1992-04-15 MNDNR Review ... ~ STATE OF WJ~~~@lf~ DEPARTMENT OF NATURAL RESOURCES DMSION OF WATERS, P.O. BOX 370, ST. CLOUD, MN 56302FILENO. PHONE NO. (612) 255-4278 April 15, 1992 Meyer-RoWin Inc. Attn: Robert RoWin 1111 Hwy. 25 North Buffalo, MN 55313 Dear Bob: CITY OF ALBERTVILLE; PSYK'S ADDITIONS; WETLAND NO. 86-414W Thank you for sending me the Preliminary Plat and plans for the Psyk's Fifth and Sixth Additions. As [ had previously advised you, I recommend using elevation 952.0 feet as the OHW level for Public Water Wetland No. 86-414w. According to the plans for the 5th and 6th Addition, all of the lots and streets will be outside the bed of this wetland. I note that the plans contain at least one storm sewer outfall to Wetland No. 86-414w. If any portion of the outfall structure, or any excavation or filling related to the structure affects land below the OHW level of the wetland, a permit will be required from the DNR. One of the conditions of such a permit is that storage and filtration of runoff be addressed before the runoff reaches the Public Water Wetland. 1 have attached the applicable portion of the State Regulations on this subject. I note that there are several areas that this development may affect that are probably covered by the Wetland Conservation Act of 1991. To date, Wright County is not yet administering the program. Therefore, absolutely no filling or drainage of any wetlands in Wright County can be legally done. The City may also administer this program if it wishes. They should contact the Minnesota Board of Water and Soil Resources at 612-297-1894 for further information on this subject. Please don't hesitate to contact me if you have any additional questions on this matter. S:9: /~ Dale E. Homuth Area Hydrologist / cc: City of Albertville Dave Hills, Regional Hydrologist AN EQUAL OPPORTUNITY EMPLOYER . . 5389 PUBLIC WATER RESOURCES 6115.0231 in flo<?d stage are reflected in the floodplain boundaries and flood protection elevatIon adopted in the local floodplain management ordinance. (b) Replacement of existing crossings. If the existing crossing has a swellhead of one-half of one foot or less for the regional flood, the replace- ment crossing shall comply with the provisions for new crossings in unit (a). If the existing crossing has a swellhead of more than one-half of one foot for the regional flood, stage increases up to the existing swellhead may be allowed provided field investigation and other available data indicate that no significant flood damage potential exists upstream from the crossing based on analysis of data submitted by the applicant. The swellhead for the replacement crossing may exceed the existing swellhead if it complies with the provisions for new crossings found in unit (a). (c) The decks and approaches to bridges or culverts on major transportation routes and on roads that provide access to development at urban densities shall be no lower than two feet below the flood protection elevation as defined in part 6120.5700, subpart 5 unless it can be shown that alternative routes or access can be provided during the regional flood. (3) The structure shall provide for game fish movement, unless the structure is intended to impede rough fish movement or the stream has negligible fisheries value. (4) The structure will not obstruct reasonable public navigation. For bridges over protected watercourses, three feet above the calculated 50-year flood stage will ordinarily satisfy navigational clearance requirements. For bridges over protected waterbasins or wetlands, and all culverts, three feet of clearance above the ordinary high water mark will ordinarily satisfy navigational requirements. (5) Any project proposed near an existing or proposed segment of the state trails system should be consistent therewith. (6) Footbridges and walkways: (a) Over watercourses. Must be designed to cause negligible backwater effects during floods. Must be securely anchored or otherwise capable of withstanding the dynamic forces of flowing water, ice, and debris. Approaches must not be raised above the adjacent floodplain lands. (b) New walkways across any portion of protected waters to provide private access to an island will be prohibited. Permits for reconstruction of existing walkways or for the construction of new walkways intended to provide public access will be issued only if: the walkway provides the only existing access to the island; there is existing development thereon; the design will provide for any public navigational needs and is consistent with the natural surroundings. B. The construction, reconstruction, or relocation of all water intake and sewer outfall structures placed in protected waters shall be permitted provided all of the following criteria are met: (1) Adequate attention is given to methods of screening the struc- ture from view as much as possible from the surface of the protected water through the use of existing vegetation or new plantings. (2) The project is not detrimental to public values including but not limited to fish and wildlife habitat, navigation, water supply, water quality, or storm water retention. (3) No site conditions will require frequent future disruption of the beds of protected waters. (4) Adequate precautions must be planned during and after con- struction to prevent silt, soil, and other suspended particles from being dis- charged into protected waters. (5) Adjacent to the intake structure, the banks and bed of the protected water must be protected from erosion and scour by placement of suitable riprap shore protection. r-------------- - "Spl'Cpmns ::lS::lq1 jO SUO~P::lS lO UO~P::lS ::ll'C~doldd'C ::lq1 u~ p::lyp::lds UO~l'CUllOjU! ::lq1 jO H'C s::lpnpu~ 11 "V :U;;lq1\'\ ::l1::l1dwo:> p::ll::lp!SUO:> ::lq H'Cqs uO~1'C:>!1dd'C U'C 'p UO!S~A~pqns "pp"~OI UO~P::lS 'S::llnl'C1S 'C10S::lUU~W ollutmSlnd .p<JJ!nb<JJ uO!l~WJoJUI"f "dqns "uo~reu~ploO:> ::ll'C~doldd-e q1~1\'\ AI1U::lllnJUO:> p::lSS::l:>old ::lq m1\'\ uop -u:>ndd'C l~Ull::ld ::lq1 pU'C lS::lnb::ll ::ls'C::l1 ::lq1 qlOg: "SPUUl p::l1:>::llJ'C ::lq1lOj ::lN~SUOdS::ll IUPYJO 1'C1U::lWll-ed::lP ::lql WOlj ::ls'C::ll 'C p::l1S::lnb::ll s'Cq ::lq l::llj'C ::lW'CU U1\'\O s~q u~ l~Wl::ld 'C lOj Aldd'C A'CW SPU'Cl p::lU1\'\0-::l1'C1S ]0 ::l::lSS::ll ::lAll:>::ldSOld Y "J "p::lp:>u'C:> s~ 1U::lW::l::ll~-e ::lq1 j~ 1U::lW::l::ll~'C ::lq1]0 :n'Cp UO~1'CU~Wl::l1 ::lql OllOpd UO~l-eH::l:>UU:> Oll:>::l!qns 'AluO ;;ls'C::ll ::lqljO Ull::l1 ::lq1l0j p::lnSS~ ::lq A'CW l~Ull::ld Y "lU::lW::l::ll~U l::lqlO lO ::lS'C::ll ::lq1]0 Ado:> 'C Aq p::l~u'Cdwo:>:>'C pu-e l::lU1\'\O ::lq1 Aq p::lU2~Sl::llUno:> s~ uop'C:>ndd'C ::lq1 1'Cq1 p::lp~AOld tl.ldd'C tI.'Cw 1U::lW::ls-e::l lO ::ls'C::ll 'C s-e q:>ns slq2p tl.ll::ldOld ::ll'C~ldoldd'C jO l::lPloq V og: "uoll-e:>ndd'C ::lq1 u~ p::lqp:>S::lp tl.Un] ::ll'C p::ll!nb:>'C ::lq 01 lO p::ll~nb:>'C Slq2P tl.ll::ldOld ::lql]~ tl.ldd'C A'CUl p::l!Old ::lql pnpuo:> 01 1\'\'Cl tl.q p::lZ~oq1n'C UO~l'ClOdlO:> .10 'A1~H1n :lnqnd 'A:>U::l~'C 1'C1U::lWUl::lA02 Y "V :ldd:>X::l 'pdsodold S~ Pd!Old 'C q:>~q1\'\ UO PU'Cl ::lq1 ]0 ldU1\'\O u'Cp'Cd~ ::lql Aq pdll!wqns dq U-eqs SUO~l'C:>nddy .Aldd~ A~W oqM "Z "dqnS "Pd1'C:>01 S~ l:>::l!Old pdsodold dq1 jO Al~O!'CW ::lq1 dldq1\'\ 'Cdl'C dqll0] d:>YJO 1'Cuo~2::ll dq1 01 pdn~wqns pU'C 1U::lWll'Cd::lp dq1 tl.q p::ll'Cddld SWlO] UO dP'CW dq U'Cqs 08ZO"~ 11901 O~ 1 O"~ 119 sll'Cd ollu'CnsJnd SUO!l'C:>ndd'C uy .UO!ss!wqns ptrn sWJO.!l"11l'CdqnS .SnWH3d SH31VM a3D310Hd HO.!l NOI1..VJI'lddV Ot'ZO.SII9 fH 'lIS 8 :uOlS!H Ht"~OI sSW :AlPoqlnv uOlOl~lS "08ZO"~ 119 ll-ed '2u!u~w lOJ Sl::ll'C1\'\ P::lPdl0ld ]0 SUO~lUld11'C pU'C ~ZLZO"~ 119 01 OLZO"~ 119 sll'Cd 'Sldl'C1\'\ pdl:>dlOldJo ::l2-eU~'Clp ~ZZzoo~ 119 01 OZZO"~ 119 sll'Cd 'S10l1UO:> l::lA::llldl-e1\'\ :n ZO"~ 11901 01 ZO"~ 119 sll-ed 'S;;unl:>nllS ~ZOZO'~ 119 01 OOZO"~ 119 sll-ed 'SUO~l'CA'C:)X::l :Z61 O"~ 119 01 061 O'~ 119 sll'Cd '2umy :01 pdl~Wn 10U lnq 2u~pnpu~ Sdll~A~l:l'C lO Al~A!p-e ldqlO .(u-e JO llud S'C pdsodold Sll::lAlnJ pu-e sd2ppq 01 A1dd'C U'Cqs 1 fZO'~ 119 pU'C otzO"~ 119 sll'Cd 'sll'Cd l::lqlo U! p::lyp::lds dS!J\'\ldqlo sSdlu [l .NOID3S -SSOHJ HO 'l..NaIDlnJ '3sanOJ NI S3~NVHJ ~NIA 'lOANI S311..IAlDV H3H1..0 HO.!l VnI3:1..nIJ aNY saHvaNV l..S 01.. dIHSNOI1.. BOX 370, ST. CLOUD, MN 56302FILENO. PHONE NO. (612) 255-4278 March 31, 1992 Meyer-Rohlin Inc. Attn: Robert Rohlin 1111 Hwy. 25 North Buffalo, MN 55313 Dear Bob: CITY OF ALBERTVILLE; WETLAND NO. 86-414W OHW DETERMINATION As you requested, I have reviewed the concept plan of the Douglas Psyk property located in the SW 1/4 of Section 1, T120N-R24W; City of Albertville. On March 31, 1992 I inspected Wetland No. 86- 414W, which is located on the Psyk property. Wetland No. 86-414w is classified as a "Public Water Wetland." Any alteration of the bed of this wetland is regulated by the Department of Natural Resources (DNR). You asked me to determine the legal boundary of Wetland No. 86-414w. On the basis of my inspection and your concept plan, I recommend that the Ordinary High Water (OHW) level of this wetland be considered to be approximately elevation 952.0 feet. All land shown to be lower than 952.0 feet on the concept plan should be considered part of the bed of Wetland No. 86-414w. Unfortunately, this wetland was partly drained many years ago. The OHW evidence is difficult to interpret due to this drainage. For example, I feel that the pre-drainage OHW level was around elevation 956 feet. With its current outlet, this water level could not be reached. The water surface level of the wetland is currently at elevation 950.5 feet. The control point of the basin is located at the downstream end of the County Road #19 Culvert, at elevation 950.48 feet. The old ditch that connects the main part of the wetland to the Co. Rd #19 culvert is choked with cattails. Based upon my experience, I would expect the OHW level to be about 1.5 feet above the runout level. Attached find a photocopy of a portion of the National Wetlands Inventory Map for this area. This map correctly shows that much of the area near the wetland, above elevation 952 feet is still considered wetland. Alteration of this portion of the wetland may be controlled by the 1991 Wetland Conservation Act. Drainage, filling or burning of any wetland area is now prohibited, unless the affected wetland is replaced. An information sheet on this program is attached. I hope this answers the questions you had about this matter. If not, don't hesitate to contact me. Sincerely; D=e. f!~ Dale E.
