Mayor Hendrickson called the meeting to order at 7:00 p.m.

3. RECOGNITIONS – PRESENTATIONS – INTRODUCTIONS
A. Long Range Plan Presentation – Andy Berg, ABDO
Berg reported on the assumptions used in the long range such as no growth in population, revenues
increase 1.5%, expenditures increase 3.0%, and keeping the general fund balance between 40-50%.
He also reported the Albertville tax rate is in the middle of the larger cities within Wright County.
He stated the biggest expense is capital outlay and reviewed the large upcoming projects.

There was no one present for the forum.

Nafstad added an Item F1 approving a MN Public Facilities Authority PSIG resolution.

A. Planning/Zoning
1). Karston Cove 5th Addition Final Plat and Development/PUD Agreement
Brixius reported that with the addition being rezoned to PUD previously, it offered greater flexibility
for the developer. He stated the addition is a coved layout and consists of eight single family homes
and three outlots. Two lots do not meet the lot width requirements, so the city approved flexibility
on those if the developer agreed to the setbacks listed in Exhibit D. Brixius stated that staff
recommended the water service lines be located outside of the driveways and the site plan
accommodates that with the exception of two lots, which the developer will work with the City
Engineer to find locations for those lines.
Cocking arrived at 7:22 p.m.
Brixius reported the sidewalk still needs to be installed. He stated staff recommends approval of the
final plat in accordance with the conditions listed in the planning memo of the agenda packet.
Vetsch stated he is not comfortable with the setbacks in the site plan.
Motioned by Hudson, seconded by Olson, to approve Resolution 2018-024 approving Karston
Cove 5th Addition Final Plat and Development/PUD Agreement. Ayes: Hendrickson, Cocking,
Hudson, and Olson. Nays: Vetsch. Absent: None. MOTION DECLARED CARRIED.
2). Laurel Academy Early Learning Center Site and Building Plan and Conditional
Use Permit For A Commercial Day Care Facility At 6558 Laketowne Place NE
Brixius reported that Laurel Academy would like to open a daycare facility at the previous MN
Lighting Store. The previous use was retail and daycare is an allowable use by conditional use

permit. He indicated the basement would be used for storage as well as a severe weather shelter.
The CUP required one parking space per employee and one space per ten children enrolled. He
stated the applicant will need to install a decorative fence, provide playground cover details, and
screening of the play areas. The building must comply with fire code and will need a fire
suppression system. The Planning Commission held the public hearing and recommended approval.
Hendrickson inquired about the setbacks from County Road 19 and Brixius replied they were 30
feet. Hendrickson inquired of the applicant when they propose to open and Ms. Chalmers replied
they hope to open in September.
Motioned by Cocking, seconded by Vetsch, to adopt Resolution Number 2018-022 approving a site
and building plan and conditional use permit to allow a daycare facility to be established at 6558
Laketowne Place NE. Ayes: Hendrickson, Cocking, Hudson, Olson, and Vetsch. Nays: None.
Absent: None. MOTION DECLARED CARRIED.
B. City Council

STMA Ice Arena Board
Hudson reported the board discussed funding the connection of the refrigeration system between the
two rinks. He indicated the board had discussed water heaters needed for resurfacing the ice and
how the two sheets use different methods for resurfacing ice. Staff felt it would be beneficial for the
same system to be compatible with both rinks and there may be pending capital needs.
FYCC
Olson reported that attendance at events is up. The board will be discussing budget and each entity
may be looking at approximately a $5,000 increase. Hendrickson inquired how Hanover funds
FYCC and Nafstad replied that FYCC sells services to Hanover and they are invoiced.
C. Fire
1). Fire Department Update
Bullen reported the Otsego Fire Study was complete and appeared well done. There were multiple
options from the station study and there could be possible boundary changes.
Bullen reported on the hiring process. They have hired one individual and two more are pending.
They received another resignation and will be down to 28 total personnel. He indicated they may
have to re-open the hiring process before fall. He stated that the age range (21-29) that are generally
most interested in serving are only 1-2% of the area’s total population, so it makes recruitment
difficult.
Bullen informed Council the department received $4,500 for the sale of Engine 12 and the new
owner has taken possession.
They have tentatively set the Memorial Dedication Ceremony for Sunday, September 9, 2018.

1). MN Public Facilities Authority PSIG Resolution
Nafstad reported this resolution is needed to move forward with the PFA grant application for
improvements to the Wastewater Treatment Facility.
Motioned by Vetsch, seconded by Olson, to approve Resolution No. 2018-023 Authorizing the City
of Albertville to Submit a Point Source Implementation Grant Application to the Minnesota
Public Facilities Authority (PFA) and to Authorize City Officials to Execute a Grant Agreement
on Behalf of the City of Albertville for the Planning, Design, and Construction of Improvements
for the Existing Wastewater Treatment Facility. Ayes: Hendrickson, Cocking, Hudson, Olson,
and Vetsch. Nays: None. Absent: None. MOTION DECLARED CARRIED.

I. Administration
1). Driveway Replacement Program
Nafstad presented a draft program policy and draft replacement assessment agreement to the
Council. He stated this program would offer assistance to those residences that wish to improve
their driveway but need assistance with financing. The resident would be assessed the cost of the
improvement over three or five years as well as a small administrative fee that would be due up
front. He suggested approving approximately $30,000 each year for the first five years, totaling
$150,000. Lannes stated that as the assessments are paid back, the interest would grow the program
and increase the amount of funds available over all.
Olson inquired if each agreement would need to be reviewed by Council and Nafstad replied they
wouldn’t if the policy is approved.
Motioned by Vetsch, seconded by Olson, to approve the Driveway Replacement Program Policy
and Agreement. Ayes: Hendrickson, Cocking, Hudson, Olson, and Vetsch. Nays: None. Absent:

2). City Administrator’s Update
Nafstad reported that the opportunity to provide conduit debt for a Buffalo project will not be
pursued at this time.
Nafstad reviewed the preliminary concept plan for 2019 improvements along CSAH 19 and 70th
Street NE. The proposed project includes intersection improvements to the outlet mall intersection,
expand County Rd 19 to four lanes with median and turn lanes, reconstruct 70th Street NE, trail
improvements, and installation of three roundabouts. Hendrickson inquired about notification to
residents and Nafstad replied that notices of a public informational meeting were sent out and the
meeting will be held from 5:00-7:00 p.m. on August 1.
Nafstad was seeking Council feedback if the trail should be installed on the west side of County Rd
19. Hendrickson felt it should. Council directed staff to pursue installation as part of the project.
Nafstad and Hudson updated the council on the Arena Board’s discussion regarding resurfacing
needs and equipment at the ice arena. As part of the second sheet addition, it appears a hot water
heater is now needed for the existing sheet of ice. There was discussion concerning the existing RO
system, compatibility of the proposed hot water heater and the existing RO system, as well as,
operations of the two sheets once the project is complete. Ideally operations and resurfacing
methods will be the same for both sheets of ice and for the resurfacing machines to be
interchangeable across both rinks. Hudson stated the goal is to get the most out of the equipment
and be as efficient as possible with capital spending. Hudson also informed the Council of other
anticipated costs associated with the second sheet such as computers, phones, etc. The Arena
Capital Improvement Fund, with the 2018 contributions of $15,000 from each entity, will not be
enough to fund the Zamboni, the additional items associated with the second sheet, and the
unanticipated $26,000 cost for the water heater. The recommendation from the Arena board was to
split the cost for the water heater with the three entities and doing so by an additional $10,000 from
each entity making the 2018 contribution $25,000. The council’s discussion included questions
concerning timing and need of the hot water heater, given the two sheets would not be connected
until next season. The council felt it was appropriate to authorize the additional capital contribution
so the Arena Board could take the appropriate action.
Motioned by Cooking, seconded by Olson, to approve the additional $10,000 capital contribution
to the arena for 2018. Ayes: Hendrickson, Cocking, Hudson, Olson, and Vetsch. Nays: None.

POLICY/PRACTICES CONSIDERATIONS: It is the City’s policy to review and approve

LEGAL CONSIDERATIONS: The Mayor and Council have the authority to approve all bills
pursuant to Minnesota State Law, which requires all bills to be paid in a timely manner,

SUBJECT: CONSENT - CITY CLERK – TEMPORARY OUTDOOR MUSIC PERMIT
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Approve a Major Temporary Outdoor Music Permit for the 152 Club, Inc. for
September 29, 2018 located at 5794 Main Avenue NE.
BACKGROUND: The applicant, Trisha Holm of 152 Club, Inc., has applied for a Major
Temporary Outdoor Music Permit for September 29, 2018. This is their annual Oktoberfest
music event.
A Major Temporary Outdoor Music Permit must meet the following requirements:
1. Any person, organization, and/or entity shall be limited to a maximum of two (2) major
permits per year. No commercial property shall host more than three (3) major events in
a calendar year.
2. The permit applicant must pay a permit fee as set by the City Council by ordinance and
provide information and/or a plan(s) that demonstrates that the site event will comply
with the performance standards of this code.
3. The permit applicant must demonstrate that there will be adequate sanitary facilities for
the event.
4. The permit applicant must demonstrate that there will be adequate security and fencing to
control access to the event at the location of the outdoor music performance.
5. The permit applicant must have sufficient off-street parking. The music event shall not
occupy required parking for the principal use of the site.
6. The major outdoor music performance must not interfere with other commercial and
governmental activities or with the quiet enjoyment of residential property.
7. The stage, performers, speakers and amplifiers are located three hundred feet (300’) from
any residence located in a residential zoning district.
8. The stage, speakers, and amplifiers are arranged in a design and manner that does not
directly broadcast music at or toward a residence within three hundred feet (300’) of the
stage.
9. Major outdoor music events shall be allowed between May 15th and October 15th and the
live outdoor music performance shall only occur on the dates and during the hours
designated by the City Council.
10. Major outdoor music events shall not perform beyond 12:00 midnight.
11. The volume of the outdoor music performance must be reasonable. The permit holder
shall comply with all requests of the Sheriff’s Department to reduce volumes to mitigate
nuisance complaints.

12. Failure to abide by these standards or the receipt of nuisance complaints may be grounds
for denial of future major outdoor music permits for the property.
The applicant has previously held both Major and Minor Temporary Outdoor Music Permits and
is familiar with the requirements that must be met.
KEY ISSUES:
• The applicant has submitted a site plan showing the location of speakers, fencing and
security, and has indicated adequate sanitary facilities as well as parking.
• The event is a special event for the establishment and music will be played from 3:00-
7:00 p.m. and 8:00 - 11:59 p.m.
• The applicant has indicated they will abide by the noise requirements.
POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the
authority to approve or deny any Temporary Outdoor Music Permit.
FINANCIAL CONSIDERATIONS: There is minimal financial revenue collected from the
applicant for the music permit.

RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO: Approve a One-Day Temporary 3.2% Malt Liquor License for the Church of St.
Albert’s Annual Parish Festival and approve the closure of Lander Ave NE between the Church
of St. Albert and the Parish Center from 8:00 a.m. to 5:00 p.m. on Sunday, September 16, 2018.
BACKGROUND: The Church of St. Albert is requesting a One-Day Temporary 3.2% Malt
Liquor License for their annual Parish Festival. The Festival will be held on Sunday, September
16, 2018 and proceeds will be used to help fund the Parish Center’s operating costs. The hours
of the event will be 10:30 a.m. to 5:00 p.m.
In addition, the applicant has requested that Lander Avenue NE be blocked off between the
Church and the Parish Center for safety reasons between the hours of 8:00 a.m. – 5:00 p.m.
KEY ISSUES:
• The Church of St. Albert has submitted the correct application and fee for a One-Day
Temporary 3.2% Malt Liquor License.
• Sale of the 3.2% malt liquor will occur on the grounds of the Parish Center.
• This is an annual event for the Church and Parish Center.
FINANCIAL CONSIDERATIONS: There is minimal financial revenue collected from the
applicant for the liquor license.
LEGAL CONSIDERATIONS: The Mayor and City Council have the authority to review and
approve or deny any liquor license.

ASSESSMENT AGREEMENT
SAC AND WAC CHARGES
BETWEEN
MARCUS STAR LLC AND CITY OF ALBERTVILLE
WHEREAS, the City of Albertville ("City") requires payment of sewer access
charges ("SAC") and water access charges ("WAC") at the time building permits are
applied for; and
WHEREAS, Marcus Star LLC ("Owner") has applied for a building permit on
property described as Lot 003; Block 001, The Shoppes at Towne Lakes One, according
to the plat of record on file in the office of the County Recorder, Wright County,
Minnesota ("Property") to remodel retail space into a daycare facility; and
WHEREAS, Owner has requested that the City special assess the City's portion of
the SAC and WAC charges that are due as a result of the application for a building permit
for the Property;
NOW, THEREFORE, the City and Owner agree as follows:
1. The applicable SAC and City portion of the WAC fees for the building
expansion are $36,478.00 and $23,401.00, respectively. The Joint Powers
portion of the WAC is $15,868.00.
2. The City shall special assess the SAC and City portion of the WAC (totaling
$44,011.00) against the Property over a 5 year period at an interest rate of 6%.
3. Owner shall promptly pay said special assessments as they come due with
the property taxes.
4. The Owner shall pay the Joint Powers its portion of WAC fees to the City prior to
the issuance of the building permit for construction of the daycare facility.
5. Owner waives its right to a public hearing pursuant to Minn. Stat. §429.061
and hereby directs the City Council to certify the special assessment to the
County Auditor.
6. Owner waives its right to appeal said special assessment to the District Court
pursuant to Minn. Stat.§ 429.081 or pursuant to any other legal authority or
legal theory and waives any procedural irregularities in the assessment process .
7. Owner shall pay the City's costs and expenses (including attorney' s fees) in the
event it violates this agreement.

SUBJECT: PLANNING – CONSIDER AN AMENDMENT TO ALBERTVILLE ZONING ORDINANCE
SECTION 200, RULES AND DEFINITIONS AND SECTION 1000.15, OUTSIDE
STORAGE, RESIDENTIAL, COMMERCIAL AND INDUSTRIAL USE
RECOMMENDATION: It is respectfully requested that the Mayor and Council give direction
to staff as to how they should approach the amending of the zoning code surrounding the outdoor
storage of recreational vehicles.
BACKGROUND: Albertville City Code allows for residents to keep recreational vehicles in the
front, side and rear yards of their residential properties. However, the city has received
complaints regarding a property at 10626 Karston Ave, where the owner is converting a school
bus for recreational use. Staff met with the property owner and found the following:
• The owner is converting the bus for his father and was chosen for its accessibility for the
disable.
• The bus is currently licensed by the state as a recreational vehicle.
• A converted bus falls under the city’s definition of a recreational vehicle, which may be
stored within a residential lot.
Based on the complaints that expressed concerns pertaining to the aesthetic impact of the
vehicle. While currently in accordance with the definition of the existing ordinance, staff were
asked to examine the ordinance and explore possible amendments which could address
community concerns.
KEY ISSUES:
• The definition for a recreational vehicle includes mobile homes, boats, RVs, converted
buses, and more. These vehicles are permitted to be stored outdoors on a residential lot
by section 1000.15 of Albertville’s zoning code. See full relevant definitions in Exhibit
A of the attachments.
• Recreational Vehicles can be stored in the front, side or rear yards provided that they
meet the conditions and setback requirements. These conditions are listed in Exhibit B of
the attachments.
• Within the definitions for recreational vehicles, no size limitations are placed on the
recreational vehicles except for manufactured homes. There is no regulation on the size
of stored recreational vehicles in a residential district. Maximum heights and sizes for
motor homes by class and that of a typical school bus are shown in Exhibit C.
• Fences or Screening could be considered as a method of mitigating the aesthetic impact
of these vehicles, but current ordinance only allows for fences of 6’ or less in residential
zoning districts. Given the height of some recreational vehicles, a screening requirement
would require some amending of the fence ordinance to be effective.

• We have also included photographs of other examples of outdoor storage in other
neighborhoods of Albertville for comparison.
POLICY/PRACTICES CONSIDERATIONS: The consideration at the root of this is whether
or not the storage of a converted bus or other vehicle is dissimilar from the storage of a Class A
motor home or other recreational vehicle in its impact upon the health, safety and welfare of
residents. The city has, within its abilities, the ability to repeal or revise ordinance language to
disallow converted buses and other uses such as manufactured homes and house cars. The
question to be addressed, do converted buses present issues different from the storage of other
large recreational vehicles, trailers, boats, within a residential district that justify them being
excluded from the permitted outdoor storage ordinance.
FINANCIAL CONSIDERATIONS: The cost of processing the ordinance amendments decided
upon.
LEGAL CONSIDERATIONS: The City Council may amend zoning ordinance in order to
address land use issues in the City.

RECREATIONAL VEHICLE: Includes, without limitation, the following, provided the
same are operable and licensed (as required by the state) to the property owner or
resident of the premises where stored: manufactured homes less than thirty five feet
(35') in overall length, including those which telescope or fold down; chassis mounted
campers, house cars, motor homes, tent trailers, slip-in campers (those mounted in a
pickup truck or similar vehicle), converted buses, converted vans used primarily for
recreational purposes; snowmobiles, boats/watercraft, all-terrain vehicles and any
nonmotorized trailer that transports recreational vehicles such as boats and
snowmobiles. A boat, snowmobile or other recreational vehicle, when stored or kept on
a trailer, shall be considered one "recreational vehicle". A "recreational vehicle" does not
include cars used for racing, off road use or demolition derby.
MANUFACTURED HOME: Any single-family dwelling transportable in one or more
sections which, in the traveling mode, is eight (8) body feet or more in width or forty (40)
body feet or more in length or, when erected on site, is three hundred twenty (320) or
more square feet, and which is built on a permanent chassis, with or without a
permanent foundation when connected to the required utilities, and includes the
plumbing, heating, air conditioning, and electrical systems contained therein.

1000.15: OUTSIDE STORAGE, RESIDENTIAL, COMMERCIAL AND INDUSTRIAL USES:
A. All outside storage of materials and equipment for residential uses (excluding farms) shall be stored
within a building or fully screened so as not to be visible from adjoining properties, except for the
following:

2. Not more than two (2) recreational vehicles, subject to the following conditions:
a. Front yard storage:
(1) All permitted recreational vehicle storage must be on a driveway or paved surface.
(2) All permitted recreational vehicle storage must be set back at least fifteen feet (15') from the
back of the curb and may not extend into any sidewalk area.
(3) Permitted recreational vehicle storage shall not interfere with stormwater drainage or be
located over an existing utility and may be subject to the review and approval of the zoning
administrator.
b. Side yard storage:
(1) All permitted recreational vehicle storage must be on an area surfaced with asphalt, concrete
or crushed rock with a border that prevents erosion.
(2) All permitted recreational vehicle storage must be set back at least two feet (2') from the
property line.
(3) Outdoor storage pads may be constructed within public utility and drainage easements
provided that:
(A) Permitted recreational vehicle or trailer storage shall not interfere with stormwater
drainage or divert stormwater to neighboring properties.
(B) No parking pad shall be located within a drainage or utility easement without written
permission of the city engineer.
(C) Removal of a parking pad or a portion thereof for the purpose of utilizing an
established drainage and utility easement shall be at the property owner's expense and
will not be replaced by the city.
(4) On a corner lot, all permitted recreational vehicle storage must be set back at least twenty
feet (20') from the property line abutting a street right of way.
c. Rear yard storage:
(1) All permitted recreational vehicle storage must be set back at least five feet (5') from the
rear lot line and five feet (5') from the side lot line(s) if not on a paved surface.
(2) Permitted recreational vehicle storage shall not interfere with stormwater drainage or be
located over an existing utility and may be subject to the review and approval of the zoning
administrator.

SUBJECT: FINANCE – TORT LIABILITY INSURANCE RENEWAL
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Not waive the City’s monetary limits on tort liability established by Minnesota
Statues, Section 466.04
BACKGROUND: The City decided not to waive the monetary limits the past few years, but
prior years the City did opt to waive the monetary limits on tort liability and purchased additional
coverage up to the $1,000,000 per occurrence and in aggregate. Waiving the monetary limits
increases exposure and raises the premium on an average of 3%. The League of Minnesota
Cities Insurance Trust (LMCIT) requires “Cities obtaining liability coverage from the League of
Minnesota Cities Insurance Trust must decide whether or not to waive the statutory tort limits to
the extent of the coverage purchased. This decision must be made by the City Council. Cities
purchasing coverage must complete and return this form to LMCIT before the effective date of
the coverage.”
The City Council must make a decision to waive or not waive the statutory limits prior to the
October 1, 2018 expiration/renewal date per LMCIT requirements in order for coverage to
continue beyond that date. Upon submission of this "signed and dated" Waiver Form, the
LMCIT will issue an Extension of Coverage Binder effective with a 10/1/2018 effective date.
It usually takes more than thirty (30) days for the LMCIT to process a renewal application. The
Extension of Coverage Binder assures the City of coverage beyond the 10/1/2018 renewal date.
POLICY/PRACTICES CONSIDERATIONS: It is the City’s policy to review and approve
tort liability options annually.
FINANCIAL CONSIDERATIONS: City staff has reviewed and recommends not waiving the
tort liability.
LEGAL CONSIDERATIONS: The Mayor and Council have the authority to contract for
insurance coverage including waiving the statutory tort liability limit.

RECOMMENDATION: This space on the agenda is reserved for the City Council to consider
acceptance of the lowest quote received for the Westwind Park Boardwalk project. It is
respectfully requested that the Mayor and Council consider the following motion:
MOTION TO: Approve the proposal from Blackstone Contractors, LLC in the amount of
$121,633 for construction of the Westwind Park boardwalk and directing staff to enter into an
agreement with Blackstone Contractors, LLC for the construction of the boardwalk.
BACKGROUND INFORMATION: Based on plans and specifications prepared by Bolton and
Menk, quotes for the city’s proposed boardwalk project were solicited and two (2) proposals were
received. The proposed improvements generally include installation of helical piers, concrete
abutments, and construction of wood boardwalk and platform. An alternative design using
galvanized pads and 4x4’s instead of the helical piers was reviewed. Although the cost of the
alternative system was less, it is not recommended for this project.
KEY ISSUES:
• Low quote for the project is $121,633.
• Low quote received by Blackstone Contractors, LLC.
• The City has received a $150,000 matching grant from the DNR for improvements to
Westwind Park and has entered into a contract with the DNR to have the park.
improvements completed by December 31, 2019.
• The boardwalk is one of several contracts for improvements to the park.
•
FINANCIAL CONSIDERATIONS: The total project will be funded through multiple funds,
including the $150,000 DNR grant, and will include multiple construction contracts. The low
quote for the boardwalk, per the Bolton and Menk plan dated 6/18/18, is for $121,633. This
amount does not include the overhead costs associated with surveying services or construction
inspection and testing.
LEGAL CONSIDERATIONS: The Mayor and Council possess the authority to authorize
municipal improvements, and to accept or reject quotes for municipal improvements.

SUBJECT: LEGAL - CONVEYANCE OF PARK AND RIDE PROPERTY TO THE STATE OF
MINNESOTA
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Approve Resolution No. 2018-025 entitled “Resolution Authorizing Mayor and
City Clerk to Execute a Quit Claim Deed Conveying Property to the State of Minnesota.”
BACKGROUND: Prior to 1974, Albertville was served by State Highway 152. In
approximately 1975 or 1976, the State opened I-94, which replaced Highway 152. Shortly after,
the State turned back portions of Highway 152 to the County and the City for local or County
Roads. That portion of Highway 152 located immediately east of CSAH 19 became CSAH 37.
The County turned over a portion of old CSAH 37 immediately east of CSAH 19 to the City as
60th Street, and the County also conveyed a portion of old CSAH 37 east of CSAH 19 to the City
for use as a park and ride parking lot, which remains in place to this day.
With the pending I-94 improvement project, the State is now looking to acquire the park and ride
property from the City for use as an entrance ramp from CSAH 19 to I-94 eastbound. The State
is requesting that the City deed this property to the State for free. While the City holds title to
this lot, it is deed restricted such that the City can only use the property for a park and ride,
which effectively prohibits the City from selling the property to a third party for a different use.
In short, other than its use as a park and ride, the lot has no value to the City as we cannot “sell”
it to anyone as it will revert to the County and/or State if we quit using it as a park and ride.
KEY ISSUES:
• The State is requesting the City to deed its park and ride property to the State for use as
part of the I-94 eastbound on ramp.
• The park and ride property is deed restricted and can only be used by the City as a park
and ride parking lot.
• Other than as a park and ride parking lot, the property has no value to the City as it is not
marketable or saleable.
• Deeding it to the State advances the City’s interest in getting the CSAH 19 eastbound on-
ramp constructed by the State.
• The City is responsible for maintaining the park and ride lot. The lot’s pavement is
nearly 30 years old and will need to be replaced at some point in the near future if it
remains a park and ride lot.
POLICY/PRACTICES CONSIDERATIONS: Deeding the lot to the State will advance the
City’s interest in getting the CSAH 19 east-bound ramp constructed. However, it will leave the
City without a park and ride lot. It is unclear how many Albertville residents use this lot.

FINANCIAL CONSIDERATIONS: There are no negative financial implications to deeding
the property to the State. Deeding the property to the State will eliminate the need to replace the
parking lot in the near future, which would otherwise be a City expense.

RESOLUTION AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE A QUIT
CLAIM DEED CONVEYING PROPERTY TO THE STATE OF MINNESOTA
WHEREAS, the City received property now used as a park and ride facility from Wright
County via a quit claim deed dated September 1, 1989, said property being that described on the
attached Exhibit A; and
WHEREAS, the State of Minnesota has committed to expanding Interstate 94 to three
lanes in each direction from St. Michael to Albertville, including the construction of an entrance
ramp from CSAH 19 to eastbound I-94; and
WHEREAS, the property owned by the City and used as a park and ride facility is
located in part over that area that the State plans on using as the I-94 east bound entrance ramp
from CSAH 19; and
WHEREAS, the Minnesota Department of Transportation (MNDOT) has requested that
the City deed the park and ride property to the State for use in the I-94 expansion project; and
WHEREAS, MNDOT has requested a resolution of authorization to further validate the
execution of the quit claim deed.
NOW, THEREFORE, BE IT RESOLVED by the City of Albertville that the City
Council hereby authorizes the Mayor and City Clerk to execute the deed of transfer to the State
of Minnesota for the parcel described on Exhibit A and hereby further validates said execution.

SUBJECT: LEGAL - AMENDMENT TO CHARITABLE GAMBLING ORDINANCE
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Approve Ordinance No. 2018-10 entitled “An Ordinance Amending Title 4,
Chapter 3, Section 2 of the Albertville City Code Relating to Charitable Gambling.”
BACKGROUND: Minnesota law (Minn. Stat. 349.213) allows the City to require charitable
organizations that operate in the City to contribute up to 10% of their net profits (which is
significantly less than their gross revenues) to the City to be used for police, fire, and other
emergency or public safety-related services, equipment and training. In the alternative, the City
can use the money to make donations to other charitable entities or to other governmental entities
(such as the School District). However, if the City uses the money itself, it is restricted to using
it for the police, fire and other emergency uses described above.
Current City ordinance (enacted in 1989) imposes this 10% contribution requirement on
charitable organizations operating in the City, but the City has never enforced this provision of
the ordinance. Further, the City’s ordinance requires that the money be placed in the City’s
building fund or such other related purpose as determined by the City Council. This portion of
the ordinance is no longer consistent with MN State law and must be modified to require use of
the money for police, fire and other emergency or public safety-related services, equipment and
training, or the City must use it to make its own charitable donations.
Once amended, City Staff will begin enforcing this ordinance unless the Council directs staff
otherwise.
KEY ISSUES:
• The current ordinance does not comply with MN State law.
• The proposed amendment will bring the City into compliance with MN State law.
• The City has not been enforcing this ordinance, but it has been on the books for nearly
30 years.
• If passed, the City will begin collecting 10% of the net profits generated by charitable
gambling in Albertville.
• Any funds collected would most likely be used for the purchase of fire equipment.
POLICY/PRACTICES CONSIDERATIONS: The proposed amendment reflects a change in
state law since this ordinance was adopted in 1989. Staff understands that the Council would
like the City to start collecting 10% of the net profits, which would be a change in practice.

FINANCIAL CONSIDERATIONS: Implementation of this ordinance will result in a net
increase in revenue to the City. Although the amount of revenue to be generated is unknown at
this time, Staff’s best guess is that it will likely raise $30,000 to $50,000 annually.
LEGAL CONSIDERATIONS: The City Attorney recommends that this amendment be passed
as the current ordinance is contrary to the applicable statutes on charitable gambling.

ORDINANCE NO. 2018-10
AN ORDINANCE AMENDING TITLE 4, CHAPTER 3, SECTION 2 OF THE
ALBERTVILLE CITY CODE RELATING TO CHARITABLE GAMBLING.
Section 1. Title 4, Chapter 3, Section 2E is hereby amended to read as follows:
E. Expenditure of Profit: Each charitable gambling licensee operating in the City shall
contribute to the City ten percent (10%) of its net profit (defined herein to mean gross
profits less amounts expended for allowable expenses and paid in taxes assessed on
lawful gambling, all as defined in Minn. Stat. Chapter 349) derived from lawful gambling
conducted at premises within the City's jurisdiction. All such contributions shall be
deposited in a fund administered by the City and shall be used exclusively for City police,
fire, and other emergency or public safety-related services, equipment, and training.
Such contribution shall be made no later than seventy-five (75) days after the end of the
licensee's tax fiscal year.
Section 2. This ordinance shall become effective immediately upon its passage and publication
according to law.

Re: Attorney Report
Below is an update of the projects our office has been working on for the City.
• I-94 Ramp Easement. The State is asking the City to obtain I-94 ramp easement
from Albertville Marketplace using a revised legal description as the State wants
clearer language in the deed from the City to the State for the ramp easement. The
easement area remains unchanged—the State simply wants its specific language
used in the easement document. Adam is trying to reach the owner to get the new
deed signed.
• Charter Cable. I have forwarded a draft of a new franchise agreement to Charter
Cable for their review. The existing franchise agreement expires this September
and will need to be replaced with a new franchise agreement.
• Maeyaert Nuisance Complaint. We will try to schedule an inspection of the
Maeyaert property shortly, after which we will bring a motion for default in the
Court action.
• WWTP Discharge Easements. I drafted an easement agreement for the sewer
discharge line on the Riverwood property in Otsego.
• Charitable Gambling Ordinance Amendment. I have drafted an amendment to
the City’s charitable gambling ordinance, updating its existing 10% contribution
requirement to comply with current law. That item is on the August 6th meeting
agenda.

City Administrator’s Update

GENERAL ADMINISTRATION
I94 Funding: MnDOT selected the full St. Michael to Albertville Expansion Project as one of their
Federal BUILD Grant candidates. If selected, this would provide additional funds to complete
the added lanes between CR 19 and CR 37, as well as, replacement of the CR 19 bridges. We
are planning for September meetings in D.C. with LGN to advocate for the $10 million grant.
We are looking for council members and business members who are available to attend.
Candidate Filing: The Mayor’s seat and two Council seats will be up for election on the
November ballot. Filing for these offices began Tuesday, July 31 and will run through 5:00 p.m.
on August 14 (Primary Election Day). Candidates must be 21 by the election, resided in
Albertville at least 30 days before the election, and be an eligible voter. Filing is available at
City Hall and the cost is $2.
Budget Workshops: Our second budget workshop will be held immediately following the
regular meeting.
Employment Opportunities: We are currently advertising for an administrative assistant and
plan to interview in late August. In the next few weeks, ads for the two arena positions to start
this fall (supervisor and assistant manager) will be posted.
Arena: Staff is working with the School District and Youth Hockey to update the advertising
agreement. I expect this to be on the Arena Board’s next agenda.
Liquor Compliance Checks: Checks were completed by Wright County and three establishments
were cited for failure to request ID of an underage person. This was the first violation for the
three establishments within a 24 month period and the $500 first offense fine was invoiced to
the establishment. Should an establishment wish to dispute the fine, they have the opportunity
to request a hearing in front of the City Council. No requests have been received as yet.
Park Property Acquisitions: We have prepared draft purchase agreements and are in
discussion the two property owners.
Absentee Voting: Voting for the Primary Election began on June 29 and is available to voters
during City Hall hours. City Hall will also be open on Saturday, August 11, from 10:00 a.m. to
3:00 p.m. for absentee voting.
CGI Video Tour: The custom videos documenting the Albertville community on our web page
are being revamped. Staff has begun work on the script and shoot locations. The videographer
is scheduled for the first week in September and it is anticipated edited and reviewed videos
will be up by mid-November.
Gambling Ordinance: This is included on Monday’s agenda.

SAC and WAC Assessment Agreement: Included on the consent agenda is an agreement
requested by Marcus Star, LLC for financing of the SAC and WAC fees associated with the
proposed Laurel Academy childcare facility. The access charges owned are approximately
$60,000. This agreement requires the JPWB portion to be paid with the building permit and
allow the balance owed to paid as a special assessment over the next five (5) years.
ENGINEERING/PUBLIC WORKS
70th Street (west of CSAH19): Staff from Albertville and Otsego are working with MnRoad to
see if there is a possibility to partner on a project to improve the 1 mile segment of 70th
between Kadler and CASH 19. The concept includes the two cities building a half mile segment
as a urban 3 lane road and MnRoad building a half mile segment as rural two lane road using
modern-day recycling processes and monitoring the performance of the segment.
2019 WWTP Improvements: Preliminary design is nearing completion and we continue to
work to negotiate the needed easements between CR 39 and the Mississippi.
CSAH 37 (west of Cr 19): The County is starting the preliminary design of the CSAH 37
improvements scheduled for 2019. I will have a draft layout for discussion in August.
CSAH 19 and CSAH 38 (70th Street): The open house was held on August 1 and was well
attended. Generally, the feedback was very positive, especially with have trails on both sides of
the two highways. I am expecting to have cost estimate and the proposed city’s share in the
next two weeks.
Towne Lakes Trails: The Contractor has one more segment of trail to overlay and Public Works
is working on irrigation and turf restoration.
