compatible and will not communicate with the old, existing, fire alarm control panel. To correct
the issue, at minimum, a new fire alarm control panel will need to be installed. The new panel
would be capable of monitoring the now 23-year old equipment, but upgrades will be needed to
the hardware at some point.
When looking at the fire alarm system as a whole, when the original system was installed, it was
installed with several redundant features that would not be required today. A new layout would
require significantly less hardware to monitor the existing structure.
It makes financial sense to replace all of the hardware at the same time as the fire alarm control
panel, completely updating the system and replacing everything with current equipment. The
new system would be monitored with a Cat5 IP address, allowing the reduction of 2 phone lines
at the Fire Hall.
As part of a project to streamline the alarm monitoring for all City buildings under one
monitoring company, the City received a quote to replace the entire, existing fire alarm system at
the Fire Hall with a new one. The City also received quotes for all City buildings to be used as a
potential budgeting plan going forward.
KEY ISSUES:
• Malfunctioning hardware in the fire alarm system at the Fire Hall has caused several false
alarms.
• The existing hardware at the Fire Hall is 23-years old. Normal service life for fire alarm
hardware is 10-12 years.

• Replacement of the entire fire system, at one time, makes financial sense. The scope of the
system hardware has been paired down considerably, while still meeting current building and
fire code requirements.
• The capital purchase has been discussed at Fire Department Board of Officer meetings and
the Joint Fire Committee meeting.
POLICY CONSIDERATIONS: It is City policy for the Council to review and approve all
capital purchases and investments.
FINANCIAL CONSIDERATIONS: The fire alarm system purchase will be funded through
fire department capital reserves.
LEGAL CONSIDERATIONS: The City has the authority to purchase equipment under the
State of Minnesota contract or by quotes.

A SUMMARY ORDINANCE AMENDING TITLE 3, CHAPTER 1 (GENERAL
FINANCE PROVISIONS), SECTION 3-1-3 (CITY FEES, FINES, AND
RATES SCHEDULE) AND VARIOUS OTHER TITLES IN THE ALBERTVILLE
MUNICIPAL CODE
NOTICE IS HEREBY GIVEN that on January 2, 2018, Ordinance No. 2018-01
amending City Fees, Fines, and Rates Schedule in the Albertville City Code was adopted by the
City Council of Albertville, Minnesota. Due to the length of the ordinance, the following
summary ordinance has been prepared for publication. The full ordinance is available for public
review at www.ci.albertville.mn.us and a paper copy is available for public review at Albertville
City Hall, 5959 Main Avenue NE.
NOTICE IS FURTHER GIVEN that the adopted amendment includes the following
components:
Titles 5, Section 2A1(False Alarms), of the Albertville City Code is amended to reflect false
alarm charges will be incurred after the third call to the property in a twelve month period.
Titles 9, Chapter 3 (Fees and Charges) of the Albertville City Code is amended to remove
plumbers license fee.
Titles 10, Chapter 1, Section 1C (Fees and Charges) of the Albertville City Code is amended to
remove final certificate of occupancy.
Titles 10, Chapter 3, Section 8A (Key Box and As Built Plans) of the Albertville City Code is
amended to establish a fee for key boxes.

LICENSE AND ONE-DAY EXEMPTION FROM THE PROHIBITION OF LIQUOR
CONSUMPTION AT THE ALBERTVILLE FIRE HALL
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO:
• Approve a One-Day Temporary Consumption and Display Liquor License for February
10, 2018 for the Albertville Fire Hall, located at 11350 57th Street NE.
• Approve an exemption from the prohibition of consumption of liquor at the Fire Hall for
February 10, 2018.
BACKGROUND: Annually, the Albertville Fire Relief Association holds a department-wide
party and dinner event. Members and guests are allowed to consume alcoholic beverages at the
event. No liquor retail sales will occur at the event, so a One-Day Temporary Consumption and
Display Liquor License must be obtained in order to consume alcoholic beverages. In addition,
City Code Section 8-4-2 prohibits the following:
LIQUOR CONSUMPTION:
A. Prohibited Areas: The consumption of alcohol is prohibited at the fire hall, the public
works facility, the wastewater treatment facility and on any of the property on which those
facilities are located unless the city has issued a permit for such consumption pursuant to
subsection B of this section.
Therefore, the Albertville Fire Relief Association is seeking a one-day exemption from this
prohibition.
KEY ISSUES:
• This is a one-time annual event and the St. Michael Fire Department covers all
Albertville Fire Department calls for the evening.
• This license is granted by the MN Department of Alcohol and Gambling Enforcement,
but requires either City approval or denial of the license prior to issuance.
• The association has held previous consumption and display licenses for their annual
party.
POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority
to approve or deny liquor licenses.

SUBJECT: LEGAL - AMENDMENT TO TOWNE LAKES 6TH AND 7TH ADDITION DEVELOPMENT
AGREEMENTS
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Approve First Amendment to Conditional Use Planned Unit Development
Agreement Towne Lakes 7th Addition and Third Amendment to Planned Unit Development
Agreement Towne Lakes 6th Addition, contingent on approval of the same by the Sentry Bank.
BACKGROUND: The single family homes in both the Towne Lakes 6th Addition and Towne
Lakes 7th Addition are subject to the terms of the Homeowners’ Association requirements. One
of those requirements calls for the Developer to put up a $2,000 cash escrow for the finished
landscaping on each lot before a building permit is pulled for that lot. The Developer has
indicated that because of increased construction demand in the Twin Cities area, construction
costs have dramatically increased since last spring. In an attempt to mitigate the impact of the
recent cost increases, the Developer has asked the HOA to waive the $2,000 landscape escrow
requirement, but the HOA is only willing to do so if the City could use the letter of credit
provided by the Developer to secure the landscaping required by the HOA.
These two amendments require the Developer to install the landscaping required by the HOA,
and allow the City to retain up to $20,000 of the letter of credit to secure the finished landscaping
required by the HOA (which is in addition to the landscaping plan that is attached to the
Development Agreements). The HOA will still monitor the installation of the finished
landscaping. The City will simply hold the letter of credit and, if necessary, install the finished
landscaping on a lot if the Developer or its builder fails to do so. This arrangement will free up
the Developer’s cash that would otherwise be held by the Association and should help offset
some of the burden of increasing costs faced by the Developer
The Developer is not proposing and City Staff is not recommending that the letter of credit be
increased as the likelihood that more than $20,000 would be needed from the letter of credit to
cover HOA required landscaping appears to be minimal.
KEY ISSUES:
• This change extends the letter of credit to cover finished landscaping costs of $2,000 per
lot.
• Staff estimates that this additional landscaping burden would likely not apply to more
than 10 finished homes at any given time.

• Because these changes will extend the letter of credit to additional items not currently
included in the Development Agreement, we will need the bank to agree to these
changes.
• Staff does not expect these changes to be an additional burden on the City.
POLICY/PRACTICES CONSIDERATIONS: These changes are relatively minor and are
being proposed as a means of assisting the Developer to meet the requirements of the HOA and
changing market conditions. This situation is unique to properties covered by the Towne Lakes
HOA.
FINANCIAL CONSIDERATIONS: These changes will have no financial impact upon the
City, but does obligate the letter of credit to cover what is estimated to be approximately $20,000
of additional landscaping improvements at any given time.
LEGAL CONSIDERATIONS: The City Council has the authority to amend the Development
Agreement as it deems appropriate.

FIRST AMENDMENT TO CONDITIONAL USE
PLANNED UNIT DEVELOPMENT AGREEMENT
TOWNE LAKES 7TH ADDITION
WHEREAS, the City of Albertville (“City”), a Minnesota municipal corporation, and HSB Ventures, LLC (“Developer”) entered into an Agreement titled “Conditional Use Planned Unit Development Agreement Towne Lakes 7th Addition” (“Developer’s Agreement”) dated December 7, 2017 and recorded as document number 1360791 at the Wright County Recorder’s Office, Wright County, Minnesota; and
WHEREAS, Developer now desires to enter into this First Amendment To Conditional Use Planned Unit Development Agreement to modify provisions related to installation of landscaping and the uses of the letter of credit provided to the City.; NOW, THEREFORE, IT IS HEREBY AND HEREIN MUTUALLY AGREED, in consideration of each party’s promises and considerations herein set forth, as follows: 1. Paragraph 4.F shall be added as follows: F. Developer shall cause to be installed on each lot, immediately following issuance of an occupancy permit for a single family home constructed on such lot, all landscaping required by the Towne Lakes Community Association, provided, however, that is said occupancy permit is issued after September 30th and before May 15th, Developer shall have until the following June 1st to install said landscaping on such lot. 2. Paragraph 7.A shall be amended to read as follows: A. Periodically, as payments are made by the Developer for the completion of portions of the Municipal Improvements and/or on- and off-site Improvements, and/or landscaping improvements, and when it is reasonably prudent, the Developer may request of the City that the surety be proportionately reduced for that portion of the Municipal Improvements and on- and off-site improvements and landscaping improvements which have been fully completed and payment made therefor, except that the landscaping portion of the letter of credit shall not be reduced below the lesser of the following: 1) $20,000; or 2) $2,000 per residential lot in Said Plat that does not have landscaping installed as required by the Towne Lakes Community Association. such decisions to reduce the letter of credit shall be at the discretion of the City Council. The City's cost for processing reduction request(s) shall be billed to the Developer. Such cost shall be paid to the City within thirty (30) days of the date of mailing of the billing.
1. Developer’s Agreement. Except as specifically altered by this Amendment, the terms of the Developer’s Agreement, the First Amendment and the Second Amendment shall remain in full force and effect for the properties in Towne Lakes 6th Addition. Dated this ___________ day of January, 2018.

THIRD AMENDMENT TO PLANNED UNIT
DEVELOPMENT AGREEMENT
TOWNE LAKES 6TH ADDITION
WHEREAS, the City of Albertville (“City”), a Minnesota municipal corporation, and
Contractor Property Developers Company entered into an Agreement titled “Planned Unit
Development Agreement Towne Lakes 6th Addition” (“Developer’s Agreement”) dated
September 7, 2005 and recorded as document number 1003634 at the Wright County Recorder’s
Office, Wright County, Minnesota; and
WHEREAS, Kilber Section 36, LLC (“Kilber”), a North Dakota limited liability
company, purchased the property subject to the Developer’s Agreement; and
WHEREAS, Kilber and the City executed an Amendment to Planned Unit Development
Agreement, Town Lakes 6th Addition (“First Amendment”) which has been recorded as
document number 1164289 at the Wright County Recorder’s Office; and
WHEREAS, Kilber sold the property that is the subject of the Developer’s Agreement
and the First Amendment to HSB Ventures, LLC., a Minnesota Limited Liability Company
(“Developer”), who entered into a Second Amendment to Planned Unit Development Agreement
(“Second Amendment”) which has been recorded as document number 1354394 at the Wright
County Recorder’s Office;; and
WHEREAS, Developer now desires to enter into this Third Amendment To Planned
Unit Development Agreement to modify provisions related to installation of landscaping and the
uses of the letter of credit provided to the City.;
NOW, THEREFORE, IT IS HEREBY AND HEREIN MUTUALLY AGREED, in
consideration of each party’s promises and considerations herein set forth, as follows:
1. Paragraph 4.F shall be added as follows:

immediately following issuance of an occupancy permit for a single family home

Below is an update of the projects our office has been working on for the City.
• I-94 Ramp Easement. The State is asking the City to obtain I-94 ramp easement
from Albertville Marketplace using a revised legal description as the State wants
clearer language in the deed from the City to the State for the ramp easement. The
easement area remains unchanged—the State simply wants its specific language
used in the easement document. Adam is trying to reach the owner to get the new
deed signed.
• Charter Cable. Charter Cable has replied to our request regarding the free cable
service it is to provide to the City. Their contention is that the City is only entitled
under Federal law to collect a maximum of 5% in franchise fees, which we are
already collecting. Charter believes that provision of free cable service to
municipal buildings over and above that 5% is prohibited under Federal law. This
issue seems to be a common dispute between Charter and a number of cities in the
State. To date, Charter has not backed down on this issue with any Minnesota
City that we know of, leading to the presumption that this issue will have to be
dealt with in the franchise renewal agreements, a number of which are coming up
in 2018. We are in the process of getting one of Charter’s most recent renewal
franchise agreements to see if this issue has been addressed and what that may
mean for the City.
• Prairie Run Lots. Fieldstone Family Homes closed on the last Prairie Run
residential lot. At this point, the City owns only the last undeveloped commercial

lot from the Prairie Run subdivision. That lot still has unpaid special assessments
related to it which the City will attempt to recoup once commercial land values
recover sufficient value.
• Amendments to Towne Lakes 6th Addition and 7th Addition Developer’s
Agreements. The developer’s agreements for both of these developments are
completed and have been recorded, but the Developer is requesting that we amend
the developer’s agreements to allow the letter of credit to be used as security for
landscaping that is required to be installed by the Towne Lakes Homeowners’
Association. Currently the Developer must escrow $2,000 for each lot that it is
seeking the issuance of a building permit for before the City will issue the building
permit. As a cost savings measure, the Developer wants to use the letter of credit
as the landscape escrow to ensure installation of the landscaping required by the
Association. It is expected that the Developer will likely not have more than 10
homes under construction at any given time, and thus this change to the
developer’s agreement would mean that $20,000 of the letter of credit would not
be released by the City until nearly all the lots are built upon and landscaped. The
changes to the Developer’s Agreements will likely be on this meeting agenda.
• Wastewater Treatment Plant Easements. The City’s appraiser was out to view
the property in Otsego that City would like to acquire an easement from for
purposes of installing the wastewater treatment plant discharge pipe to the
Mississippi River. That appraisal should be completed within 30 days or so, after
which time we would open negotiations with the land owner.
• Ice Arena Replat. The title commitment for the two existing ice arena properties
has just come back, clearing the way for the new plat of these two properties to be
filed with Wright County.

SUBJECT: PUBLIC WORKS – ORDINANCES RELATING TO THE STORM SEWER SYSTEM
RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:

• Motion to adopt Ordinance No. 2018-02 Amending Section 11-7-10 of the Albertville City
Council relating to Drainage and Stormwater Management Standard in the City of
Albertville
• Motion to adopt Ordinance No. 2018-03 Amending Section 11-7-12 of the Albertville
City Code relating to Erosion and Sediment Control Standards Associated with
Subdivision of Land with Albertville
• Motion to adopt Ordinance No. 2018-04 Establishing Chapter 8, Illicit Discharge
Detection and Elimination
BACKGROUND: In June of 2017, Albertville received its Issuance of Coverage under the
National Pollutant Discharge Elimination System/State Disposal System (NPDES/SDS) General
Permit MNR040000 for MS4s, aka the Municipal Separate Storm Sewer Systems (MS4) General
Permit. This permit requires the City to ensure it has certain ‘regulatory mechanisms’ in place to
prohibit non-stormwater discharge, establish requirements for erosion and sediment control, and
address post-construction stormwater management activities. Generally, the permit requires
these mechanisms be in place within 12 months of the permit issuance.
KEY ISSUES:
• Staff has reviewed current ordinances and recommends additions/modifications
proposed.
• Currently the City does not have an illicit discharge ordinance. The proposed illicit
discharge ordinance is based on the model ordinance provided by the MPCA.
• The existing ordinances regarding drainage systems and erosion and sediment control
have been amended to meet the requirement of the MS4 permit.
• These ordinance additions/revisions are required to be in compliance with our permit
coverage.
• Over the next 24 months, the city has several other MS4 action items it will need to
address to be in compliance with our permit coverage.
LEGAL CONSIDERATIONS: Per the MPCA, the MS4 permit establishes conditions for
discharging stormwater and other specific related discharges to waters of the state. The permit is
required for discharges that are from MS4s. Applicants who submit a complete application in
accordance with the requirements of the permit, and receive written notification of permit
coverage, are authorized to discharge stormwater under the terms and conditions of the permit.

AN ORDINANCE AMENDING THE ALBERTVILLE CITY CODE TITLE 11
SUBDIVISION REGULATIONS SECTION 11-7-10 DRAINAGE SYSTEM
RELATING TO THE DRAINAGE AND STORMWATER MANAGEMENT
STANDARDS IN THE CITY OF ALBERTVILLE, MINNESOTA
The City Council of the City of Albertville, Minnesota hereby ordains:
Section 1. Title 11 Subdivision Regulations, Section 11-7-10 of the Albertville City Code is
hereby amended to repeal the strikeout language and include the underlined language as follows.
11-7-10: DRAINAGE SYSTEM:
A. Complete Design Required: A complete and adequate drainage system design shall be
required for the subdivision and may include a storm sewer system or system of open ditches,
culverts, pipes, catch basins and ponding areas, or a combination thereof. (Amended Ord.
1988-8, 9-8-1988)
B. Design: Drainage system utilities shall be designed in accordance with standards established
by the city in the "city's standard detail plates" or as otherwise specified by the city engineer.
1. A plan shall be developed that requires the use of any combination of best management
practices, with highest preference given to green infrastructure techniques and practices
(e.g., infiltration, evapotranspiration, reuse/harvesting, conservation design, urban
forestry, green roofs, etc.), necessary to meet the conditions on the site of a construction
activity to the maximum extent practicable.
C. Rate Control: The applicant shall install or construct or pay the city fees for all stormwater
management facilities necessary to manage increased runoff, so that the 2-year (2.7 inch), 10-
year (4.1 inch), and 100-year (5.9 inch) storm peak discharge rates existing before the
proposed development shall not be increased. Precipitation depths using NOAA Atlas 14
volume 8 precipitation frequency estimates, published June 2013, or its successor, shall be
used for each project location. Also, accelerated channel erosion shall not occur as a result of
the proposed land disturbing or development activity. An applicant may also make an in-kind
or a monetary contribution to the development and maintenance of community stormwater
management facilities designed to serve multiple land disturbing and development activities
undertaken by one or more persons, including the applicant.
1. All property within the county ditch no. 9 watershed shall not drain or discharge more than
one-half (1/2 ) of the predevelopment rate of runoff.
D. Volume Control: Development and redevelopment that creates one acre or more of
impervious surface and increases runoff volumes above existing conditions for the 2-year,

twenty four (24) hour storm event (not including snowmelt events) shall incorporate runoff
volume control practices into the design to retain a water quality volume of one (1) inch of
runoff from the new impervious surfaces on site. The design shall explicitly address the use
of BMPs to limit the loss of pervious area, and limit runoff volume increases from
impervious areas to the extent feasible considering site specific conditions. At a minimum,
volume control practices shall comply with the following:
1. Limit the proposed runoff volume to the existing runoff volume for a 2-year, twenty four
(24) hour storm.The infiltration/filtration practice shall be capable of draining down within
forty eight (48) hours or less.
2. When using infiltration for volume control, infiltration volumes and facility sizes shall be
calculated using the appropriate hydrological soil group classification and saturated
infiltration rate from the table below, and shall be capable of infiltrating the required
volume within seventy two (72) hours. Site specific infiltration or hydraulic conductivity
measurements completed by a licensed soil scientist or geotechnical engineer may be used
in place of the values in the following table:

3. Infiltration areas will be limited to the horizontal areas subject to prolonged wetting.
4. The bottom area of treatment ponds shall not be accepted as part of an infiltration
practice; however, properly designed slopes and safety shelves may be accepted.
5. Before infiltrating runoff, pretreatment shall be required for gravel and paved surface lot
runoff that will enter the infiltration system. The pretreatment shall be designed to protect
the infiltration system from clogging and to protect ground water quality. Pretreatment
options may include, but are not limited to, oil/grease separation, sedimentation,
biofiltration, filtration, swales or filter strips. To minimize potential ground water impacts
it is desirable to infiltrate the cleanest runoff. To achieve this, a design may propose
greater infiltration of runoff from low pollutant sources such as roofs, and less from
higher pollution source areas such as parking lots.
6. Infiltration systems shall be designed to bypass higher flows without incurring damage
from erosion or loss of topsoils.
7. Infiltration areas shall be fenced or otherwise protected from compaction and/or
disturbance before and during all land disturbing activities.
8. Constructed infiltration practices, such as infiltration ponds and trenches are discouraged
in favor of other appropriate volume control practices. Constructed infiltration practices
shall not be used in the following situations:

a. For runoff from fueling and vehicle maintenance areas and industrial areas with
exposed significant materials.
b. In areas with less than three feet (3') of vertical separation from the bottom of the
infiltration system to the elevation of seasonal high ground water or top of bedrock.
c. For areas with runoff fromWhere industrial, commercial, and institutional parking lots
and roads where there is less than three feet (3') of separation from the bottom of the
infiltration system to the elevation of seasonal high ground water facilities are not
authorized to infiltrate industrial stormwater under an NPDES/SDS Industrial
Stormwater Permit issued by the MPCA.
d. Where high levels of contaminants in soil or groundwater will be mobilized by the
infiltrating stormwater.
9. Infiltration practices shall be restricted, without higher engineering review that provides
sufficient information to show that the treatment system can function properly and
prevent adverse impacts to groundwater when the infiltration practice will be constructed
in areas:
da. In areas with predominately hydrologic type D soils, unless adequate underdrains are
provided.
b. Within one thousand feet (1,000’) up-gradient, or one hundred feet (100’) down-
gradient of active karst features.
c. Within a drinking water supply management area (DWSMA) as defined in Minn. R.
4720.5100, subp. 13.
d. Where soil infiltration rates are more than 8.3 inches per hour.
910. Constructed infiltration facilities in areas of medium or high ground water
susceptibility; within four hundred feet (400') of a community water system, or within
one hundred feet (100') of a private well shall have acceptable pretreatment of runoff.
1011. Infiltration facilities to be maintained by the city shall be located in outlots dedicated
to the city.
12. New development projects shall achieve no net increase from pre-project conditions (on
an annual average basis) of:
a. Stormwater discharge volume, unless restricted in this ordinance (Section D.8.);
b. Stormwater discharges of total suspended solids (TSS); and

c. Stormwater discharges of total phosphorus (TP).
13. Redevelopment projects shall achieve a net reduction from pre-project conditions (on an
annual average basis) of:
a. Stormwater discharge volume, unless restricted in this ordinance (Section D.8.);
b. Stormwater discharges of total suspended solids (TSS); and
c. Stormwater discharges of total phosphorus (TP).
14. For linear projects that lack right-of-way for the installation of volume control practices,
a reasonable attempt must be made to obtain right-of-way during the planning process.
Exceptions may be made for lesser volume on site if any limitations are encountered as
allowed per the Municipal Separate Storm Sewer System permit (MN R040000).
15. Mitigation Provisions: If the owner and/or operator of a construction activity believes
that the requirements for TP and/or TSS cannot be met on the site of the original
construction activity, the owner and/or operator must provide appropriate documentation
to the City as support. The stormwater discharge requirements for TSS and/or TP not
met on the site of the original construction activity may be mitigated off-site at the City’s
discretion. If off-site mitigation is allowed, the mitigation provisions of the MPCA
Municipal Separate Storm Sewer System permit (MN R040000) must be followed.
E. Information Submitted: All calculations and hydrologic models/information used in
determining peak flows shall be submitted along with the stormwater pollution prevention
plan. A delineation of all ponds, infiltration facilities, ditches, public waters and wetlands
located on and adjacent to the site, including the normal water level (NWL), the 100-year
high water level (HWL), and the ordinary high water level (OHW).
F. Incorporation Of Natural Topography: The applicant shall consider reducing the need for
stormwater management facilities by incorporating the use of natural topography and land
cover such as natural swales and depressions as they exist before development to the degree
that they can accommodate the additional flow of water without compromising the integrity
or quality of the wetland or pond.
G. Minimum Design Standards For Stormwater Wet Detention Facilities: The stormwater wet
detention facilities shall conform to the most current technology as reflected in the current
version of the Minnesota stormwater manual, and the current requirements found in the
MPCA's NPDES permit for stormwater associated with construction activities.
H. Protection For Natural Wetlands: Wetlands must not be drained or filled, wholly or partially,
unless replaced by either restoring or creating wetland areas of at least equal public value
pursuant to the wetland conservation act.
I. Models/Methodologies/Computations: Hydrologic models and design methodologies used for
determining runoff characteristics and analyzing stormwater management structures shall be

approved by the city engineer. Plans, specifications and computations for stormwater
management facilities submitted for review shall be signed by a registered professional
engineer.
J. Access Routes To Ponding Areas: Show or define access routes for maintenance purposes to
all ponding areas (must be maximum of 8 percent grade, 2 percent cross slope and 10 feet
wide). Paving or pavers on the access routes is required with a design load to able support
maintenance vehicles.
K. Emergency Overflow: An emergency overflow, sufficient to convey the incoming flow from
a 100-year storm event, shall be included with the design and construction of all ponding
facilities. (Ord. 2009-007, 3-2-2009)
L. Long-term maintenance of structural stormwater BMPs: All stormwater management
structures and facilities shall be maintained in perpetuity to assure the structures and facilities
function as originally designed. The responsibility for maintenance shall be assumed by
either the City with jurisdiction over the structures and facilities, or by the Applicant entering
into a maintenance agreement with the City.
1. Maintenance of private structural stormwater BMPs. Any structural stormwater BMP that
the City determines to be private shall meet the following requirements:
a. A permanent public easement shall be provided to the City for access for inspection
and/or maintenance purposes. Costs incurred by the City for any maintenance of
private systems will be billed and/or assessed to the owner/operator;
b. Recorded inspection and maintenance agreements that define inspection and
maintenance responsibilities are required. A minimum annual inspection for private
systems shall be required. These requirements are transferrable to any party that
becomes the owner/operator of the site; and,
a.c. If site configurations or structural stormwater BMPs change, causing decreased
BMP effectiveness, new or improved structural stormwater BMPs must be
implemented to meet the requirements of this section.

The City Council of the City of Albertville, Minnesota hereby ordains:
Section 1. Title 11 Subdivision Regulations Section 11-7-12 Erosion and Sediment Control is
hereby amended to repeal the strikeout language and include the underlined language as follows:
11-7-12: EROSION AND SEDIMENT CONTROL:
A. Stormwater Pollution Prevention Plan: A stormwater pollution prevention plan shall be
submitted for review and approval by the city engineer for projects disturbing one acre or
more of land. The plan should be prepared by a qualified individual, conform to the MPCA’s
current Construction Stormwater General Permit (MN R100001), and incorporate the
appropriate best management practices (BMPs) described in the “Minnesota Stormwater
Manual”. The stormwater pollution prevention plan shall include: (Ord. 2009-007, 3-2-2009)
1. Project description including the nature and purpose of the land disturbing activity and the
amount of grading, utilities, and building construction involved.
2. Project phasing plan including the time frames and schedules for the project's various
aspects.
3. A map of the existing site conditions: existing topography, property information, steep
slopes, existing drainage systems/patterns, type of soils, waterways, wetlands, vegetative
cover, and 100-year floodplains. (Amended Ord. 1988-8, 9-8-1988)
4. A site construction plan that includes the proposed land disturbing activities, soil stockpiles,
erosion and sediment control plan, construction schedule, and the maintenance and
inspection of the stormwater pollution prevention measures. (Ord. 2009-007, 3-2-2009)
5. Adjacent areas, neighboring streams, lakes, residential areas, roads, etc., within one hundred
feet (100') of the subject site, which may be affected by the land disturbing activity.
6. The methods that will be used to control erosion and sedimentation on the site, both during
and after construction, including the following items:
a. Schedule and methods to stabilize all exposed soils, soil stockpiles and steep slopes.

b. Schedule and methods to establish permanent vegetation.
c. Methods to prevent sedimentation damage to adjacent properties and natural features.

f. Methods to protect paved roads from sediment and mud brought in from access routes.
g. Methods to maintain both temporary and permanent erosion and sediment control
devices.
h. Methods to restabilize utility construction areas as soon as possible.
i. Calculations and design parameters for sediment basins, wet detention basins, diversions,
waterways, and other applicable practices. (Amended Ord. 1988-8, 9-8-1988)
7. Waste and Material Collection and Disposal. All waste and unused building materials
(including garbage, debris, cleaning wastes, litter, wastewater or sewage, toxic materials or
hazardous materials) shall be properly contained while on site, properly disposed of off-site,
and not allowed to be carried by water and/or wind off the site or into a receiving channel or
storm sewer system. Waste containers and all construction materials shall not be placed or
stored such that they obstruct, encroach upon, or interfere wholly or in part with any public
right-of-way, including but not limited to, public roadways, trails, sidewalks, parks or other
public properties.
B. Minimum Stormwater Pollution Prevention Plan Requirements: The following minimum
control measures are required where bare soil is exposed. The exposed soils on site need to
be stabilized according to the time frames and slopes specified in the Construction
Stormwater General Permit (MN R100001). Due to the diversity of individual construction
sites, each site will be individually evaluated. Where additional control measures are needed,
they will be specified at the discretion of the city engineer. (Ord. 2009-007, 3-2-2009)
1. Diversion of channeled runoff around disturbed areas, if practical, or the protection of the
channel.
2. The scheduling of the site's activities to lessen their impact on erosion and sediment control
measures.
3. Minimize the amount of exposed soil. (Amended Ord. 1988-8, 9-8-1988)
4. Control runoff as follows:
a. Stabilize inactive disturbed areas with sod or seed with mulch; and

b. Construct temporary or permanent sedimentation basins. Sedimentation basins must be
constructed in accordance with NURP criteria or the Minnesota stormwater manual.
Sedimentation basins must be maintained regularly, including sediment removal, to
maintain a three foot (3') depth. Basin discharge rates must also be controlled to prevent
erosion in the discharge channel. The applicant is required to obtain a national pollutant
discharge elimination system/state disposal system (NPDES/SDS) construction
stormwater permit from the MPCA. (Ord. 2009-007, 3-2-2009)
5. For soil stockpiles greater than ten (10) cubic yards, the toe of the pile must be more than
twenty five feet (25') from a road, drainage channel or stormwater inlet. If left for more than
seven (7) days, they must be stabilized with mulch, vegetation, tarps or other means. If left
for less than seven (7) days, erosion from stockpiles must be controlled with silt fences or
rock check dams. If for any reason a soil stockpile is located closer than twenty five feet
(25') from a road, drainage channel or stormwater inlet, and left for more than seven (7)
days, it must be covered with tarps or controlled in some other manner.
6. Temporary stockpiling of fifty (50) or more cubic yards of excess soil on any lot or other
vacant area will not be allowed without issuance of a grading permit for the earthmoving
activity in question. (Amended Ord. 1988-8, 9-8-1988)
7. Where a project's ultimate development replaces surface vegetation with one or more acres
of cumulative impervious surface, and all runoff has not been accounted for in the city's
existing stormwater management plan or practice, the runoff shall be discharged to a wet
sedimentation basin prior to entering waters of the state. Work shall conform with the
current version of the Minnesota stormwater manual and the current requirements found in
the MPCA's NPDES permit for stormwater associated with construction activities. (Ord.
2009-007, 3-2-2009)
8. Generally, sufficient silt fence will be required to hold all sheet flow runoff generated at an
individual site, until it can infiltrate or seep through silt fence pores.
9. Temporary rock construction entrances shall be required wherever vehicles enter and exit a
development site. (Amended Ord. 1988-8, 9-8-1988)
10. Sediment control measures shall be properly installed and maintained before construction
activity begins. Such structures may be adjusted during dry weather to accommodate short
term activities, such as those that require very large vehicles. As soon as this activity is
finished or before rainfall, the erosion and sediment control structures must be returned to a
functioning configuration.
11. The permittee shall be responsible to ensure that erosion and sediment control measures
are properly installed and maintained. In cases where the erosion and sediment control
measures fail to conform with the approved plan, construction stop orders may be issued by
the city until said measures are corrected to the satisfaction of the city. (Ord. 2009-007, 3-2-

12. Streets shall be cleaned and swept whenever tracking of sediments occurs and before sites
are left idle for weekends and holidays. (Amended Ord. 1988-8, 9-8-1988)
13. All storm drain inlets shall be protected during construction until control measures are in
place with either silt fence or an equivalent barrier that meets accepted design criteria,
standards and specifications contained in the latest version of the Minnesota stormwater
manual.
14. A structure with a three foot (3') sump for collecting coarse grained material shall be
provided with new storm sewer systems. The sump catch basin or manhole shall be located
within the street and just prior to discharge into a water body. Such basins shall be cleaned
when they are half filled with material. (Ord. 2009-007, 3-2-2009)
15. All stormwater pollution control management facilities shall be designed to minimize the
need of maintenance, to provide easy access for maintenance purposes and be structurally
sound. These facilities shall have a plan of operation and maintenance that ensures
continued effective removal of the pollutants carried in stormwater runoff. The city or its
designated representative shall inspect all stormwater management facilities as part of the
normal maintenance program for public works facilities. It shall be the responsibility of the
applicant to obtain any necessary easements or other property interests to allow access to the
stormwater management facilities for inspection and maintenance purpose. (Amended Ord.
1988-8, 9-8-1988)
16. If a stormwater management plan involves directing some or all runoff from the site, the
applicant shall obtain from adjacent property owners any necessary easements or other
property interests concerning flowage of water.
17. Stormwater pollution prevention measures shall be consistent with approved BMPs and
shall be sufficient to retain construction generated sediment on the site.
18. Stormwater pollution controls shall be installed on all down gradient perimeters before
commencing the land disturbing activity, and shall not be removed without city approval.
Upon city acceptance of turf establishment and other such permanent erosion control
measures, the owner shall remove all silt fence and other temporary erosion control
measures.
19. If the activity is taking place on a site where the soils are currently disturbed (e.g., a tilled
agricultural site that is being developed), areas that will not be disturbed as part of the
development and areas that will not be disturbed according to the time frames and slopes
specified in the NPDES/SDS permit, shall be seeded with temporary or permanent cover
before commencing the proposed land disturbing activity.
20. Slopes greater than four to one (4:1) shall have erosion control blanket installed
immediately after finished grading. (Ord. 2009-007, 3-2-2009)

5-8-1: PURPOSE AND OBJECTIVES
The purpose of this ordinance is to provide for the health, safety, and general welfare of the
citizens of the City of Albertville through the regulation of non-stormwater discharges to the
storm sewer system to the maximum extent practicable as required by state and federal law. This
ordinance establishes methods for controlling the introduction of pollutants into the municipal
separate storm sewer system (MS4) in order to comply with requirements of the National
Pollutant Discharge Elimination System (NPDES) MS4 permit process. The objectives of this
ordinance are:
A. To regulate the contribution of pollutants to the municipal separate storm sewer system
by stormwater discharges by any user.
B. To prohibit illicit connections and discharges to the municipal separate storm sewer
system.
C. To establish legal authority to carry out all inspection, surveillance, and monitoring
procedures necessary to ensure compliance with this ordinance.
5-8-2: DEFINITIONS
For the purposes of this ordinance, the following terms shall have the following meanings:
Authorized Enforcement Agency: employees or designees of the City of Albertville or the
Minnesota Pollution Control Agency as designated to enforce this ordinance.
Best Management Practices (BMPs): Techniques proven to be effective in controlling runoff,
erosion and sedimentation including those documented by the Minnesota Pollution Control
Agency (MPCA) and other sources as approved by the City, as may be amended. BMPs also
include treatment practices, operating procedures, and practices to control site runoff, spillage or
leaks, sludge or water disposal, or drainage from raw materials storage.
City: The City of Albertville.
Construction Activity: Activities subject to NPDES Construction Permits. These include
construction projects resulting in land disturbance of 1 acre or more and projects that disturb less
than 1 acre if they are part of a larger common plan of development. Such activities include but
are not limited to clearing and grubbing, grading, excavating, and demolition.
Discharge: Adding, introducing, releasing, leaking, spilling, casting, throwing, or emitting any
pollutant, or placing any pollutant where it is likely to pollute public waters.
Groundwater: Water contained below the surface of the earth in the saturated zone, including,
without limitation, all waters whether under confined, unconfined, or perched conditions, in near
surface unconsolidated sediment or in rock formations deeper underground.

Hazardous Materials: Any material, including any substance, waste, or combination thereof,
which because of its quantity, concentration, or physical, chemical, or infectious characteristics
may cause, or significantly contribute to, a substantial present or potential hazard to human
health, safety, property, or the environment, when improperly treated, stored, transported,
disposed of, or otherwise managed.
Illegal Discharge: Any direct or indirect non-stormwater discharge to the storm sewer system,
except as exempted in this ordinance.
Illicit Connection: An illicit connection is defined as either of the following:
(1) Any drain or conveyance, whether on the surface or subsurface, which allows an illegal
discharge to enter the storm sewer system including, but not limited to, any conveyances
which allow any non-stormwater discharge including sewage, process wastewater, and
wash water to enter the storm sewer system and any connections to the storm sewer
system from indoor drains and sinks, regardless of whether said drain or connection had
been previously allowed, permitted, or approved by an authorized enforcement agency;
or
(2) Any drain or conveyance connected from a commercial or industrial land use to the storm
sewer system which has not been documented in plans, maps, or equivalent records and
approved by the City.
Industrial Activity: Activities subject to NPDES Industrial Permits as defined in 40 CFR,
Section 122.26 (b)(14).
MPCA: Minnesota Pollution Control Agency.
Municipal Separate Storm Sewer System (MS4): The system of conveyances (including
sidewalks, roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches,
constructed channels or storm drains) owned or operated by the city and designed or used for
collecting or conveying stormwater, and not used for collecting or conveying wastewater that
discharges to waters of the United States.
National Pollutant Discharge Elimination System (NPDES) Stormwater Discharge Permit:
A permit issued by EPA (or by the State of Minnesota under authority delegated pursuant to 33
USC § 1342(b)) that authorizes the discharge of pollutants to Waters of the State, whether the
permit is applicable on an individual, group, or general area-wide basis.
Non-Stormwater Discharge: Any discharge to the storm sewer system that is not composed
entirely of storm water.
Person: Any individual, association, franchise, organization, partnership, firm, corporation or
government entity.
Pollutant: Anything that causes or contributes to pollution. Pollutants may include, but are not
limited to: paints, varnishes, and solvents; oil and other automotive fluids; non-hazardous

liquids, solid wastes, and yard wastes; refuse, rubbish, garbage, litter, or other discarded or
abandoned objects, and accumulations, so that same may cause or contribute to pollution;
floatables; pesticides, herbicides, and fertilizers; hazardous substances and wastes; sewage, fecal
coliform and pathogens; dissolved and particulate metals; animal wastes; wastes and residues
that result from constructing a building or structure; and noxious or offensive matter of any kind
that may degrade, impair or pollute ground or surface waters.
Premises: Any building, lot, parcel of land, or portion of land whether improved or unimproved
including adjacent sidewalks and boulevards.
Storm Sewer System: Publicly owned facilities by which stormwater is collected and/or
conveyed, including, but not limited to, any roads with drainage systems, municipal streets,
gutters, curbs, inlets, piped storm drains, pumping facilities, infiltration, retention and detention
basins, natural and human-made or altered drainage channels, reservoirs, and other drainage
structures.
Stormwater: Any surface flow, runoff, and drainage consisting entirely of water from any form
of natural precipitation, and resulting from such precipitation.
Stormwater Pollution Prevention Plan (SWPPP): A plan of BMPs and activities to be
implemented by a person or business to identify sources of pollution or contamination at a site
and the actions to eliminate or reduce pollutant discharges from leaving the site to the maximum
extent practicable in accordance with the standards set forth by the MPCA and City ordinances.
Wastewater: Any water or other liquid, other than uncontaminated stormwater, discharged from
a facility or property.
Waters of the State: All streams, lakes, ponds, marshes, watercourses, waterways, wells,
springs, reservoirs, aquifers, irrigation systems, drainage systems, and all other bodies or
accumulations of water, surface or underground, natural or artificial, public or private, which are
contained within, flow through, or border upon the state of Minnesota or any portion thereof.
5-8-3: APPLICABILITY
This ordinance shall apply to all water entering the storm sewer system generated on any
developed or undeveloped lands unless explicitly exempted by an authorized enforcement
agency.
5-8-4: RESPONSIBILITY FOR ADMINISTRATION
The City and its authorized representatives are authorized to administer, implement, and enforce
the provisions of this ordinance.
5-8-5: ILLEGAL DISPOSAL AND DUMPING
A. No person shall throw, deposit, place, leave, maintain, or keep any substance upon any
street, alley, sidewalk, storm drain inlet, catch basin conduit or drainage structure, business, or

upon any public or private land, so that the same might be or become a pollutant, unless the
substance is in containers, recycling bags, or any other lawfully established waste disposal
device.
B. No person shall intentionally dispose of grass, leaves, dirt, or landscape material into a
water resource, buffer, street, road, alley, catch basin, culvert, curb, gutter, inlet, ditch, natural
watercourse, flood control channel, canal, storm drain or any fabricated natural conveyance.
5-8-6: DISCHARGE PROHIBITIONS
A. Illegal Discharges
No person shall discharge or cause to be discharged into the municipal storm sewer system or
watercourses any materials, including but not limited to pollutants or waters containing any
pollutants that cause or contribute to a violation of applicable water quality standards, other than
stormwater. The commencement, conduct or continuance of any illegal discharge to the storm
sewer system is prohibited except as described as follows:
Discharge Exemptions:
1. The following discharges are exempt from discharge prohibitions established by this
ordinance: water line flushing or other potable water sources, landscape irrigation or lawn
watering, diverted stream flows, rising groundwater, groundwater infiltration to storm drains,
uncontaminated pumped groundwater, foundation or footing drains (not including active
groundwater dewatering systems), crawl space pumps, air conditioning condensation,
springs, non-commercial washing of vehicles, natural riparian habitat or wetland flows,
swimming pools (the water must be allowed to sit seven (7) days without the addition of
chlorine to allow for chlorine to evaporate before discharging to the storm sewer system), fire
fighting activities, and any other water source not containing pollutants, and the use of
fertilizers, herbicides and pesticides for agricultural or landscaping purposes when applied
for their intended purpose in accordance with label directions and with all applicable local,
state and federal ordinances, laws and regulations.
2. Discharges specified in writing by the authorized enforcement agency as being
necessary to protect public health and safety.
3. Dye testing is an allowable discharge, but requires a verbal notification to the City
Engineer 48-hours prior to the start of the test.
4. The prohibition shall not apply to any non-stormwater discharge permitted under an
NPDES permit, waiver, or waste discharge order issued to the discharger and administered
under the authority of the MPCA or Federal Environmental Protection Agency, provided that
the discharger is in full compliance with all requirements of the permit, waiver, or order and
other applicable laws and regulations, and provided that written approval has been granted
for any discharge to the storm sewer system.

B. Illicit Connections
1. The construction, use, maintenance or continued existence of illicit connections to the
storm sewer system is prohibited.
2. This prohibition expressly includes, without limitation, illicit connections made in the
past, regardless of whether the connection was permissible under law or practices
applicable or prevailing at the time of connection.
3. A person is considered to be in violation of this ordinance if the person connects a
line conveying sewage to the storm sewer system, or allows such a connection to
continue.
5-8-7: SUSPENSION OF MS4 ACCESS
A. Suspension due to Illicit Discharges in Emergency Situations. The City may, without
prior notice, suspend MS4 discharge access to a person when such suspension is necessary to
stop an actual or threatened discharge which presents or may present imminent and substantial
danger to the environment, or to the health or welfare of persons, or to the MS4 or Waters of the
State. If the violator fails to comply with a suspension order issued in an emergency, the City
may take such steps as deemed necessary to prevent or minimize damage to the MS4 or Waters
of the State, or to minimize danger to persons.
B. Suspension due to the Detection of Illicit Discharge. Any person discharging to the MS4
in violation of this ordinance may have their MS4 access terminated if such termination would
abate or reduce an illicit discharge. The City will notify a violator of the proposed termination of
its MS4 access.
C. A person commits an offense if the person reinstates MS4 access to premises terminated
pursuant to this Section, without the prior approval of the City.
5-8-8: INDUSTRIAL OR CONSTRUCTION ACTIVITY DISCHARGES
Any person subject to an industrial or construction activity NPDES stormwater discharge permit
shall comply with all provisions of such permit. Written proof of compliance may be required
prior to discharge to the City’s MS4.
5-8-9: MONITORING OF DISCHARGES
A. The City shall be permitted to enter and inspect facilities subject to regulation under this
Ordinance as often as may be necessary to determine compliance with this Ordinance. If a
discharger does not wish to allow the City to enter a building to conduct the required activity,
they may retain a private inspector to conduct the activity. The private inspector must have
credentials that are acceptable to the City. The private inspector shall provide the City with
relevant samples, test results, reports, reports or any other information that is being requested.

B. Facility operators shall allow the City ready access to all parts of the premises for the
purposes of inspection, sampling, examination and copying of records that must be kept under
the conditions of the NPDES permit to discharge stormwater, and the performance of any
additional duties as defined by state and federal law.
C. The City has the right to require the discharger to install monitoring equipment as
necessary. The facility's sampling and monitoring equipment shall be maintained at all times in a
safe and proper operating condition by the discharger at its own expense. All devices used to
measure stormwater flow and quality shall be calibrated to ensure their accuracy per
manufacturer’s recommendations.
D. Any temporary or permanent obstruction to safe and easy access to the facility to be
inspected and/or sampled shall be promptly removed by the operator at the written or oral
request of the City and shall not be replaced. The costs of clearing such access shall be borne by
the operator.
E. Unreasonable delays in allowing the City access to a permitted facility are a violation of a
stormwater discharge permit and of this section. A person who is the operator of the facility with
an NPDES permit to discharge stormwater associated with industrial activity commits an offense
if the person denies the City reasonable access to the permitted facility for the purpose of
conducting any activity authorized or required by this section.
F. If the City has been refused access to any part of the premises from which stormwater is
discharged, and he/she is able to demonstrate probable cause to believe that there may be a
violation of this Ordinance, or that there is a need to inspect and/or sample as part of a routine
inspection and sampling program designed to verify compliance with this Ordinance or any order
issued hereunder, or to protect the overall public health, safety, and welfare of the community,
then the City may seek issuance of a search warrant from any court of competent jurisdiction.
5-8-10: REQUIREMENT TO PREVENT, CONTROL, AND REDUCE
STORMWATER POLLUTANTS BY THE USE OF BEST MANAGEMENT PRACTICES
Compliance with all terms and conditions of a valid NPDES permit shall be deemed compliant
with the provisions of this section. The City will adopt requirements identifying BMPs for any
activity, operation, or facility which may cause or contribute to pollution or contamination of
stormwater, the storm sewer system, or Waters of the State. The owner or operator of such
activity, operation or facility shall provide, at their own expense, reasonable protection from
accidental discharge of prohibited materials or other wastes into the storm sewer system or
Waters of the State through the use of these structural and non-structural BMPs. These BMPs
shall be part of a stormwater pollution prevention plan (SWPPP) as necessary for compliance
with requirements of the NPDES permit. Any person responsible for a property or premise,
which is, or may be, the source of an illicit discharge, may be required to implement, at their
expense, additional BMPs to prevent the further discharge of pollutants to the City’s MS4.

5-8-11: WATERCOURSE PROTECTION
Every person owning property through which a watercourse passes, or such person's lessee, shall
keep and maintain that part of the watercourse within the property free of trash, debris, excessive
vegetation, and other obstacles that would pollute, contaminate, or significantly retard the flow
of water through the watercourse. In addition, the owner or lessee shall maintain existing
privately owned structures within or adjacent to a watercourse, so that such structures will not
become a hazard to the use, function, or physical integrity of the watercourse.
5-8-12: NOTIFICATION OF SPILLS
Notwithstanding other requirements of law, as soon as any person responsible for a facility or
operation, or responsible for emergency response for a facility or operation has information of
any known or suspected release of materials which are resulting or may result in illegal
discharges or pollutants discharging into the storm sewer system, or Waters of the State, said
person shall take all necessary steps to ensure the discovery, containment, and cleanup of such a
release. In the event of such a release of hazardous materials said person shall immediately
notify emergency response agencies of the occurrence via emergency dispatch services. In the
event of a release of non-hazardous materials, said person shall notify the City in person or by
telephone or facsimile no later than the next business day. Notifications in person or by phone
shall be confirmed by written notice addressed and mailed to the City of Albertville within three
business days of the telephone notice. If the discharge of prohibited materials emanates from a
commercial or industrial establishment, the owner or operator of such establishment shall also
retain an on-site written record of the discharge and the actions taken to prevent its recurrence.
Such records shall be retained for at least three years.
5-8-13: ENFORCEMENT
A. Notice of Violation.
Whenever the City finds that a person has violated a prohibition or failed to meet a requirement
of this Ordinance, the City may order compliance by written Notice of Violation to the
responsible person. Such notice may require without limitation:
1. The performance of monitoring, analyses, and reporting;
2. The elimination of illicit connections or discharges;
3. The violating discharges, practices, or operations shall cease and desist;
4. The abatement or remediation of stormwater pollution or contamination hazards and the
restoration of any affected property; and
5. Payment of a fine to cover administrative and remediation costs; and
6. The implementation of source control or treatment BMPs; and
7. The deadline within which to remedy the violation.
If abatement of a violation and/or restoration of affected property is required, the notice shall set
forth a deadline within which such remediation or restoration must be completed. Said notice
shall further advise that, should the violator fail to remediate or restore within the established

deadline, the work will be done by a designated governmental agency or a contractor and the
expense thereof shall be charged to the violator.
5-8-14: APPEAL OF NOTICE OF VIOLATION
Any person receiving a Notice of Violation may appeal the determination of the City. The notice
of appeal must be received by the City within seven (7) calendar days from the date of the Notice
of Violation. The appeal shall be heard by the City Council within thirty (30) calendar days from
the date of receipt of the notice of appeal. The decision of the City Council shall be final.
5-8-15: ENFORCEMENT MEASURES AFTER APPEAL
If the violation has not been corrected pursuant to the requirements set forth in the Notice of
Violation, or, in the event of an appeal, within the deadline extended by the decision of the City
Council, then representatives of the City shall enter upon the subject private property and are
authorized to take any and all measures necessary to abate the violation and/or restore the
property. It shall be unlawful for any person, owner, agent, or person in possession of any
premises to refuse to allow the City or its designated contractor to enter upon the premises for
the purposes set forth above.
5-8-16: COST OF ABATEMENT OF THE VIOLATION
Within thirty (30) days after abatement of the violation, the owner of the property will be
notified of the cost of abatement, including administrative costs, and the deadline to pay the
abatement costs. If the amount due is not paid within a timely manner as determined by the
decision of the City Council after hearing the appeal, the charges shall be filed with Wright
County and shall become a special assessment against the property and shall constitute a lien on
the property for the amount of the assessment.
5-8-17: CRIMINAL PROSECUTION
Any person that has violated or continues to violate this ordinance shall be shall be deemed
guilty of a misdemeanor and upon conviction thereof, may be subject to the maximum fine and
imprisonment allowed by State law. Each such violation shall constitute a separate offense
punishable to the maximum extent of the law.
The authorized enforcement agency may recover all attorneys’ fees court costs and other
expenses associated with enforcement of this ordinance, including sampling and monitoring
expenses.
Section 2. This ordinance shall be in full force and effect after its final passage and publication
according to law.

City Administrator’s Update
January 11, 2018
GENERAL ADMINISTRATION
Personnel Committee: The personnel committee will be meeting in early February to review
2017. Annually the committee meets to review personnel policies, pay schedules, salary
surveys, employee performance, staffing levels, etc.
Public Works Committee: We plan to have a Public Works Committee meeting in February to
review the city’s fleet CIP and proposed purchases for 2018.
January Joint Governance Meeting: The meeting has been cancelled.
Joint Powers Water: Staff from Veolia and the three cities met this week to discuss a number
of operational and capital improvement items, which I will update the Council on at the
meeting.
ENGINEERING/PUBLIC WORKS
2019 WWTP Improvements: Bill Waytas, of Nagell Appraising, has reviewed the two parcels
between Cr 39 and the Mississippi that we need utility easements for the new discharge pipe. I
anticipate Bill’s report in the next few weeks.
Utilities and WWTP Operations:
• This winter we have had one residential water service freeze
• Replaced influent flow meter at WWTP
• Currently repairing one of the ditch mixers
• Reviewing quotes/options for replacing the makeup HVAC unit for the screen room
• Cutting and burning plants in the reed beds is complete for year
Speed Trailer: We purchased a used speed trailer on MnBid to assist with speed compliance. I
receive a number of speed complaints and believe this trailer will greatly assist in speed
compliance. I plan to put the trailer in service next week. The cost of the trailer was $1,100.
Mapping: We are in the process of updating the City’s infrastructure maps. 2018 maps should
be available in late February.
CSAH 19 Median Lights: The decorative median lights to on CSAH 19 have been updated to
LED.
Sliding Hill: Staff is reviewing options for a sliding hill in Central Park.
Park Property: Staff is researching park property pursuant to previous Council discussions.
CSAH 19 and 57th Street Signal Improvements: In the spring, the Contractor will need to sod all
disturbed areas, and paint the signal poles and mast arms per the contract.
