CALL TO ORDER - PLEDGE OF ALLEGIANCE Mayor Hendrickson called the meeting to order at 7:00 p.m. Leo Kruger was present to lead the pledge of allegiance. 2. Committee Updates (STMA Ice Arena, Planning, JPWB, Parks, Fire Board, FYCC, etc.) Fire Advisory Committee Sorensen reported that Otsego will be conducting a fire station study and the consensus was for the committee to wait until that is completed to move forward with the Joint Powers Agreement for fire service. Nafstad reported that Otsego received a resignation notice from their City Administrator. B. Fire 1). Purchase of Self-Contained Breathing Apparatus (SCBA) Bullen stated the department had applied for a FEMA grant for the SCBA and were turned down in August 2016. He stated that several of the SCBA’s have issues and will be costly to repair. Bullen stated the purchase would include 12 SCBA packs, 30 SCBA bottles, 34 SCBA masks, and 2 RIT packs in the amount of $84,716. He stated this order is smaller than the order for the FEMA grant, because the heavy rescue will be removed from the fleet. When that vehicle is replaced, additional SCBA equipment will need to be ordered at that time. Motioned by Olson, seconded by Vetsch, to Authorize the purchase of new Fire Department SCBA, based on low quotes, for a total purchase amount not-to-exceed $84,716. Fire Update Bullen reported they had the kindergartners from Albertville Primary at the Fire Station to learn about fire prevention. Sorensen stated the event was a great success and very well done. Bullen stated that conditional job offers for reserve firefighters were sent to four candidates and he hopes for a January start. Bullen reported they are in the process of the biannual promotions for captain and lieutenants. He stated that they have ten applicants for three captains and three lieutenants. Agenda Page 5 City Council Meeting Minutes Page 3 Regular Meeting of October 17, 2016 Bullen reported that for the 2016 AFG grant, they are gathering information and hoping for seven sets of turn-out gear, 6 SCBA packs/6 SCBA bottles, and turn-out gear dryer. Bullen reported that Assistant Fire Chief Mills begins his new job next week as the Fire Service Specialist for the MN State Fire Marshal’s Office. C. City Clerk 1). 2017 Open Book Meeting Option Nafstad reported the Council must decide by December if they wish to change to the Open Book option for the Local Appeal and Equalization process for home valuations. The Open Book option allows resident to meet directly with Wright County assessing staff and bypass the formal meeting at the City Council. Nafstad stated no action is needed unless the Council wants to go to the Open Book meeting option. Sorensen and Vetsch stated their preference to keep the Local Board of Appeals and Equalization with the City Council and to continue with their current practice. Nafstad clarified that even if the Council maintains the local board a property owner can still meet with the County and then appeal to the Council. Council reached a consensus to maintain the Local Board of Appeals and Equalization. 2). Tree of Life Massage Therapy Enterprise License Nafstad reported that Tree of Life wishes to open a wellness center at 5676 LaCentre Avenue NE, Suite 202, and is requesting a massage therapy enterprise license as required by the City Code. Motioned by Sorensen, seconded by Olson, to approve a Massage Therapy Enterprise License for Tree of Life, located at 5676 LaCentre Avenue NE #202, contingent upon final inspection and approval of the Building Official and Fire Chief, payment of license fees, and successful background check. Public Works/Engineering 1). 2017 CSAH 19 & 57th Street NE Signal Improvements - Discussion Nafstad reported the Council had previously reviewed a traffic report from SRF for the intersection of CSAH 19 and 57th Street NE. The report concluded that dedicated left turn lanes and signalization are needed at the intersection. Staff has been working with SRF to develop a scope and proposal for design services should it be considered for a 2017 improvement. The proposal is not to exceed $45,205. Olson inquired what funds would be used and Nafstad replied funds would come from a combination of street improvement and overlay funds, State Aid funds that have already been pulled, and general funds. Olson inquired if they would have to go through the State Aid process and Nafstad replied they would not since the funds have already been pulled. Motioned by Vetsch, seconded by Hudson, to approve the SRF proposal for preparation of plans and specification of the design services for CSAH 19 and 57th Street NE Signal and Intersection Improvements at an hourly not-to-exceed $45,205. MN Dot Transportation Alternatives Nafstad reported that federal grants and opportunities for those non-street related projects that have been administered by MnDOT have now been consolidated into the Transportation Alternatives Funding Solicitation which addresses projects such as trails, sidewalks, etc. He stated they are working with the Wright County Highway Department, Wright County Commissioners, and the City of Otsego on restriping CSAH 37 on the bridge over I-94. He stated that it would have turn lanes and reduce the shoulder of CSAH 37. He reported that this would be the time to consider a pedestrian bridge over I-94 at CSAH 37. He stated they would make formal application for a grant for the project and he would need to submit a letter of intent to the State. He stated he is looking for Council approval to begin the process and did state the City would need to contribute some funds to the project. He reported that Albertville would probably take the lead on the application. Hendrickson inquired if they should have a resolution of support. Nafstad replied that would eventually come into play later in the application process. Council directed staff to proceed with the grant. E. Finance – None F. Planning/Zoning – None G. Building – None H. Legal - None I. Administration 1). City Administrator’s Update Nafstad reported that they have received resignation notice from Jane Arnoldy and she is planning to retire after the November election. Nafstad stated that MOE is looking to update the existing AUAR (Alternative Urban Area Review) and is a large step in the development process. He stated that a traffic analysis will need to be done and ideally it should be the City to conduct the study, but the City would need to be reimbursed for that work. At the next meeting, he anticipates a scope of services for the traffic study from SRF and an agreement for how the City will be reimbursed. Nafstad reported that the 2017 Street Improvements will include streets west of CSAH 19 and he will be holding a neighborhood meeting to discuss the details with impacted residents. 9. WATER RATE PRESENTATION Lannes reported the first presentation reviewed the water rates for 2017, the need for an increase, and options to address the shortage. The second presentation gave options for increasing the base rate, increasing the tiered rates, or increasing a combination of both. She stated Council had asked to see the residential utility accounts. Lannes reported that the majority of residential accounts did not hit the tiered rates and there are under 200 accounts that are considered high users and in the tiered rate. Lannes reported they could match the tiers to mirror Joint Powers Water Board. She then presented several options to the Council that would match Joint Powers, but not address depreciation: • 4 tier option with an increase to tiers • 4 tier option with no increase • 4 tier option with an increase to the base Lannes explained how the different options would affect commercial versus residential accounts and stated there are endless options on how to adjust the rates. Olson inquired how much they are short in the fund. Lannes explained they are currently depleting the fund and are short $60,000 a year in operations. If they include depreciation, it would be $120,000 per year. She stated that the fund would be in the negative in four years, so she would like to see the solution in place before then. Council discussed several options, factors that impact water usage, and impact to water users. Nafstad stated the Council will need to make a decision in December. Agenda Page 8 City Council Meeting Minutes Page 6 Regular Meeting of October 17, 2016 Hendrickson was concerned about covering depreciation. Couri stated that if depreciation is not funded now, when the time comes to replace infrastructure, the Council will need to issue debt to cover the cost. Then there is no choice but to raise rates to cover replacement and interest. He stated that the Council is in the position now to make a small change over time rather than being forced to make a big change suddenly. Lannes inquired if Council is comfortable moving forward with the 4 tier option to match Joint Powers rather than staying with 3 tiers and Council indicated they are. Hendrickson inquired if there were professionals they could ask for advice about the rates. Lannes explained that would be the rate study that the auditors had discussed. Nafstad explained that a rate study would tell the Council to the cent what the rates should be. Lannes reported this presentation gives the Council options. Nafstad reported that staff will come back to Council with a hybrid of a base and tier increase and an implementation plan. 11. Darkenwald/Mall of Entertainment AUAR Casey Darkenwald, Darkenwald Holdings Ltd, and Darren Lazan, Landform Professional Services, were present at the meeting. Lazan gave a brief update on the project. He reviewed the original concept. He added that they would like to have multi-family housing as part of the concept. There will be office and medical along I-94. Lazan stated AUAR (Alternative Urban Area Review) update will update the 2003 AUAR that was done and will address any changes from the original plan. He stated the City must request the update of the AUAR and will need to review the funding agreement for that. It would be most efficient to have the City’s consultant, SRF, conduct the traffic study. However, they are requesting a smaller escrow deposit at the beginning that may be rechargeable or require additional escrows. Hendrickson stated the original escrow proposed was $100,000. Lazan replied the City has asked for the $100,000 and the traffic study would be about $60,000. Couri stated that if the City estimates $100,000 they should try their best to get that amount upfront; if the City were to accept a lesser amount of escrow and the costs came in above that number, the City could face some business risk for those costs. Lazan stated the developer would like to put an escrow in place that covers the estimated cost of the traffic study rather than the $100,000. Vetsch had concerns about multi-family housing. Lazan replied that the mixed use in the concept is what will make their concept successful. Brixius stated this is only one scenario that will be reviewed in the AUAR. Lazan proposed a $75,000 escrow. Brixius and Couri recommended that the escrow not fall below $10,000. Couri stated they can modify the cost reimbursement agreement to reference a $75,000 escrow and provided the following language to replace the last two sentences of bullet item 3 in the agreement: Agenda Page 11 City Council Meeting Minutes Page 3 Regular Meeting of November 7, 2016 Darkenwald shall maintain the escrow at minimum amount of $10,000 at all times. From time to time, the City shall inform Darkenwald of the anticipated draws on the escrow and Darkenwald replenish the escrow in the amount the City reasonably requests within 10 days of a written request by the City. The City shall provide Darkenwald with invoices from all consultants when such invoices contain charges that are to be reimbursed from the escrow. Nafstad requested that the resolution authorizing the AUAR be amended. He asked the paragraph with the last “whereas” in the resolution be removed. Motioned by Sorensen, seconded by Olson, to Approve Resolution 2016-030 Authorizing the Preparation of an AUAR For Land Owned By Darkenwald Holding Ltd In Northwest Albertville; Authorizing a Traffic Study Related to Said AUAR; and Authorizing the City to Enter Into a Cost Reimbursement Agreement with Darkenwald Holdings Ltd to Cover City Costs Associated with Said AUAR. Approval of the 2016 Certification of Outstanding Utility Bills and Invoices Lannes reported that the Council should open the meeting to anyone wishing to speak regarding outstanding bills and invoices that will be certified to taxes. Motioned by Vetsch, seconded by Olson, to approve Resolution No. 2016-031 entitled a Resolution Certifying the 2016 Uncollected Utility Bills and invoices to Wright County for Collection with Real Estate Taxes. FYCC is advertising for winter rink attendants and there has been some difficulty in the past with getting applicants. Hendrickson wanted to make sure it is advertised on the City’s website and Facebook. D. Public Works/Engineering 1). 2017 Street and Sidewalk Improvements Nafstad reported that over the last five years they have evaluated the condition of city streets and identified needs. Generally, the City has taken on a major street project every other year. The streets identified that need repair are below: • 57th Street NE – 58th Street NE to CSAH 19 • 56th Street NE – Kahler Drive NE to Kalenda Drive NE • Kahler Drive NE – Karston Drive NE to 58th Street NE • Karston Ave NE – Kahler Drive NE to 500’ east of Kahler Drive NE • 58th Street NE – 57th Street NE to Kalland Ave NE • Kalland Avenue NE – 58th Street NE to 250’ south of Kalland Drive NE Agenda Page 12 City Council Meeting Minutes Page 4 Regular Meeting of November 7, 2016 Nafstad stated that he added the overlay of the Oakside Park trail and replacement of the bituminous trail along 57th Street NE, Karston Avenue NE, and Kalland Avenue NE with a concrete walk and grass boulevard. The subject site is zoned B-2, Limited Business. Within the B-2 District, clinical offices are an allowed use. The proposed orthodontist office is an allowed use within the B-2 Zoning District. In addition, the site shows drainage and utility easements around the remainder of the parcel. The easements are an existing condition and appear compliant with the City’s requirements. Maximum Site Coverage. Within the B-2 District, the total impervious surface is limited to 80%. The total lot area is 1.03 acres. The proposed building footprint is 4,370 square feet. The site shows a parking lot and private drive that covers approximately 17,088 square feet. The site coverage will be well below the 80% limit. Maximum Building Height. The maximum building height in the B-2 District is 35 feet. The submitted plans show a building height of less than 35 feet. Building Type and Design. The applicant’s submitted plans shows the design of the building and building materials. The building will be finished with EFIS, concrete masonry units, and asphalt shingles. These materials are compliant with the City’s code. The building elevations show an attractive building. Site Lighting. The applicant has submitted a lighting plan. The light plan shows three existing street light fixtures along the private drive. In addition, the applicant is proposing four additional fixtures to service the parking lot area. The applicant shall submit cut sheets that show the light fixtures are a 90-degree cut-off. In addition, the plan shows that there is no lighting proposed to be attached to the building. The applicant shall clarify that this is correct. Agenda Page 33 17 Trash Enclosure. The site plan does not show an outdoor trash enclosure. Based on review of the site plan and building plan, it appears that the trash enclosure will be stored indoors at the southwest corner of the building. This area has limited maneuvering for trucks. The applicant shall illustrate how garbage trucks will access, service, and egress the site. Loading Berths. By code, a building under 10,000 square feet is required to have one loading berth. The building plan shows one overhead door on the west side of the building. Based on the proposed clinic use, no additional large truck loading areas will be required. The applicant must describe how site deliveries will be handled. Parking. By code, a medical facility is required to have one parking stall per 200 square feet of building square feet, plus three spaces. The site plan shows 3,933 square feet of building space. Therefore, 23 parking spaces are required for this project. The site plan shows 26 parking stalls as well as two disability parking stalls, which is appropriate for a project of this size. The parking lot design is properly dimensioned with 9 foot by 20 foot parking stalls and drive aisles 24 feet wide. The proposal meets the requirements of the City’s code. The parking lot will be paved and have concrete perimeter curbing. By code, the curb setback for the side yard is five feet. The curb cut is at least eight feet from each property line. The area to the east of the proposed building is currently open space with deferred parking for the existing medical building. To better serve the parking lot in the future, staff recommends that a curb cut be added to the eastern side of the parking lot to connect to future parking. Curb Cut Access. The applicant is proposing one curb cut. The curb cut is 24 feet in width and is connected to a private drive. The curb cut meets the City’s requirements. Landscaping. The City Ordinance requires a landscape plan for all commercial properties. The plan shows some existing shade trees and sod that will remain on the west side of the property. These trees were part of the original landscaping plan that was approved in 2006. The proposed landscape plan for the clinic is generally adequate except for the following items: 1. The landscaping along the west side of the parking lot consists of Chinese Silver Grass. The City requires the screening of parking lots from residential properties. The grasses will not provide year round screening. These grasses must be replaced with shrubs. 2. The landscape plan proposes that the south and east sides of the site will be seeded with native grasses and wildflowers. The introduction of this ground cover is out of character with the original 2006 landscape plan and the more manicured lawns around the medical clinic and the west side of the site. Staff is Agenda Page 34 18 recommending that the site ground cover consist of sod and the site be maintained in a manicured manner consistent with the adjoining sites. In addition, staff seeks clarity from the applicant if an irrigation system is intended for this site. Grading and Drainage Plan. The applicant has submitted a grading and drainage plan that directs hard surface stormwater to the west central area of the site. This is subject to further review by the City Engineer. Storm Water Pollution Prevention Plan. The applicant has also submitted a SWPPP. The plan is subject to review by the City Engineer. Utility Connections. The utility connections are all located along the private drive to the north. The building will connect to the utilities toward the north side of the building. This is subject to further review by the City Engineer. Fire Connection. The site plan shows an existing fire hydrant along Jason Avenue NE, and the private drive along the north side of the property. The proposed access also indicates that a large truck can access the parking lot. The site plan also shows a fire sprinkler connection on the north side of the building indicating that the building will be fire sprinkled. Snow Storage. The applicant’s site plan shows a snow storage area to the south and east of the proposed parking. The snow storage plan does not use any required parking stalls and does not interfere with the landscaping plan. The snow storage plan appears to meet the City’s requirements. Signs. The Albertville Zoning Ordinance limits wall signs within the B-2 District to two wall signs per public street frontage. Additional signs may be allowed with the approval of a comprehensive sign plan. The applicant has requested a comprehensive sign plan for this site to allow a third sign on the east building wall. In review of the proposed sign plan, we offer the following comments: 1. The total wall sign area shall not exceed 15% of the building wall fronting on a public street. The building’s south wall fronts Jason Avenue. This wall has a wall façade of 1,356 square feet, allowing a maximum total wall sign area of 203 square feet. The accumulative area of all the wall signs is 189 square feet (north wall 52 square feet; south wall 52 square feet; and east wall 85 square feet). This falls within the B-2 District standard. 2. No wall sign shall exceed 15% of the wall on which it is placed. The east side of the building has the smallest wall façade (896 square feet) and largest sign (85 square feet). The sign covers only 9.4% of the wall. Agenda Page 35 19 3. The freestanding signs shall be limited to one freestanding monument at the southwest corner of the lot not to exceed 53 square feet in sign area or four feet in height. The comprehensive sign plan does not exceed the maximum sign area allowed for the building; it does allow for the extra wall sign. With limited freestanding sign allotment, staff recommends approval of the comprehensive sign plan for Accorde Orthodontists allowing the third wall sign. RECOMMENDATION Based on our review of the plan set submitted by Accorde Orthodontists dated October 11, 2016, we recommend approval of site and building and comprehensive sign plans with the following conditions: 1. The applicant describe truck turn movements for garbage collection and provide a description of type of deliveries received by the clinic with regard to truck type, size and frequency. 2. The landscape plan be revised to address the following: a. Replace grasses with shrubs along the west side of the parking lot to screen the cars and headlights. b. This lot is within the Albert Villas 6th Addition which has covenants that limit lots to one outbuilding that may not exceed 120 square feet in area. The property lot is 27,321 square feet in area and abuts Swamp Lake. While the proposed building may have met City zoning standards, the building was prohibited based on Section 1000.4.B.5 above. A second request this June was for a second garage for property located at 10141 49th Street NE. This lot is in Albert Villas 4th Addition. Review of this subdivision reveals that the developer of the 4th Addition did not place the same building restrictions on the 4th Addition as they did in the 6th Addition. This lot is 1.99 acres in size and is eligible for an oversized second accessory building by administrative permit. The City Council reviewed this issue in July and directed the Planning Commission to study this matter further to determine what zoning ordinance changes were appropriate. The Planning Commission studied this issue and at their November planning commission meeting held a public hearing to consider the attached ordinance amendment. At the close of the public hearing they recommended that the City Council should approve the zoning ordinance amendment. KEY ISSUES: • The comparison of these two lots within the Albert Villas subdivision demonstrates an inequity in the treatment of properties within the same subdivision. BACKGROUND: The City’s current residential rental property ordinance does not allow any exceptions for properties that are involved in a real estate transaction, or properties where the owner is renting out a room. This makes certain properties in the City out of compliance with the City during the “transition” phase of a real estate transaction. KEY ISSUES: The current ordinance states that all residential real estate that is rented in the City must have a license. However, there are situations where this policy was not intended to apply and the ordinance reaches outside of its original intent. Such situations are: • Property involved in a real estate transaction where the occupant is temporarily not the owner. • Property that is owner occupied, but the owner is renting out a room to a boarder. • Property that is registered as Contract for Deed. The attached ordinance amendment would exempt the above situations from requiring a rental property license. In addition, Section 10-4-10 K 2 of the City Code requires all nonresidential properties to register the occupant of each commercial or industrial building. This is a requirement that the City has never enforced. Currently, the City has not had a reason to keep such a record and is therefore suggesting a repeal of this requirement. POLICY CONSIDERATIONS: There are no significant policy considerations related to this ordinance amendment. FINANCIAL CONSIDERATIONS: The fee that would have been collected under the scenarios listed above will no longer be collected. On Monday, December 5th, the City Council will host a public hearing, known as a Truth-In-Taxation, for the Council to take public comments on the proposed budget and levy. Following public comments, the City Council at a regularly convened meeting may approve or make adjustments to the final levy, which is then certified to Wright County for taxes payable in 2017. Coinciding with the adoption of the City’s Levy, the City Council officially adopts a 2017 budget detailing projected revenue and expenses. KEY ISSUES: • The public Truth-in-Taxation hearing was held prior to Council approvals. • The proposed budget and levy represents a total levy increase of 2.94% • The debt service budget has decreased by $5,646 and the general fund operations levy has increased by $113,642 for the 2.94% levy increase • The proposed budget includes anticipated LGA funding (estimated $92,181) which will assist with infrastructure expenses. • Staff provides the final levy to the County Auditor no later than end of business day December 15, 2016. However, since the last workshop, a programming error in the utility billing software has been discovered that was essentially under charging the upper tier users. The software has been updated and the effect will be additional water and sewer revenue. Prior to correcting the software (or formula in the software), the system was calculating rates based on the tier rate per 1,000 gallons and treating the base-fee as a minimum rate to charge. So instead of using the base plus the tier usage rates the system was using the tier only, which is the reason the annual $1 increase on the base has had little effect since it was passed in 2012. Correcting the error primarily affects the high user accounts, which are mainly commercial accounts. In a single billing cycle, a high user account could see a total of up to an $8 increase for sewer and water, depending on usage. Staff estimates this correction will increase water revenues by about $37,000 annually and sewer revenues by $13,000, if usage remains the same. This projection, with the previously programed $1.00 base rate increase for 2017, should sufficiently fund operations in 2017. At this time staff believes the best option is to continue with the annual $1 base rate increase in 2017 and review the performance of the fund again in 2017. KEY ISSUES: • A programming error in the utility billing software was not accurately calculating the annual rate increases. • The software correction will increase the revenues. • Commercial accounts and other high usage accounts will notice a higher monthly rate beginning this month. • Projected revenue for 2017 will likely cash flow operations, but will not fund depreciation. • In 2017, the base water rate will be $7.38. Memo To: Adam Nafstad, City Administrator; Albertville City Council From: Mike Couri Date: December 1, 2016 Re: Attorney Report Below is an update of the projects our office has been working on for the City. • I-94 Ramp Easement. The State is asking the City to obtain I-94 ramp easement from Albertville Marketplace using a revised legal description as the State wants clearer language in the deed from the City to the State for the ramp easement. The easement area remains unchanged—the State simply wants its specific language used in the easement document. Adam is trying to reach the owner to get the new deed signed. • Charter Cable. Charter Cable has replied to our request regarding the free cable service it is to provide to the City. Their contention is that the City is only entitled under Federal law to collect a maximum of 5% in franchise fees, which we are already collecting. Charter believes that provision of free cable service to municipal buildings over and above that 5% is prohibited under Federal law. I will check the law on this and see if Charter’s interpretation is correct. • City Hall Cleaning Contract. I have been working with Adam on preparing a new City Hall cleaning contract. • Karston Cove III/IV. The Developer’s Agreement for Karston Cove IV (replat of Karston Cove III as an outlot) has been signed. I believe the final plat has cleared Wright County review and should be recorded in the next week or so Agenda Page 57 Page 2 of 2 • Fire Department. We are reviewing revisions to the Fire Departments Standard Operating Guidelines. • Fire Department. Eric and I presented to the Wright County Fire Chief’s Association the concept of a standard mutual aid agreement for all cities in Wright County that would provide the legal framework for one City to recover costs from the owners or insurers of vehicles that are provided emergency services. The standard mutual aid agreement would allow the requesting City to recover the responding Cities’ costs from the recipient of the services. An agreement of this type would have allowed Albertville to recover the costs of those fire departments providing mutual aid to Albertville during the tanker truck accident on I-94 a few years back. We will be preparing a standard mutual aid agreement for all cities to review and adopt in the next few months. RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: MOTION TO: Authorize the sale of the 25-foot wide remnant adjacent to the old water tower lot to the Donatus Vetsch estate for $__________. BACKGROUND: In 1962 Donatus and Irma Vetsch purchased lots 9 and 10 of Eull’s addition on 57th street for residential purposes. In 1961, the City of Albertville purchased a 160-foot wide vacant property from the Marx family that abutted the east lot line of the Vetsch property for use as a water tower lot. Sometime shortly thereafter the City constructed a water tower on this property and utilized the property as a water tower lot until the mid-1990s. In 1963, the City conveyed the west 25 feet of its water tower lot to Donatus and Irma Vetsch, leaving the City with a 135-foot wide lot. In 1976, for reasons that are now unknown, the Vetschs conveyed the 25 foot strip of land back to the City, but this came back to the City as a separate parcel and not as an addition to the 135-foot wide water tower lot. Somewhere between 1976 and 1996, when the City decommissioned the water tower and decided to put the 135-foot wide water tower lot up for sale, no one at the City realized that the City had acquired the 25-foot strip back from the Vetschs. Prior to the City putting the water tower lot up for sale, Donatus Vetsch approached the City and asked if he could acquire a 25- foot strip of land from the City’s water tower property. Donatus indicated that he had been mowing and maintaining this 25-foot wide area for many years, and had also maintained a garden on that lot for many years. Donatus also informed the City that for many years in the past (likely in the 1960s and early 1970s), he had maintained the water tower lot and had taken regular readings on the water levels in the tower (it is unclear whether this was done on a volunteer basis or as a City maintenance employee). At the time, the City believed conveying 25-foot of the water tower lot to Donatus would reduce the 135-foot wide lot to a 110-foot wide lot, and believed that this would hurt the marketability of the lot for what was assumed would be a rambler or two-story home with a 3-car garage. The City did not realize that it owned the 25-foot strip to the west of the 135-foot lot. Given what the City Council understood in 1996, the Council decided not to sell 25 feet of its 135-foot lot to the Vetschs. There turned out to be title problems with the City’s water tower lot that delayed the sale of the lot until 2002, when the 135-foot wide lot was sold. Because the City did not realize that it owned the 25-foot wide lot, it never sold that lot when it sold the main water tower lot. This summer, Donatus Vetsch passed away. In wrapping up his estate, it has now become known to the Vetsch heirs that Donatus’ house is constructed only a few feet from the common lot line between the Vetsch and City properties (see attached aerial photo and survey). The Vetsch estate is planning on selling the house to one of Donatus’ grandchildren, and would like to purchase the 25 foot strip that the City still owns to go with the house to provide a side-yard setback where none currently exists. When the Vetschs contacted City Staff regarding this lot, we did not realize that the City actually owned the lot. After checking the City’s files and the Vetschs’ title records, it became clear that the 25-foot parcel remains in the City’s name and was not sold with the sale of the water tower lot in 2002. City Staff believes that Donatus has been maintaining the 25-foot lot since at least the 1980s, and probably fifteen or twenty years before that. Under Minnesota law, a person cannot acquire property from a municipality through adverse possession (by possessing the property for 15 consecutive years). The County has the lot valued at $800. The minutes from 1996 did not discuss a potential price for 25 feet of property, probably because the discussion never got that far. In the past, the City has sold small fragments of lots to adjoining owners where the City has no use for the properties. KEY ISSUES: • The City owns a 25-foot strip of property between two houses on 57th Street that is currently not being put to a productive municipal use. • The Vetsch family would like to acquire the property from the City. • Donatus Vetsch has mowed this property for several decades. • The County has valued this property at $800. POLICY/PRACTICES CONSIDERATIONS: In the past the City has sold properties that it believes will no longer be needed for a public use. Transferring these properties to private ownership allows the properties to be put to a more productive use and returns the properties to the tax rolls. Preference has traditionally been given to adjoining properties when putting a property up for sale as the adjoining owners can generally put the property to more productive use than someone who would use the property as a stand-alone lot. FINANCIAL CONSIDERATIONS: The 25-foot wide property is currently classified as tax exempt, meaning that the City pays no taxes on this lot. Because Donatus Vetsch had been maintaining this lot for the past several decades, the City has not incurred any maintenance costs on the property. If the City does not sell the property to the Vetsch family, it is reasonable to assume that the new owners of the Vetsch property will no longer maintain the property, in which case the City’s maintenance crew would have to mow the property on a regular basis during the growing season. That cost has not been estimated at this point. LEGAL CONSIDERATIONS: The City can sell real estate in any manner and for any amount it believes to be best for the City. No formal action is required. Currently we have rate increases planned through 2017 and we will continue to monitor fund balances. These four funds are funded by utility rates. Water Rates: With the software now corrected, staff is recommending rates remain as previously approved in 2012 and with the $1.00 per year base rate increase through 2017. Joint Fire: The Fire Chief and I will be meeting with the Fire Committee members prior to year- end to review where we are at with the draft terms of a JPA. Cell Phone Policy: We are working on a cell phone policy that would provide reimbursement to employees that choose to use/provide their personal phone in lieu of using the phone issued by the City. Mall of Entertainment: The reimbursement agreement has been signed and the escrow is in place. 2017 Lobbying Services: The Mayor and I met with Andy from LGN to discuss services in 2017 and to potentially include State lobbying services. Andy will be sending service options for the city to review. Currently, our scope of service with LGN is for Federal lobbying services. Planning Commission: Two commission seats are expiring at the end of the year (Commissioners Edgren and Barthel). Per the appointment policy adopted in early 2016, the two commissioners have been notified of their term expirations and asked to submit a letter of interest if they wish to serve another term. The two seats have been advertised in the local paper and staff expects to schedule Council interview before the January 17, 2017 Council meeting. The deadline to submit a letter of interest to serve on the Planning Commission is December 31, 2016. Trailblazer Transit: Wright County Area Transportation (WCAT) alliance is exploring alternative options for transit in Wright County. Service will continue to be provided by Trailblazer through the JPA between WCAT and Sibley and McCloud Counties. Annual Evaluations: Following the meeting on the 19th, I would like to conduct consultant and administrator evaluations. ENGINEERING/PUBLIC WORKS CSAH 37 and I-94 Signal Revisions: SRF has completed the MnDOT required signal modification plan and I have sent to MnDOT for review Agenda Page 65 City Administrator’s Update Page 2 of 2 December 1, 2016 2017 CSAH 19 and 57th Street Signal Improvements: Project plans and specifications are being prepared. Ballfield Lighting: The poles have been set and our electrician is currently wiring the system. I expect Xcel will complete the hookup this winter or early spring. Main Avenue RR Crossing: I have been in contact with the Railroad, but still do not know when they will replace the crossing. Assuming it is yet this year, the City’s portion of the project will not commence until next spring. Also, I am making modifications to the City’s plans so the project is eligible for MSA needs. CenturyLink Fiber Projects: CenturyLink is working to extend fiber to several neighborhoods. Project information is available on the City’s website.
